Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

In March 2021, the Spanish Congress approved the law regulating euthanasia, that regulates both euthanasia and physician-assisted suicide (PAS). In this article, we analyse the Spanish law regulating euthanasia and PAS, comparing it with the rest of the European laws on euthanasia and PAS (Netherlands, Belgium and Luxembourg). Identified strengths of the Spanish law, with respect to other norms, are that it is a law with many safeguards, which broadly recognises professionals’ right to conscientious objection and the specification that it (...) makes on the prior comprehensive care of the patient, including the approach to care dependency. Regarding its shortcomings, the law does not differentiate well between euthanasia and PAS; it barely assigns a role to the healthcare team as a whole (similar to other regulations); it does not clarify the functions of the different professionals involved; it does not detail the specific composition and duration of theevaluation commission; it has not been accompanied by a prior or simultaneous regulation of palliative care; and, lastly, the period of time to implement the law is too short. Regularization may be used as an alternative to dimensionality reduction when the number of variables in a model is much larger than the number of available observations. In a recent study from our group regularized regression was employed to quantify brain functional connectivity in a sample of healthy controls using a brain parcellation and resting state fMRI images. Here regularization is applied to evaluate resting state connectivity abnormalities at the voxel level in a sample of patients with schizophrenia. Specifically, ridge (...) regression is implemented with different degrees of regularization. Results are compared to those delivered by the weighted global brain connectivity method, which is based on averaged bivariate correlations and from the non-redundant connectivity method, a dimensionality reduction approach that applies supervised principal component regressions. Ridge regression is able to detect a larger set of abnormally connected regions than both GBC and NRC methods, including schizophrenia related connectivity reductions in fronto-medial, somatosensory and occipital structures. Due to its multivariate nature, the proposed method is much more sensitive to group abnormalities than the GBC, but it also outperforms the NRC, which is multivariate too. Voxel based regularized regression is a simple and sensitive alternative for quantifying brain functional connectivity. (shrink)

El acceso equitativo a la energía y a la vivienda es una preocupación básica de la justicia social. A pesar de los numerosos vínculos entre estos dos bienes esenciales, los marcos teóricos de la justicia y la pobreza energética se han referido casi exclusivamente a la cuestión de la vivienda en términos de la eficiencia energética de los edificios residenciales. En respuesta a esta carencia conceptual, se propone la reintegración del factor vivienda en el marco de la justicia y pobreza (...) energética a lo largo de los siguientes tres ejes: dimensiones materiales y temporales; dimensiones políticas; y dimensiones éticas y legales. Como ejemplo empírico de la importancia del nexo vivienda-energía en la práctica de la justicia social, se presenta el caso de dos movimientos sociales surgidos en Barcelona que trabajan con una perspectiva conjunta de derecho a la vivienda y a la energía: la Plataforma de Afectados por la Hipoteca (PAH) y la Aliança contra la Pobresa Energètica (APE). El artículo subraya la importancia de la vivienda y la energía como fundamentos materiales de una vida digna y su naturaleza conflictiva como necesidades esenciales y bienes de mercado. (shrink)

El objetivo de este artículo es mostrar que el marco conceptual que reduce la psiquiatría a una ciencia empírica, dejando al margen a la filosofía, es claramente insuficiente. Para ello se recupera la propuesta del psiquiatra Kurt Schneider y se muesran sus paralelos con fenomenólogos como Edmund Husserl o Max Scheler. El artículo se centra en la distinción entre motivo y causa, que es fundamental en la definición de neurosis y psicosis, y que es también el núcleo de la argumentación (...) de Husserl cuando aboga por la “actitud personalista”, frente a la “actitud naturalista”. Las metodologías activas son unas excelentes herramientas para la mejora del desarrollo de competencias, así como del aprendizaje del alumnado. Se recogen las percepciones y el uso que 92 profesores de educación secundaria de la Comunidad Valenciana (España) manifestaron en un cuestionario tras haber realizado una formación en las mismas. Los resultados permiten constatar que, si bien se produce un aumento en el uso y una mejora en las percepciones, sigue habiendo una considerable resistencia al cambio de este colectivo de (...) profesorado. Encuentran desventajas como considerarlas muy exigentes con el tiempo y son escépticos en el aprendizaje real del alumnado. (shrink)

RESUMEN El artículo ingresa en la ontología del acontecer y recorre cuatro momentos. En primer lugar, distingue la visión del mundo en general, propia de la llamada “metafísica” de la visión del ser como acontecer, y busca un diálogo entre la perspectiva del ser en la metafísica y ontología de Hans-Georg Gadamer. En segundo lugar, analiza la estructura del acontecer o el modo como se despliega el movimiento del sentido, para determinar la lógica de la pregunta como estructura del acontecer. (...) En tercer lugar, entabla un diálogo entre la idea de acontecer y la categoría de finitud, para evidenciar que, cuando se piensa en una ontología del acontecer, esta remite a la determinación de la finitud. Y, finalmente, plantea algunas líneas de desarrollo para profundizar en esta investigación. ABSTRACT The articles discusses the ontology of the event and covers four moments. First, it identifies the general worldview typical of the “metaphysics” of being as event, and seeks to establish a dialogue between the perspective of being in Hans-Georg Gadamer’s metaphysics and his ontology. Secondly, it analyzes the structure of the event or the way in which the movement of meaning unfolds, in order to determine the logic of the question as structure of the event. Third, through a dialogue between the idea of event and the category of finitude, the article shows that thinking the ontology of the event leads to the determination of finitude. Finally, the article suggests a few lines of inquiry for further in-depth research of this topic. (shrink)

El cordobés Damián de Castro, gran exponente de la platería rococó española en la centuria dieciochesca, realizó junto a otros artífices diferentes piezas para el cardenal Delgado y Venegas, arzobispo hispalense entre 1776 y 1781. Hoy muchas de estas piezas las podemos contemplar en las vitrinas de nuestro museo catedralicio, sin embargo la existencia en su tiempo de diferentes piezas similares produjo cierta confusión en su posterior identificación. RESUMEN El presente artículo tiene como objetivo reflexionar a partir de las principales ideas filosóficas de Walter Benjamin y Frantz Fanon sobre el problema de la violencia política para luego mostrar las diferencias y posibles relaciones en los planteamientos de los autores. En un primer momento se mostrarán las denuncias hechas por los dos autores al sistema político moderno en cuanto a que la apariencia pacífica de las relaciones sociales se fundamenta en relaciones mediadas por la violencia. Luego, se analizarán (...) los principales planteamientos acerca de la violencia divina y de la violencia revolucionaria o contraviolencia en cada uno de los filósofos. Por último, se aportarán algunas conclusiones que contrasten las propuestas de este diálogo y permitan trazar límites y posibilidades en la lucha política que cada autor en su particularidad está presentando. ABSTRACT The aim of this article is to reflect about the main philosophical ideas of Walter Benjamin and Frantz Fanon on the problem of political violence and then to present the differences and possible relations in the author's approaches. At the first time, will show the denunciations made by the two authors to the modern political system as a pacific appearance of social relations that are based on relations mediated by violence. Later, the main approaches to divine violence and revolutionary violence or counter-violence in each of the philosopher will be analyzed. Finally, some conclusions will be drawn to contrast with this dialogue and thus allow us to observe the limits and possibilities in the political struggle that each author in his particularity is presenting. This article intends to contribute to the science–religion historiography with two topics—philology and the construction of national identities—that can help provide a more complex picture of the relations between science and religion. We use the life and work of the Mallorcan Catholic priest Antoni Maria Alcover (1862–1932) as a case study that puts language, linguistics, and nationalism on the board of science and religion studies. Alcover was the main driving force of the Catalan Dictionary, a collective enterprise that set out (...) to inventory the complete oral and literary lexicon of this language, and which mobilized thousands of people, many of which were clergymen, from all over the Catalan‐speaking territories. In the article, we will explore Alcover's education; the way he established a link between language, religion, and fatherland; the shaping of his identity as a philologist in the image mainly of new German notions and practices; as well as his role in the institutionalization process of the Catalan language as a scientific language, as a language for science and for religion. The stream on political corporate social responsibility argues that companies have recently assumed state-like roles to influence global governance. However, following emerging calls for greater contextualization of CSR, we trace the historic evolution of PCSR in the case of Colombia and argue that such political engagement by firms is not new. Looking beyond a linear chronological account, we reveal the sedimentation process behind PCSR by exploring the archetypical political roles businesses have taken on in providing public goods and acting as (...) regulators, and chart their transformation. Our findings allow us to make two main contributions. First, by unearthing different strata of business and society relations, we enrich the research on PCSR, highlighting its historical sedimentation dynamics. By integrating institutional and historical perspectives, we respond to calls for complementary accounts of one of the premises found in the literature that considers globalization as the starting point of PCSR. Second, our exploration of the past and present of PCSR in Colombia provides scholars and practitioners with an overview of the complex state and stakes of CSR in that country. We also discuss the implications of sedimentation for PCSR theory and future research directions. (shrink)

Human genomics is a translational field spanning research, clinical care, public health, and direct-to-consumer testing. However, law differs across these domains on issues including liability, consent, promoting quality of analysis and interpretation, and safeguarding privacy. Genomic activities crossing domains can thus encounter confusion and conflicts among these approaches. This paper suggests how to resolve these conflicts while protecting the rights and interests of individuals sequenced. Translational genomics requires this more translational approach to law.

Critical aspects in the field of education are currently related to low levels of socioemotional competences and high rates of school dropouts. However, there are no standard practices or guidelines for helping countries to assess and train social and emotional competences. To overcome this limitation, the project Learning to be (L2B) aims to propose a comprehensive model of the assessment and development of social and emotional competences that bring together policymakers, researchers, teachers, school authorities and learners from different participating countries: (...) Finland, Italy, Latvia, Lithuania, Portugal, Slovenia, and Spain. The project attempts to create an international framework for regulating activities and supporting teachers working on the social and emotional competences of the students and to provide tools which can be used across countries. The aim of the paper is to describe how L2B has been developed in Spain by analyzing the contributions of the international framework and extracting the specific needs in the Spanish context. Specifically, we describe two products of the project: a) the process for creating a toolkit, a tool focused on creating activities and materials for helping teachers develop social and emotional competences of students and b) the results of an exploratory study in Spain in which social and emotional competences are assessed and compared to the international framework. First, we explain the definition of social and emotional competences used for creating the toolkit. Second, we analyze responses of Spanish students to questionnaires administered before applying the toolkit in the schools. The paper describes social and emotional competences in Spain and evaluates the overlap between relevant variables in Spain and those used for developing the toolkit, the international tool. Specific needs in Spain are discussed, as well as the contribution of the project for promoting the improved development of students’ social and emotional competences, improving learning outcomes and stronger social cohesion in schools and local communities, as well as the utility of the results for creating new educational policies. En este ensayo se destaca fundamentalmente las aportaciones de T.S. Kuhn, quien al aproximarse al conocimiento científico a partir del quehacer o práctica científica, observando a los observadores científicos, apunta a dos aspectos centrales sobre el cambio radical que ha experimentado la concep..

Partiendo de la constatación husserliana de la crisis filosófica como crisis vital de una humanidad que se ha desviado de su _télos_ al implantar el modelo tecno-científico del dominio del mundo, el artículo investiga el lugar de la filosofía en el sistema educativo, explorando las reformas propuestas en Baviera y Prusia por Niethammer y Humboldt a principios del siglo XIX y que plantean, cada una a su modo, la necesaria incorporación de la filosofía a una educación de Estado que, frente (...) a las pretensiones utilitarias del filantropismo, logre elevar al hombre a su humanidad. En este sentido, retorna al concepto humanista de formación (_Bildung_) al que se consagran ambas reformas y que Gadamer recupera precisamente en _Verdad y método_ como un ideal para enfrentar la pretensión de universalidad de la ciencia moderna en relación a las nociones de conocimiento y de verdad, así como para pensar el horizonte ontológico de la experiencia hermenéutica. Es precisamente este ideal el que permite localizar el lugar de la filosofía en el conjunto del saber y conducir al hombre a su humanidad. (shrink)

El objetivo del estudio es presentar de manera detallada el marcoantropológico introducido por Kant en su obra La religión dentro de los límites de la mera razón. Se intenta mostrar la manera como Kant reinterpreta los elementos esenciales de su sistema ético y comienza a entender el obrar incorrecto (transgresión moral) desde una perspectiva teológica.

Lo que me propongo presentar en este texto no son más que algunas observaciones y reflexiones, algunas de ellas incluso un poco marginales, a un trabajo mucho más amplio que vengo realizando desde hace más de seis años: la traducción y adaptación cultural para el mundo de habla hispana de la novela filosófica Suki, de Matthew Lipman, y de su correspondiente manual de apoyo para el profesor, que tiene por título Escribir: ¿cómo y por qué? Me ocuparé, en primer lugar, (...) de clarificar el origen y las características de este trabajo de traducción y adaptación cultural, en orden a mostrar algunos de los criterios generales que para ello fui elaborando a medida que desarrollaba mi trabajo. A continuación presentaré algunas experiencias de escritura con niños y jóvenes que me han servido de punto de referencia en mi reflexión sobre la dimensión filosófica del acto de la escritura. Lo esencial en el esfuerzo por generar en otros el interés y las habilidades para desarrollar la composición poética está muchas veces en ayudarles a expresarse nuevamente en términos sencillos, pero evocadores. Concluiré con algunas reflexiones generales, inspiradas en Matthew Lipman, sobre la relación existente entre la reflexión filosófica y la escritura poética. En el trabajo de adaptación del manual Escribir: ¿cómo y por qué? he hecho, entonces, una recopilación bastante amplia de poemas de grandes autores de muchísimos países hispanoamericanos. Hay allí poemas de autores como Miguel Hernández, Antonio Machado o Federico García Lorca, y otros , del mexicano Octavio Paz, del nicaragüense Rubén Darío, del peruano César Vallejo, o del chileno Pablo Neruda, o incluso canciones del panameño Rubén Blades, del cubano Silvio Rodríguez, del argentino Piero o hasta del brasileño Vinicius de Moraes. Pero he incluido también poemas escritos por niños de mi país. (shrink)

Humans and some animal species are able to learn stimulus-response associations by observing others' behavior. It saves energy and time and avoids the danger of trying the wrong actions. Observational learning depends on the capability of mapping the actions of others into our own behaviors, processing outcomes, and combining this knowledge to serve our goals. Observational learning plays a central role in the learning of social skills, cultural knowledge, and tool use. Thus, it is one of the fundamental processes in (...) which infants learn about and from adults. In this paper, we review current methodological approaches employed in observational learning research. We highlight the important role of the prefrontal cortex and cognitive flexibility to support this learning process, develop a new neural working model of observational learning, illustrate how imitation relates to observational learning, and provide directions for future research. The flowers of the primitive angiosperm plants were radially symmetrical (actinomorphic). Flowers with bilateral symmetry (zygomorphic) evolved in several clades independently as an adaptation to specialized methods of pollination and played an important role in the diversification of flowering plants. In the model species Antirrhinum majus (snapdragon), the related genes CYCLOIDEA (CYC) and DICHOTOMA (DICH) are key in the development of this trait. This raises the question of whether they played a role in the evolution of floral bilateral symmetry. To (...) address this, the evolution of CYC in relation to the evolution of zygomorphy is being investigated. Phylogenetic and functional analyses of CYC‐like genes are being carried out in groups either closely related to Antirhinum or in families where zygomorphy evolved as an independent event. In addition, the origin of zygomorphy is being studied by comparing the function of CYC‐like genes in species with zygomorphic flowers with their function in species with radially symmetrical flowers. ABSTRACT My aim in this paper is to present a pluralist thesis about the inferential role of logical constants, which embraces classical, relevant, linear and ordered logic. That is, I defend that a logical constant c has more than one correct inferential role. The thesis depends on a particular interpretation of substructural logics' vocabulary, according to which classical logic captures the literal meaning of logical constants and substructural logics encode a pragmatically enriched sense of those connectives. The paper is divided (...) into four parts: first, I introduce the motivation for the pluralist thesis of the paper; second I introduce the calculus for the different logics endorsed in the pluralist thesis; third, I motivate how the different behaviors of the logical vocabulary of these logics can be pragmatically interpreted, and fourth, I motivate how the different inferential roles that each substructural logic attribute to logical constants can coexist, and how we should reason with a logical constant c given this plurality.
