This paper offers a qualified defence of physician non-compliance with antiabortion legislation in the wake of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization. The paper examines two ethically troubling trends of post-Dobbs legislation: narrow and vague maternal health exemption clauses and mandatory reporting of miscarriages in jurisdictions where patients may criminal prosecution for medically induced abortions. It then examines and defends a professional obligation on the part of physicians to comply with the law. This obligation, however, (...) is defeasible. The paper then argues that physicians’ obligations to comply with the law is defeated when the law is illegitimate and following the law would constitute bad medical practice. Given that I share this presumption that the texts we love to study matter to our lives, I would like to look more closely at how the process occurs, taking Milton's Paradise Regained as a test case.Does our reading of literary texts affect us ethically, and should it?1 An ancient and powerful critical tradition has taken for granted that the answer to both questions is yes. At the very least, good literature read properly is seen as one among the shaping forces of our education. But, beginning in the late eighteenth century, the theoretical movement to separate esthetics from ethics rendered this assumption problematic. Perhaps the beautiful is a value quite separate from the good. The term "implicated" that is characteristically used in such analysis claims at a minimum that the literary text in question has been shaped in production, consumption, or both by larger cultural forces, shaped in such a way as to incorporate certain values. Most such analyses go further to assert or suggest that the text under study helps to reinforce those values in the original audience or in later consumers (sometimes by attacking opposed values).3 The characteristic rhetorical stance in such readings is an implied warning to the reader against the insidious effect of the text lest it instill some fallacious, unethical, or politically harmful attitude or idea. Often the reader is rhetorically invited to share a position of intellectual superiority along with the critic, both of them above the corruption that afflicts an unspecified gullible audience. What the term "poetry" refers to is a group of publicly visible things in the social world that we call poems, but there is no distillation in the mind that is the essence of poetry, the sense of the term. Of course we have a sense of the term that controls its range of reference. That sense is made up of our bases for calling one thing poetry and not another: the qualities that incline us to see a text as a poem. Wittgenstein would call these defining qualities criteria. The crucial fact is that they are determined by social processes and so are available to public inspection, not hidden away to be discovered only by introspection.Another observation about what it is to assign meaning to a term is important here. If someone asserts that "poetry" means X, he or she can appropriately be asserting that in fact the offered definition describes how people use the term, or else he or she can be suggesting how the term should or will be used in a specific discourse, that is, offering a definition proposal or stipulative definition. In the latter case the proposer needs to show the utility of the change from ordinary speech for his or her purposes. That is of course what literary critics do when they specify meanings for a term like "tragedy" or "irony" that are different from common usage. It is not that Wayne Booth's way of talking about irony uses the real meaning (both his and the ordinary senses are perfectly real since both are socially used), but that his is more useful for literary criticism than the general usage because it is more precise and nuanced. 3Thus it would make sense to begin defining "poetry" by looking at how people use the term and in particular how it is used in literary discourse. However, though I will pay some attention to what critics actually say and write, I would like primarily to offer certain proposals for refining our use of the term so as to avoid confusion and vagueness. It is not that this investigation will be approaching the real meaning of "poetry," which I have suggested is an imaginary goal, but that it will propose a use of the term constituting a vehicle for talking and writing about poetry that... In this thesis, I defend John Rawls’s assertion that political liberalism does not use the concept of truth. I respond to objections from Joshua Cohen and David Estlund. I argue that Cohen fails to show that public reason needs a minimalist conception of truth, since individuals with a range of conceptions of moral truth can meet the requirements of public reason. I dispute Estlund’s argument that the liberal principle of legitimacy is merely insular. Estlund assumes that the claim that the (...) liberal principle of legitimacy is reasonable is no different than the claim that the principle is acceptable to reasonable persons. I argue that this assumption is incorrect, and that therefore the liberal principle of legitimacy is justifiable on the grounds that it is reasonable. I argue that political liberals need not worry that doing without the concept of truth will undermine the semantic coherence or objectivity of political liberalism. (shrink)

Public health ethicists face two difficult questions. First, what makes something a matter of public health? While protecting citizens from outbreaks of communicable diseases is clearly a matter of public health, is the same true of policies that aim to reduce obesity, gun violence or political corruption? Second, what should the scope of the government’s authority be in promoting public health? May government enact public health policies some citizens reasonably object to or policies that are paternalistic? Recently, some theorists have (...) attempted to address these questions by arguing that something is a matter of public health if and only if it involves a health-related public good, such as clean water or herd immunity. Relatedly, they have argued that appeals to the promotion of public health should only be used to justify the provision of health-related public goods. This public goods conception of public health (PGC) is meant to enjoy advantages over its rivals in three respects: it provides a better definition of public health than rival views, it respects moral disagreement, and it avoids licensing objectionably paternalistic public health policies. We argue, however, that the PGC does just as poorly, or worse, than its rivals in all three respects. (shrink)

Significant changes in the natural environment over the past 40 years pose key challenges to health and health care in the 21st century. Health care has not yet given serious attention to what the current environmental situation means for human health, or for maintaining an effective health care system. Bioethics is in a good position to help health professionals engage environmental questions. But bioethics, as a field, will first need to explore and integrate ecological thinking —thinking based in the concept (...) of connectedness and committed to viewing humans are part of nature rather than exempt from it. A quick tour through an average U.S. hospital gives pause to anyone with even a rudimentary concern for environmental issues. To a careful observer, the typical U.S. hospital presents an array of challenges to the health of ecosystems. For example, hospitals consume vast quantities of natural resources. The most obvious of these are fossil fuels, which form the basic building blocks of the industrialized medical care industry. Aside from the worry that our healthcare systems are technologically and functionally dependent upon (...) nonrenewable, relatively scarce, and politically volatile resources, our heavy reliance on fossil fuels has important ill effects, including unfavorable health outcomes for humans. For example, the combustion of fossil fuels is the driving force behind global warming, which will likely result in increasing heat-related mortality and morbidity and may contribute to the spread and resurgence of infectious diseases around the world. Also, the combustion of coal and oil releases pollutants such as sulfur oxides, nitrogen oxides, and ground-level ozone that contribute to various respiratory ailments. In addition to being energy intensive, the modern hospital uses a great deal of water, wood, paper, metals, minerals, plastics, chemicals, food, and land. (shrink)

The use of social media as a recruitment tool for research with humans is increasing, and likely to continue to grow. Despite this, to date there has been no specific regulatory guidance and there has been little in the bioethics literature to guide investigators and institutional review boards faced with navigating the ethical issues such use raises. We begin to fill this gap by first defending a nonexceptionalist methodology for assessing social media recruitment; second, examining respect for privacy and investigator (...) transparency as key norms governing social media recruitment; and, finally, analyzing three relatively novel aspects of social media recruitment: the ethical significance of compliance with website “terms of use”; the ethics of recruiting from the online networks of research participants; and the ethical implications of online communication from and between participants. Two checklists aimed at guiding investigators and IRBs through the ethical issues are included as appendices. (shrink)

This study examined the impact of perceived ethical culture of the firm and selected demographic variables on auditors' ethical evaluation of, and intention to engage in, various time pressure-induced dysfunctional behaviours. Four audit cases and questionnaires were distributed to experienced pre-manager level auditors in Ireland and the U. S. The findings revealed that while perceived unethical pressure to engage in dysfunctional behaviours and unethical tone at the top were significant in forming an ethical evaluation, only perceived unethical pressure had an (...) impact on intention to engage in the behaviours. Country was also found to have a significant impact, with U. S. respondents reporting higher ethical evaluations and lower intentions to engage in unethical acts than Irish respondents.
