We examine the influence of face-based judgments of CFO and CEO honesty on earnings management for the largest publicly traded companies in America. After controlling for incentives and opportunities to manage earnings, CFOs perceived to be less honest engage in higher levels of accruals earnings management and real earnings management. The beneficial impact of perceived honesty on earnings quality is most pronounced when both the CFO and the CEO are perceived to be more honest. Thick terms and concepts, such as honesty and cruelty, are at the heart of a variety of debates in philosophy of language and metaethics. Central to these debates is the question of how the descriptive and evaluative components of thick concepts are related and whether they can be separated from each other. So far, no empirical data on how thick terms are used in ordinary language has been collected to inform these debates. In this paper, we present the first empirical (...) study, designed to investigate whether the evaluative component of thick concepts is communicated as part of the semantic meaning or by means of conversational implicatures. While neither the semantic nor the pragmatic view can fully account for the use of thick terms in ordinary language, our results do favour the semanticist interpretation: the evaluation of a thick concept is only slightly easier to cancel than semantically entailed content. We further discovered a polarity effect, demonstrating that how easily an evaluation can be cancelled depends on whether the thick term is of positive or negative polarity. (shrink)

Is it tautological to call an action "wrongful discrimination?" Some philosophers and political theorists answer this question in the affirmative and claim that the term "discrimination" is intrinsically evaluative. Others agree that "discrimination" usually conveys the action’s moral wrongness but claim that the term can be used in a purely descriptive way. In this paper, we present two corpus studies and two experiments designed to test whether the folk concept of discrimination is evaluative. We demonstrate that the term has undergone (...) a historical development and is nowadays no longer used purely descriptively. Further, we show that this evaluation cannot be cancelled without yielding a contradiction. We conclude that the descriptive use of "discriminatory" is a thing of the past. (shrink)

Analytic philosophy is once again in a methodological frame of mind. Nowhere is this more evident than in metaphysics, whose practitioners and historians are actively reflecting on the nature of ontological questions, the status of their answers, and the relevance of contributions both from other areas within philosophy and beyond. Such reflections are hardly new: the debate between Willard van Orman Quine and Rudolf Carnap about how to understand and resolve ontological questions is widely seen as a turning point in (...) twentieth-century analytic philosophy. And indeed, this volume is occasioned by the fact that the deflationary approach to metaphysics advocated by Carnap in that debate is once again attracting considerable interest and support. Eleven original essays by many of today's leading voices in metametaphysics aim to deepen our understanding of Carnap's contributions to metaontology and to explore how this legacy might be mined for insights into the contemporary debate. Bolzano was the first to establish an explicit distinction between the deductive methods that allow us to recognise the certainty of a given truth and those that provide its objective ground. His conception of the relation between what we, in this paper, call "subjective consequence", i.e., the relation from epistemic reason to consequence and "objective consequence", i.e., grounding however allows for an interpretation according to which Bolzano advocates an "explicativist" conception of proof: proofs par excellence are those that reflect the (...) objective order of grounding. In this paper, we expose the problems involved by such a conception and argue in favour of a more rigorous demarcation between the ontological and the epistemological concern in the elaboration of a theory of demonstration. La plupart des recherches entreprises sur la philosophie de Michel Foucault ont visé jusqu’à maintenant à définir et assigner son travail à une étiquette politique définie. Foucault est pour les uns anarchiste, pour les autres nihiliste ou encore simple militant de gauche. Ce qui est étonnant avec cet effort, c’est que malgré la multiplicité des lectures, elles peuvent toutes se justifier et trouver quelques appuis dans son oeuvre. Par contre, en entreprenant la recherchedu politique de cette façon, c’est-à-dire en posant (...) à Foucault la question programmatique du « ce qu’il faut faire », nous tombons dans un piège que lui-même a toujours souhaité éviter, celui d’« unidimensionnaliser » sa pensée. Mais alors, comment lire son oeuvre sans nous-mêmes appliquer cette morale d’État civil demandant à chaque philosophe ses papiers politiques? En quoi, si nous refusons cette question, la pensée de Foucault peut-elle demeurer une pensée politique? Notre thèse est la suivante : en examinant la manière avec laquelle Foucault ré????léchit le politique dans son cours au Collège de France Le Gouvernement de soi et des autres, nous p ouvons m ontrer c omment, vers la fin de sa vie, il a changé l’angle de la question. En effet, dans ce cours, l’activité politique n’est plus envisagée à partir de la question du « ce qu’il faut faire », mais à partir de l’expérience du pouvoir elle-même, c’est-àdire comment sommes-nous en mesure d’exercer le pouvoir sur les autres. La tâche du philosophe n’est donc plus celle du « donneur de leçon » pense Foucault dans ce cours, mais celle de faire de sa vie un exemple où parole et acte, discours et vérité sont intimement reliés. It has recently been argued that normative considerations play an important role in causal cognition. For instance, when an agent violates a moral rule and thereby produces a negative outcome, she will be judged to be much more of a cause of the outcome, compared to someone who performed the same action but did not violate a norm. While there is a substantial amount of evidence reporting these effects, it is still a matter of debate how this evidence is to (...) be interpreted. In this paper, we engage with the three most influential classes of explanations, namely, (a) the Norm‐Sensitive Cognitive Process View, (b) the Normative Concept View, and (c) the Pragmatics View. We will outline how these theories explain the empirical results and in what ways they differ. We conclude with a reflection on how well these strategies do overall and what questions they still leave unanswered. (shrink)

A growing literature is taking an institutionalist and governance perspective on how algorithms shape society based on unprecedented capacities for managing social complexity. Algorithmic governance altogether emerges as a novel and distinctive kind of societal steering. It appears to transcend established categories and modes of governance—and thus seems to call for new ways of thinking about how social relations can be regulated and ordered. However, as this paper argues, despite its novel way of realizing outcomes of collective steering and coordination, (...) it can nevertheless be grasped with an old and fundamental figure in political philosophy: that of Thomas Hobbes’ Leviathan. Comparing algorithmic governance with this figure serves to highlight their similarities as socio-political arrangements, and specifically to clarify how algorithmic governance parallels the apolitical traits of the Leviathan—it eliminates the political as it requires compliance and forgoing contestation to best fulfill its role and to produce satisfying outcomes. How evaluative are legal texts? Do legal scholars and jurists speak a more descriptive or perhaps a more evaluative language? In this paper, we present the results of a corpus study in which we examined the use of evaluative language in both the legal domain as well as public discourse. For this purpose, we created two corpora. Our legal professional corpus is based on court opinions from the U.S. Courts of Appeals. We compared this professional corpus to a public corpus, (...) which is based on blog discussions on the internet forum Reddit. While many linguistic phenomena can give insights into evaluativity, we investigated the use of a wide selection of evaluative adjectives (more specifically, thick adjectives) to gain a more comprehensive picture of the degree of evaluativity in the legal domain. Our analysis shows that legal professionals use thick terms less evaluatively than laypeople, which suggests that legal texts are less evaluative than ordinary discussions. This result, more generally, supports the philosophical idea that thick concepts may vary in their evaluative intensity. (shrink)

Imagine you and your friend Pierre agreed on meeting each other at a café, but he does not show up. What is the difference between a friend’s not showing up meeting? and any other person not coming? In some sense, all people who did not come show the same kind of behaviour, but most people would be willing to say that the absence of a friend who you expected to see is different in kind. In this paper, I will spell (...) out this difference by investigating laypeople’s conceptualisation of absences of actions in four experiments. In languages such as German, French, Italian, or Polish, people consider a friend’s not coming an omission. Any other person’s not coming, in contrast, is not considered an omission at all, but just a mere nothing. This use of the term omission differs from the usage in English, where ‘omission’ refers to all kinds of absences. In addition, ‘omission’ is not even an everyday term, but invented by philosophers for the sake of philosophical investigation. In other languages, ‘omission’ is part of an everyday vocabulary. Finally, I will discuss how this folk concept of omission could be made fruitful for philosophical questions. (shrink)

The authors work in a variety of clinical ethics consultation services (CECSs) that employ a range of methods and approaches. This article discusses the approach to ethics consultation at the Center for Medical Ethics and Health Policy at Baylor College of Medicine and describes the development and transformation of the authors’ CECSs. It discusses how one CECS shifted from a nascent program with only fifty consultations a year to a vibrant, heavily staffed service with five hundred ethics consultations a year.

The main aim of this paper is to introduce first-order versions of logics of evidence and truth, together with corresponding sound and complete Kripke semantics with variable and constant domains. According to the intuitive interpretation proposed here, these logics intend to represent possibly inconsistent and incomplete information bases over time. The paper also discusses the connections between Belnap-Dunn’s and da Costa’s approaches to paraconsistency, and argues that the logics of evidence and truth combine them in a very natural way.

In this paper, we propose Kripke-style models for the logics of evidence and truth LETJ and LETF. These logics extend, respectively, Nelson’s logic N4 and the logic of first-degree entailment with a classicality operator ∘ that recovers classical logic for formulas in its scope. According to the intended interpretation here proposed, these models represent a database that receives information as time passes, and such information can be positive, negative, non-reliable, or reliable, while a formula ∘A means that the information about (...) A, either positive or negative, is reliable. This proposal is in line with the interpretation of N4 and FDE as information-based logics, but adds to the four scenarios expressed by them two new scenarios: reliable information for the truth and for the falsity of a given proposition. Acts that are considered undesirable standardly violate our expectations. In contrast, acts that count as morally desirable can either meet our expectations or exceed them. The zone in which an act can be morally desirable yet not exceed our expectations is what we call the zone of moral indifference, and it has so far been neglected. Factors include: type of organ donated (kidney vs. liver), relationship to the recipient (related—biological or non–biological vs. non–related), decision–making and motivation for donation, support systems available within and outside of the (...) transplant program, and outcomes of the donation for both recipient and donor. The variety of experiences is apparent in the narratives within this special issue. I want to thank the authors of each story for sharing their experiences of the live donation process. As difficult as it must have been to write, it was difficult for someone like me, a transplant professional who is a strong advocate for quality donor care, to hear. But with each success and failure of transplantation, we can learn in the hopes of improving things for the next.Despite the fact that the field of transplantation is over 50 years old and the first kidney donors were live donors, viewing the field of live donation as a subspecialty of transplantation is a new concept (LaPointe Rudow, 2011). Live donation is, in fact, as specialized as lung transplant, liver transplant, transplant infectious disease, and kidney transplant. All of those subspecialties have clinicians and researchers with expertise in the area. Live donation experts exist and teams of live donor professionals staff most transplant programs today. Additionally regulatory bodies, professional societies, and advocacy groups strive to improve the care of the live organ donor (Medicare Conditions of Participation, 2007; Organ Procurement and Transplant Network, 2011; National Kidney Foundation 2011). Many years have been spent perfecting the surgical procedure and refining the proper testing to ensure that donation is safe for the donor. Live donation is, however, more than a surgery; in recent years, transplant professionals acknowledge that the psychosocial impact of donation on donors, whether positive or negative, can be significant but it is not yet completely understood.Much debate has occurred as to the components of the psychosocial evaluation, length and type of follow up, and the role of the independent live donor advocate (Amsterdam Forum, 2005; Ommen et al. 2011; Pruett et. al. 2006; Schroder et. al. 2008; Simpson & Pomfret 2012). The ethical concepts of paternalism and autonomy are in tension as we attempt to justify live donation. Perhaps nowhere else is ethical deliberation more vigorous than in the debate regarding whether informed consent for live donation is attainable, driven largely by the plight of the patient and the consequent vulnerability of the donor in an effort to help the patient. One donor has nothing but good things to report regarding his or her experience while another feels lasting ill emotional affects requiring ongoing counseling even though the recipient has done well.Pre–donation psychological issuesTraditionally, the psychosocial evaluation explores the pre–donation emotional and family stressors to ensure that there are no issues or underlying psychiatric disorders that will make donation high risk for psychological complications. This paper introduces the logic _Q__L__E__T_ _F_, a quantified extension of the logic of evidence and truth _L__E__T_ _F_, together with a corresponding sound and complete first-order non-deterministic valuation semantics. _L__E__T_ _F_ is a paraconsistent and paracomplete sentential logic that extends the logic of first-degree entailment (_FDE_) with a classicality operator ∘ and a non-classicality operator ∙, dual to each other: while ∘_A_ entails that _A_ behaves classically, ∙_A_ follows from _A_’s violating some classically valid inferences. The semantics of _Q__L__E__T_ (...) _F_ combines structures that interpret negated predicates in terms of anti-extensions with first-order non-deterministic valuations, and completeness is obtained through a generalization of Henkin’s method. By providing sound and complete semantics for first-order extensions of _FDE_, _K3_, and _LP_, we show how these tools, which we call here the method of _anti-extensions + valuations_, can be naturally applied to a number of non-classical logics. The omission effect, first described by Spranca and colleagues, has since been extensively studied and repeatedly confirmed. All else being equal, most people judge it to be morally worse to actively bring about a negative event than to passively allow that event to happen. In this paper, we provide new experimental data that challenges previous studies of the omission effect both methodologically and philosophically. We argue that previous studies have failed to control for the equivalence of rules that are violated (...) by actions and omissions. Once equivalent norms are introduced, our results show that the omission effect is eliminated, even if the negative outcome of the behavior is foreseen and intended by the agent. We show that the omission effect does not constitute a basic, moral disposition but occurs exclusively in complex moral situations. Building on these empirical results, we cast doubt onto two influential explanations of the omission effect, the Causal Relevance Hypothesis and the Overgeneralization Hypothesis, and provide a novel explanation of the phenomenon. Furthermore, we discuss various ramifications of the interplay between our understanding of omissions and legal systems. (shrink)

In view of the limitations of classical, free, and modal logics to deal with fictional names, we develop in this paper a four-valued logical framework that we see as a promising strategy for modeling contexts of reasoning in which those names occur. Specifically, we propose to evaluate statements in terms of factual and fictional truth values in such a way that, say, declaring ‘Socrates is a man’ to be true does not come down to the same thing as declaring ‘Sherlock (...) Holmes is a man’ to be so. As a result, our framework is capable of representing reasoning involving fictional characters that avoids evaluating statements according to the same semantic standards. The framework encompasses two logics that differ according to alternative ways one may interpret the relationships among the factual and fictional truth values. (shrink)

High-hope and low-hope research participants (males and females), as preselected on the basis of a dispositional self-report scale, choose freely between brief audiotaped messages that varied in depressive content. In the first experiment, the messages were of either positive or negative content. Highhope as compared to low-hope persons preferred listening to the positive tapes (no differences related to Gender), and this Hope main effect remained after the shared variance related to depression and positive and negative affectivity were removed. In a (...) modified replication, the contents of the tapes were comprised of successful or unsuccessful goal-attainment statements related to hopeful thinking. High-hope as compared to low-hope persons again preferred to listen to the successful goal pursuit messages (no differences related to Gender), and this Hope main effect on listening choices remained after the shared variances related to depression, positive and negative affectivity, and self-esteem were removed. Existentialist philosophy offers an understanding of how trying to eliminate ambiguities that inevitably mark the human condition only seemingly leads to freedom. This existentialist outlook can also serve to shed light on how democratic politics may similarly show tendencies which aim at overcoming immanent tensions. Such tendencies in democratic politics can be clarified using Sartre’s notion of ignorance – and truth as its counterpart. His concept of ignorance goes beyond merely facts or knowledge and refers to a mode of being. (...) It expresses a subject’s desire to avoid, rather than confront, resistances stemming from the world. Based on a distinction of different forms in which this orientation can manifest itself, this article shows how democratic politics, too, can be threatened by ignorance as a way of doing politics. This ignorance comes in different guises which all express a desire to eliminate tensions that democratic politics cannot overcome without undermining itself. (shrink)

Neste trabalho investigamos a natureza da imagem tendo como objeto empírico os registros rupestres de tempos pré-coloniais localizados na região da Serra do Cipó, Estado de Minas Gerais, Brasil. Tradicionalmente estudadas pela ciencia arqueológica que interpreta tais imagens com o rigor metodológico e as teorías que lhe embasam, neste trabalho propomos analisá-las como resultante de uma triangulação entre corpo, meio e ambiente, tendo como horizonte teórico a Antropología da Imagem, de Hans Belting, e a Teoria da Cultura, de Ivan Bystrina. (...) Essa triangulação revelou que tais imagens, em sua relação de proximidade e distancia com o observador, possuem um valor de culto. Walter Benjamin estudou a configuração da sociedade moderna observando textos literários, como a lírica baudelairiana. Ora, a arte é a primeira a repercutir os fenômenos de seu tempo, estando o artista à vanguarda do pensamento intelectual sistemático. Considerando a arte e a filosofia como formas legítimas de formação do pensamento crítico, buscamos ligar alguns conceitos benjaminianos com a arte moderna, de Camus a Chico Buarque, de Dostoiévski a Belquior.

To identify how digital media are being used by community-led initiatives of the Centro Region of Portugal, and to identify the requirements that a digital platform for mediation between agents in the territory should have, two focus groups were conducted, involving six small-sized community-led initiatives and six larger-sized community-led initiatives. This article details the results of these focus groups, according to the following main categories: use of existing communication and mediation tools; the purpose of use of digital tools; type of (...) experiences prompted by digital tools and attributes and features desired in a digital platform to support community-led initiatives. The results show differences between the use and needs of digital tools by small- and larger-sized initiatives and offer interesting insights to prototype an innovative digital solution, to enhance the actions of community-led initiatives. A reference framework for digital mediation strategies and a mobile app prototype were developed, based on these surveys. The article contributes with an analytical view about the development of digital solutions, which aim to strengthen the relationship among agents of local communities and promote mediation mechanisms among all stakeholders in territorial-based innovation.
