The reasons why this occurs are as manifold as the patients and analysts themselves, and oftentimes are a source of frustration and vexation to clinicians, who aren't always eager to discuss them. Taking the challenge head-on, Arnold Goldberg proposes to demystify failure in an effort to determine its essential meaning before determining its causes. Utilizing multiple vignettes of failed cases, (...) he offers a deconstruction and a subsequent taxonomy of failure, delineating cases that go bad after six months from cases that never get off the ground, mismatches from impasses, failures of empathy from failures of inattention. Commonalities in the experience of failure – conceived as less a misapplication of technique than consequences of a co-constructed yet fraught therapeutic relationship – begin to emerge for scrutiny. In this paper I argue against the view, defended by some philosophers, that it is part of the meaning of mental that being mental is incompatible with being physical. I call this outlook metalinguistic dualism, and I distinguish it from metaphysical theories of the mind-body relation such as Cartesian dualism. I argue that MLD is mistaken, but I don't try to defend the contrary view that mentalistic terms can be definitionally reduced to nonmental ones. After criticizing arguments by certain philosophers (...) which purport to establish MLD, I formulate a criterion for a phenomenon's being mental. I then show that this criterion is neutral between monistic and dualistic theories of the mind-body relation. Since if MLD were true it should be impossible to construct such a criterion, I conclude that it is false. The significance of my paper is that if I am right then I remove one important type of objection to aposteriori, noneliminative forms of the identity theory of mind, namely that such theories ought to be rejected merely on the basis of semantical considerations about the word mental. Beyond that, I believe that my criterion of mental phenomena correctly captures our intuitions about the nature of the distinction between mental and nonmental phenomena. (shrink)

Why Don't You Just Talk to Him? looks at the broad political contexts in which violence, specifically domestic violence, occurs. Kathleen Arnold argues that liberal and Enlightenment notions of the social contract, rationality and egalitarianism -- the ideas that constitute norms of good citizenship -- have an inextricable relationship to violence. According to this dynamic, targets of abuse are not rational, make bad choices, are unable to negotiate with their abusers, or otherwise violate norms of the social contract; they (...) are, thus, second-class citizens. In fact, as Arnold shows, drawing from Nietzsche and Foucault's theories of power and arguing against much of the standard policy literature on domestic violence, the very mechanisms that purportedly help targets of domestic abuse actually work to compound the problem by exacerbating the power differences between the abuser and the abused. The book argues that a key to understanding how to prevent domestic violence is seeing it as a political rather than a personal issue, with political consequences. It seeks to challenge Enlightenment ideas about intimacy that conceive of personal relationships as mutual, equal and contractual. Put another way, it challenges policy ideas that suggest that targets of abuse can simply choose to leave abusive relationships without other personal or economic consequences, or that there is a clear and consistent level of help once they make the choice to leave. Asking "Why Don't You Just Talk to Him?" is in reality a suggestion riven with contradictions and false choices. Arnold further explores these issues by looking at two key asylum cases that highlight contradictions within the government's treatment of foreigners and that of long-term residents. These cases expose problematic assumptions in the approach to domestic violence more generally. Exposing major injustices from the point of view of domestic violence targets, this book promises to generate further debate, if not consensus. (shrink)

As G. A. Cohen’s camping trip argument shows, community is an important value. But is there anything particularly socialist about it? Critics suggest not. Jason Brennan argues that we don’t need socialist institutions to secure community; capitalist ones will do just fine. Louis-Philippe Hodgson argues, in a similar spirit, that we don’t need explicitly socialist principles to secure community; standard-issue liberal egalitarian ones (like Rawls’s) suffice. But these critics are mistaken. Pace Brennan, I show that capitalism inevitably runs roughshod over (...) community. Pace Hodgson, I show that Rawls’s justice as fairness cannot, absent explicitly socialist supplementation, adequately protect community. In sum, I show that advocates of community must also, and for that reason, be advocates for distinctively socialist principles and institutions. Or, in a slogan: no community without socialism. In particular, his articles have prompted significant revision in thought regarding the development of Mahāyāna and regarding the role of the monastic religious in Buddhist cultic life.With the publication of this collection of Schopen's essays, Bones, Stones, and Buddhist Monks: Collected Papers on the Archaeology, Epigraphy, and Texts of Monastic Buddhism in India (the first of two such volumes, according to the Preface by Donald Lopez), Schopen's work stands to receive a wider hearing, and so to extend its already significant influence in the field of Buddhist studies. This is as it should be; for all scholars in the field are very much in Schopen's debt for the illuminating interpretations and conclusions that he has distilled from monumental amounts of epigraphical data. While Schopen has devoted care to the edition, translation, and interpretation of manuscript remains from Gilgit (chiefly, the Vinaya of the Mūlasarvāstivādins), his most characteristic and original interpretations have been of the kind of "donative inscriptions" attached to the material remains of Indian Buddhist cultic life—a task that requires, among other things, a rare expertise across the range of Middle Indic dialects. In deploying such expertise, Schopen has presented compelling evidence, for example, that it was in fact monks and nuns who sponsored the kinds of practices typically associated with the rise of Mahāyāna—a conclusion that counters the long-unchallenged view that it was Buddhist laypeople who initiated this movement. It would be good indeed if such conclusions, as well as the exemplary scholarship that warrants them, were to have influence in proportion to their originality and importance.Still, it must be said that the presentation of the essays collected in this volume also reveals one important problem, and it is to be hoped that this feature does not become entrenched as part of Schopen's influence. For particularly when reading these essays all at once, one is struck by the recurrent statement of a specious dichotomy between what religious people "actually did," and what canonical texts say they should have done. He starts by arguing (contra the presupposition of many of his predecessors) that there is little basis for taking the Pāli canon as reflecting anything like the state of practice at an early point in history. He then goes on to show (on the basis of donative inscriptions that are much more reliably datable indicators of what was happening on the ground) that, contrary to what the "canon" would lead us to expect, it was in fact chiefly monks and nuns who sponsored the production of cultic images. This evidence calls for the recognition that "from its first appearance in inscriptions, the Mahāyāna was a monk-dominated movement" (p. 32); that "not only was the image cult overwhelmingly a monastic concern, it was also, on the basis of the available information, a monastically initiated cult" (p. 32); and that, "All of... ABSTRACT:In a series of reports the United Nations Special Representative on the issue of Human Rights and Transnational Corporations has emphasized a tripartite framework regarding business and human rights that includes the state “duty to protect,” the TNC “responsibility to respect,” and “appropriate remedies” for human rights violations. This article examines the recent history of UN initiatives regarding business and human rights and places the tripartite framework in historical context. Three approaches to human rights are distinguished: moral, political, and legal. (...) It is argued that the tripartite framework’s grounding of the responsibility of TNCs to respect human rights is properly understood as moral and not merely as a political or legal duty. A moral account of the duty of TNCs to respect basic human rights is defended and contrasted with a merely strategic approach. The main conclusion of the article is that only a moral account of the basic human rights duties of TNCs provides a sufficiently deep justification of “the corporate responsibility to respect human rights” feature of the tripartite framework. In _Buddhists, Brahmins, and Belief_, Dan Arnold examines how the Brahmanical tradition of Purva Mimamsa and the writings of the seventh-century Buddhist Madhyamika philosopher Candrakirti challenged dominant Indian Buddhist views of epistemology. Arnold retrieves these two very different but equally important voices of philosophical dissent, showing them to have developed highly sophisticated and cogent critiques of influential Buddhist epistemologists such as Dignaga and Dharmakirti. His analysis--developed in conversation with modern Western philosophers like William Alston and J. L. Austin--offers (...) an innovative reinterpretation of the Indian philosophical tradition, while suggesting that pre-modern Indian thinkers have much to contribute to contemporary philosophical debates. In logically distinct ways, Purva Mimamsa and Candrakirti's Madhyamaka opposed the influential Buddhist school of thought that emphasized the foundational character of perception. Arnold argues that Mimamsaka arguments concerning the "intrinsic validity" of the earliest Vedic scriptures are best understood as a critique of the tradition of Buddhist philosophy stemming from Dignaga. Though often dismissed as antithetical to "real philosophy," Mimamsaka thought has affinities with the reformed epistemology that has recently influenced contemporary philosophy of religion. Candrakirti's arguments, in contrast, amount to a principled refusal of epistemology. Arnold contends that Candrakirti marshals against Buddhist foundationalism an approach that resembles twentieth-century ordinary language philosophy--and does so by employing what are finally best understood as transcendental arguments. The conclusion that Candrakirti's arguments thus support a metaphysical claim represents a bold new understanding of Madhyamaka. (shrink)

As a way to address both ominous and ordinary threats of artificial intelligence, researchers have started proposing ways to stop an AI system before it has a chance to escape outside control and cause harm. A so-called “big red button” would enable human operators to interrupt or divert a system while preventing the system from learning that such an intervention is a threat. Though an emergency button for AI seems to make intuitive sense, that approach ultimately concentrates on the point (...) when a system has already “gone rogue” and seeks to obstruct interference. A better approach would be to make ongoing self-evaluation and testing an integral part of a system’s operation, diagnose how the system is in error and to prevent chaos and risk before they start. In this paper, we describe the demands that recent big red button proposals have not addressed, and we offer a preliminary model of an approach that could better meet them. We argue for an ethical core that consists of a scenario-generation mechanism and a simulation environment that are used to test a system’s decisions in simulated worlds, rather than the real world. This EC would be kept opaque to the system itself: through careful design of memory and the character of the scenario, the system’s algorithms would be prevented from learning about its operation and its function, and ultimately its presence. By monitoring and checking for deviant behavior, we conclude, a continual testing approach will be far more effective, responsive, and vigilant toward a system’s learning and action in the world than an emergency button which one might not get to push in time. Premodern Buddhists are sometimes characterized as veritable "mind scientists" whose insights anticipate modern research on the brain and mind. Aiming to complicate this story, Dan Arnold confronts a significant obstacle to popular attempts at harmonizing classical Buddhist and modern scientific thought: since most Indian Buddhists held that the mental continuum is uninterrupted by death, they would have no truck with the idea that everything about the mental can be explained in terms of brain events. Nevertheless, a predominant stream of (...) Indian Buddhist thought, associated with the seventh-century thinker Dharmakirti, turns out to be vulnerable to arguments modern philosophers have leveled against physicalism. By characterizing the philosophical problems commonly faced by Dharmakirti and contemporary philosophers such as Jerry Fodor and Daniel Dennett, Arnold seeks to advance an understanding of both first-millennium Indian arguments and contemporary debates on the philosophy of mind. The issues center on what modern philosophers have called _intentionality_--the fact that the mind can be about other things. Tracing an account of intentionality through Kant, Wilfrid Sellars, and John McDowell, Arnold argues that intentionality cannot, in principle, be explained in causal terms. Elaborating some of Dharmakirti's central commitments, Arnold shows that despite his concern to refute physicalism, Dharmakirti's causal explanations of the mental mean that modern arguments from intentionality cut as much against his project as they do against physicalist philosophies of mind. This is evident in the arguments of some of Dharmakirti's contemporaneous Indian critics, whose critiques exemplify the same logic as modern arguments from intentionality. Elaborating these various strands of thought, Arnold shows that seemingly arcane arguments among first-millennium Indian thinkers can illuminate matters still very much at the heart of contemporary philosophy. EDITORIAL NOTE.—Arnold Hauser died in February 1978 shortly after returning to his native Hungary; he had lived nearly half of his 85 years in a kind of self-imposed exile. He is considered, by those who know his work, to be perhaps the greatest sociologist of art, though his last years were spent in comparative neglect and obscurity. We present here as a testament to the importance of both the critic and the discipline he helped shape a section from the (...) translation of his Sociology of Art . Hauser's work draws on the influences of his teachers, Simmel, Bergson, Lukács, Mannheim, Sombart, and Troeltsch. He developed in his immense Social History of Art the groundwork for a sociological analysis of art ranging from prehistoric cave painting to film. In his later works—The Philosophy of Art History , Mannerism: The Crisis of the Renaissance and the Origins of Modern Art , and The Sociology of Art—he continued to redefine his brilliant defense of art for society's sake. The theory of l'art pour l'art wants nothing to do with this contradiction and denies not only the moral and social usefulness of art but its every possible practical function as well. "Nobody would write poetry," says Eugenio Montale, "if the problem of literature consisted in making oneself understood." It has been doubted whether the capacity of making oneself understood, the unambiguous communication of feelings and experiences, even lies within the power of art. What Eduardo Hanslick asserts about music in Von musikalischen Schönen, namely, that its relation to everything which is nonmusical, everything which has emotional content, is vague and noncommittal, is to some extent true for all arts. Just as music expresses something which cannot be translated into any other form, so literature expresses something which is eminently literary, linguistic, something locked into words and syntactic structures. In the same way the untranslatable content of a painting, a pictorial idea, a vision, can only be seized and held onto in optical forms. The composer thinks in tones, the painter in lines and colors, the poet in words, tropes, and rhythms. Indubitable as this is, it is not the whole truth; side by side with the content which can only be expressed adequately in a particular form, there is an intrinsic value which can be translated into any form. This book is the scholarly & fully annotated edition of the award-winning _The Illustrated To Think Like God.__ _To Think Like God_ focuses on the emergence of philosophy as a speculative science, tracing its origins to the Greek colonies of Southern Italy, from the late 6th century to mid-5th century B.C. Special attention is paid to the sage Pythagoras and his movement, the poet Xenophanes of Colophon, and the lawmaker Parmenides of Elea. In their own ways, each thinker held that (...) true insight, whether as wisdom or certainty, belonged not to mortal human beings but to the gods. The Pythagoreans sought to approach this otherwordly knowledge by studying numerical relationships, believing them to govern the universe, and that those who know the number of a thing know its true nature. Yet their quest was a hopeless one, bogged down by cultism, numerology, political conspiracies, bloody uprisings, and exile. Above all, number did not turn out as the most reliable of mediums; it was certainly not a key to the realm of the divine. Thus, their contributions to philosophy's inception, while much better-publicized, was not the most significant. That particular role was reserved for an unusual challenge and the elaborate reaction it provoked. The challenge came from Xenophanes, who had argued that reliable truth was beyond mortal reach, because even if by accident a human being should state what is exactly the case, he had no way of knowing that he did, all things being susceptible to opinion. This dilemma is sure to have bothered a legislative mind like that of Parmenides, and we find him introducing techniques for testing the veracity of statements. These methods were meant to be carried out by reasoning and argument alone, without relying in physical evidence or mortal sense-perception, which was deemed untrustworthy. Reason was that one faculty shared by gods and humans alike. In time, Parmenides' ingenious arguments have earned him the titled of the first logician and metaphysician whose influence on subsequent thinkers was immeasurable. Parmenides taught us that philosophy was not about claims but about proof, which also makes him the father of theoretical science -- which, curiously, began as a quest into the mind of God. Recent developments in the field of artificial intelligence (AI) present profound challenges for law. These challenges stem from law’s anthropocentrism, which is often left unspoken. This essay examines both the epistemic and normative dimensions of anthropocentrism within German Law, with a focus on Private Law. It defends the proposition that law’s anthropocentrism does not inherently oppose the idea of granting AI some form of legal capacity. Rather, so the essay argues, it is essentially a question of regulatory prudence to determine (...) the conditions and criteria under which the law should grant a legal status, legal capacity, or partial legal capacity to AI entities. Nonetheless, it is crucial to acknowledge that the core principles of private law as well as questions of liability for fault and negligence are rooted in human agency and cannot be directly applied to AI. It will be argued that the legal discourse on the recognition of AI is to be understood as a fundamentally political discourse. The political dimension of that discourse will be analyzed through the lens of the political theories of Hannah Arendt and Jaques Rancière, among others. (shrink)

Benedict (Baruch) de Spinoza (1632–1677) was one of the most systematic, inspiring, and influential philosophers of the early modern period. From a pantheistic starting point that identified God with Nature as all of reality, he sought to demonstrate an ethics of reason, virtue, and freedom while unifying religion with science and mind with body. Alfred Tarski was a nominalist. But he published almost nothing on his nominalist views, and until recently the only sources scholars had for studying Tarski’s nominalism were conversational reports from his friends and colleagues. However, a recently-discovered archival resource provides the most detailed information yet about Tarski’s nominalism. Tarski spent the academic year 1940-41 at Harvard, along with many of the leading lights of scientific philosophy: Carnap, Quine, Hempel, Goodman, and (for the fall semester) Russell. This group met frequently to (...) discuss logical and philosophical topics of shared interest. At these meetings, Carnap took dictation notes, which are now stored in the Archives of Scientific Philosophy. Interestingly, and somewhat surprisingly, the plurality of notes covers a proposal Tarski presents for a nominalist language of unified science. This chapter addresses the following questions about this project. What, precisely, is Tarski’s nominalist position? What rationales are given for Tarski’s nominalist stance—and are these rationales defensible? Finally, how is Tarskian nominalism of 1941 related to current nominalist projects? (shrink)

This article applies the Kantian doctrine of respect for persons to the problem of sweatshops. We argue that multinational enterprises are properly regarded as responsible for the practices of their subcontractors and suppliers. We then argue that multinationalenterprises have the following duties in their off-shore manufacturing facilities: to ensure that local labor laws are followed; to refrain from coercion; to meet minimum safety standards; and to provide a living wage for employees. Auch seine letzte Monographie Moral und Hypermoral sah Gehlen in der direkten Nachfolge seines anthropologischen Hauptwerkes Der Mensch. Insofern verstand er seinen Entwurf einer pluralistischen Ethik als Konkretisierung seiner Lehre vom Menschen. In diesem Buch, das eine Genealogie der Moralen entwickeln will, stellte sich Gehlen die Aufgabe, Anthropologie, Verhaltensforschung und Soziologie so zu verbinden, dass vier voneinander nicht ableitbare Ethosformen empirisch freigelegt werden konnten: von einem aus der aGegenseitigkeit entwickelten Ethos uber Eudaimonismus und Humanitarismus bis hin zu einem Ethos der (...) Institutionen einschliesslich des Staates. Gehlen wollte der abstrakten Ethik der Aufklarung widersprechen, wie sie beispielsweise in Voltaires Diktum zum Ausdruck kam, nach welchem es nur eine Moral gebe, so wie es nur eine Geometrie gibt. Systematisch geht es in erster Linie um eine anthropologische Begrundung der Ethik, d.h. um eine Mehrheit moralischer Instanzen und Sozial-Regulationen. Diese werden nicht evolutionar interpretiert, d.h. als Fortschritt von der Nahethik zu einer schliesslich weltumspannenden Moralitat. Manche Moralen konnen als instinktnah angenommen werden, andere ergeben sich aus den Notwendigkeiten bestimmter Institutionen. Immer jedoch sind sie kulturell geformt und zugleich auf unterschiedlichen Ebenen der Abstraktion angesiedelt. Es bleibt im Zuge einer neuerlichen Rezeption von Moral und Hypermoral die These zu prufen, ob die Modellvorstellung eines unversohnlichen Pluralismus moralischer Normen eine Dimension des Ethischen zum Ausdruck bringt, die in den evolutiven Konzepten der ethischen Anpassung an je hohere gesellschaftliche Synthesen unterschatzt wird. Insofern gehort dieses Buch in den Zusammenhang einer philosophisch-soziologischen Grundlagenforschung, wie sie seit Max Scheler und Helmuth Plessner als Philosophische Anthropologie durchgefuhrt wurde und welche Arnold Gehlen - von den Elementarbestanden der menschlichen Existenz bis zur Analyse der modernen Malerei - mit so viel Sachhaltigkeit weiterverfolgt hat. What distinguishes deception from manipulation? Cohen (Australasian Journal of Philosophy, 96, 483 and 2018) proposes a new answer and explores its ethical implications. Appealing to new cases of “non‐deceptive manipulation” that involve intentionally causing a false belief, he offers a new definition of deception in terms of communication that rules out these counterexamples to the traditional definition. And, he leverages this definition in support of the claim that deception “carries heavier moral weight” than manipulation. In this paper, I argue that (...) these cases of “non‐deceptive manipulation” are even more prevalent than Cohen suggests—especially in the digital world. Thus, if his moral claim were correct, a lot of what is happening on the internet these days would constitute moral improvement over old‐fashioned deception. Fortunately, we are not forced to accept this counterintuitive conclusion. Cohen's definition must be rejected because it incorrectly rules out clear instances of deception. In this paper, I defend a definition of deception in terms of evidence that does correctly distinguish between deception and non‐deceptive manipulation. Moreover, it does not support Cohen's claim that deception is morally worse than other forms of manipulation. (shrink)
