Poder-se-ia afirmar que os valores e ideais da modernidade conduzem à constituição das instituições do Estado Democrático de Direito. Trata-se de um longo e intrincado processo de feitura cujo resultado pode ser rastreado a partir de um complexo conjunto de visões teóricas e compromissos institucionais: princípios dos liberalismos político e filosófico, constitucionalismo e democracia deliberativa. Tal percurso revela-se acidentado, no entanto há uma presença constante entre os críticos da modernidade. Trata-se da perspectiva antiliberal de algumas posições conservadoras. Contemporaneamente, o quadro (...) das democracias ocidentais permite-nos rastrear as dimensões dessa críticatanto no que diz respeito às instituições representativas, quanto àinterpretação do papel e escopo de atuação do Direito no controle dos atos do Executivo. Ambas as posições se encontram vinculadas nos movimentos encetados por populistas plebiscitários em defesa de uma democraciailiberal. No presenteartigo, que se oferece como uma carta ou mapa de intenções para um plano de pesquisa futura, buscamos rastrear as bases de ambos os braços da crítica ao arranjo liberal das democracias constitucionais nas influências schmittianas sobre as reflexões de uma democracia iliberal parceira de um constitucionalismo do bem comum. By analyzing the Dirac equation with static electric and magnetic fields it is shown that Dirac’s theory is nothing but a generalized one-particle quantum theory compatible with the special theory of relativity. This equation describes a quantum dynamics of a single relativistic fermion, and its solution is reduced to solution of the generalized Pauli equation for two quasiparticles which move in the Euclidean space with their effective masses holding information about the Lorentzian symmetry of the four-dimensional space-time. We reveal the (...) correspondence between the Dirac bispinor and Pauli spinor , and show that all four components of the Dirac bispinor correspond to a fermion . Mixing the particle and antiparticle states is prohibited. On this basis we discuss the paradoxical phenomena of Zitterbewegung and the Klein tunneling. (shrink)

Connecting human minds to various technological devices and applications through brain-computer interfaces (BCIs) affords intriguingly novel ways for humans to engage and interact with the world. Not only do BCIs play an important role in restorative medicine, they are also increasingly used outside of medical or therapeutic contexts (e.g., gaming or mental state monitoring). A striking peculiarity of BCI technology is that the kind of actions it enables seems to differ from paradigmatic human actions, because, effects in the world are (...) brought about by devices such as robotic arms, prosthesis, or other machines, and their execution runs through a computer directed by brain signals. In contrast to usual forms of action, the sequence does not need to involve bodily or muscle movements at all. A motionless body, the epitome of inaction, might be acting. How do theories of action relate to such BCI-mediated forms of changing the world? We wish to explore this question through the lenses of three perspectives on agency: subjective experience of agency, philosophical action theory, and legal concepts of action. Our analysis pursues three aims: First, we shall discuss whether and which BCI-mediated events qualify as actions, according to the main concepts of action in philosophy and law. Secondly, en passant, we wish to highlight the ten most interesting novelties or peculiarities of BCI-mediated movements. Thirdly, we seek to explore whether these novel forms of movement may have consequences for concepts of agency. More concretely, we think that convincing assessments of BCI-movements require more fine-grained accounts of agency and a distinction between various forms of control during movements. In addition, we show that the disembodied nature of BCI-mediated events causes troubles for the standard legal account of actions as bodily movements. In an exchange with views from philosophy, we wish to propose that the law ought to reform its concept of action to include some, but not all, BCI-mediated events and sketch some of the wider implications this may have, especially for the venerable legal idea of the right to freedom of thought. In this regard, BCIs are an example of the way in which technological access to yet largely sealed-off domains of the person may necessitate adjusting normative boundaries between the personal and the social sphere. A structure is automatic if its domain, functions, and relations are all regular languages. Using the fact that every automatic structure is decidable, in the literature many decision problems have been solved by giving an automatic presentation of a particular structure. Khoussainov and Nerode asked whether there is some way to tell whether a structure has, or does not have, an automatic presentation. We answer this question by showing that the set of Turing machines that represent automata-presentable structures is ${\rm{\Sigma (...) }}_1^1 $-complete. We also use similar methods to show that there is no reasonable characterisation of the structures with a polynomial-time presentation in the sense of Nerode and Remmel. (shrink)

Mobile phones play an essential role in the everyday lives and social relationships of young people. They are deeply embedded in peer interactions, not only as tools but also as references of interaction. The article is based on an empirical study, which investigates how young people interpret various situations of interaction through, and related to, mobile phones. Providing a useful heuristic to reconstruct the inherent rules, claims and expectations of such situations, Goffman’s concept of the interaction order was modified in (...) regard to youth-specific and mobile media-specific dimensions with the help of a grounded theory approach. The article deals with the methodical strategies that were applied as well as respective methodological questions that arose during the research process. In order to gain insights into the participants’ episodic and semantic knowledge about mobile media related situations, group interviews/discussions, mobile phone diaries and individual interviews were conducted. Each collection strategy is discussed in respect to its preconditions and execution. Additionally, problems regarding the role of the researcher in relation to the participants will be explicated. In addition, an in-depth reading of a subsample of 39 articles offers more details on the role of governments in the CSR literature. This paper raises the question whether the Economic Nobel Prize is ideologically biased. Based on a review of a significant number of the Prize Committee’s award justifications, the article concludes at a persistent bias against private property and the free market and in favour of collectivism and state interventionism. From a methodological point of view, the Prize has contributed to the widespread use by professional economists of formal mathematics within the positivistic approach. With respect to research findings, the Prize has (...) favoured the doctrine that market processes are faulty, while government policies are an appropriate fix. Additionally, the paper casts doubts on the scientific integrity of the Prize, given the Committee’s acknowledged lack of concern for fundamental revisionism and outright dismissal of possible criticisms. The purpose of the study is an institutional view of the state and modern Russia, as opposed to the civilizational and formational worldview. It allows you to switch public and scientific consciousness from a statocentric to a sociocentric worldview, in its own way reveals the correlation of the categories of people, society and the state in the political universe. As a result, the history of political society appears to be a socio-dialectical sequence of public legal structures built by historically changeable (...) political norms. The analysis of institutional transitions and political norms allows us to assert that modern society, including the Russian one, is rationally moving towards a libertarian institution, i.e. to co-governance of citizens equal in law. Unlike conceptual analysis, conceptual engineering does not aim to identify the content that our current concepts do have, but the content which these concepts should have. For this method to show the results that its practitioners typically aim for, being able to change meanings seems to be a crucial presupposition. However, certain branches of semantic externalism raise doubts about whether this presupposition can be met. To the extent that meanings are determined by external factors such as causal histories or microphysical (...) structures, it seems that they cannot be changed intentionally. This paper gives an extended discussion of this ‘externalist challenge’. Pace Herman Cappelen’s recent take on this issue, it argues that the viability of conceptual engineering crucially depends on our ability to bring about meaning change. Furthermore, it argues that, contrary to first appearance, causal theories of reference do allow for a sufficient degree of meaning control. To this purpose, it argues that there is a sense of what is called ‘collective long-range control’, and that popular versions of the causal theory of reference imply that people have this kind of control over meanings. Having the ambition to contribute to the practical value of the theory on corporate social performance (CSP), this paper approaches the question whether CSP can contribute to the competitive advantage of firms. We adopted an explorative case-study methodology to explore the variety of positive and negative effects of CSP on the competitiveness of organizations. As this study aimed at identifying as great variety of these effects as possible, we selected a diversified group of respondents. Data was thus collected through embedded (...) units of analysis in a petrochemical company, and triangulated with the opinions of experts on CSP. Overall, we found various positive and negative effects of CSP on the competitiveness of organizations. CSP is therefore not an innocent adventure for executives, but rather a strategy for achieving corporate objectives. If not carefully implemented, the CSP strategy may harm the competitive advantage of the firm, as our results have suggested. (shrink)

Currently, electronic agents are being designed and implemented that, unprecedentedly, will be capable of performing legally binding actions. These advances necessitate a thorough treatment of their legal consequences. In our paper, we first demonstrate that electronic agents behave structurally similar to human agents. Then we study how declarations of intention stated by an electronic agent are related to ordinary declarations of intention given by natural persons or legal entities, and also how the actions of electronic agents in this respect have (...) to be classified under German law. We discuss four different approaches of classifying agent declarations. As one of these, we propose the concept of an electronic person (i.e., agents with limited liability), enrolment of agents into an agent register, and agent liability funds as means to serve the needs of all contracting parties. Bayesian approaches for estimating multilevel latent variable models can be beneficial in small samples. Prior distributions can be used to overcome small sample problems, for example, when priors that increase the accuracy of estimation are chosen. This article discusses two different but not mutually exclusive approaches for specifying priors. Both approaches aim at stabilizing estimators in such a way that the Mean Squared Error of the estimator of the between-group slope will be small. In the first approach, the MSE is (...) decreased by specifying a slightly informative prior for the group-level variance of the predictor variable, whereas in the second approach, the decrease is achieved directly by using a slightly informative prior for the slope. Mathematical and graphical inspections suggest that both approaches can be effective for reducing the MSE in small samples, thus rendering them attractive in these situations. The Anthropocene concept arose within the Earth System science community, albeit explicitly as a geological time term. Its current analysis by the stratigraphical community, as a potential formal addition to the Geological Time Scale, necessitates comparison of the methodologies and patterns of enquiry of these two communities. One means of comparison is to consider some of the most widely used results of the ESS, the ‘planetary boundaries’ concept of Rockström and colleagues, and the ‘Great Acceleration’ graphs of Steffen and colleagues, (...) in terms of their stratigraphical expression. This expression varies from virtually non-existent to pronounced and many-faceted, while in some cases stratigraphical proxies may help constrain anthropogenic process. The Anthropocene concepts of the ESS and stratigraphy emerge as complementary, and effective stratigraphic definition should facilitate wider transdisciplinary communication. (shrink)

It seems natural to think that Carnapian explication and experimental philosophy can go hand in hand. But what exactly explicators can gain from the data provided by experimental philosophers remains controversial. According to an influential proposal by Shepherd and Justus, explicators should use experimental data in the process of ‘explication preparation’. Against this proposal, Mark Pinder has recently suggested that experimental data can directly assist an explicator’s search for fruitful replacements of the explicandum. In developing his argument, he also proposes (...) a novel aspect of what makes a concept fruitful, namely, that it is taken up by the relevant community. In this paper, I defend explication preparation against Pinder’s objections and argue that his uptake proposal conflates theoretical and practical success conditions of explications. Furthermore, I argue that Pinder’s suggested experimental procedure needs substantial revision. I end by distinguishing two kinds of explication projects, and showing how experimental philosophy can contribute to each of them. (shrink)

A philosopher argues that state-sponsored cyberattacks against central military or civilian targets are always acts of war. What is this philosopher doing? According to conceptual analysts, the philosopher is making a claim about our concept of war. According to philosophical realists, the philosopher is making a claim about war per se. In a quickly developing literature, a third option is being explored: the philosopher is engineering the concept of war. On this view, the philosopher is making a proposal about which (...) concept we should have – even if it deviates from the extant concept, and even if it does not capture ‘what war really is’. The activity or method of proposing such revisionary definitions, as well as the metaphilosophical reflection on it, has become known as conceptual engineering. (shrink)

Genes induced by the plant hormone auxin are probably involved in the execution of vital cellular functions and developmental processes. Experimental approaches designed to elucidate the molecular mechanisms of auxin action have focused on auxin perception, genetic dissection of the signaling apparatus and specific gene activation. Auxin‐responsive promoter elements of early genes provide molecular tools for probing auxin signaling in reverse. Functional analysis of several auxin‐specific promoters of unrelated early genes suggests combinatorial utilization of both conserved and variable elements. These (...) elements are arranged into autonomous domains and the combination of such modules generates uniquely composed promoters. The paper suggests an explanation of the failure of liberal reforms in Russia in 1990th using a specific concept of social space. A society can be interpreted as ‘rings in the water’ system with an individual as the center and more distant social groups as ‘rings’. The key factor in such system would be an individual’s ability to translate his/her will through the ‘rings’. Russian social space is characterized by a sharp discrepancy between high standards for personal spiritual and moral (...) growth and low ethical standards of real social life. What is strictly forbidden inside the personal social circle (the ‘ring’ of relatives and close friends) is easilycondoned outside of it. External ‘rings’ of social space are more like ‘dangerous and irrational wild nature’ than cultural territory. This discrepancy (constant for Russian history for at least last 500-600 years) puts all kinds of barriers for active social interaction. The failure of liberal reforms in Russia shouldn’t be interpreted as the failure of liberal ideas, but as the failure of an attempt to apply them to the territory mentally and socially absolutely alien to them. In this article, we draw on established views of CSR dysfunctionalities to show how and why CSR is regularly observed to be both shaped by and supportive of capitalism. We proceed to show that these dysfunctionalities are maintained by both the pro- and anticapitalist approaches to CSR, both of which imply an ill-defined separation of the economy and society as well an overly strong problem or solution focus on political and economic issues. Finally, we present a post-capitalist approach to CSR (...) that overcomes (1) the ill-defined separation of the economy and society, (2) the capitalist bias towards economic rationalities, and (3) the overidentification of society with its political system; this approach thus helps to manage the abovementioned CSR dysfunctionalities. The present paper considers using Social Networking Sites (SNS) as the primary means of communication . Current situations of communication are often associated with the active use of various SNS - convenient tool for information exchange, as new media, and one of the most widespread ways of self-presentation. The author comes to the conclusion that a SNS (like Facebook) gives no effective means to discern the real face - ego-, personal or actual social identity. However, modern Internet technologies provide us (...) with useful instruments, applied to the social network analysis and semiotic approach, to define the virtual social (or personal) identity that can (or cannot) be the same as the real one. Conceptual engineers aim to revise rather than describe our concepts. But what are concepts? And how does one engineer them? Answering these questions is of central importance for implementing and theorizing about conceptual engineering. This paper discusses and criticizes two influential views of this issue: semanticism, according to which conceptual engineers aim to change linguistic meanings, and psychologism, according to which conceptual engineers aim to change psychological structures. I argue that neither of these accounts can give us the full story. (...) Instead, I propose and defend the Dual Content View of Conceptual Engineering. On this view, conceptual engineering targets concepts, where concepts are understood as having two kinds of contents: referential content and cognitive content. I show that this view is independently plausible and that it gives us a comprehensive account of conceptual engineering that helps to make progress on some of the most difficult problems surrounding conceptual engineering. Karl Popper has often been cast as one of the most solitary figures of twentieth-century philosophy. The received image is of a thinker who developed his scientific philosophy virtually alone and in opposition to a crowd of brilliant members of the Vienna Circle. This paper challenges the received view and undertakes to correctly situate on the map of the history of philosophy Popper’s contribution, in particular, his renowned fallibilist theory of knowledge. The motive for doing so is the conviction that (...) the mainstream perspective on Popper’s philosophy makes him more difficult to understand than might otherwise be the case. The thinker who figures most significantly in the account of Popper developed in these pages is Leonard Nelson. Both a neo-Friesian and neo-Kantian, this philosopher deeply influenced Popper through his student Julius Kraft, who met with Popper on numerous occasions in the mid 1920s. It is in the light of this influence that we understand Popper’s recollection that when he criticized the Vienna Circle in the early 1930s, he looked upon himself “as an unorthodox Kantian”. Aesthetics is today widely seen as the philosophy of art and/or beauty, limited to artworks and their perception. In this paper, I will argue that today's aesthetics and the original programme developed by the German Enlightenment thinker Alexander Gottlieb Baumgarten in the first half of the eighteenth century have only the name in common. Baumgarten did not primarily develop his aesthetics as a philosophy of art. The making and understanding of artworks had served in his original programme only as an (...) example for the application of his philosophy. What he really attempts to present is an alternative philosophy of knowledge that goes beyond the purely rationalist, empiricist, and sensualist approaches. In short, Baumgarten transcends the old opposition between rationalism and sensualism. His core theme is the improvement (perfectio) of human knowledge and cognition and the ways to reach this goal. The study of Baumgarten's foundational works on aesthetics should not be undertaken merely out of antiquarian interest. I will argue, instead, that Baumgarten's importance and contemporary relevance lies in this: that his Aesthetica may serve as a profound contribution to the philosophy of the cultural sciences and humanities. Revisiting Baumgarten's original idea of aesthetics will lead us to a more inclusive concept of that philosophical discipline. (shrink)

This paper outlines the intellectual biography of Walter Dubislav. Besides being a leading member of the Berlin Group headed by Hans Reichenbach, Dubislav played a defining role as well in the Society for Empirical/Scientific Philosophy in Berlin. A student of David Hilbert, Dubislav applied the method of axiomatic to produce original work in logic and formalist philosophy of mathematics. He also introduced the elements of a formalist philosophy of science and addressed more general problems concerning the substantiation of human knowledge. (...) What set Dubislav apart from the other logical empiricists was his expertise in the history of logic and exact philosophy which enabled him to elucidate and advance the thinking in both disciplines. In the realm of logic proper, Dubislav is best known for his pioneering work in theory of definitions. What is more, he did original work on the so called ‘quasi truth-tables’ which aided Reichenbach in developing his logic of probability. Dubislav also elaborated an influe.. (shrink)

From 1901 till, at least, 1919, Russell persistently maintained that there are two kinds of logic, between which he sharply discriminated: mathematical logic and philosophical logic. In this paper, we discuss the concept of philosophical logic, as used by Russell. This was only a tentative program that Russell did not clarify in detail, so our task will be to make it explicit. We shall show that there are three (-and-a-half) kinds of Russellian philosophical logic: (i) “pure logic”; (ii) philosophical logic (...) investigating the logical forms of propositions; (iii) philosophical logic exploring the logical forms of facts: in epistemology; and in the external world. In particular, Russell’s program or philosophical logic of the facts of the external world remained less than sketchily outlined. We shall discuss it in some detail in the hope that it can start a new life. (shrink)

This text offers a discussion of the concept and experience of alienation, as it has been theorized in two very different traditions. Accordingly, I juxtapose a recent discussion by Italian Autonomist Marxist Franko “Bifo” Berardi to that of Argentine philosopher and scholar of indigenous cosmologies Rodolfo Kusch. Unlike Berardi’s anti-capitalist critique, Kusch identifies Western Modernity (and not just capitalism) as the source of alienation, and proposes a “de-linking” from its categories and epistemic practices. I caution that even a progressive meta-theory (...) such as Marxism can engage in conceptual violence, when it claims universal validity. (shrink)

This article pursues two distinct yet interrelated levels of analysis. Theoretically, the article seeks to destabilize Western narratives of a transition from humanism to anti- and post-humanism in radical scholarship by foregrounding two traditions from Eastern Europe and the Caribbean where the language of the human persisted long after its declared obsolescence in the West. The argument made here is that these divergent narratives of the human were neither wholly contingent nor just a matter of distinct intellectual traditions, but were (...) deeply interwoven with both the history of the Cold War and the legacies of colonialism. On a praxical-political level, the article also engages in a close reading of arguably the major tradition of Marxist humanism in Eastern Europe, that of the Praxis circle in former Yugoslavia. If, on the other hand, it is construed as the activity of introducing new technical terms, then it becomes trivial. According to Deutsch, this conclusion need not worry us, however, for conceptual engineering is ill-motivated to begin with. Between April and November 1912, Bertrand Russell and Ludwig Wittgenstein were engaged in a joint philosophical program. Wittgenstein‘s meeting with Gottlob Frege in December 1912 led, however, to its dissolution – the joint program was abandoned. Section 2 of this paper outlines the key points of that program, identifying what Russell and Wittgenstein each contributed to it. The third section determines precisely those features of their collaborative work that Frege criticized. Finally, building upon the evidence developed in the preceding two (...) sections, section 4 recasts along previously undeveloped lines Wittgenstein‘s logical–philosophical discoveries in the two years following his encounter with Frege in 1912. The paper concludes, in section 5, with an overview of the dramatic consequences the Frege-Wittgenstein critique had for Russell‘s philosophical development. (shrink)

In the cytoplasm of practically all living cells, potassium is the major cation while sodium dominates in the media (seawater, extracellular fluids). Both prokaryotes and eukaryotes have elaborate mechanisms and spend significant energy to maintain this asymmetric K+/Na+ distribution. This essay proposes an original line of evidence to explain how bacteria selected potassium at the very beginning of the evolutionary process and why it remains essential for eukaryotes.

A brief essay of Nikolay Raynov against war.

We study the algorithmic complexity of embeddings between bi-embeddable equivalence structures. We define the notions of computable bi-embeddable categoricity, \ bi-embeddable categoricity, and degrees of bi-embeddable categoricity. These notions mirror the classical notions used to study the complexity of isomorphisms between structures. We show that the notions of \ bi-embeddable categoricity and relative \ bi-embeddable categoricity coincide for equivalence structures for \. We also prove that computable equivalence structures have degree of bi-embeddable categoricity \, or \. In 1930, at the initiative of Nikolay Raynov, was founded the Bulgarian Roerich Society. This brief essay, written and published by Raynov in the Newspaper Zarya 1933, aims to introduce the oeuvre of Nicholas Roerich and his ideas of Pax Cultura – peace trough culture – to a larger Bulgarian audience. Raynov argues that it is not enough to create oeuvres of art, i.e. to write books or to paint pictures, but that it is also necessary to fight for (...) the protection of cultural works and monuments, especially in times of conflict and war. In this sense, this brief essay can be conceived as a call to the Bulgarian public to join the Roerich Pact, elaborated in 1928/1929. (shrink)
