La seriedad que ha dominado la lectura de la obra de Platón en nuestra tradición no es ajena al temprano protagonismo que adquirió la interpretación neoplatónica de la obra del filósofo ni a la importante presencia que el neoplatonismo adquirió en el largo proceso de elaboración doctrinal del cristianismo a partir del siglo II. Este olvido del recurso al humor condicionaría con frecuencia y de modo significativo la recta comprensión de los diálogos. Al leer la obra de Platón, descubrimos, por (...) otro lado, que el recurso al humor no se reduce a la muy comentada ironía socrática, sino que encontramos también bromas entre los personajes, juegos de palabras, imitaciones paródicas de hombres ilustres, chascarrillos graciosos, burlas y comedia de situaciones; encontramos, en resumen, un extenso y variado repertorio de recursos cómicos puestos al servicio de la eficaz transmisión de contenidos serios. Porque, no lo olvidemos, el humor en Platón está sometido a la expresión eficaz de lo que el filósofo entiende que debe ser tanto el modo de transmisión filosófica como los propios contenidos filosóficos. Con la intención de descifrar las claves que permitan comprender mejor el uso de los recursos humorísticos en los diálogos platónicos presentamos este volumen colectivo en el que once autores abordan distintos aspectos de la cuestión. Wittgenstein on the Human Spirit provides a new understanding of Wittgenstein’s discourse as an insightful philosophy of culture, pursued through self-reflection. It offers an edifying perspective on the conceptual underpinnings of culture as a shared expressive spiritual form of life. The ideas investigated in it are highly relevant for discussions in philosophy, aesthetics, anthropology, and cultural studies. The book embraces three studies: The Spirit of Jews, The Spirits of Culture and Civilization, and The Common Spirit of Human Beings. It shows how overcoming the anti-Semitic attitude implicit in them set off the major change in his philosophy. The second discusses Wittgenstein’s reflections on the “deterioration of culture” in the modern period, showing how they are related to his remarks about following rules. The third discusses Wittgenstein’s insights regarding the symbolic nature of myth, magic and religion. It suggests that modern human beings and those of ancient cultures possess a common expressive spiritual nature. Justification logics are constructive analogues of modal logics. They are often used as epistemic logics, particularly as models of evidentialist justification. However, in this role, justification (and modal) logics are defective insofar as they represent justification with a necessity-like operator, whereas actual evidentialist justification is usually probabilistic. This paper first examines and rejects extant candidates for solving this problem: Milnikel’s Logic of Uncertain Justifications, Ghari’s Hájek–Pavelka-Style Justification Logics and a version of probabilistic justification logic developed by Kokkinis et al. Human beings are a cultural species. This predicament enables them to take on many different cultural identities, all of which transcend the bounds of natural behavior of other species. To contemplate this predicament through philosophy is to reflect on such questions as, What makes cultural forms of life possible? What is encompassed in them? What lies at their core? What distinguishes them from natural forms of life? What brings them about, sustains, and causes them to change? Philosophical answers to these (...) questions predate abstract ways of thinking, as they are sometimes embedded in ancient mythical and religious narratives. Such is the story told in the first three chapters of the book of _Genesis_ in the Bible, revealing how human beings became the cultural beings that they are. This study suggests how that ancient and most celebrated story in the literature of the West may be read as harboring insightful philosophical observations on the cultural nature of human beings. It first focuses on the very concept of cultural forms of life, revealing its complicated conceptual links to natural forms of life. It then offers an interpretive framework for reading mythical, symbolic narratives. Using these ideas, it provides a philosophical reading of the Biblical narrative, disclosing it to harbor a metaphysically oriented conception of nature and two insightful philosophical overviews of the cultural nature of human beings. Both overviews endow human beings with an ability to manipulate nature, but in different ways: the first by subjugating parcels of nature to human will; the second by subjugating human beings themselves to a value-laden conception of things and ethical forms of life. Thus, human beings are portrayed as natural creatures possessed of a cultural nature that enables them to transform nature and recreate themselves through their unique cultural predicament. (shrink)

There are certain remarks in Culture and Value in which Wittgenstein writes about Jews and about what he describes as their ‘Jewish mind’. In these remarks he appears to be trying to make a distinction between two different spiritual forces which operate in Western culture and which give rise to two different types of artists and works of art. On one side of the divide are Jews and works of art imbued with Jewish spirit. On the other side are men (...) of culture and works of art which exhibit a non-Jewish spirit. Among the various remarks made in this context, he offers the following thoughts about the spiritual nature of Jews, their mentality, character and artistic achievements: ‘You get tragedy when a tree, instead of bending, breaks. Tragedy is something un-Jewish’ . Following Renan he writes: ‘The Semitic races have an unpoetic mentality, which heads straight for what is concrete’ . This, he explains, is because Jews are attracted by ‘pure intellectualism’. ‘I think it would be possible now to have a form of theatre played in masks. The characters would simply be stylized human types.’ ‘Masked theatre is anyway the expression of an intellectualistic character. And for the same reason perhaps it is a theatrical form that will attract only Jews’ . ‘The Jew is a desert region, but underneath its thin layer of rock lies the molten lava of spirit and intellect’ . ‘It is typical for a Jewish mind to understand somebody else's work better than that person understands it himself.’ But intellect, it seems, is not a mental attribute providing for genius and true creative powers. ‘Amongst Jews “genius” is found only in the holy man. Even the greatest of Jewish thinkers is no more than talented. … It might be said that the Jewish mind does not have the power to produce even the tiniest flower or blade of grass; its way is rather to make a drawing of the flower or blade of grass which has grown in the soil of another's mind and to put it into a comprehensive picture. We aren't pointing to a fault when we say this and everything is all right as long as what is being done is quite clear. It is only when the nature of a Jewish work is confused with that of a non-Jewish work that there is any danger, especially when the author of the Jewish work falls into the confusion himself, as he so easily may. ’. BackgroundThe Freedom of Information Act (FOIA) provides access to unreleased government records that can be used to enhance the transparency and integrity of biomedical research. We characterized FOIA requests to Department of Health and Human Services (HHS) agencies, including request outcomes, processing times, backlogs, and costs.MethodsUsing HHS FOIA annual reports, we extracted data on the number of FOIA requests received and processed by HHS agencies between 2008 and 2017, as well as request outcomes. Processing times were reported in three time (...) increments, < 1–20, 21–60, or 61+ days, and trends in backlog status were also described. Information about costs and fees collected were aggregated.ResultsBetween 2008 and 2017, 69.6% of 530,094 HHS FOIA requests were received by the Centers for Medicare and Medicaid Services (CMS), 18.9% by the Food and Drug Administration (FDA), and 11.6% by all other HHS agencies. During this period, CMS processed 374,728 requests, FDA 114,938, and other HHS agencies 61,890. CMS and FDA reduced backlogged requests by 9396 (89.7%) and 4289 (65.3%), respectively, leaving backlogs of 1081 and 2279 requests at the end of 2017. CMS fully or partially granted 60.3% of requests whereas FDA fully or partially granted 72.4%. Of all requests to CMS, 82.0% were considered simple and 18.0% complex; 82.2% of simple requests and 54.9% of complex requests were processed in 20 days, and 5.6% and 29.9% were processed in 61+ days. In contrast, 60.2% of requests to FDA were considered simple and 39.8% complex; 28.8% of simple requests and 9.0% of complex requests were processed in 20 days, and 58.3% and 81.5% were processed in 61+ days. The costs to HHS associated with FOIA requests totaled $446.4 million ($809 per processed request), increasing from $28.1 million ($423 per request) in 2008 to $53.3 million ($1544 per request) in 2017. In total, HHS collected $8.5 million in fees (1.9% of total costs).ConclusionsFOIA is frequently used to obtain information about HHS and its agencies. With growing costs, minimal fees collected, and lengthy processing times, HHS agencies’ FOIA programs might be made more efficient through greater proactive record disclosure. (shrink)

This article explores two examples of non-visibility as a way of describing the specificity of contemporary surfaces of visualization. The two cases are the disappearance of Malaysia Airlines Flight 370, the scheduled passenger flight from Kuala Lumpur to Beijing, which lost contact with air traffic control on 8 March 2014 at 01:20 MYT, and the 276 Nigerian girls who went ‘missing’ at about the same time. The analysis is developed through an exploration of these examples in terms of the patterning (...) of vision produced in recursive relations, or relations of feedback with the environment. We argue that changes in the organization of this feedback, which we describe as ‘rendition’, equip contemporary observers with both the capacity to see ‘close up at a distance’ and the capacity to be situated adjacent, next to or ‘beside from above’. In social and cultural theory, topology has been used to articulate changes in structures and spaces of power. In this introduction, we argue that culture itself is becoming topological. In particular, this ‘becoming topological’ can be identified in the significance of a new order of spatio-temporal continuity for forms of economic, political and cultural life today. This ordering emerges, sometimes without explicit coordination, in practices of sorting, naming, numbering, comparing, listing, and calculating. We show that the effect of these practices (...) is both to introduce new continuities into a discontinuous world by establishing equivalences or similitudes, and to make and mark discontinuities through repeated contrasts. In this multiplication of relations, topological change is established as being constant, normal and immanent, rather than being an exceptional form, which is externally produced; that is, forms of economic, political and cultural life are identified and made legible in terms of their capacities for continuous change. Outlining the contributions to this Special Issue, the introduction discusses the meaning of topological culture and provides an analytic framework through which to understand its implications. There have been many attempts during the history of applied ethics that have tried to develop a theory of moral reasoning. The goal of this paper is to explicate one aspect of the debate between various attempts of offering a specific method for resolving moral dilemmas. We contrast two kinds of deliberative methods: deliberative methods whose goal is decision-making and deliberative methods that are aimed at gaining edifying perspectives. The decision-making methods assessed include the traditional moral theories like utilitarianism and (...) Kantianism, as well as second order principles, such as principlism and specified principlism. In light of this assessment, we suggest taking a closer look at two perceptive models, casuistry and particularism. These models are used for dealing with moral dilemmas that provide for edifying perspectives rather than decision-making. These perceptive models, though less scientific and not as good at prescribing an action, are more human in the sense that they enrich our moral sensibilities and enhance our understanding of the meaning of the situation. What intelligent person has never pondered the meaning of life? For Yuval Lurie, this is more than a puzzling philosophical question; it is a journey, and in this book he takes readers on a search that ranges from ancient quests for the purpose of life to the ruminations of postmodern thinkers on meaning. One would expect, therefore, that basic human rights would be valid and sacred in any context, including industrial relations. However, the complexity of the employee–employer relationship obscures this issue, and it is not clear whether such rights can be protected or whether they are valid in the context of industrial relations. Since rights are relational, they are preconditioned on the (...) special nature of the relationship between employee and employer. Hence, the specific meaning that these rights have in industrial relations cannot be grounded in the notion of human rights as such, but rather depends on the special relationships between employers and employees. Though much legislation has been passed to regulate the relationship between employees and employers, the issues surrounding this relationship remain one of the most debated topics in business ethics. Our paper focuses specifically on the right to equal pay and the right to privacy. With respect to the right to property, the paper examines whether there is a conflict between general human rights and the fundamental right of employers to their property. The Israeli legislature has responded to this conflict by enacting ‘protective laws’ that legally outline and mandate certain human rights. Under these laws, employees are prevented and prohibited from waiving the rights granted to them by law, even if employed in private industries. Despite this legislative effort, market forces are at times stronger, and consequently some basic rights are not fully applied or implemented. (shrink)

The purpose of this article is to propose an ethical framework for software engineers that connects software developers’ ethical responsibilities directly to their professional standards. The implementation of such an ethical framework can overcome the traditional dichotomy between professional skills and ethical skills, which plagues the engineering professions, by proposing an approach to the fundamental tasks of the practitioner, i.e., software development, in which the professional standards are intrinsically connected to the ethical responsibilities. In so doing, the ethical framework improves (...) the practitioner’s professionalism and ethics. We call this approach Ethical-Driven Software Development, as an approach to software development. EDSD manifests the advantages of an ethical framework as an alternative to the all too familiar approach in professional ethics that advocates “stand-alone codes of ethics”. We believe that one outcome of this synergy between professional and ethical skills is simply better engineers. Moreover, since there are often different software solutions, which the engineer can provide to an issue at stake, the ethical framework provides a guiding principle, within the process of software development, that helps the engineer evaluate the advantages and disadvantages of different software solutions. It does not and cannot affect the end-product in and of-itself. However, it can and should, make the software engineer more conscious and aware of the ethical ramifications of certain engineering decisions within the process. (shrink)

This view aligns his thinking to that of the Romantic tradition in philosophy. It also leads him to perceive ?the disappearance of a culture? in our time. In many of his remarks on art and certain artists he expresses this view by attempting to clarify the different ways in which the spirit of man is manifested in modern times (...) (in arts, science, and industry) as opposed to how it is manifested in an age of culture. This article undertakes to describe and explain the remarks which lead him to this view. The Israeli legislator refrains from intervening in fundamental rights such as freedom of expression, free trade, occupation, and liberty of contract in advertising. However, there are also few interventions to prevent phenomena that are dangerous or abusive, especially to groups needing protection. The Israeli courts do try to apply moral considerations in cases tried by them, but living up (...) to moral responsibilities is different from complying with legal obligations. Advertisers in Israel have a(i) Treatise(r), consisting of ten ethical guidelines, which neither sums up advertising ethics in its entirety nor is legally binding. Sociological and psychological features of the culture need to be examined in order to spell out what truth and honesty in advertising actually mean in this society, and the manner in which these values are practised. Lacking sanctions in public law against misleading consumers or manipulation based on false facts, consumers must find remedy in civil actions which rely on moral and ethical rules. (shrink)

This article addresses how it is possible to view Damien Hirst as a brand name. It argues that the brand name is not the mark of an originary relation between producer and product but of a set of highly mediated relations between products. In a discussion of the spot paintings, the process of mediation is seen to contribute to the open-endedness of the relations between products or works established in Hirst’s practice. This open-endedness contributes to the distinctiveness of the Hirst (...) brand name as ‘life as it is lived’ or living-ness. This characterization of the distinctiveness of the Hirst brand name draws attention to the ways in which his practice may be seen as a commentary on contemporary science, in particular the bio-sciences. It is further argued that Hirst does not merely represent himself as a scientist, but as a pharmacist, thus drawing attention to the role of branding in shifts in the processes of creativity, invention and discovery across the arts and sciences. Aczel's theory of hypersets provides an interesting alternative to the standard view of sets as inductively constructed, well-founded objects, thus providing a convienent formalism in which to consider non-well-founded versions of classically well-founded constructions, such as the "circular logic" of [3]. This theory and ZFC are mutually interpretable; in particular, any model of ZFC has a canonical "extension" to a non-well-founded universe. The construction of this model does not immediately generalize to weaker set theories such as the theory of admissible (...) sets. In this paper, we formulate a version of Aczel's antifoundation axiom suitable for the theory of admissible sets. We investigate the properties of models of the axiom system KPU - , that is, KPU with foundation replaced by an appropriate strengthening of the extensionality axiom. Finally, we forge connections between "non-wellfounded sets over the admissible set A" and the fragment L A of the modal language L ∞. (shrink)
