Verfassungsgerichtliche Institutionen- und Kompetenzprofile finden sich gegenwärtig in vielen politischen Gemeinwesen. Dort, wo nicht nur die Prozeduren, sondern sogar die Inhalte des politischen Prozesses dem letztverbindlichen Richterspruch unterliegen, entfaltet die Verfassungsrechtsprechung eine besonders nachhaltige und weitreichende Wirkung. Höchstrichterliche Entscheidungen prägen politisches System und Rechtskultur in diesem Fall derart, dass der Jurisdiktion der Status einer souveränen Instanz zukommt. Mit der Legitimität dieser Version von Verfassungsgerichtsbarkeit befasst sich das vorliegende Werk. Es behandelt das Thema Verfassungsgerichtsbarkeit als Abstraktum, bringt die Mannigfaltigkeit der Erscheinungsformen (...) von (Verfassungs-)Gerichtsbarkeit in eine gedankliche Ordnung, konzipiert Verfassungsgerichtsbarkeit als die institutionell verankerte gerichtliche Überprüfbarkeit sämtlicher staatlicher Akte und erörtert das "Ob und Überhaupt" von Verfassungsgerichtsbarkeit im demokratischen Verfassungsstaat. Der Studie zufolge sprechen pragmatische Gründe sowohl für die Rechtfertigbarkeit einer solchen gerichtlichen Aufsicht als auch für die Geeignetheit der Gerichtsbarkeit hierzu. Prinzipientheoretische Eindeutigkeit hingegen lasse sich weder für noch gegen die Institution der umfassenden Verfassungsgerichtsbarkeit anführen. Whether the prefrontal cortex is part of the neural substrates of consciousness is currently debated. Against prefrontal theories of consciousness, many have argued that neural activity in the prefrontal cortex does not correlate with consciousness but with subjective reports. We defend prefrontal theories of consciousness against this argument. We surmise that the requirement for reports is not a satisfying explanation of the difference in neural activity between conscious and unconscious trials, and that prefrontal theories of consciousness come out of this (...) debate unscathed. I develop a theory of counterfactuals about relative computability, i.e. counterfactuals such as 'If the validity problem were algorithmically decidable, then the halting problem would also be algorithmically decidable,' which is true, and 'If the validity problem were algorithmically decidable, then arithmetical truth would also be algorithmically decidable,' which is false. These counterfactuals are counterpossibles, i.e. they have metaphysically impossible antecedents. They thus pose a challenge to the orthodoxy about counterfactuals, which would treat them as uniformly true. What’s more, I (...) argue that these counterpossibles don’t just appear in the periphery of relative computability theory but instead they play an ineliminable role in the development of the theory. Finally, I present and discuss a model theory for these counterfactuals that is a straightforward extension of the familiar comparative similarity models. (shrink)

This chapter canvasses the metaphysical and moral themes (...) across the three trilogies that make up the “Skywalker saga” to construct a genealogy of how “the Force” evolved throughout these films. At the heart of this conceptual development is the question of how the light and dark sides of the Force are related to each other and what that relationship can help us understand about the nature of good and evil in our own experience. Local theories of consciousness state that one is conscious of a feature if it is adequately represented and processed in sensory brain areas, given some background conditions. We challenge the core prediction of local theories based on long-lasting postdictive effects demonstrating that features can be represented for hundreds of milliseconds in perceptual areas without being consciously perceived. Unlike previous empirical data aimed against local theories, localists cannot explain these effects away by conjecturing that subjects are phenomenally conscious of features that (...) they cannot report. Traditionally, the manufacturer/operator of a machine is held (morally and legally) responsible for the consequences of its operation. Autonomous, learning machines, based on neural networks, genetic algorithms and agent architectures, create a new situation, where the manufacturer/operator of the machine is in principle not capable of predicting the future machine behaviour any more, and thus cannot be held morally responsible or liable for it. The society must decide between not using this kind of machine any more (which is not a (...) realistic option), or facing a responsibility gap, which cannot be bridged by traditional concepts of responsibility ascription. To study consciousness, scientists need to determine when participants are conscious and when they are not. They do so with consciousness detection procedures. A recurring skeptical argument against those procedures is that they cannot be calibrated: there is no way to make sure that detection outcomes are accurate. In this article, I address two main skeptical arguments purporting to show that consciousness scientists cannot calibrate detection procedures. I conclude that there is nothing wrong with calibration in consciousness science.

The reimagined Battlestar Galactica series (2003–2009) and its prequel series Caprica (2009–2010) provoked viewers to consider anew perennial philosophical questions regarding, among others, the nature of personhood and the role of religion in culture and politics. While no single philosophical viewpoint encapsulates the creators’ vision as a whole, the theory of biopolitics, as formulated by Michel Foucault, Giorgio Agamben, and others, is a fruitful lens through which various points of story and character development may be analyzed. Two noteworthy areas of (...) attention are, first, whether a race of intelligent, self-aware beings, who have been artificially created, should be considered “persons” with attendant moral and legal status, and second, whether the purported ontological division between the “biological” and the “artificial” has moral import concerning the degree of control one class of beings may legitimately exercise over another. In this article, I try to shed new light on Frege’s envisaged definitional introduction of real and complex numbers in _Die Grundlagen der Arithmetik_ (1884) and the status of cross-sortal identity claims with side glances at _Grundgesetze der Arithmetik_ (vol. I 1893, vol. II 1903). As far as I can see, this topic has not yet been discussed in the context of _Grundlagen_. I show why Frege’s strategy in the case of the projected definitions of real and complex numbers in (...) _Grundlagen_ is modelled on his definitional introduction of cardinal numbers in two steps, tentatively via a contextual definition and finally and definitively via an explicit definition. I argue that the strategy leaves a few important questions open, in particular one relating to the status of the envisioned abstraction principles for the real and complex numbers and another concerning the proper handling of cross-sortal identity claims. The aim of the current investigation is to analyze the writings On Kingship in the context of sole rulership in Antiquity. Writings On Kingship first appeared in the time of Alexander the Great and flourished during the Hellenistic period, but there are although some treatises written under Roman rule during the Imperial period and in Late Antiquity. Starting point of the analysis is to understand the treatises On Kingship as a literary genre. By taking into account the authors, the addressees, (...) the implicit readers, and the content as well as the literary form it can be shown that the writings On Kingship played an important role in the always difficult communication between kings and Greek cities during the Hellenistic period. As the communicative contexts changed during the Roman Imperial period and in Late Antiquity, the treatises On Kingship lost their original social function. Therefore, the sporadic writings originating from post-Hellenistic times can be understood as a case of failed literary reception. (shrink)

Logical empiricism is commonly seen as a counter-position to scientific realism. In the present paper it is shown that there indeed existed a realist faction within the logical empiricist movement. In particular, I shall point out that at least four types of realistic arguments can be distinguished within this faction: Reichenbach’s ‘probabilistic argument,’ Feigl’s ‘pragmatic argument,’ Hempel’s ‘indispensability argument,’ and Kaila’s ‘invariantist argument.’ All these variations of arguments are intended to prevent the logical empiricist agenda from the shortcomings of radical (...) positivism, instrumentalism, and other forms of scientific antirealism. On the whole, it will be seen that logical empiricism and scientific realism are essentially compatible with each other. Especially Kaila’s invariantist approach to science (and nature) comes quite close to what nowadays is discussed under the label ‘structural realism.’ This, in turn, necessitates a fundamental reevaluation of Kaila’s role in the logical empiricist movement in particular and in twentieth-century philosophy of science in general. There is currently a great debate about whether the holobiont, i.e. a multicellular host and its residential microorganisms, constitutes a biological individual. We propose that resident microorganisms have a general and important role in the individuality of the host organism, not the holobiont. Drawing upon the Equilibrium Model of Immunity, we argue that microorganisms are scaffolds of immune capacities and processes that determine the constituency and persistence of the host organism. A scaffolding perspective accommodates the contingency and heterogeneity of resident (...) microorganisms while accounting for their necessity and unifying contributions to host individuality. In our symbiotic view of life, holobionts may not be organisms or units of selection, but macroorganisms cannot persist nor function as individuals without their scaffolding microorganisms. (shrink)

Theodor Adorno is a widely-studied figure, but most often with regard to his work on cultural theory, philosophy and aesthetics. The Sociology of Theodor Adorno provides the first thorough English-language account of Adorno's sociological thinking. Matthias Benzer reads Adorno's sociology through six major themes: the problem of conceptualising capitalist society; empirical research; theoretical analysis; social critique; the sociological text; and the question of the non-social. Making good decisions in extremely complex and difficult processes and situations has always been both a key task as well as a challenge in the clinic and has led to a large amount of clinical, legal and ethical routines, protocols and reflections in order to guarantee fair, participatory and up-to-date pathways for clinical decision-making. Nevertheless, the complexity of processes and physical phenomena, time as well as economic constraints and not least further endeavours as well as achievements in medicine and healthcare (...) continuously raise the need to evaluate and to improve clinical decision-making. This article scrutinises if and how clinical decision-making processes are challenged by the rise of so-called artificial intelligence-driven decision support systems (AI-DSS). In a first step, this article analyses how the rise of AI-DSS will affect and transform the modes of interaction between different agents in the clinic. In a second step, we point out how these changing modes of interaction also imply shifts in the conditions of trustworthiness, epistemic challenges regarding transparency, the underlying normative concepts of agency and its embedding into concrete contexts of deployment and, finally, the consequences for (possible) ascriptions of responsibility. Third, we draw first conclusions for further steps regarding a ‘meaningful human control’ of clinical AI-DSS. (shrink)

Recently, Edward Furton commented on an article that we published in Health Care Ethics USA concerning the philosophical and theological anthropology informing the discussion of appropriate care for individuals with gender dysphoria and intersex conditions. We appreciate the opportunity to clarify the points we made in that article, particularly the metaphysical mechanics underlying our contention that, as part of a unified human person, the human rational soul is sexed. We hope this more in-depth metaphysical explanation shows that Furton’s concern, while (...) valid insofar as our position may have needed clarifying, is nevertheless ill-founded with respect to our contention that actually existent human rational souls are sexed. Introspection is the capacity by which we know our own conscious mental states. Several theories aim to explain it. According to acquaintance theory, we know our experiences by being acquainted with them. Acquaintance is non-causal, non-inferential, and non-observational. I present a dilemma for the acquaintance theory of introspection. Either subjects are always acquainted with all their experiences; or some attentional mechanism selects the relevant experiences (or aspects of experiences) for introspection. The first option is implausible: it implies that subjects are (...) omniscient about their own experiences. The second option is also implausible: if acquaintance is a non-causal relation, introspection cannot target specific (aspects of) experiences without violating the principle of causal closure of the physical. Many philosophers have claimed that relying on the testimony of others in normative questions is in some way problematic. In this paper, I consider whether we should be troubled by deference in democratic politics. I argue that deference is less problematic in impure cases of political deference, and most non-ideal cases of political deference are impure. To establish the second point, I rely on empirical research from political psychology. I also outline two principled reasons why we should expect political deference (...) to be untroubling: political problems are difficult and require a division of epistemic labour; furthermore, there is value in exercising epistemic solidarity with those one shares an identity or interests with. American critical realism was defended in two versions, an “essentialist” and an “empirical.” The main proponent of the essentialist version was George Santayana, who in his Scepticism and Animal Faith (1923) outlined a critical realist account of epistemology based substantially on an articulate doctrine of essences. In the present paper, an attempt is made to critically examine the resulting approach, particularly in relation to perception. It will be argued that Santayana failed to develop a sufficiently convincing essentialist view of perception, (...) and that his actual significance in terms of the impact of the critical realist movement was, contrary to what is often claimed, quite limited. A general class of labeled sequent calculi is investigated, and necessary and sufficient conditions are given for when such a calculus is sound and complete for a finite -valued logic if the labels are interpreted as sets of truth values. Furthermore, it is shown that any finite -valued logic can be given an axiomatization by such a labeled calculus using arbitrary "systems of signs," i.e., of sets of truth values, as labels. Simulations are used in very different contexts and for very different purposes. An emerging development is the possibility of using simulations to obtain a more or less representative reproduction of organs or even entire persons. Such simulations are framed and discussed using the term ‘digital twin’. This paper unpacks and scrutinises the current use of such digital twins in medicine and the ideas embedded in this practice. First, the paper maps the different types of digital twins. A special focus is (...) put on the concrete challenges inherent in the interactions between persons and their digital twin. Second, the paper addresses the questions of how far a digital twin can represent a person and what the consequences of this may be. In der Tiefe zeigt sich als die entscheidende Eigenart literarischer Texte ihr Wertcharakter. Die Konsequenzen, die sich daraus für die Produktion und Rezeption von literarischer Kunst ergeben, werden in der vorliegenden Arbeit kritisch erörtert.

Conditional structures lie at the heart of the sciences, humanities, and everyday reasoning. It is hence not surprising that conditional logics – logics specifically designed to account for natural language conditionals – are an active and interdisciplinary area. The present book gives a formal and a philosophical account of indicative and counterfactual conditionals in terms of Chellas-Segerberg semantics. For that purpose a range of topics are discussed such as Bennett’s arguments against truth value based semantics for indicative conditionals.

The core feature that distinguishes moods from emotions is that moods, in contrast to emotions, are diffuse and global. This article outlines a dispositional theory of moods (DTM) that accounts for this and other features of mood experience. DTM holds that moods are temporary dispositions to have or to generate particular kinds of emotion-relevant appraisals. Furthermore, DTM assumes that the cognitions and appraisals one is disposed to have in a given mood partly constitute the experience of mood. There are two bodies of literature, one offering theories of the legitimacy of domestic institutions like states, another offering theories of the legitimacy of international institutions like the IMF. Accounts of domestic legitimacy stress the importance of democratic procedure, while few to no theorists make democracy a necessary condition for the legitimacy of international institutions. In this paper, I ask whether this asymmetry can be defended. Is there a unified higher-order theory which can explain why legitimacy requires democracy in the (...) domestic context, but not in the international context? I argue that no proceduralist higher-order theory succeeds, and that we need to look for other solutions. (shrink)

Trust is one of the big buzzwords in debates about the shaping of society, democracy, and emerging technologies. For example, one prominent idea put forward by the High‐Level Expert Group on Artificial Intelligence appointed by the European Commission is that artificial intelligence should be trustworthy. In this essay, we explore the notion of trust and argue that both proponents and critics of trustworthy AI have flawed pictures of the nature of trust. We develop an approach to understanding trust in AI (...) that does not conceive of trust merely as an accelerator for societal acceptance of AI technologies. Instead, we argue, trust is granted through leaps of faith. For this reason, trust remains precarious, fragile, and resistant to promotion through formulaic approaches. We also highlight the significance of distrust in societal deliberation, as it is relevant to trust in various and intricate ways. Among the fruitful aspects of distrust is that it enables individuals to forgo technology if desired, to constrain its power, and to exercise meaningful human control. (shrink)

We investigate interpolation properties of many-valued propositional logics related to continuous t-norms. In case of failure of interpolation, we characterize the minimal interpolating extensions of the languages. For finite-valued logics, we count the number of interpolating extensions by Fibonacci sequences.

Phänomenologie der Normativität ist der Versuch zu zeigen, wie Normativität in der menschlichen Natur gründet. Im Anschluss an die phänomenologische Anthropologie Max Schelers und Helmuth Plessners stellt der Autor die Strukturen menschlichen Lebens heraus, die alle menschlichen Lebensformen fundieren. Menschen sind Lebewesen, die einen Leib haben, und dieses Phänomen ist ursprünglicher als die Unterscheidung von Körper und Geist. Hält man sich dies vor Augen, werden bestimmte Formen menschlicher Normativität verständlich: Die menschliche Lebensweise ist auf ein Gleichgewicht verschiedener Formen des Miteinanders (...) angelegt, das nur möglich ist, weil es leiblich vermitteltes Ausdrucksverstehen gibt. Mitfühlen mit dem anderen und Liebe zu ihm fundiert das Erkennen, und was menschliche Würde ist, verstehen wir, weil wir wissen, wie die Integrität des Leibes geschützt, aber auch verletzt werden kann.
