Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Da Banca Examinadora, que o aprovou com distinção, participaram os juristas Tércio Sampaio Ferraz Jr. (orientador), Dalmo de Abreu Dallari, Celso Bastos, Maria Helena Diniz e Eros Roberto Grau. This article reports a study carried out in order to measure how semantic factors affect reductions in the difficulty of the Chinese Ring Puzzle (CRP) that involves removing five objects according to a recursive rule. We hypothesised that semantics would guide inferences about action decision making. The study involved a comparison of problem solving for two semantic isomorphic variants of the CRP ( fish and fleas ) with problem solving for the puzzle's classic variant (the Balls and Boxes problem; Kotovsky (...) learning involves generalising the relations within a coherent, interconnected whole that makes up the puzzle's rules. It seems that semantics make it easier for the puzzle's elements to be grouped together within coherent, meaningful wholes, which reduces relational complexity and facilitates problem solving. Boghossian’s (2003) proposal to conditionalize concepts as a way to secure their legitimacy in disputable cases applies well, not just to pejoratives – on whose account Boghossian first proposed it – but also to thick ethical concepts. It actually has important advantages when dealing with some worries raised by the application of thick ethical terms, and the truth and facticity of corresponding statements. In this paper, I will try to show, however, that thick ethical concepts present a specific case, whose (...) analysis requires a somewhat different reconstruction from that which Boghossian offers. A proper account of thick ethical concepts should be able to explain how ‘evaluated’ and ‘evaluation’ are connected. (shrink)

Popular Traditions, Folklore and Politics The article studies how the "language" of folk traditions and folklore continues to be a tried-and-tested means for the representation and propagation of political concepts and ideas. The author notes transformations in the significance of folklore and folk traditions in historically changing both political and socio-cultural contexts. Attention is drawn to the significance of folklore in the nation-forming thinking of the 19th century, the place of honour accorded to it as an expression of the working (...) people during the period of socialism, and its contradictory perception in the post-socialist context today. Ancient critics reproached Xenocrates for beginning his work on the dialectic with a discussion of voice, and until now the question why he did so has never been systematically explored. Neither do we know why Xenocrates counted syllables, as Plutarch reports, and how he arrived at such an implausibly high number. In the first part of this paper, I show that Xenocrates’ interest in voice was suggested by Plato’s discussion of letters in his later dialogues, such as the Theatetus, the (...) Sophist, the Statesman, and the Philebus. Second, a fragment from Sextus attributed to Xenocrates confirms that Xenocrates allowed for various ‘levels’ of elements, and that explains why Theuth’s method, recommended in the Philebus, is applied to syllables. Finally, I address the very possibility of knowing the actual number of syllables and words, and address some of the problems connected to the reconstruction of the mathematical argument. (shrink)

Since the beginning of signed language research, the linguistic units have been divided into conventional, standard and fixed signs, all of which were considered as the core of the language, and iconic and productive signs, put at the edge of language. In the present paper, we will review different models proposed by signed language researchers over the years to describe the signed lexicon, showing how to overcome the hierarchical division between standard and productive lexicon. Drawing from the semiotic insights of (...) Peirce we proposed to look at signs as a triadic construction built on symbolic, iconic, and indexical features. In our model, the different iconic, symbolic, and indexical features of signs are seen as the three sides of the same triangle, detectable in the single linguistic sign. The key aspect is that the dominance of the feature will determine the different use of the linguistic unit, as we will show with examples from different discourse types. (shrink)

Este presente artigo visa buscar os pressupostos da dupla reflexão de Climacus para melhor compreender a sua crítica ao pensamento dialético-especulativo. É tendo em mente que a dupla reflexão retoma os conceitos do trágico e do cômico, da seriedade e do gracejo – ainda que sobre uma nova perspectiva– que compreenderemos a importância dessa comunicação para a linguagem indireta, que tem por objetivo comunicar uma contradição absoluta.

The concept of indiscernibility in a structure is analysed with the aim of emphasizing that in asserting that two objects are indiscernible, it is useful to consider these objects as members of (the domain of) a structure. A case for this usefulness is presented by examining the consequences of this view to the philosophical discussion on identity and indiscernibility in quantum theory.

This paper attempts to be a contribution to the epistemological project of explaining complex conceptual structures departing from more basic ones. The central thesis of the paper is that there are what I call “functionally structured concepts”, these are non-harmonic concepts in Dummett’s sense that might be legitimized if there is a function that justifies the tie between the inferential connection the concept allows us to trace. Proving this requires enhancing the russellian existential analysis of definite descriptions to apply to (...) functions and using this in proving the legitimacy of such concepts. The utility of the proposal is shown for the case of thick ethical terms and an attempt is made to use it in explaining the development of natural numbers. This last move could allow us to go one step lower in explaining the genesis of natural numbers while maintaining the notion of abstract numbers as higher order entities. (shrink)

Cognitive representations are typically analysed in terms of content, vehicle and format. While current work on formats appeals to intuitions about external representations, such as words and maps, in this paper we develop a computational view of formats that does not rely on intuitions. In our view, formats are individuated by the computational profiles of vehicles, i.e., the set of constraints that fix the computational transformations vehicles can undergo. The resulting picture is strongly pluralistic, it makes space for a variety (...) of different formats, and is intimately tied to the computational approach to cognition in cognitive science and artificial intelligence. Este trabajo analiza dos novelas del escritor honduro-salvadoreño Horacio Castellanos Moya, La sirvienta y el luchador (2011) y Moronga (2018), y demuestra que la producción novelística del autor representa un todo complejo y abarcador donde los lectores se informan, no solo a través del texto de la obra, sino también por el hecho de acceder al espacio entre las novelas donde ocurren muchos de los eventos cruciales para la historia del istmo y las vidas de los personajes de estas obras. Aunque cada una de las obras escritas por Castellanos Moya se puede leer sin conocimiento previo de otras novelas suyas, la capacidad de los lectores de entender el valor y el sentido de cada obra se ve profundamente impactada por su acceso a los intersticios que se ubican entre las novelas. The article is devoted to the ideas of religious and political identification of modern Russia and the USA. The main conceptual positions of Russian and American philosophers, political scientists, and theologians are presented. These ideas create the specific axiological unity of American and Russian forms of culture and civilizations. The search for national idea and cultural identification is presented in the article from the position of national and international security of the USA and Russia. The author pays attention to original (...) concepts of American philosophers, which have developed new «typologies of God». From this point of view God exists in human being in the new «technocratic» or «political» qualities. Overzicht van recent in Nederland ontwikkelde vormen van niet-universitaire toepassingen van de filosofie, zoals in het bedrijfsleven en de horeca-sector.

“Love hurts”—as the saying goes—and a certain amount of pain and difficulty in intimate relationships is unavoidable. Sometimes it may even be beneficial, since adversity can lead to personal growth, self-discovery, and a range of other components of a life well-lived. But other times, love can be downright dangerous. It may bind a spouse to her domestic abuser, draw an unscrupulous adult toward sexual involvement with a child, put someone under the insidious spell of a cult leader, and even inspire (...) jealousy-fueled homicide. How might these perilous devotions be diminished? The ancients thought that treatments such as phlebotomy, exercise, or bloodletting could “cure” an individual of love. But modern neuroscience and emerging developments in psychopharmacology open up a range of possible interventions that might actually work. These developments raise profound moral questions about the potential uses—and misuses—of such anti-love biotechnology. In this article, we describe a number of prospective love-diminishing interventions, and offer a preliminary ethical framework for dealing with them responsibly should they arise. (shrink)

An influential view in cognitive science is that computation in cognitive systems is semantic, conceptually depending on representation: to compute is to manipulate representations. I argue that accepting the non-semantic teleomechanistic view of computation lays the ground for a promising alternative strategy, in which computation helps to explain and naturalise representation, rather than the other way around. I show that this computation-based approach to representation presents six decisive advantages over the semantic view. I claim that it can improve the two (...) most influential current theories of representation, teleosemantics and structural representation, by providing them with precious tools to tackle some of their main shortcomings. In addition, the computation-based approach opens up interesting new theoretical paths for the project of naturalising representation, in which teleology plays a role in individuating computations, but not representations. I analyze a tension at the core of the mechanistic view of computation generated by its joint commitment to the medium independence of computational vehicles and to computational systems possessing teleological functions to compute. While computation is individuated in medium-independent terms, teleology is sensitive to the constitutive physical properties of vehicles. This tension spells trouble for the mechanistic view, suggesting that there can be no teleological functions to compute. I argue that, once considerations about the relevant function-bestowing factors for computational (...) systems are brought to bear, the tension dissolves: physical systems can have the teleological function to compute. Philosophers have disagreed on the composition of force for decades. The main divergence concerns the fundamental question: given a certain motion that is observable, which force or forces are present in it, component or resultant forces? The present paper focuses on the conditions for dealing with this problem. I will argue that we are not able to infer force from the observation of a motion, as required by the problem. I will further argue that the validity of the Newtonian algorithm (...) is not a sufficient condition for that inference because the Gaussian algorithm, which is equally valid, differs from the former with regard to the forces present in motions. Under these circumstances, I will make recourse to an experiment available in physics in which the force present in a motion is measured. Thus, we obtain a numerical value for this force. This result, playing the role of a counterexample, clarifies the composition of force issue significantly. (shrink)

The principle of conservation of energy tells us that ‘energy can neither be created nor destroyed but only transformed’. The validity of the principle is without question. The problem is the concept. Contemporary physicists have asserted that we do not know what energy is. We find, however, 19th century physicists, contemporary physicists and historians of science who converge on the point: Mayer and Joule discovered energy. Therefore, we do not know what energy is, but we know these authors discovered it. (...) What did they then discover? What can we learn from this with regard to the energy concept problem? To deal with this issue, I will distinguish between what the authors did experimentally and what they said about the phenomena. This method of analysis makes the difference in relation to historical works on the subject. In a second step, I will consider the introduction of the energy concept, which is from 1850s, and the reification of the energy in 1880s. Finally, I will address the energy conservation principle and the concept of energy conveyed by this principle in contemporary textbooks. As we shall see, the conservation of a magnitude that we call energy nowadays was discovered by Mayer and Joule; an indestructible and transformable entity was not. Adopting the original conservation principle would be enough to avoid the energy concept problem. (shrink)

This book provides a solution to the problem with the energy concept. This problem manifests itself in the fact that physicists clearly diverge regarding the question of what energy is. Some define it but others state that we do not know what it is. Although this is a problem for physicists who need to explain the concept, it is not a problem for physics that can be solved by laboratory means. Penetrating into the origin of the notion of energy, this (...) book offers a clear idea of what was discovered and what was invented to interpret the findings. Following the development of the concept, it provides an explanation of the trends in contemporary textbooks. The author's repetition, in his "History and Philosophy of Physics Laboratory", of Joule’s famous experiment – the paddle wheel experiment – with a calorimeter as originally used by Joule and with a calorimeter as proposed in textbooks, is presented, yielding new insight into the phenomenon. Thus, science teachers and students will benefit from reading the book as well as historians, philosophers, students of the history and philosophy of science, and all who are interested in knowing about what it is that we call energy. Confronted with an unprecedented scale of human-induced environmental crisis, there is a need for new modes of theorizing that would abandon human exceptionalism and anthropocentrism and instead focus on developing environmentally ethical projects suitable for our times. In this paper, we offer an anti-anthropocentric project of an ethos for living in the Anthropocene. We develop it through revisiting the notion of sustainability in order to problematize the linear vision of human-centric futurity and the uniform ‘we’ of humanity upon which it (...) relies. We ground our analyses in posthumanism and material feminism, using works by posthumanist and material feminist thinkers such as Stacy Alaimo, Rosi Braidotti, Donna Haraway and Jane Bennett, among others. In dialogue with them, we offer the concept of posthuman sustainability that decenters the human, re-positions it in its ecosystem and, while remaining attentive to difference, fosters the thriving of all instances of life. The main subject of this research is the specificity of I. E. Repin's perception of the dynamics of artistic-aesthetic tasks formed under the influence of changing modernity. In view of this, one of the compositional centers of the research is the history of relationship that developed between I. E. Repin and the artists of the “first wave of symbolism” – members of the association “The World of Art”. Special attention is given to the question of perception of I. E. Repin (...) by certain representatives of the avant-garde in 1910s. Developing in the range “attraction – negation”, full of dramatic and comic moments, the dialogue between Repin and younger generation indicates the hastiness of univocal view of realism and Art Nouveau as opposing imagery systems. For the first time, on the current level of scientific comprehension of the aesthetics of symbolism and neo-romanticism, the article analyzes the attitude of I. E. Repin towards the innovative imagery pursuits of the Art Nouveau artists. At the same time, the very concept of Art Nouveau is interpreted in two dimensions: as a certain milestone in the context of the development of the history of art of the late XIX – early XX century; and as an inner dynamic potential embedded by I. E. Repin in his works since the beginning of his creative path. Based on systematization of the artistic and documentary sources and the method of complex reconstruction of the views of Peredvizhniki and symbolist artists upon the objectives and nature of art, the author concludes that the poetics of art of Ilya Repin, synthesizing the ideas of time, tends to reflect a complicated and distinctive artistic image formed by realistic and idealistic principles. The subject of this article is the works of the Russian artists of the late XIX – early XX centuries in the context of problematic of symbolism and Art Nouveau, as well as the scientific foundation that has developed as yet in studying this topic. Research methodology is based on the conceptual synthesis of classical art history approaches towards the analysis of artistic material with the theoretical interdisciplinary methods of humanities, such as iconology and hermeneutics, as well as the contextual-associative (...) method developed by the author. The goal of this article consists in determination of the peculiarities of symbolism in Russia due to the transformation of the attitude towards the spiritual problematic of art of the turn of the XIX – XX centuries, which is relevant for the modern art history. The author is firs in the Russian art history to conduct a comprehensive analytical overview of the development stages of symbolism in the Russian visual art based on the years-long work with the archival materials, scientific publications, and works of the Art Nouveau authors stored in the museum funds, many of which after 1917 appeared to be on the periphery of attention of art historians due to ideological reasons. The revealed individual characteristics of symbolism as a holistic artistic phenomenon, created on the level of modern humanistic knowledge, determine the novelty of this work and can valuable in further study of symbolism and Art Nouveau. Broadening of representations on the Russian art of the late XIX – early XX centuries, allow returning the heritage of the symbolist artists into the context of art, which is of undeniable importance from the perspective of restoration of natural logic of the development of the history of art in Russia, making this publication valuable in various fields of study of art and culture. This article is first within the Russian and Western art history to examine the concept of visual poetics as a separate subject of research. Based on the analysis of iconographic and theoretical searches of the masters of symbolism, which found reflection within the boundaries of expressive means of visual art, the author comes concludes on the poetic principles of symbolist artists as the fundamental sources of the formation of the style of Art Nouveau – a new sculptural language of the (...) XIX – early XX centuries. Detail characteristic of the philosophical-aesthetic content that underlies optical forms of the visual symbolist image, in its scientific origins leans on the capabilities of the art comparative-formal analysis, as well as iconological method adapted to the period under review. The innovative conceptual approach towards studying the art of symbolism lies in the fact that poetry as the concept is depicted beyond the literary sphere, as a specific type of artistic worldview that influenced the development of the visual language of art in the era of Art Nouveau. At the same time, visual poetics is compared to the complex system of internal images, which shape in with the works of the master throughout the entire path of his self-expression, and are directly related to profoundness of the poetic principle of the soul, lyrical and metaphorical intuition of the artist. This approach allows us broadening the representation on the aesthetic benchmarks of the symbolist artists, as well as designating the new methodological coordinates in the field of studying the art of symbolism in both national and international contexts. The article is dedicated to the development of theatrical art in Mariupol at the beginning of 20th century. The theatrical life of Mariupol has not been investigated yet as an original art phenomenon, and therefore, it demands for the detailed studying. There are the repertoire, the role of touring troupes and development of charitable activities of actors in the city described in the article as well. The information was collected from literature, newspapers and funds of local lore museums. The study (...) showed us the rising of ideological and educational value of the scene provincial theaters at the beginning of XX c. In Mariupol worked several theaters, which created conditions for the formation of theater seasons, touring groups' arrivals and also the base for the development of local amateur groups. Performances of guest performers - Ukrainian, Russian and foreign stars of theater scene contributed to the promotion and enrichment of theatrical culture, transforming Mariupol into the cultural centers of the region. The author considers the features of the state policy in the sphere of theatrical art during the Civil War and in the first years of Soviet government power. The Soviet government made a circle of attempts to use the theater in the business of agitation and propaganda as much as possible. In consequence with nationwide problems, the conditions which theater city institutions worked in, сconsiderably got worsened because of the fact of the demand of entertaining genres in the repertoire of the theaters. Nevertheless, thanks to the safekeeping of the best examples of the theatrical traditions, the priorities in the repertoire policy were given to the Ukrainian, Russian and foreign classics. In conclusion, it may be said also, that theater in Mariupol at the beginning of XX c., was developed, despite the complications that have been appeared under the influence of existing political regime and differed from others in the existence of various professional and amateur groups, wide touring guest activities of the prominent masters of the stage and diverse repertoire. Although epidemiology as a scientific study of disease in populations claimed an independent disciplinary status already in the mid–nineteenth century, its history in the twentieth century can be seen as a continuous and often contentious attempt to define the field’s social and intellectual boundaries vis-à-vis a variety of neighboring scientific fields and public health practices. In a period dominated by laboratory biomedical sciences, epidemiologists repeatedly tried to spell out how their discipline met the requirements of scientificity despite its focus on (...) disease as a collective phenomenon and its reliance on nonlaboratory methods. This article asks about the relationship between the changing institutional and intellectual contexts of British epidemiological practice and the epidemiologists’attempts to define both science in general and epidemiology in particular. An examination of the epidemiologists’boundary-making endeavors is also used to reflect on the circumstances in which scientists engage in the discourse of disciplinary demarcations. (shrink)

A Mecânica clássica parte da lei de inércia e usa um conceito de força que é consequência lógica da lei (§ 2-3). Acontece porém que nem a lei de inércia tem fundamento experimental (§ 1) nem o conceito de força tem referente nos fenómenos (§ 4). O estudo da função da lei e da força nas teorias mecânicas veio mostrar que a lei de inércia expressa apenas um movimento unidade e a força desvios à unidade (§ 5). Segue-se que a (...) ciência praticava uma metodologia, mas expressava-se como possuindo um conhecimento dos meandros da natureza. Isto coloca pelo menos uma questão à filosofia, porquanto a caracterização da ciência pela epistemologia usual se mostra inadequada para a mecânica. /// The classical mechanics assumes the law of inertia and uses a concept of force that is a logical consequence of the law (§ 2-3). As a matter of fact the law of inertia has no experimental basis (§ 1) and beyond that the concept of force does not correspond to anything in the mechanical phenomena (§ 4). The study of the structure of the mechanical theories has shown that the law of inertia expresses only a reference motion and the force represents deflections from that motion (§ 5). Therefore it can be concluded that even though science seems to have a far reaching knowledge of nature, it has indeed only practiced a methodology. This poses a problem for the philosophy insofar as it makes the usual epistemological framework inadequate to characterize mechanics. (shrink)

Abstracts The aim of the paper is to propose an alternative model to realist and non-cognitive explanations of the rule-guided use of thick ethical concepts and to examine the implications that may be drawn from this and similar cases for our general understanding of rule-following and the relation between criteria of application, truth and correctness. It addresses McDowell’s non-cognitivism critique and challenges his defence of the entanglement thesis for thick ethical concepts. Contrary to non-cognitivists, however, I propose to view the (...) relation between the two terms of the entanglement as resulting from the satisfaction of a previously applied moral function.
