Many philosophers accept that, as well as having a right that others not harm us, we also have a right that others not subject us to a risk of harm. And yet, when we attempt to spell out precisely what this ‘right against risk imposition’ involves, we encounter a series of notorious puzzles. Existing attempts to deal with these puzzles have tended to focus on the nature of rights – but I propose an approach that focusses instead on the nature (...) of risk. The key move is to distinguish two different ways in which to conceptualise the risk that a given action presents – one of which is linked to the notion of probability and the other to the notion of normalcy. Recent years have seen the rise of a new family of non-probabilistic accounts of epistemic justification. According to these views—we may call them Normalcy Views—a belief in P is justified only if, given the evidence, there exists no normal world in which S falsely beliefs that P. This paper aims to raise some trouble for this new approach to justification by arguing that Normalcy Views, while initially attractive, give rise to problematic accounts of epistemic defeat. As we will see, on (...) Normalcy Views seemingly insignificant pieces of evidence turn out to have considerable defeating powers. This problem—I will call it the Easy-Defeat Problem—gives rise to a two-pronged challenge. First, it shows that the Normalcy View has counterintuitive implications and, second, it opens the door to an uncomfortable skeptical threat. (shrink)

We show that in quantum logic of closed subspaces of Hilbert space one cannot substitute quantum operations for classical (standard Hilbert space) ones and treat them as primitive operations. We consider two possible ways of such a substitution and arrive at operation algebras that are not lattices what proves the claim. We devise algorithms and programs which write down any two-variable expression in an orthomodular lattice by means of classical and quantum operations in an identical form. Our results show that (...) lattice structure and classical operations uniquely determine quantum logic underlying Hilbert space. As a consequence of our result, recent proposals for a deduction theorem with quantum operations in an orthomodular lattice as well as a, substitution of quantum operations for the usual standard Hilbert space ones in quantum logic prove to be misleading. Thought experiments as counterexamples are a familiar tool in philosophy. Frequently understanding a vignette seems to generate a challenge to a target theory. In this paper I explore the content of the judgement that we have in response to these vignettes. I first introduce several competing proposals for the content of our judgement, and explain why they are inadequate. I then advance an alternative view. I argue that when we hear vignettes we consider the normal instances of the vignette. If (...) the normal instance of the vignette exhibits a counter-instance, the vignette constitutes a challenge to the target theory. I argue that this proposal shows how responses to vignettes are an ordinary, everyday judgement, and I explain how the proposal avoids the problems generated by competing theories. Finally, I argue this ‘normalcy proposal’ most naturally accords with our understanding of the method. (shrink)

Emerging from the internationally recognised Theorising Normalcy and the Mundane conference series, the chapters in this book offer wide-ranging critiques of that most pervasive of ideas, 'normal'. In particular, they explore the precarious positions we are presented with and, more often than not, forced into by 'normal', and its operating system, 'normalcy' (Davis, 2010). They are written by activists, students, practitioners and academics and offer related but diverse approaches. Importantly, however, the chapters also ask, what if increasingly precarious encounters with, (...) and positions of, marginality and non-normativity offers us a chance (perhaps the chance) to critically explore the possibilities of 'imagining otherwise'? The book questions the privileged position of 'non-normativity'; in youth and unpacks the expectation of the 'normal' student in both higher and primary education. It uses the position of transable people to push the boundaries of 'disability', interrogates the psycho-emotional disablism of box-ticking bureaucracy and spotlights the 'urge to know' impairment. It draws on cross-movement and cross-disciplinary work around disability to explore topics as diverse as drug use, The Bible and relational autonomy. Finally, and perhaps most controversially, it explores the benefits of (re)instating 'normal'. By paying attention to the opportunities presented amongst the fissures of critique and defiance, this book offers new applications and perspectives for thinking through the most ordinary of ideas, 'normal'. NOTE: This paper is a reworking of some aspects of an earlier paper – ‘What else justification could be’ and also an early draft of chapter 2 of Between Probability and Certainty. I'm leaving it online as it has a couple of citations and there is some material here which didn't make it into the book (and which I may yet try to develop elsewhere). My concern in this paper is with a certain, pervasive picture of epistemic justification. On this (...) picture, acquiring justification for believing something is essentially a matter of minimising one’s risk of error – so one is justified in believing something just in case it is sufficiently likely, given one’s evidence, to be true. This view is motivated by an admittedly natural thought: If we want to be fallibilists about justification then we shouldn’t demand that something be certain – that we completely eliminate error risk – before we can be justified in believing it. But if justification does not require the complete elimination of error risk, then what could it possibly require if not its minimisation? If justification does not require epistemic certainty then what could it possibly require if not epistemic likelihood? When all is said and done, I’m not sure that I can offer satisfactory answers to these questions – but I will attempt to trace out some possible answers here. The alternative picture that I’ll outline makes use of a notion of normalcy that I take to be irreducible to notions of statistical frequency or predominance. (shrink)

This article examines Smith’s recent treatment of the problem of statistical evidence and the conception of epistemic justification that he puts forward. Two possible solutions to the problem of statistical evidence that result from his analysis of cases involving a contrast between statistical and individual evidence are considered. The solution resulting from Smith’s conception of epistemic justification is shown to be inferior to the solution calling for an explanationist conception of epistemic justification. As a result, Smith’s analysis of cases illustrating (...) the problem of statistical evidence, given his own standards of theory choice, is shown to support an explanationist conception of epistemic justification as an alternative to the probabilistic conception that he urges us to reject. Feminist scholars have been critical of the expectations placed upon mothers to accomplish a perfect version of motherhood, but have often failed to interrogate the values about normalcy and disability imbedded in modern mothering ideologies. Mothers with disabilities are well positioned to expose the underlying beliefs about normalcy with which all mothers must contend. Drawing from interviews and focus groups conducted with mothers who have physical and sensory disabilities, I explore Deaf/disabled women’s experiences negotiating the scientific motherhood regime. Illuminating a (...) paradox, I argue these women are labeled “risky mothers” under scientific motherhood, which prizes the management of risk and the prevention of disability. Yet, these mothers are simultaneously rendered invisible by inaccessible and inflexible medical practices, and by a consumer market of expert advice which prescribes that mothers inhabit a typical body. These women’s experiences illuminate the normalcy project as a central tenet of scientific motherhood. (shrink)

I argue that, if it is thought desirable to avoid the collapse of disability into generic social disadvantage, it is necessary to draw a distinction between impairment (a bodily configuration) and disability (the way in which the environment prevents someone with an impairment from undertaking certain kinds of activities), as in social models of disability. I show how to draw such a distinction by utilizing a distinction between intrinsic and extrinsic properties. I argue further that, using this distinction, it is (...) possible to define ‘impairment’ in ways that do not appeal to notions of the normal, and to define ‘disability’ in terms of ‘impairment.’. This paper puts forward a novel pluralist theory of epistemic justification that brings together two competing views in the literature—probabilistic and non-probabilistic accounts of justification. The first part of the paper motivates the new theory by arguing that neither probabilistic nor non-probabilistic accounts alone are wholly satisfactory. The second part puts forward what I call the Functional Theory of Justification. The key merit of the new theory is that it combines the most attractive features of both probabilistic and non-probabilistic accounts (...) of justification while avoiding their most serious shortcomings. Bradley. If one assumes that relations are real and that a relation links any property to a subject – so runs the argument – then one falls prey to an infinite regress. Thus, he attempts first to interpret the relation of inherence as something ‘metaphoric’, originating from our ‘spatial way’ of looking at the surrounding world; and then he tries to reduce it to the part-whole relation which clearly he considers weaker, from the ontological point of view, than that of ‘being in’. The paper discusses the notion of defeasibility and focuses specifically on defeasible norms. First, it delineates a robust notion of the phenomenon of defeasibility, which poses a serious problem for both moral and legal theory. It does this by laying out the conditions and desiderata that a model of defeasibility should be able to meet. It further focuses on a specific model of defeasibility that utilises the notion of normal conditions to expound the robust notion of defeasibility. It argues that (...) this model fails in its attempt to do this, particularly since it presupposes further pertinent norms and we have reasons to doubt if these are defeasible. It thus does not allow defeasibility to go “all the way down” in the normative domain and limits it merely to a feature of some sort of mid-level norm. In conclusion, it draws lessons from this and positions defeasibility models within a more general pluralistic approach to norms. (shrink)

Martin Smith has recently proposed, in this journal, a novel and intriguing approach to puzzles and paradoxes in evidence law arising from the evidential standard of the Preponderance of the Evidence. According to Smith, the relation of normic support provides us with an elegant solution to those puzzles. In this paper I develop a counterexample to Smith’s approach and argue that normic support can neither account for our reluctance to base affirmative verdicts on bare statistical evidence nor resolve the pertinent (...) paradoxes. Normic support is, as a consequence, not a successful epistemic anti-luck condition. (shrink)

The ongoing debate within neuroethics concerning the degree to which neuromodulation such as deep brain stimulation (DBS) changes the personality, identity, and agency (PIA) of patients has paid relatively little attention to the perspectives of prospective patients. Even less attention has been given to pediatric populations. To understand patients’ views about identity changes due to DBS in obsessive-compulsive disorder (OCD), the authors conducted and analyzed semistructured interviews with adolescent patients with OCD and their parents/caregivers. Patients were asked about projected impacts (...) to PIA generally due to DBS. All patient respondents and half of caregivers reported that DBS would impact patient self-identity in significant ways. For example, many patients expressed how DBS could positively impact identity by allowing them to explore their identities free from OCD. Others voiced concerns that DBS-related resolution of OCD might negatively impact patient agency and authenticity. Half of patients expressed that DBS may positively facilitate social access through relieving symptoms, while half indicated that DBS could increase social stigma. These views give insights into how to approach decision-making and informed consent if DBS for OCD becomes available for adolescents. They also offer insights into adolescent experiences of disability identity and “normalcy” in the context of OCD. (shrink)

This article proposes a solution to the ‘paradox of normalcy’, a problem raised by the early Frankfurt Sehool in its questioning of basic concepts of psychoanalysis. After reviewing the different definitions of normalcy put forward by Freud, the paradoxical character of the concept of normalcy, as perceived by the various members of the Frankfurt School, will be made explicit. The solution to the paradox will take the form ofa practical ‘dis-solution’, and will bring to the fore a fundamental principle of (...) Critical Theory identified as the ’banning of graven images’, which will be shown to operate even in the contemporary work of Habermas.Cet artiele propose une solution au ‘paradoxe de la normalité’ qui émergea lors des analyses psychanalytiques de I’École de Francfort de première heure. It is widely assumed that the scope of indefinites is island insensitive, i.e., that, generally, an indefinite inside of a syntactic island, such as an adjunct clause, is capable of taking scope outside of that island. This paper challenges this assumption by studying the scope behaviour of the Spanish plural indefinite algunos ’). It presents an experimental study that shows that the scope of algunos is not free and depends on its syntactic environment, at least in the dialect of Spanish (...) studied here. The paper discusses some of the implications of the study for current theories of indefinite scope: it points out the problems that choice functions and singleton indefinites have with the Spanish data, and it also discusses the implications for Schwarzschild's solution to the so-called ‘Donald Duck’ problem. Within the broad field of human enhancement, pediatric cognitive neuro-enhancement appears to arouse particular interest. The increasing importance of cognitive capacities in our contemporary and cultural context appears to be the main reason for the focus on cognition as the preferred trait of enhancement, while the choice of pharmacological means is based on factors of feasibility, accessibility, and cost. While the ethical issues arising in the adult context have already been extensively covered in the literature, pediatric neuro-enhancement brings with it (...) additional ethical challenges requiring further attention. Although there are numerous important ethical considerations, the focus of this chapter is on the pursuit of normalcy as the goal in pediatric neuro-enhancement. Parental attempts to shape children are not new, and the resources available for them to do so include widespread and mostly uncontroversial tools, such as education. The increasing use of psychotropic drugs, however, reveals the significant impact of the concept of normalcy, which has resulted in a trend to medicalize what used to be considered “normal” behavior. In this context, special challenges are posed by psychiatric disorders, where the familiar treatment-enhancement distinction continues to be relied upon to justify interventions in children. Drawing on the examples of attention deficit/hyperactivity disorder and autism spectrum disorder, it will be argued that children are already being enhanced within psychiatric practice and that this is incompatible with an understanding of disability under a mixed model. This essay draws on two emerging fields—the study of comics or graphic fiction, and disability studies—to demonstrate how graphic fictions articulate the embodied, ethical, and sociopolitical experiences of impairment and disability. Examining David B’s Epileptic and Paul Karasik and Judy Karasik’s The Ride Together, I argue that these graphic novels unsettle conventional notions of normalcy and disability. In so doing, they also challenge our assumed dimensions and possibilities of the comics genre and medium, demonstrating the great potential comics hold for (...) disability studies. (shrink)

I contrast two approaches to the interpretation of generics such as ‘ravens are black:’ majority-based views, on which they are about what is the case most of the time, and inquiry-based views, on which they are about a feature we focus on in inquiry. I argue that majority-based views face far more systematic counterexamples than has previously been supposed. They cannot account for generics about kinds with multiple characteristic properties, such as ‘elephants live in Africa and Asia.’ I then go (...) on to sketch an inquiry-based view. (shrink)

Healthism and ableism intertwine through an imperative of normalcy and the ensuing devaluing of those who fail to meet societally dominant norms and expectations around “normal” health. This paper tracks the effect of that imperative of normalcy through current research into gut microbiome therapies, using therapies targeting fatness and autism as examples. The complexity of the gut microbiome ought to encourage us to rethink our conception of ourselves and our embeddedness in the world; instead, the microbiome is transformed into one (...) more tool for controlling unruly bodies and minds. Our understanding of subjunctive conditionals has been greatly enhanced through the use of possible world semantics and, more precisely, by the idea that they involve variably strict quantification over possible worlds. I propose to extend this treatment to ceteris paribus conditionals – that is, conditionals that incorporate a ceteris paribus or ‘other things being equal’ clause. Although such conditionals are commonly invoked in scientific theorising, they traditionally arouse suspicion and apprehensiveness amongst philosophers. By treating ceteris paribus conditionals as a species (...) of variably strict conditional I hope to shed new light upon their content and their logic. (shrink)

This article examines the contradictions inherent in blind women’s appearance management. Based on an anthropological analysis of interviews with 40 blind women in Israel, the article argues that while serving as a valuable tool within stigma management, appearance management operates simultaneously as a site of rigorous discipline of the body in an effort to comply with feminine visual norms, and as a vehicle for the expression and reception of sensory pleasure. It argues for the significant role of blind women’s appearance (...) in negotiating normalcy and rejecting the normative, stigmatizing script written for them as disabled-blind-women. By studying the role of appearance in the lives of women who do not rely on sight as a central mode of perception, the article addresses the complicated position of blind women in visual culture and challenges the traditional ocular focus of the study of feminine identity and gender performance.
