La contribution de Michel Troper à la théorie générale du droit et à la théorie constitutionnelle est aujourd'hui reconnue et célébrée un peu partout dans le monde. Un talent d'architecte se tient à l'origine de cette audience rarement égalée dans la sphère francophone : celui qu'il faut pour accommoder toutes les exigences, quel que soit l'ordre de valeur dans lequel on les trouve : originalité, rigueur, souci de la fonction, esthétisme, solidité, adaptation, intelligence, inquiétude, esprit critique, renoncement, réalisme... A ces (...) mérites, on ajoutera une curiosité insatiable, un goût prononcé pour l'échange et le débat, un refus distingué de l'académisme, un sens exigeant de l'amitié et une méfiance profônde pour les adjectifs... It is widely believed, among philosophers of literature, that imagining contradictions is as easy as telling or reading a story with contradictory content. Italo Calvino’s The Nonexistent Knight, for instance, concerns a knight who performs many brave deeds, but who does not exist. Anything at all, they argue, can be true in a story, including contradictions and other impossibilia. While most will readily concede that we cannot objectually imagine contradictions, they nevertheless insist that we can propositionally imagine them, and regularly (...) do, simply by entertaining a text which prompts us to do so. I argue that this narrative does not bear scrutiny for two main reasons. First, because propositional imagining is beside the point, where truth in fiction is concerned; evaluating truth in fiction engages the cognitive architecture in ways that prohibit the mobilization of merely propositional imagination to that end. And second, because it is not obvious, given the strategies usually suggested, that we ever propositionally imagine contradictions in the first place—in fact, it seems we go out of our way to avoid directly imagining them. It is widely agreed that fiction is necessarily incomplete, but some recent work postulates the existence of universal fictions—stories according to which everything is true. Building such a story is supposedly straightforward: authors can either assert that everything is true in their story, define a complement function that does the assertoric work for them, or, most compellingly, write a story combining a contradiction with the principle of explosion. The case for universal fictions thus turns on the intuitive priority we assign (...) to the law of non-contradiction. My goal in this paper is to show that our critical and reflective literary practices set constraints on story-telling which preclude universal fictions. I will raise four stumbling blocks for universal fictionalists: the gap between saying and making true, our actual interpretive reactions to story-level contradictions, the criteria we accept for what counts as a story in our literary practices, and the undesirability of the universal fictionalist’s closure principles. The premise that every work belongs to an art-kind has recently inspired a kind-centred approach to theories of art. Kind-centred analyses posit that we should abandon the project of giving a general theory of art and focus instead on giving theories of the arts. The main difficulty, however, is to explain what makes a given kind an art-kind in the first place. Kind-centred theorists have passed this buck on to appreciative practices, but this move proves unsatisfactory. I argue that the (...) root of this dissatisfaction stems not from the act of kicking the can down the road, but from not kicking it far enough. The missing ingredient, I argue, is a notion of convention which does the work of marking the difference between art and non-art for a given physical medium. (shrink)

Schopenhauer’s invective is legendary among philosophers, and is unmatched in the historical canon. But these complaints are themselves worthy of careful consideration: they are rooted in Schopenhauer’s philosophy of language, which itself reflects the structure of his metaphysics. This short chapter argues that Schopenhauer’s vitriol rewards philosophical attention; not because it expresses his critical take on Fichte, Hegel, Herbart, Schelling, and Schleiermacher, but because it neatly illustrates his philosophy of language. This chapter draws upon the archaeological and philosophical literature to offer an analysis and diagnosis of the popular ‘ancient aliens’ theory. First, we argue that ancient aliens theory is a form of conspiracy theory. Second, we argue that it differs from other familiar conspiracy theories because it does distinctive ideological work. Third, we argue that ancient aliens theory is a form of non-contextualized inquiry that sacrifices the very thing that makes archaeological research successful, and does so for the sake of (...) popular accessibility. Rather than merely dismissing ancient aliens as ‘pseudoarchaeology’ on demarcationist grounds, we offer a more complicated account of how the theory works, and what ideological work it does. Depuis 2014, je rédige régulièrement des billets (180 jusqu’à présent) sur le blogue du site de Philosophie pour enfants de l’Université Laval (philoenfant.org). Ce livre réunit une trentaine de billets publiés sur ce site. Si les chapitres que contient ce livre n’ont rien de vraiment nouveau, ils permettent néanmoins une restructuration de différents billets conduisant à entrevoir une cohérence entre ces derniers et à centrer, du même coup, l’attention du lecteur sur trois aspects qui caractérisent bon nombre des publications sur (...) le site : 1) la pratique de la philosophie en communauté de recherche ; 2) la philosophie pour enfants ; 3) des rapports entre la pratique de la philosophie pour enfants et celle des arts libéraux. Par le choix des billets retenus et leur organisation selon ces trois axes, ce livre devrait permettre au lecteur de saisir que la pratique de la philosophie en communauté de recherche, entre rupture et continuité, vise un équilibre réflexif dans le monde de l’éducation. En s’appuyant sur la pratique du dialogue en communauté de recherche, l’éducation devient principalement collaborative et la pratique de la philosophie (re)devient un geste social offrant des outils à chaque personne qui souhaite apprendre ou approfondir l’acte consistant à penser par et pour soi-même, avec les autres. Recently, there has been renewed interest in the search for low-mass magnetic monopoles. At the University of Oklahoma we are performing an experiment (Fermilab E882) using material from the old D0 and CDF detectors to set limits on the existence of Dirac monopoles of masses of the order of 500 GeV. To set such limits, estimates must be made of the production rate of such monopoles at the Tevatron collider, and of the binding strength of any such produced monopoles to (...) matter. Here we sketch the still primitive theory of such interactions, and indicate why we believe a credible limit may still be obtained. On the other hand, there have been proposals that the classic Euler–Heisenberg Lagrangian together with duality could be employed to set limits on magnetic monopoles having masses less than 1 TeV, based on virtual, rather than real processes. The D0 collaboration at Fermilab has used such a proposal to set mass limits based on the nonobservation of pairs of photons each with high transverse momentum. We critique the underlying theory, by showing that the cross section violates unitarity at the quoted limits and is unstable with respect to radiative corrections. We therefore believe that no significant limit can be obtained from the current experiments, based on virtual monopole processes. (shrink)

This paper deals with causal analysis in the social sciences. We first present a conceptual framework according to which causal analysis is based on a rationale of variation and invariance, and not only on regularity. We then develop a formal framework for causal analysis by means of structural modelling. Within this framework we approach causality in terms of exogeneity in a structural conditional model based which is based on (i) congruence with background knowledge, (ii) invariance under a large variety of (...) environmental changes, and (iii) model fit. We also tackle the issue of confounding and show how latent confounders can play havoc with exogeneity. This framework avoids making untestable metaphysical claims about causal relations and yet remains useful for cognitive and action-oriented goals. (shrink)

A escola é um espaço importantíssimo para o desenvolvimento de trabalhos e ações que envolvem a gestão de resíduos sólidos, tema cada vez mais discutido em trabalhos e eventos científicos. Com o objetivo de sensibilizar educandos para o problema, um grupo de bolsistas do Pibid Interdisciplinar – Educação ambiental realizou um experimento em que ações socioambientais foram propostas e desenvolvidas junto com educandos de uma escola parceira. As experiências vivenciadas no cotidiano escolar dos dois grupos tiveram como técnicas de coleta (...) de dados necessários à elaboração coletiva das ações, observações e oficinas teórico-práticas, em quatro encontros, nos quais o tema foi abordado teoricamente, através de exibição de documentários e realização de algumas dinâmicas. A ação resultante foi um trabalho de reciclagem com o reaproveitamento de materiais que seriam descartados, ao longo do qual ocorreram discussões que consistiam em uma problematização que, a partir da realidade dos alunos, tentava contribuir para que eles percebessem problemas ambientais presentes em seu dia a dia, convidando-os a refletir sobre os seus hábitos de consumo, a forma de descarte dos resíduos provenientes do seu ato de consumir e os prejuízos por eles causado na natureza.
