Introduction No consent for health and medical research is appropriate when the criteria for a waiver of consent are met, yet some ethics committees and data custodians still require informed consent. Methods A single-blind parallel-group randomised controlled trial: 1129 families of children born at a South Australian hospital were sent information explaining data linkage of childhood immunisation and hospital records for vaccine safety surveillance with 4 weeks to opt in or opt out by reply form, telephone or email. A subsequent (...) telephone interview gauged the intent of 1026 parents (91%) in relation to their actions and the sociodemographic differences between participants and non-participants in each arm. Results The participation rate was 21% (n=120/564) in the opt-in arm and 96% (n=540/565) in the opt-out arm (χ2 (1 df) = 567.7, p<0.001). Participants in the opt-in arm were more likely than non-participants to be older, married/de facto, university educated and of higher socioeconomic status. Participants in the opt-out arm were similar to non-participants, except men were more likely to opt out. Substantial proportions did not receive, understand or properly consider study invitations, and opting in or opting out behaviour was often at odds with parents' stated underlying intentions. Conclusions The opt-in approach resulted in low participation and a biased sample that would render any subsequent data linkage unfeasible, while the opt-out approach achieved high participation and a representative sample. The waiver of consent afforded under current privacy regulations for data linkage studies meeting all appropriate criteria should be granted by ethics committees, and supported by data custodians. Game theory is central to modern understandings of how people deal with problems of coordination and cooperation. Yet, ironically, it cannot give a straightforward explanation of some of the simplest forms of human coordination and cooperation--most famously, that people can use the apparently arbitrary features of "focal points" to solve coordination problems, and that people sometimes cooperate in "prisoner's dilemmas." Addressing a wide readership of economists, sociologists, psychologists, and philosophers, Michael Bacharach here proposes a revision of game theory that (...) resolves these long-standing problems. In the classical tradition of game theory, Bacharach models human beings as rational actors, but he revises the standard definition of rationality to incorporate two major new ideas. He enlarges the model of a game so that it includes the ways agents describe to themselves their decision problems. And he allows the possibility that people reason as members of groups, each taking herself to have reason to perform her component of the combination of actions that best achieves the group's common goal. Bacharach shows that certain tendencies for individuals to engage in team reasoning are consistent with recent findings in social psychology and evolutionary biology. As the culmination of Bacharach's long-standing program of pathbreaking work on the foundations of game theory, this book has been eagerly awaited. Following Bacharach's premature death, Natalie Gold and Robert Sugden edited the unfinished work and added two substantial chapters that allow the book to be read as a coherent whole. (shrink)

The separation of men’s and women’s competitions in the sporting world has been suggested as a necessary protection for female athletes against the superior athletic performances of male athletes. The comparison of the most elite performers in these two categories maintains the historical pattern of viewing male sport and the male athlete as the standard, and female sport and the female athlete as the inferior ‘other’. This paper argues for a transformative utilization of the separation of men’s and women’s sports (...) by female athletes and sporting organizations. Female sporting organizations may creatively change the rules and practices of the malestandard, so as to challenge the historical patterning of sport. This paper will use the image of the cyborg, and the motivation behind cyborg politics, to call for creativity in dealing with the ban on drugs in sport. (shrink)

Real kinds or categories, according to conventional wisdom, enter into lawlike generalizations, while nominal kinds do not. Thus, gold but not jewelry is a real kind. However, by such a criterion, few if any kinds or systems of classification employed in the social science are real, for the social sciences offer, at best, only restricted generalizations. Thus, according to conventional wisdom, race and class are on a par with telephone area codes and postal zones; all are nominal rather than (...) real. I propose an account of real kinds that recognizes the current reality of race but not zip codes and shows how a kind can be both constructed and real. One virtue of such an understanding of realism is the light shed on our current practice of racial classification. Race is not a real biological kind but neither is race a myth or illusion. However, the question of whether a social kind is real is separate from whether the category is legitimate. W. E. B. Du Bois maintained that while there are no biological races, race is real and should be conserved. My aim, in this paper, is not to argue for the legitimacy or conservation of race but to defend Du Bois's idea that kinds of people can be both made up and real and provide an understanding of realism that does justice to the social sciences. Since the early 1990s, the extractive industries have increasingly valued corporate social responsibility in the communities where they operate. More recently, these industries have begun to recognize the importance of adapting CSR efforts to unique local contexts rather than applying a one-size-fits-all model. However, firms understand local context to mean culture and treat the physical properties of the host region—topography, geology, hydrology, and climate—as the exclusive purview of mineral geologists and engineers. In this article, we examine the organization of CSR (...) at two industrial-scale gold mines in Guatemala, owned by the same firm, which yielded starkly distinct levels of support among host community residents. We develop the idea of social terrain to convey the way in which the biophysical environment informs local social relations and imbues phenomena with particular social meanings. We argue that firms must account for social terrain in organizing for CSR. The literature struggles to provide guidelines for identifying and understanding stakeholders. Social terrain, we argue, can begin to bridge this gap between theory and practice. (shrink)

Should those who work on ethics welcome or resist moves to open access publishing? This paper analyses arguments in favour and against the increasing requirement for open access publishing and considers their implications for bioethics research. In the context of biomedical science, major funders are increasingly mandating open access as a condition of funding and such moves are also common in other disciplines. Whilst there has been some debate about the implications of open-access for the social sciences and humanities, there (...) has been little if any discussion about the implications of open access for ethics. This is surprising given both the central role of public reason and critique in ethics and the fact that many of the arguments made for and against open access have been couched in moral terms. In what follows I argue that those who work in ethics have a strong interest in supporting moves towards more open publishing approaches which have the potential both to inform and promote richer and more diverse forms of public deliberation and to be enriched by them. The importance of public deliberation in practical and applied ethics suggests that ethicists have a particular interest in the promotion of diverse and experimental forms of publication and debate and in supporting new, more creative and more participatory approaches to publication. The Darwinian Revolution--the change in thinking sparked by Charles Darwin's On the Origin of Species, which argued that all organisms including humans are the end product of a long, slow, natural process of evolution rather than the miraculous creation of an all-powerful God--is one of the truly momentous cultural events in Western Civilization. Darwinism as Religion is an innovative and exciting approach to this revolution through creative writing, showing how the theory of evolution as expressed by Darwin has, from the (...) first, functioned as a secular religion. Drawing on a deep understanding of both the science and the history, Michael Ruse surveys the naturalistic thinking about the origins of organisms, including the origins of humankind, as portrayed in novels and in poetry, taking the story from its beginnings in the Age of Enlightenment in the 18th century right up to the present. He shows that, contrary to the opinion of many historians of the era, there was indeed a revolution in thought and that the English naturalist Charles Darwin was at the heart of it. However, contrary also to what many think, this revolution was not primarily scientific as such, but more religious or metaphysical, as people were taken from the secure world of the Christian faith into a darker, more hostile world of evolutionism. In a fashion unusual for the history of ideas, Ruse turns to the novelists and poets of the period for inspiration and information. His book covers a wide range of creative writers - from novelists like Voltaire and poets like Erasmus Darwin in the eighteenth century, through the nineteenth century with novelists including Elizabeth Gaskell, George Eliot, Thomas Hardy, Henry James and H. G. Wells and poets including Robert Browning, Alfred Tennyson, Walt Whitman, Emily Dickinson and Gerard Manley Hopkins, and on to the twentieth century with novelists including Edith Wharton, D. H. Lawrence, John Steinbeck, William Golding, Graham Greene, Ian McEwan and Marilynne Robinson, and poets including Robert Frost, Edna St Vincent Millay and Philip Appleman. Covering such topics as God, origins, humans, race and class, morality, sexuality, and sin and redemption, and written in an engaging manner and spiced with wry humor, Darwinism as Religion gives us an entirely fresh, engaging and provocative view of one of the cultural highpoints of Western thought. Whether or not MSF should provide unconditional treatment for lead poisoning in Nigeria partly depends on answers to empirical questions regarding what the overall consequences of such a practice are likely to be. Conditional provision of treatment may yield greater health benefits (especially if treatment resources are limited).

Randomised placebo-controlled trials (RPCTs) are the gold standard for evaluating novel treatments. However, this design is rarely used in the context of orthopaedic interventions where participants are assigned to a real or placebo surgery. The present study examines attitudes towards RPCTs for orthopaedic surgery among 687 orthopaedic surgeons across the USA. When presented with a vignette describing an RPCT for orthopaedic surgery, 52.3% of participants viewed it as ‘completely’ or ‘mostly’ unethical. Participants were also asked to rank-order the value (...) of five different types of evidence supporting the efficacy of a surgery, ranging from RPCT to an anecdotal report. Responses regarding RPCTs were polarised with 26.4% viewing it as the least valuable (even less valuable than an anecdote) and 35.7.% viewing it as the most valuable. Where equipoise exists, if we want to subject orthopaedic surgeries to the highest standard of evidence (RPCTs) before they are implemented in clinical practice, it will be necessary to educate physicians on the value and ethics of placebo surgery control conditions. Otherwise, invasive procedures may be performed without any benefits beyond possible placebo effects. (shrink)

This paper addresses several concerns in teaching engineering ethics. First, there is the problem of finding space within already crowded engineering curricula for meaningful discussions of ethical dimensions in engineering. Some engineering programs may offer entire courses on engineering ethics; however, most do not at present and may not in the foreseeable future. A promising possibility is to weave ethics into already existing courses using case studies, but most current case studies are not well integrated with engineering technical analysis. There (...) is a danger that case studies will be viewed by both instructors and students as departures from “business as usual”—interesting perhaps, but not essentially connected with “real” engineering. We offer a case study, inspired by the National Society of Professional Engineer’s popular video Gilbane Gold, that can be used to make the connection. It requires students to engage in technical analysis, but in a context that makes apparent the ethical responsibility of engineers. Further, the case we present marks a significant departure from more typical cases that primarily focus on wrongdoing and its prevention. We concentrate more positively on what responsible engineering requires. There is a need for more such cases, regardless of whether they are to be used in standard engineering courses or in separate courses in engineering ethics. (shrink)

This article examines Lamb, Gable & de Ruyter's critique of consent as the standard by which one can determine if a sexual encounter is ethical in their ‘Mutuality in sexual relationships: a standard of ethical sex?’. Their examination of this issue is to be welcomed for a number of reasons, including growing criticism of ‘consent’ as the gold standard in medical and social science research ethics. The focus of this article is specifically on school sex education (principally, for 11–16-year-olds). (...) Contrary to Lamb et al., I argue that it is difficult to maintain that ‘The standard of mutuality should be taught in all schools and the government should indeed demand or support this, even with checks to see if children have learned this standard, at least in attitudes about sexual behavior’ for three reasons. First, while there are good arguments in favour of school children being introduced to the ideal of mutuality, it seems too high a bar to require children to ‘have learned’—a phrase that can be taken to mean to ‘have come to accept’ rather than merely to ‘understand’—this; consent is a more appropriate requirement and is itself a sufficiently rich term that it merits analysis by students, aided by their teachers. Second, my judgement as a sex educator is that sex education is more effective when students are given the opportunity to explore what is good and what is right, rather than simply being told. Third, if we have to adopt a single principle, there is much to be said for ‘respect for others’ to trump both ‘consent’ and ‘mutuality’. (shrink)

A.D. Smith opens his excellent paper, “Space and Sight,” by remarking, One of the most notable features of both philosophy and psychology throughout the eighteenth and nineteenth centuries is the almost universal denial that we are immediately aware through sight of objects arrayed in three-dimensional space. This was not merely a denial of Direct Realism, but a denial that truly visual objects are even phenomenally presented in depth (481). Times have changed. As Smith writes, “It is hard to think of (...) a more radical reversal in thinking than the one that separates such an outlook from that which prevails today; for this erstwhile orthodoxy is hardly given even serious consideration in our own times, at least among philosophers” (482). Even so, how could this doctrine come and go? How can there be fashion in phenomenology?1 Let me answer the question indirectly, by considering Locke’s reasons for advancing the doctrine. He writes, “When we set before our Eyes a round Globe, of any uniform colour, v.g. Gold, Alabaster, or Jet, ‘tis certain, that the Idea thereby imprinted in our Mind, is of a flat Circle variously shadow’d, with several degrees of Light and Brightness coming to our Eyes” (2.9.8).2 Adults have acquired ideas of three-dimensional objects (presumably by.. The two must be taken up in that order, for only after we have described the sphere within which money operates, and the scope of its operations, can we sensibly address its distribution. We must figure out how important money really is. It is best to begin with the naive view, which is also the common view, that money is all-important, the root of (...) all evil, the source of all good. "Money answereth all things," as Ecclesiastes says. According to Marx, it is the universal pander, arranging scandalous couplings between people and goods, breaching every natural, every moral barrier. Marx might have discovered this by looking around in nineteenth-century Europe, but in fact he found it in a book, Shakespeare's Timon of Athens, where Timon, digging for buried gold, interrogates his object: Gold? yellow, glittering, precious gold? My basic supposition is that the destruction of the little Jew's face and hands in Vandover and the Brute images the irruption of mere materiality within the scene of writing-that instead of Crane's double process of eliciting and repressing that materiality, what is figured in the shipwreck scene is a single, unstoppable process of materialization, involving both the act of representation and the marking tool and actual page , the result of which can only be the defeat of the very (...) possibility of writing .Here it might be objected that such a reading derives whatever plausibility it has from the comparison with Crane, and in a sense this is true: my claim is precisely that it's only against the background of Crane's seemingly bizarre but, in this regard, normative or centric enterprise that the wider problematic of late nineteenth- and early twentieth-century literary "impressionism" can be made out. In another sense, however, the comparison with Crane involves an appeal to issues—notably that of materialism—which have long been basic to Norris criticism and which the recent work of Walter Benn Michaels has brought to a new level of conceptual sophistication and historical refinement. Specifically, the title essay in Michaels's book, The Gold Standard and the Logic of Naturalism, interprets both McTeague and Vandover and the Brute in terms of a conflict between materiality and representation that found contemporary expression both in the debates over the gold and silver standards versus paper money and in the vogue for trompe l'oeil painting ." In this regard a crucial moment in Vandover's regression from man to beast is his discovery that, as a painter, he has lost the ability to represent nature three-dimensionally; Michaels treats this development as equivalent to "replac[ing] the painting with nature itself" , and goes on to remark: "But this ... is ultimately a distinction without a difference. Vandover the artist can so easily devolve into Vandover the brute precisely because both artist and brute are already committed to a naturalist ontology—in money, to precious metals; in art, to three-dimensionality. The moral of Vandover's regression, from this standpoint, is that it can only take place because . . . it has already taken place. Discovering that man is a brute, Norris repeats the discovery that paper money is just paper and that a painting of paper money is just paint" . My reading of the shipwreck passage would thus be consistent with what Michaels calls Norris's "trompe l'oeil materialism" , though the nearly sadomasochistic violence of that passage may be taken to imply that materialism's consequences for writing threaten to be even more disastrous than they are for painting. But rather than analyze the role of writing as such in Vandover, which would involve an intricate discussion not just of that novel and McTeague but also of Michaels's essay, I want to turn to another, lesser-known book by Norris, in which a thematic of writing plays a conspicuous and more nearly univocal role: A Man's Woman . : To honor Bernard Goldstein, this article highlights in the "Defense of Theon against George of Trebizond" by Regiomontanus (1436-1476) themes that resonate with leading strands of Goldstein's scholarship. I argue that, in this poorly-known work, Regiomontanus's mastery of Ptolemy's mathematical astronomy, his interest in making astronomy physical, and his homocentric ideals stand in unresolved tension. Each of these themes resonates with Gold- stein's fundamental work on the Almagest, the Planetary Hypotheses, and al-Bitruji's Principles of Astronomy. I flesh out (...) these tensions with an intriguing interpretation of the history of astronomy, in which Regiomontanus contrasts the two-dimensional "eccentric astronomy" attributed to the Almagest and the Arabs with the three-dimensional spheres of the "later" astronomers. A similar contrast reappears when Regiomontanus portrays as a "fictitious art" an astronomy that does not go beyond the accommodation of computations to the appearances. To conclude, I use Regiomontanus's expression to reinstate (pace Goldstein and Barker in this journal, 1998) fictionalism as an actor's category in Osiander and sixteenth-century astronomy. (shrink)

ABSTRACTThis paper examines John M. Keynes’s relationship with Gustav Cassel and Eli Hecksher and puts together the events related to his being awarded the 1939 Söderström Gold Medal by The Royal Swedish Academy of Sciences. The correspondence between these economists during the interwar years is detailed, with emphasis on their personal approaches to economic theory and history. Cassel’s and Heckscher’s critical reviews of Keynes’s General Theory are outlined as well. Lastly, an account is provided of the grounds for conferring (...) the award on Keynes while also drawing attention to the conflict-laden proceedings within the Academy when the issue was under consideration by the institution. The final remarks ponder why Keynes received the prize despite the controversy among Swedish economists over the General Theory at the time. (shrink)

Our sense of culture is characteristically meant to displace race, but part of the argument of this essay has been that culture has turned out to be a way of continuing rather than repudiating racial thought. It is only the appeal to race that makes culture an object of affect and that gives notions like losing our culture, preserving it, stealing someone else’s culture, restoring people’s culture to them, and so on, their pathos. Our race identifies the culture to which (...) we have a right, a right that may be violated or defended, repudiated or recovered. Race transforms people who learn to do what we do into the thieves of our culture and people who teach us to do what they do into the destroyers of our culture; it makes assimilation into a kind of betrayal and the refusal to assimilate into a form of heroism. Without race, losing our culture can mean no more than doing things differently from the way we now do them and preserving our culture can mean no more than doing things the same—the melodrama of assimilation disappears.41 If, of course, doing things differently turns out to mean doing them worse, then the change will seem regrettable. But it’s not the loss of our culture that will make it regrettable; it’s the fact that the culture that will then be ours will be worse than the culture that used to be ours. It is, of course, always possible and often likely that things will get worse; abandoning our idea of culture, however, will not make them worse. In his Essay concerning Human Understanding, John Locke explicitly refers to Newton’s Philosophiae naturalis principia mathematica in laudatory but restrained terms: “Mr. Newton, in his never enough to be admired Book, has demonstrated several Propositions, which are so many new Truths, before unknown to the World, and are farther Advances in Mathematical Knowledge” (Essay, 4.7.3). The mathematica of the Principia are thus acknowledged. But what of philosophia naturalis? Locke maintains that natural philosophy, conceived as natural science (as opposed to natural (...) history), would give us demonstrations of the necessary connection between the (ultimately, simple) ideas constitutive of our complex ideas of various natural kinds of substances (e.g., gold). Indeed Locke goes so far as to suggest that a completely adequate natural science would also realize (perhaps, per impossibile) the goal of transforming the corpuscularian hypothesis into knowledge by demonstrating the necessary connection between the ‘microstructure’ (primary qualities of insensible corpuscles) of a particular natural kind of substance (e.g., gold) and the ideas of secondary qualities constitutive of the complex idea of that kind of substance. Locke’s conclusion concerning the possibility of the development of a natural science thus conceived is pessimistic: In vain therefore shall we endeavor to discover by our Ideas, (the only true way of certain and universal knowledge,) what other Ideas are to be found constantly joined with that of our complex Idea of any Substance: since we neither know the real Constitution of the minute Parts, on which their Qualities do depend; not, did we know them could we discover any necessary connexion between them, and any of their Secondary Qualities: which is necessary to be done, before we can certainly know their necessary co-existence (Essay, 4.3.14). It is understandable that, with such a conception of the science of nature, Locke found little of it in Newton’s Principia. In this paper, I further explore what might, perhaps with some hyperbole, be termed Locke’s ‘disappointment’ with the Prinicipia as a contribution to natural science. In particular, I argue that Locke’s adherence to the idealist epistemology of the Way of Ideas entails that mathematics cannot lend its certainty as a scientia to natural philosophy. Consequently, he finds more mathematics than natural philosophy in the Principia. (shrink)

This article proposes three states in an actor-network and a global/local distinction among actants. This theoretical framework is applied to two invention networks: one created by an inventor of solar heating systems and another created by a designer who wanted to create an environmentally sustainable furniture fabric. Both solar inventor and fabric designer wanted to develop technologies that would improve the environment and also make money. The article concludes by considering whether invention networks that intend to turn “good into (...) class='Hi'>gold” have to evolve a shared representation or whether it is sufficient for a new design to serve as a boundary object for actants. The trivial neuron doctrine (TND) holds that psychology merely depends on neurobiology. The radical neuron doctrine (RND) goes further and claims that psychology is superfluous in that neuroscience can “replace it.” Popular among RND notions of “replacement” is “reduction,” and in our commentary we challenge Gold & Stoljar (G&S) to make clear their distinction between merely depends on (TND) and is reducible to (RND). G&S give us a TND–RND distinction that is a distinction without a difference; a defensible TND–RND (...) distinction must have a metaphysical basis. We suggest a denial of compositionalism as such a basis. (shrink)

In “Against Theory” we argued that a text means what its author intends it to mean. We argued further that all attempts to found a method of interpretation on a general account of language involve imagining that a text can mean something other than what its author intends. Therefore, we concluded, all such attempts are bound to fail; there can be no method of interpretation. But the attempt to imagine that a text can mean something other than what its author (...) intends is not restricted to writers interested in interpretive method. In fact, the denial that meaning is determined by intention is central to projects as indifferent to method as hermeneutics and deconstruction. For hermeneutics, a text means that its author intends but also necessarily means more, acquiring new meanings as readers apply it to new situations. For deconstruction, an author can never succeed in determining the meaning of a text; every text participates in a code that necessarily eludes authorial control. Since both these projects are committed to the view that a text from mean something other than what its author intends, they are also committed to the view that a text derives its identity from something other than authorial intention. The text is what it is, no matter what meaning is assigned to it by its author and no matter how that meaning is revised by its readers.What gives a text its autonomous identity? On most accounts, the answer is linguistic conventions—the semantic and syntactic rules of the language in which the text is written. One of our aims in the present essay is to criticize the particular notions of textual identity advanced by hermeneutics and deconstruction, but our more general target is the notion that there can be any plausible criteria of textual identity that can function independent of authorial intention. Because there can be no such criteria, nonmethodological versions of interpretive theory are as incoherent as methodological ones and, like the methodological ones, should be abandoned. Face perception and emotion categorization are widely investigated under laboratory conditions that are devoid of real social interaction. Using mobile eye-tracking glasses in a standardized diagnostic setting while applying the Autism Diagnostic Observation Schedule, we had the opportunity to record gaze behavior of children and adolescents with and without Autism Spectrum Conditions during social interaction. The objective was to investigate differences in eye-gaze behavior between three groups of children and adolescents either with ASC or with unconfirmed diagnosis of ASC or (...) with neurotypical development during social interaction with an adult interviewer in a diagnostic standard situation using the ADOS-2. In a case control study, we used mobile eye-tracking glasses in an ecologically valid and highly standardized diagnostic interview to investigate suspected cases of ASC. After completion of the ASC diagnostic gold standard including the ADOS-2, the participants were assigned to two groups based on their diagnosis and compared with a matched group of neurotypically developed controls. The primary outcome measure is the percentage of total dwell times assessed for different areas of interest with regard to the face and body of a diagnostic interviewer and the surrounding space. Overall, 65 children and adolescents within an age range of 8.3–17.9 years were included in the study. The data revealed significant group differences, especially in the central-face area. Previous investigations under laboratory conditions gave preferential attention to the eye region during face perception to describe differences between ASC and NTD. In this study – using an ecologically valid setting within a standard diagnostic procedure – the results indicate that neurotypically developed controls seem to process faces and facial expressions in a holistic manner originating from the central-face region. Conversely, participants on the Autism Spectrum seem to avoid the central-face region and show unsystematic gaze behavior, not using the preferred landing position in the central-face region as the Archimedean point of face perception. This study uses a new approach, and it will be important to replicate these preliminary findings in future research. (shrink)

Sometimes we make a decision about an action we will undertake later and form an intention, but our judgment of what it is best to do undergoes a temporary shift when the time for action comes round. What makes it rational not to give in to temptation? Many contemporary solutions privilege diachronic rationality; in some “rational non-reconsideration” (RNR) accounts once the agent forms an intention, it is rational not to reconsider. This leads to other puzzles: how can someone be motivated (...) to follow a plan that is contrary to their current judgment? How can it be rational to form a plan to resist if we can predict that our judgment will shift? I show how these puzzles can be solved in a framework where there are multiple units of agency, distinguishing between the judgments of the timeslice and those of the person over time, and allowing that the timeslice can “self identify”, taking the person over time as the relevant unit of agency and doing intrapersonal team reasoning (with a different causal role for intentions than RNR accounts). On my account, resisting temptation is compatible with synchronic rationality, so synchronic and diachronic rationality are aligned. However, either resisting or succumbing to temptation can be instrumentally rational, depending on the unit of agency that is identified with. In order to show why we ought to resist temptation, we need to draw on a non-instrumental rationale. I sketch possible routes for doing this. (shrink)

I was a doctoral student at IU then and had studied the writings of many of the conference presenters and so the experience of hearing and meeting them in person was a heady one, indeed. I will never forget those impressions of (...) Phil Alperson, Wayne Bowman, Allen Britton, David Elliott, Peter Kivy, Gerard Knieter, Thomas Regelski, Bennett Reimer, John Shepherd, Ann Stokes, Eleanor Stubley, Keith Swanwick, and many others.I was interested in meeting Michael after hearing his response to the presentation of one of my favorite IU professors of musicology, Austin Caswell. Caswell’s provocative paper, “How We Got into Canonicity and What it has Done to Us: An American Music Historian’s View of Music in Academia,” claimed that “the effect of canonicity on American musical life is destructive,” while Michael’s response was characterized by his style of writing that I came to recognize over the decades as distinct, calm, logical, methodical, and based in an extraordinarily wide and deep wealth of historical knowledge. While I greatly admired my rebellious and passionate professor’s views and temperament which were not unlike my own, I also appreciated hearing Michael’s measured and thoughtful response. Thus began my friendship with Michael, who, I learned, was not only a professor [End Page 92] and dean at Towson State University but also an avid big band woodwind doubler who showed interest in my doctoral research in the art of vocal jazz improvisation. That friendship lasted for almost twenty-eight years and we enjoyed memorable reunions at other conferences. For example, there was the ISPME conference held at UCLA where he invited me to dinner with his good friend and connoisseur of fine wines, Bennett Reimer, and the ISPME conference in Helsinki where, after I tripped and severely broke my ankle, requiring surgery, Michael, Estelle Jorgensen, Iris Yob, and two then-doctoral students (Kasia Bugaj and Leonard Tan) visited me in the Helsinki hospital.When I began teaching at the University of Southern California in 1995, it was fortuitous that Michael’s brother, Brian, lived in the Los Angeles area. His frequent visits allowed him to make several guest lectures to my graduate research methods classes, very welcome opportunities. After one of those lectures, I relayed the history of my family’s ballroom in the Chicago area that was open for business with big band music from 1929 until 1967. He asked if I had any artifacts from Madura’s Danceland, and when I mentioned my father’s stacks of dusty record books, newsletters, photos, and posters in our basement, he became very enthusiastic and told me that I had a “gold mine” of an archive with which to write a book about the place! As a trained quantitative researcher, I began to explore the record books to analyze trends in band pay over the Depression and World War II years.1 Over the next ten years, with help from Michael’s regular prodding and encouragement, I organized the large archive into the history of Madura’s Danceland.2 I owe this personally important accomplishment to Michael Mark.Michael invited me (in his endearing way which I could not refuse) to coauthor a music education textbook with him3 and our writing partnership went so smoothly that he invited me to co-author the 4th edition of his Contemporary Music Education.4 Although our writing styles and areas of expertise were very different, I learned much from his narrative approach which included illustrative scenarios, interviews, and the informal use of contractions, a style of writing that was not second nature for me. The Indian Buddhist philosopher Vasubandhu is known for his critical contribution to Buddhist Abhidharma thought, his turn to the Mahayana tradition, and his concise, influential Yogacara-Vijñanavada texts. _Paving the Great Way_ reveals another dimension of his legacy: his integration of several seemingly incompatible intellectual and scriptural traditions, with far-ranging consequences for the development of Buddhist epistemology and the theorization of tantra. Most scholars read Vasubandhu's texts in isolation and separate his intellectual development into distinct phases. Featuring close studies of Vasubandhu's (...) _Abhidharmakosabhasya_, _Vyakhyayukti_, _Vimsatika_, and _Trisvabhavanirdesa_, among other works, this book identifies recurrent treatments of causality and scriptural interpretation that unify distinct strands of thought under a single, coherent Buddhist philosophy. In Vasubandhu's hands, the Buddha's rejection of the self as a false construction provides a framework through which to clarify problematic philosophical issues, such as the nature of moral agency and subjectivity under a broadly causal worldview. Recognizing this continuity of purpose across Vasubandhu's diverse corpus recasts the interests of the philosopher and his truly innovative vision, which influenced Buddhist thought for a millennium and continues to resonate with today's philosophical issues. The increasing use of DNA evidence has revolutionized criminal investigations. Over the past several years, DNA forensics—once thought to be a less reliable identifier than other forensic techniques, such as latent fingerprinting—have now become the evidentiary gold standard in criminal prosecutions. At the same time, non-DNA-based forensic techniques that have incarcerated thousands are coming under fire.
