L’enfant placé a souvent vécu des traumatismes qui ont impacté sa capacité à réguler ses émotions dans les relations interpersonnelles. Afin d’aider les assistants familiaux et les parents à mieux s’ajuster à l’enfant ont été instaurés des temps d’observation dans les conditions naturelles des interactions adulte-enfant qui ont été enregistrés en vidéo. Le vidéo-feedback a ensuite été utilisé avec chacun des adultes. L’exemple de Matthias montre comment ce dispositif a permis aux parents d’identifier les conséquences de leur comportement sur leur (...) enfant. L’exercice a été plus difficile pour l’assistante familiale davantage centrée sur ses besoins. (shrink)

In this paper we argue that the consensus around normative standards for the ethics of research in clinical trials, strongly influenced by the Declaration of Helsinki, is perceived from various quarters as too conservative and potentially restrictive of research that is seen as urgent and necessary. We examine this problem from the perspective of various challengers who argue for alternative approaches to what ought or ought not to be permitted. Key themes within this analysis will examine these claims and argue (...) they have implications for the interests of the research subject, research governance and regulation. Using our work with TREAT-NMD, the neuromuscular clinical trials network, we posit that there is a place for advancing the discourse of moral rights and moral duties in the context of research, especially from the perspective of patients and their families, and for including the politics of patient activism and empowerment. At the same time we remain vigilant to the danger that the therapeutic misconception and other serious vulnerabilities for the patient population in clinical trials, are at risk of being overlooked. Although the therapeutic misconception (TM) has been well described over a period of approximately 20 years, there has been disagreement about its implications for informed consent to research. In this paper we review some of the history and debate over the ethical implications of TM but also bring a new perspective to those debates. Drawing upon our experience of working in the context of translational research for rare childhood diseases such as Duchenne muscular dystrophy, we consider the ethical and legal (...) implications of the TM for parental consent to research. In this situation, it is potentially the parent who is vulnerable to TM. In our analysis we not only consider the context of informed consent for research but also the wider environment in which the value of research is promoted, more broadly through the media but also more specifically through the communication strategies of patient organizations. All dissemination about developments in research for health runs the risk of portraying an overly optimistic view of the promise of biotechnological solutions and has the potential to encourage a ‘collective’ TM. In this paper we consider the challenge that TM presents to parents as well as explore the ethical and legal responsibilities of researchers to ensure an appropriately informed consent: compatible with a hopeful disposition of parents who consent for the their children whilst avoiding a blind and misleading optimism. Objective: To measure the stability of life-sustaining treatment preferences amongst older people and analyse the factors that influence stability. Design: Longitudinal cohort study. Setting: Primary care centres, Granada (Spain). Eighty-five persons age 65 years or older. Participants filled out a questionnaire with six contexts of illness (LSPQ-e). They had to decide whether or not to receive treatment. Participants completed the questionnaire at baseline and 18 months later. Results: 86 percent of the patients did not change preferences. Sex, age, marital status, (...) hospitalisation, and self-perception of health and pain did not affect preferences. Morbidity and the death of a relative did. Conclusion: Stability of preferences of older persons in relation to end-of-life decisions seems to be more probable than instability. Some factors, such as the death of a relative or the increase in morbidity, can change preferences. These findings have implications for advance directives (ADs) and advance care planning. (shrink)

Stroke is a severe health issue, and motor recovery after stroke remains an important challenge in the rehabilitation field. Neurofeedback, as part of a brain–computer interface, is a technique for modulating brain activity using on-line feedback that has proved to be useful in motor rehabilitation for the chronic stroke population in addition to traditional therapies. Nevertheless, its use and applications in the field still leave unresolved questions. The brain pathophysiological mechanisms after stroke remain partly unknown, and the possibilities for intervention (...) on these mechanisms to promote cerebral plasticity are limited in clinical practice. In NFB motor rehabilitation, the aim is to adapt the therapy to the patient’s clinical context using brain imaging, considering the time after stroke, the localization of brain lesions, and their clinical impact, while taking into account currently used biomarkers and technical limitations. These modern techniques also allow a better understanding of the physiopathology and neuroplasticity of the brain after stroke. We conducted a narrative literature review of studies using NFB for post-stroke motor rehabilitation. The main goal was to decompose all the elements that can be modified in NFB therapies, which can lead to their adaptation according to the patient’s context and according to the current technological limits. Adaptation and individualization of care could derive from this analysis to better meet the patients’ needs. We focused on and highlighted the various clinical and technological components considering the most recent experiments. The second goal was to propose general recommendations and enhance the limits and perspectives to improve our general knowledge in the field and allow clinical applications. We highlighted the multidisciplinary approach of this work by combining engineering abilities and medical experience. Engineering development is essential for the available technological tools and aims to increase neuroscience knowledge in the NFB topic. This technological development was born out of the real clinical need to provide complementary therapeutic solutions to a public health problem, considering the actual clinical context of the post-stroke patient and the practical limits resulting from it. As systems based on opaque Artificial Intelligence (AI) continue to flourish in diverse real-world applications, understanding these black box models has become paramount. In response, Explainable AI (XAI) has emerged as a field of research with practical and ethical benefits across various domains. This paper not only highlights the advancements in XAI and its application in real-world scenarios but also addresses the ongoing challenges within XAI, emphasizing the need for broader perspectives and collaborative efforts. We bring together experts from diverse (...) fields to identify open problems, striving to synchronize research agendas and accelerate XAI in practical applications. By fostering collaborative discussion and interdisciplinary cooperation, we aim to propel XAI forward, contributing to its continued success. Our goal is to put forward a comprehensive proposal for advancing XAI. To achieve this goal, we present a manifesto of 27 open problems categorized into nine categories. These challenges encapsulate the complexities and nuances of XAI and offer a road map for future research. For each problem, we provide promising research directions in the hope of harnessing the collective intelligence of interested stakeholders. (shrink)

It is the purpose of the book to consider how religious beliefs and cultic rituals were given expression in the world of the Greek citizen - the functions performed by the religious personnel, and the place that religion occupied in (...) individual, social and political life. The chapters cover first ritual and then myth, rooting the account in the practices of the classical city while also taking seriously the world of the imagination. For this edition the bibliography has been substantially revised to meet the needs of a mainly student, English-speaking readership. En el estudio que aquí se presenta se analiza hasta qué punto se puede llegar a una situación democrática estable, siguiendo los planteamientos del Cesarismo Democrático de Laureano Valenilla Lanz, que para conseguir los objetivos utilitaristas señalados por Simón Bolívar en su Manifiesto de Cartagena, intentó construir un sistema autoritario de gobierno. En contra de los razonamientos expresados por el autor venezolano, y desde una óptica más actual, hablar de democracia no supone quedarse en la mera constatación de las realidades (...) concretas, sino hacerlo desde una perspectiva de deber ser. Aceptar los hechos tal y como son, tiene como consecuencia teórica la ausencia de criterio demarcador que oriente la política concreta y, cómo no, la labor intelectual. Entre los objetivos de estas páginas resaltan dos: la democracia se refuerza con un mayor grado de democracia; y que la lucha por las condiciones económicas, sociales o laborales, no puede ser desgajada de la pugna política por conseguir cada vez mayores espacios democráticos, tanto en la sociedad como en el Estado. This article considers the recent publications of French philosopher Simone de Beauvoir, and offers an overview of contemporary scholarship in Beauvoir Studies. Beauvoir’s canonization in Gallimard’s La Pléiade collection in 2018 is discussed, specifically Gallimard’s choice of Beauvoir’s Mémoires for these first two volumes. Exploring the imbrication of Beauvoir’s philosophy with her own lived experience, the article traces what Annie Ernaux describes as the ‘running threads’ connecting us, namely the ways in which Beauvoir’s legacy is interwoven in our lives today. Surveying recent scholarship highlights the pertinence of Beauvoir’s work to contemporary contexts on issues ranging from sexual violence, subjective agency and female subjugation to emancipatory politics and transnational feminist solidarities. Thereafter, the importance Beauvoir placed on self–Other relations is explored in relation to scholarship on Beauvoir’s epistolary exchanges, the publication of her lost novella Les Inséparables, and on Beauvoir’s philosophy of alterity and old age in light of the pandemic. In lieu of an abstract, here is a brief excerpt of the content:Why Theory?Oscar Martín (bio) and Simone Pinet (bio)Theory is, of course, a medieval word, brought from Greek into Latin from a common root (theastai) that also gives us theater, linked through shared meanings related to speculation, contemplation, and so forth. It is used in the Bible, and its English modern use, according to the Oxford english dictionary, probably comes from a medieval Latin translation of Aristotle. The dictionary does (...) not direct us to any specific translation, but prompts us to compare with Italian and, of course, French usage. In French, however, the word théorie was not used until quite late. In fact, it appeared for the first time in French in a 1584 translation of Antonio de Guevara, the famous Spanish court preacher and man of letters whose oeuvre was translated, imitated, and plagiarized in France, Italy, Germany, and England during the sixteenth century. In Spanish, the word theoria had begun its vernacular life a few years before in the writings of Fernando de Herrera.Theoria is already documented by Antonio de Nebrija’s Vocabulario español-latino of 1495, listed between “speculation” and “species” and designating the contemplative and the art of speculation, from theory to the perception of its quality. It is appropriate that Spanish would give theory to the West, sharing with it a point of view or, better, a series of perspectives or miradores, as María Rosa Menocal would call them, from which to look back into or beyond cultural and literary practices [“Visions of al-Andalus”]. For Medieval Iberia was, as this collection of essays purports to be, not a space or a history but a shifting and fluid gaze on the conflicting world surrounding the different literary and cultural works dealt with in this issue.Reluctant at best, and most of the time resentful of theoretical approaches to the study of literature and culture, medievalism found in Hispanism a surprising and most loyal ally. If in most Spanish departments critical theory pushed its way into the study of later periods, to the point that today even the mourning itself (or celebration) of the agony of theory is done from a theoretical standpoint, Hispanomedievalism remained suspicious longer, and sharpened its words on statistics and “scientific” claims to authority. Its close relationship to historical research, however, also made this philology vulnerable to the practices of interpretation. This is the first comprehensive account of Kant’s cosmopolitanism, highlighting its moral, political, legal, economic, cultural, and psychological aspects. Contrasting Kant’s views with those of his German contemporaries, and relating them to current debates, Pauline Kleingeld sheds new light on texts that have been hitherto neglected or underestimated. The “boomerang thesis” enjoys widespread currency in contemporary scholarship: that the means and ends of colonial domination would “spin back” to the metropole is an idea with intuitive grip. This article extrapolates the depth of meaning this metaphor contains, as well as what it conceals. It first considers the “boomerang” as it appears in Aimé Césaire’s Discourse on Colonialism, a poetic work that captures the moral and experiential return-effects of imperial violence. Turning to Hannah Arendt’s The Origins of Totalitarianism—the only (...) articulation of the thesis that uses the word “boomerang”—the article disaggregates the teleological, ideological, and institutional elements that spun back from European colonies in the imperial era. Finally, it traces the development of the thesis in Michel Foucault’s “Society Must Be Defended,” where it is transformed into a more general explanatory mechanism. Each theorist indicates how distance operates to transform dubious, even hateful ideas into acceptable practices. (shrink)

Por su parte, en el bando comunitarista, nos encontramos aquellos planteamientos -cuyo denominador común es una crítica a toda visión puramente procedimentalista de la filosofía pública-, que consideran que sólo se posee una comunidad política cuando se recurre a un patrimonio común de contenidos, valores y tradiciones, en el que todos los miembros de la comunidad se sienten radicados. En esta obra se presenta un análisis detallado de los protagonistas y de las etapas de este debate, proponiendo como conclusión un modelo de sociedad que pretende dar respuesta tanto a las instancias radicadas en el modelo procedimental como a las presentes en el modelo comunitario. In 2006 the Government issued a White Paper in which it proposed a ban on human-animal embryo research pending greater clarity on its potential. The Commons Select Committee on Science and Technology initiated an Inquiry and concluded that such research was necessary and should be permitted immediately. The Government agreed and this is reflected in revised legislation. The Government has issued guidelines on the gathering and use of scientific advice and evidence, designed to ensure that these are “credible, reliable and (...) objective.” This article tests the Committee’s approach in the light of its remit and these, and other, relevant guidelines and concludes that it failed to meet these standards. Rather, it effectively ceded to an interest group the regulation of its own activities. The article ends by suggesting alterations to the Committee’s remit and composition designed to ensure that the public interest is better protected in future. (shrink)

Professor Vaillancourt has written an unique introductory volume designed to assist non-Marxist scholars and students to understand and evaluate Marxist inquiry. In clear, straightforward language, the author identifies and examines the research of four of the most important contemporary Marxist currents--structuralists, philosophics, materialists, and deductivists. Marxist research-relevant assumptions about epistemology, methodology, and science are scrutinized along with how each of the various Marxist groups goes about conducting research in terms of contemporary social science norms. Simone Weil (1909-1943) was a defining figure of the twentieth century; a philosopher, Christian, resistance fighter, anarchist, feminist, labor activist and teacher. She was described by T. S. Eliot as "a woman of genius, of a kind of genius akin to that of the saints," and by Albert Camus as "the only great spirit of our time." Originally published posthumously in two volumes, these newly reissued notebooks, are among the very few unedited personal writings of Weil's that still survive today. (...) Containing her thoughts on art, love, science, God and the meaning of life, they give context and meaning to Weil's famous works, revealing a unique philosophy in development and offering a rare private glimpse of her singular personality. Background:Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals.Aim:To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations.Methods:Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group.Ethical considerations:Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research.Result/conclusion:Two categories emerged: one in ‘ethical issues’ and one in ‘emotions and feelings in caring’. The (...) four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. Une théorie qui veut établir les principes d'une science du droit, mais dont les fondements épistémologiques remontent aux premières années du XXe siècle, peut-elle garder sa validité de nos jours ?

Particle indistinguishability has always been considered a purely quantum mechanical concept. In parallel, indistinguishable particles have been thought to be entities that are not properly speaking objects at all. I argue, to the contrary, that the concept can equally be applied to classical particles, and that in either case particles may (with certain exceptions) be counted as objects even though they are indistinguishable. The exceptions are elementary bosons (for example photons).

The Moral Self addresses the question of how morality enters into our lives. Pauline Chazan draws upon psychology, moral philosophy, and literary interpretation to rebut the view that morality's role is to limit desire and control self-love. Preserving the ancients' connection between what is good for the self and what is morally good, Chazan argues that a certain kind of care for the self is central to moral agency. We demonstrate that the quantum-mechanical description of composite physical systems of an arbitrary number of similar fermions in all their admissible states, mixed or pure, for all finite-dimensional Hilbert spaces, is not in conflict with Leibniz's Principle of the Identity of Indiscernibles (PII). We discern the fermions by means of physically meaningful, permutation-invariant categorical relations, i.e. relations independent of the quantum-mechanical probabilities. If, indeed, probabilistic relations are permitted as well, we argue that similar bosons can also be discerned in all (...) their admissible states; but their categorical discernibility turns out to be a state-dependent matter. In all demonstrated cases of discernibility, the fermions and the bosons are discerned (i) with only minimal assumptions on the interpretation of quantum mechanics; (ii) without appealing to metaphysical notions, such as Scotusian haecceitas, Lockean substrata, Postian transcendental individuality or Adamsian primitive thisness; and (iii) without revising the general framework of classical elementary predicate logic and standard set theory, thus without revising standard mathematics. This confutes: (a) the currently dominant view that, provided (i) and (ii), the quantum-mechanical description of such composite physical systems always conflicts with PII; and (b) that if PII can be saved at all, the only way to do it is by adopting one or other of the thick metaphysical notions mentioned above. Among the most general and influential arguments for the currently dominant view are those due to Schrodinger, Margenau, Cortes, Dalla Chiara, Di Francia, Redhead, French, Teller, Butterfield, Giuntini, Mittelstaedt, Castellani, Krause and Huggett. I show that frequentism, as an explanation of probability in classical statistical mechanics, can be extended in a natural way to a decoherent quantum history space, the analogue of a classical phase space. The result is a form of finite frequentism, in which Gibbs’ concept of an infinite ensemble of gases is replaced by the quantum state expressed as a superposition of a finite number of decohering microstates. It is a form of finite and actual frequentism (as opposed to hypothetical (...) frequentism) insofar as all the microstates exist, in keeping with the decoherence-based Everett interpretation, and some versions of pilot-wave theory.
