Penance is often said to be a part of the process of making amends for wrongdoing. Here I clarify the nature of penance as a remedial action, highlighting the differences between it and more familiar corrective actions such as reparation and apology, and I offer an account of how penance contributes to the expiation of wrongdoing. In doing so, I reject a popular view according to which one does penance primarily by either punishing oneself or voluntarily (...) submitting to punishment at the hands of others. I contend that non‐punitive actions such gifts or acts of service are typically more conducive to achieving the reparative aims of penance. (shrink)

A consideration of the concept of repentance both theologically and in law. Penance generally refers to repentance or contrition for sin. It refers, more particularly in the Orthodox and Roman Catholic traditions, to a sacrament, or an outward sign of an inward grace. In these traditions, the authority for regarding penance a sacrament is scriptural: “As the Father hath sent me, I also send you. When He had said this, He breathed on them; and He said to them: (...) Receive ye the Holy Ghost. Whose sins you shall forgive, they are forgiven them; and whose sins you shall retain, they are retained” (John 20:21–23). In both traditions this is ordinarily interpreted as Christ's grant of power to the apostles in keeping with his own acts of explicitly forgiving sin (Matthew 9:2–8; Luke 5:20, 7:47; Revelation 1:5). St. Augustine affirms that the church has the power to “forgive all sins” and urges the faithful to reject those who would deny it. St. Ambrose rejects the Novatianists, who believe the power to forgive sin lies with Christ alone, with the observation that “the Church obeys Him in both respects, by binding sin and by loosing it; for the Lord willed that for both the power should be equal” (De Poenitentiae, I, ii,6). I am currently composing a monograph on this sacrament for a series in biblical theology, surveying the Scriptures to see how, within them, the Church's sacraments are prefigured, revealed, and commanded, and to illustrate Scripture's witness in a way that will "strengthen" and "rejuvenate" our theology (...) and practice, following Dei Verbum (DV) §24. My contribution here focuses especially on how to approach writing a biblical theology of penance. Biblical treatments and defenses of the sacrament are often brief, contenting themselves with proving a few conceptual points or doubling down on Jesus's giving his apostles the power and duty of absolution in John 20:19–23. Robert Fastiggi's discussion of the biblical "foundations" of reconciliation, for instance, spans less than thirty pages for both testaments combined, and concludes with a kind of anti-climactic apology: "While it's clear that the Sacrament of Penance has been instituted by Christ, the actual form of the administration of the sacrament will need to develop within the Church's tradition."1 This is a roundabout way of saying that although Scripture clearly attests to the sacrament's theological foundations, it leaves us only with foundations. If this is true, how far can a biblical theology of the sacrament go, and how should one go about it?Approaching a biblical theology of penance, I think, requires us to pause and consider two aspects of the task. First, we should give an account [End Page 1371] of "biblical theology" and our aims in writing one. Secondly, we should consider how to write a theology of this sacrament in particular. What should we be looking for? Such questions will help us gain a clearer vision of what illumination we should expect from Scripture about penance and how we will go about finding it. With our approach and aims discussed, this essay can then conclude with an attempt to follow them in practice by offering a theological, penance-focused exegesis of the sin of Cain (Gen 4:1–16).A Biblical Theology of the SacramentWriting a biblical theology of the sacrament of reconciliation requires us to attend to the notion of "biblical theology." Unfortunately, there continues to be little agreement on exactly what biblical theology is. The phrase is "a wax nose" molded always to the interpreter practicing it.2 Thankfully, however, this lack of consensus allows us to offer our own proposal and tailor it to the task at hand. This book traces the long-term genesis of the sixth-century Roman legal penalty of forced monastic penance. The late antique evidence on this penal institution runs counter to a scholarly consensus that Roman legal principle did not acknowledge the use of corrective punitive confinement. Dr Hillner argues that forced monastic penance was a product of a late Roman penal landscape that was more complex than previous models of Roman punishment have allowed. She focuses on invigoration of classical normative discourses (...) around punishment as education through Christian concepts of penance, on social uses of corrective confinement that can be found in a vast range of public and private scenarios and spaces, as well as on a literary Christian tradition that gave the experience of punitive imprisonment a new meaning. In this historical contribution, we assess Duns Scotus’s analysis of atonement (Commentary on the Sentences bk. III). We also include a partial exploration of his analysis of penance (Sentences bk. IV), because certain topics which we tend to discuss within atonement-theory, for example the analysis of the virtue of punishment, pertained to the subject of penance for Scotus. In recent scholarship, Andrew Rosato has argued that Scotus adapted the Anselmian non-penal view of Christ’s substitutionary satisfaction to the penal (...) understanding of satisfaction operative in penance. In this contribution, however, we argue that Scotus’s understanding remained non-penal: his view of the atonement depends on meritorious supererogatory acts of love. Additionally, we harvest some valuable Scotistic insights for atonement-theory, some of them applicable to penal theories as well. (shrink)

In the study of Buddhism it is commonly accepted that a monk or nun who commits a pārājika offence is permanently and irrevocably expelled from the Buddhist monastic order. This view is based primarily on readings of the Pāli Vinaya. With the exception of the Pāli Vinaya, however, all other extant Buddhist monastic law codes (Dharmaguptaka, Mahāsāṅghika, Mahīśāsaka, Sarvāstivāda and Mūlasarvāstivāda) contain detailed provisions for monks and nuns who commit pārājikas but nevertheless wish to remain within the saṅgha. These monastics (...) are not expelled. Rather, they are granted a special status known as the śikṣādattaka. In this paper I explore the rules. concerning pārājika penance and the śikṣādattaka with specific regard to monastic celibacy. Given that five out of six extant law codes recognise this remarkable accommodation to the rule of celibacy, I argue that we must look to Vinayas other than the Pāli Vinaya if we are to arrive at a nuanced and representative view of Indian Buddhist monasticism. This essay suggests that while Antony Duff's model of criminal punishment as secular penance is pregnant with possibilities for theological reception and reflection, it proceeds by way of a number of separations that are brought into question by the penitential traditions of Christianity. The first three of these—between justice and mercy, censure and invitation, and state and victim, constrain the true communicative character of his account of punishment. The second set of oppositions, between sacrament and virtue, interior character and (...) external action, and formal and moral reconciliation, subject the model of state punishment as secular penance to problematic liberal and libertarian constraints. A postsecular analogy, outlining a theology of the invitational nature of divine judgment, and drawing on Thomas Aquinas's account of penance as both sacrament and virtue, is proposed. (shrink)

This article traces the evolution of auricular confession from its origins in the spiritual diakresis in the early desert tradition and argues that through the Celtic churches of Northern Europe the practice is introduced into the Western Church culminating in the decrees of the Fourth Lateran Council in 1215. By developing the desert tradition of diakresis it will be argued that the Celtic system triumphed because of its stronger psychological verisimilitude compared to the Southern Mediterranean traditions of public one-off (...) class='Hi'>penance. St. Thomas Aquinas treats penance as both a sacrament and a virtue. In either form, penance’s principal human act is contrition—a willed sorrow for one’s sins and an intention to avoid future sins. A look at Aquinas’s understanding of penitential contrition reveals a complex interplay of the different objects of love, the gift of fear, and finally friendship with God. This article offers an analysis of Aquinas’s accounts of penance and contrition with respect to these key elements. (...) I argue that contrition performs a fundamental role in countering, restoring, and safeguarding a proper ordering of love and attainment of the ultimate good of union with God. In short, contrition is the act that directly counters the interior disorder wrought by sin and provides an ongoing counter to the threat of additional disorder. The aim of this paper is to provide a broad sketch of the advantages of the debt/atonement approach to punishment. Such an approach is appealing for it can benefit both the victim and the remorseful victimizer. Compared to other theories, it gives a fuller and more unified account of our intuitions about paying debts, doing penance, alleviating guilt, granting forgiveness, and offsetting privileges, pleasures and burdens. The theory also allows us to avoid justifying punishment on the basis of using (...) some people to deter others. And it does all of this while channeling in a positive and productive way the deeply felt vindictive need to "get even." Thus, contrary to the traditional wisdom that justice and revenge are diametrically opposed, providing the former may actually depend upon allowing the latter. (shrink)

In this follow up to I Was Wrong: The Meanings of Apologies, Nick Smith expands his ambitious theories of categorical apologies to civil and criminal law. After rejecting court-ordered apologies as unjustifiable humiliation, this book explains that penitentiaries were originally designed to bring about penance - something like apology - and that this tradition has been lost in the assembly line of mass incarceration. Smith argues that the state should modernize these principles and techniques to reduce punishments for offenders (...) who demonstrate moral transformation through apologizing. Smith also explains the counterintuitive situation whereby apologies come to have considerable financial worth in civil cases because victims associate them with priceless matters of the soul. Julian of Norwich emphasizes God’s eternal and unchanging love for humankind. Her visions show how God is not angry with our sins and so has no need to forgive us. God does not shame or blame us but excuses us and plans how to reward and compensate us for sin. In relation to Mother Jesus, we remain dear lovely children who need help, correction, and education. Although these remarks suggest to some that Julian must be soft on sin, that she (...) has no adequate appreciation of the worthiness of God or the dignity of human nature, I argue that this is far from the case. On the contrary, she makes Divine worthiness axiomatic and urges readers to live into it. She relocates human dignity not in its intrinsic value but in our centrality to God’s plan. She measures the seriousness of sin in terms of the real hard work it takes to rear us up out of it: crucifixion for Christ, the hell of being a sinner and the crucifixion of life-long penance for us. Nevertheless, the brightness of her visions dominates with her assurance that despite the sin-produced sufferings of this present life, all will be well. (shrink)

This thesis provides an ethical analysis of imprisonment as a mode of punishment. Consisting in an introduction and four papers the thesis addresses several important questions concerning imprisonment from a number of different perspectives and theoretical starting points. One overall conclusion of this thesis is that imprisonment, as a mode of punishment, deserves more attention from moral and legal philosophers. It is also concluded that a more complete ethical assessment of prison conditions and prison management requires a broader focus. It (...) must include an explicit discussion of both how imprisonment directly affects prison inmates and its negative side-effects on third parties. Another conclusion is that ethical discussions on prison conditions should not be too easily reduced to a question about how harsh or lenient is should be. Paper 1 argues that prisoners have a right to privacy. It is argued that respect for inmates’ privacy is related to respect for them as moral agents. Consequently, respect for inmates’ privacy is called for by different established philosophical theories about the justification of legal punishment. Practical implications of this argument are discussed and it is argued that invasion of privacy should be minimized to the greatest extent possible, without compromising other important values or the rights to safety and security. It is also proposed that respect for privacy should be part of the objective of creating and upholding a secure environment. Paper 2 discusses whether the collateral harm of imprisonment to the children and other close family members of prison inmates may give rise to special moral obligations towards them. Several collateral harms, including decreased psychological wellbeing, financial costs, loss of economic opportunities, and intrusion and control over their private lives, are identified. Two perspectives in moral philosophy, consequentialism and deontology, are then applied in order to assess whether these harms are permissible. It is argued that from either perspective it is hard to defend the claim that allowing for these harms are morally permissible. Consequently, imprisonment should be used only as a last resort. Where it is deemed necessary, it gives rise to special moral obligations. Using the notion of residual obligation, these obligations are then categorized and clarified. Paper 3 focuses on an argument that has figured in the philosophical debate on felon disenfranchisement. This argument states that as a matter of democratic self-determination, a legitimate democratic collective has the collective right to decide whether to disenfranchise felons as a way of defining their political identity. Yet, such a collective’s right to self-determination is limited, since the choice to disenfranchise anyone must be connected to normative considerations of political significance. This paper defends this argument against three charges that has been raised to it. In doing so it also explores under what circumstances felon disenfranchisement can be permissible. Paper 4 explores the question of whether prison inmates suffering from ADHD should be administered psychopharmacological intervention for their condition. The theoretical starting point for the discussion is the communicative theory of punishment, which understands criminal punishment as a form of secular penance. Viewed through the lens of the communicative theory it is argued that the provision of pharmacological treatment to offenders with ADHD need not necessarily be conceived of as an alternative to punishment, but as an aid to achieving the penological ends of secular penance. Thus, in this view offenders diagnosed with ADHD should have the option to undergo pharmacological treatment. (shrink)

The importance of employment exchanges in the governance of mass unemployment in the 1930s presented social researchers with a rich site for the investigation of the meaning of unemployment from a governmental perspective, or more precisely, of how that meaning is encoded into social spaces. Comparing writing from the 1930s and earlier with my own contemporary research in Jobcentres, Benefits Agencies and Jobcentre Plus offices facilitates an understanding of how that meaning, and its literally concrete means of deployment, has shifted. (...) Observation conducted in these institutional spaces adds an empirical dimension to extant discursive analyses of the governance of unemployment. Broadly, there has been a move from an overt, gendered stigmatization of being without paid work as a moral failing deserving of penance in the 1930s employment exchange, to an attempt to discursively rearticulate unemployment with a mainstream nexus of work-consumerism in Jobcentre Plus. These changes are also indicative of broader societal shifts in the values ascribed to work and consumerism, and the ways in which a governmentally consecrated subjectivity can be achieved. (shrink)

Abstract:Business negotiations often involve cooperative arrangements. Sometimes one party will renege on a cooperative enterprise for short-term opportunistic gain. There is a common assumption that such behavior necessarily leads to a spiral of mutual antagonism. We use some of the philosophical literature to frame general research questions and identify relevant variables in dealing with defection. We then describe an experimental approach for examining the possibility of reconciliation and discuss the results of one such experiment where participants were the victims of (...) defection. In contrast to the initial assumptions we found that many participants were willing to reconcile, and that penance conditions, when demanded, were less stringent than expected. Augustine and female homoeroticism in the early Middle Ages: A Foucaultian idea-historical interpretation. Taking his reading of Romans 1:26–27 and Genesis 19 as its hermeneutical key, an idea-historical interpretation of the views of the Western church father Augustine of Hippo (354–430) on female homoeroticism is presented in this article. The accentuation of French philosopher Michel Foucault (1926–1984) on the overall significance of Augustine in the Western history of sexuality, in his posthumous Histoire de la sexualité 4 ( Les aveux de (...) la chair, under editorship of Frédéric Gros, 2018 ), is used to contextualise Augustine’s views on sexual desire as the ‘form of the will’, here positioned specifically within a female homoerotic context. Drawing on the substantial studies of John Boswell (in 1980) and Bernadette Brooten (in 1996), which, although relatively dated, are still without equal in Medieval research, the article subsequently explores Augustine’s views on intimate relations between women, both in monasteries and in secular society. It is shown that intimate relations between women must have transpired in fifth-century monasteries and that female homoeroticism was for the next two centuries dealt with with restraint rather than with forms of exclusion and punishment, despite the negative portrayals of same-sex relations by some of Augustine’s patristic contemporaries (particularly John Chrysostom [ca.347–407]), yet precisely on the basis of Augustine’s understated approach. Although Augustine renounced homoerotic relations as a form of ‘unnatural’ (for him, expressly, all ‘non-procreative’) sex, he dealt with the incidence of female same-sex relations with understatement. Given his general authority in the early Middle Ages, one effect of Augustine’s non-homophobic approach was that female homoeroticism was de facto bypassed as a ‘moral problem’ in the fifth and sixth centuries, until handbooks of penance, that prohibited all forms of same-sex relations, started circulating at the end of the sixth century. Contribution: This article contributes to the ongoing study of Medieval female sexuality, and particularly of female homoeroticism in late Antiquity and the early Middle Ages, by exploring Augustine’s views on same-sex relations between women around the early fifth century, while concurrently contributing to ongoing analyses of Michel Foucault’s interpretation of the church and desert fathers in the (edited) fourth volume of Histoire de la sexualité ( Les aveux de la chair ), published in 2018.
