We read commentaries on our feature article ‘The ethics of consent during labour and birth: episiotomies’1 with gratitude and interest. Nearly all commenting authors agree that consent for in-labour procedures is necessary and ideally given at the point of intervening. Both Shalowitz & Ralston and Stirrat note that this is already required by professional statements and guidelines in the USA2 and UK3, respectively, but also note that practice does not yet conform. The Americans authors helpfully emphasise the importance of multilevel (...) institutional measures for closing this gap, including consent policies and reporting mechanisms, as well as ongoing education.2 The UK writer seconds the role for education within wider shared decision-making and informed choice approaches, and generously commends our paper for close study by all maternity care providers. Others add a cautionary note. Lee applauds all our recommendations, but notes our proposals cannot fully secure autonomy because of, among others, epistemic injustice and other power differentials.4 Kumar-Hazard and Dahlen worry that opt-out consent is equal to substitute decision-making; weakens women’s rights; and is open to abuse.5 Nelson and Clough object to our willlingness to work within a flawed conceptual framework, which ought to be challenged.6 We agree that there are limits to what our proposal can do. It cannot rectify unequal distributions of epistemic credibilities, either in general or in any particular interaction. Unconsented episiotomies and other procedures during labour are commonly reported by women in several countries, and often highlighted in birth activism. Yet, forced caesarean sections aside, the ethics of consent during labour has received little attention. Focusing on episiotomies, this paper addresses whether and how consent in labour should be obtained. We briefly review the rationale for informed consent, distinguishing its intrinsic and instrumental relevance for respecting autonomy. We also emphasise two non-explicit ways of giving consent: implied and opt-out consent. (...) We then discuss challenges and opportunities for obtaining consent in labour and birth, given its unique position in medicine.We argue that consent for procedures in labour is always necessary, but this consent does not always have to be fully informed or explicit. We recommend an individualised approach where the antenatal period is used to exchange information and explore values and preferences with respect to the relevant procedures. Explicit consent should always be sought at the point of intervening, unless women antenatally insist otherwise. We caution against implied consent. However, if a woman does not give a conclusive response during labour and the stakes are high, care providers can move to clearly communicated opt-out consent. Our discussion is focused on episiotomies, but also provides a useful starting point for addressing the ethics of consent for other procedures during labour, as well as general time-critical medical procedures. Martin Heidegger's commitment to the idea that _Dasein_ is ultimately gender neutral, as well as several other major aspects of his thought, raises significant questions for feminist philosophers. The fourteen essays included in this volume clearly illustrate the ways in which feminist readings can deepen our understanding of his philosophy. They illuminate both the richness and the limitations of the resources his work can provide for feminist thought. This volume engages the full scope of Heidegger's writings from_ Being and Time (...) _through his latest work, from his readings of the ancient Greek poets to his critique of modern technology. This article examines Grotius’ lifelong support for Dutch expansion overseas. As noted in other publications of mine, Grotius cooperated closely with the directors of the Dutch East India Company (VOC) in the years 1604–1615. Right up to his arrest for high treason in August 1618, he contributed towards Dutch government discussions about the establishment of a West India Company (WIC). Three years of imprisonment at Loevestein Castle and, following his escape, long years of exile could not weaken his dedication to (...) the cause. His relatives in Holland, in particular his brother Willem de Groot and his brother-in-law Nicolaas van Reigersberch, kept him up-to-date on the fortunes of the VOC and WIC. His expertise on maritime affairs was in high demand. For example, Cardinal Richelieu invited him in November 1626 to become actively involved in the establishment of a French East India Company. As itinerant ideologue of empire, Grotius sought to further his own career and those of his nearest family members, without damaging the interests of the United Provinces. Through Willem de Groot and Nicolaas van Reigersberch, he provided informal advice on Dutch imperial policy to the VOC directors and government officials in The Hague. He was rewarded with the appointment of his brother and his second son, Pieter de Groot, as VOC lawyers (ordinaris advocaten) in 1639 and 1644, respectively. They served as his proxies in diplomatic disputes involving the VOC, the States General and the Portuguese ambassador in autumn 1644, when Pieter and Willem de Groot wrote a defense of VOC claims to the cinnamon-producing areas of Ceylon (modern-day Sri Lanka), liberally citing De Jure Belli ac Pacis. Holland I FIRST, A CONFESSION. Like, I suspect, many of my readers, I am an unpublished fiction writer. Unlike most of the closet fiction writers in academia, however, I write genre fiction. The question that immediately follows is how that writing is related to (...) the intellectual work I do in philosophy.This question, of course, is open to a broad range of answers, from the possibility that the two aren't related at all, to potential Freudian answers it might take years of therapy to unearth. Teaching informs one's life, however, as much as the reverse, and in teaching Martin Heidegger's "The Origin of the Work of Art" to my Metaphysics class last year, I began to understand at least one dimension of the appeal that writing genre fiction has for me as a philosopher.But first, let me explain what I mean by genre fiction. In what follows, I will be referring primarily to four forms of genre fiction that have clear roots in the nineteenth century in Western Europe and North America: two gender-segregated genres, the western and the romance, and two gender-marked genres, science fiction and detective novels. I will be comparing these to two other forms of "popular culture" that also developed in the nineteenth century and have, I would argue, similar relationships to the older, more "legitimate," more elite art forms which they closely resemble: photography 1 and popular music, [End Page 216] especially those forms of popular music such as ragtime, blues, jazz, and rock that are informed by the African-American experience in the United States. 2These "low brow" art forms all appear to have arisen out of the growth of the middle class in developing parts of the world during the nineteenth century and the correlative confluence of greater leisure, greater aggregate prosperity, and higher levels of education across a broader spectrum of society. Further, these art forms all combine the surface appearance of their respective "high brow" correlate arts with the reassurance of repetition that is the cornerstone of the folk arts with which they are also correlated. Each of these forms of popular culture balances itself, then, between a demand for more and more "works of art" (and/or class aspirations based on the appearance of such) and a demand for the familiar in a rapidly changing, materially challenging world.Thus, photography gives us a frozen and thereby purified visual reality, an icon of memory to which we can return at will. The truth it reveals is most often starker than that of folk painting and portraiture, but also gives the appearance of being free from the subjectivity of the artist. Great iconic photographs such as the kiss on V-E day, I have heard it said, become more real than the reality they encapsulated.Popular music similarly combines often amazing musical complexity (which is not unknown, although rarer, in western folk music) with the reassurance of a form that not only repeats itself within a song, but also between songs of the same genre. Thus, blues can be recognized by both the minor chords in its melodies and the characteristic rhyme pattern of its lyrics. Moreover, most western popular music, even to some extent free-form jazz, has a familiar and reassuring beginning-middle-end structure, both melodically and dynamically, that locates a listener immediately within the song's "story-arc." 3This same beginning-middle-end structure is one clear hallmark of genre fiction. Another is repetition. In this connection the peculiar character of Platon der Erzieher is a side issue. Gaiser seems only moderately interested in paideia and even tries to free Stenzel from the suspicion that he should have considered paideia as the essence of Platonism. Some sentences (...) in Stenzel's book which might suggest such an opinion are said to be "consciously one-sided formulations" (p. viii, note 7). Gaiser's true interest is Plato's ontology. Nothing explains his stand better than his endorsement of H. J. Kr~imer's representative work Arete bei Platon und Aristoteles. Kr~imer, whose major objective is a reconstruction of what he thinks was Plato's esoteric philosophy, has emphatically declared that he arrived at his results by pursuing the method and the factual interests of Stenzel. Gaiser's attempt to locate Stenzel's position must be understood in the light of this and perhaps similar declarations.1 This is not the place to discuss those of Stenzel's theories which are at best touched upon in Platon der Erzieher or even the theories of those who proclaim to be his heirs. There is, however, one point on which I insist. Gaiser tries to link Stenzel with Heidegger and points to the interest which Stenzel took in Heidegger in his later years. Platon der Erzieher appeared in the same year as Sein und Zeit. I believe that the two works belong to entirely different worlds. Whereas Heidegger powerfully broke up new dimensions of thought, the philosopher Stenzel, for better or worse, represents a period which had reached its end when he died in 1934. Westerink, whose interest in the Alexandrian commentators on Plato has already borne ample and distinguished fruit in his editions of the Alcibiades commentaries of Olympiodorus and Proclus and of Damascius' lectures on the Philebus, has now further enriched our knowledge of Platonic studies in the sixth century A.D.by publishing a new critical text of a little-known set of introductory lectures to Plato, which originated in the Alexandrian school. The importance of the present work is indicated by the facts that the last critical text of these prolegomena, which forms part of a tenth-century manuscript in the Vienna National Library (Vindob. 1Cf. also Gaiser's new book Platons Ungeschriebene Lehre (Stuttgart, 1963), which appeared after this review was written. BOOK REVIEWS 247 phil. gr. 314), was published over a century ago by K. F. Hermann in his Appendix Platonica, and that the most recent commentary is that of L. Skowronski in a dissertation published in 1884. In other words, nothing substantial had appeared on the Prolegomena after the publication of the Commentaria in Aristotelem Graeca, and Westerink's great merit consists in bringing to bear upon the present work the insights gained from a study of these Aristotelian commentaries. For the same professors taught both Plato and Aristotle at Alexandria, and not only did their teaching of one color their views on the other, but they frequently borrowed ideas, quotations, stories, and even phrases from one another. The chief aim of the Introduction (pp. ix-l) is to investigate the authorship of the Prolegomena, which the almost unanimous agreement of scholars since 1675 (the one exception is Beutler in RE s.v. "Olympiodorus") had attributed to Olympiodorus. W. begins by establishing the Alexandrian background of these lectures and by discussing, one by one, the characteristic beliefs of the various members of the school and the way in which these are reflected in introductory lectures to Aristotle. This is followed by a painstaking analysis of the sources of the Prolegomena and finally the conclusion that the present text belongs "in the immediate surroundings of Olympiodorus and Elias" (p. xlix). ABSTRACT Politics, religion and legal argumentation were inextricably intertwined in the reception of John Selden’s Mare Clausum/The Closed Sea (1635). The work’s writing and printing history is closely tied to Stuart foreign policy, particularly James I’s and Charles I’s attempts to tax the Dutch herring fisheries. Mare Clausum’s immediate impact on European international relations has received little attention from historians so far. It is clear, however, that government authorities in London, The Hague and Venice expected an official reply from Hugo (...) Grotius, author of Mare Liberum/the Free Sea (1609) and Swedish ambassador in Paris. Yet the latter declined to assist the Dutch authorities in this matter, blaming them for his imprisonment in 1618–1621 and his second banishment from Holland in 1632. The antipathy was mutual. The Dutch authorities abhorred Grotius’ pleas for religious tolerance and commissioned his Calvinist kinsman Dirk Graswinckel to respond to Selden instead. Graswinckel had already published Libertas Veneta/venetian Liberty (1634), a learned defense of the Republic of Venice’s political interests. In ‘Vindiciae maris liberi’/vindication of the Free Sea (written 1636–1637), he tried –but arguably failed – to reconcile Dutch claims to freedom of navigation, trade and fishing with Venetian claims to the Adriatic. This paper looks at some of the ways in which environmental philosophers have sought to press ecological concepts into the service of environmental ethics. It seeks to show that although ecology plays a major role in opening our eyes to sources of value in the natural world, we should not necessarily attempt to build our account of nature’s value upon the concepts which ecology supplies. No description is going to capture nature’s essence; no formula is going to demonstrate its value. (...) We should recognise the natural world as a particular historic individual and relate to it accordingly. This means acknowledging its value in a contingent, conditional and provisional way, and recognizing its value as a precondition of the value of our own lives. (shrink)

Erik Midelfort's website. Martin Mulsow's seismic reinterpretation of the origins of the Enlightenment in Germany won awards and renown in its original German edition, and now H. C. Erik Midelfort's translation makes this sensational book available to English-speaking readers. In Enlightenment Underground, Mulsow shows that even in the (...) late seventeenth century some thinkers in Germany ventured to express extremely dangerous ideas, but did so as part of a secret underground. Scouring manuscript collections across northern Europe, Mulsow studied the writings of countless hitherto unknown radical jurists, theologians, historians, and dissident students who pushed for the secularization of legal, political, social, and religious knowledge. Often their works circulated in manuscript, anonymously, or as clandestinely published books. Working as a philosophical microhistorian, Mulsow has discovered the identities of several covert radicals and linked them to circles of young German scholars, many of whom were connected with the vibrant radical cultures of the Netherlands, England, and Denmark. The author reveals how radical ideas and contributions to intellectual doubt came from Socinians and Jews, church historians and biblical scholars, political theorists, and unemployed university students. He shows that misreadings of humorous or ironic works sometimes gave rise to unintended skeptical thoughts or corrosively political interpretations of Christianity. This landmark book overturns stereotypical views of the early Enlightenment in Germany as cautious, conservative, and moderate, and replaces them with a new portrait that reveals a movement far more radical, unintended, and puzzling than previously suspected. Recent investigations on how people derive meaning from language have focused on task‐dependent shifts between two cognitive systems. The symbolic (amodal) system represents meaning as the statistical relationships between words. The embodied (modal) system represents meaning through neurocognitive simulation of perceptual or sensorimotor systems associated with a word's referent. A primary finding of literature in this field is that the embodied system is only dominant when a task necessitates it, but in certain paradigms, this has only been demonstrated using nouns (...) and adjectives. The purpose of this paper is to study whether similar effects hold with verbs. Experiment 1 evaluated a novel task in which participants rated a selection of verbs on their implied vertical movement. Ratings correlated well with distributional semantic models, establishing convergent validity, though some variance was unexplained by language statistics alone. Experiment 2 replicated previous noun‐based location‐cue congruency experimental paradigms with verbs and showed that the ratings obtained in Experiment 1 predicted reaction times more strongly than language statistics. Experiment 3 modified the location‐cue paradigm by adding movement to create an animated, temporally decoupled, movement‐verb judgment task designed to examine the relative influence of symbolic and embodied processing for verbs. Results were generally consistent with linguistic shortcut hypotheses of symbolic‐embodied integrated language processing; location‐cue congruence elicited processing facilitation in some conditions, and perceptual information accounted for reaction times and accuracy better than language statistics alone. These studies demonstrate novel ways in which embodied and linguistic information can be examined while using verbs as stimuli. (shrink)

L’addition, dans la cinquième édition en 1683 de La Logique ou L’Art de penser, d’un chapitre consacré à la définition générale du signe et de plusieurs chapitres relevant spécifiquement d’une analyse des signes linguistiques, a été parfois interprétée comme une apparition tardive du “problème du langage” dans le traité d’Arnauld et Nicole. Parce que la plupart de ces chapitres supplémentaires sont la transposition de passages auparavant destinés dans la Perpétuité de la foi (1669-1674) à réfuter le sens calviniste de Ceci (...) est mon corps, on a été enclin à attribuer l’importance de la question du signe et du “problème du langage” dans l’édition de 1683 à une origine théologique. J’essaie au contraire de montrer que, dès la première édition de L’Art de penser en 1662, la problématisation des écarts des expressions linguistiques avec une correspondance terme à terme entre les mots et les idées a été indissociable pour Port-Royal de l’analyse des opérations de l’esprit. Selon moi, dans la Perpétuité de la foi, la critique du sens calviniste de la formule eucharistique constitue elle-même une application de cette analyse logique du langage : les passages incorporés ensuite dans L’Art de penser sont dans le prolongement des réflexions de 1662 sur les difficultés d’adéquation entre le dire et le vouloir-dire. Je montre pour finir que la définition générale du signe à Port-Royal suppose une restructuration de la définition augustinienne du De doctrina christiana, et fonde en 1683 une identification de la relation de signification linguistique à un rapport de représentation des mots aux idées, qui vient redoubler le rapport de représentation des idées aux choses établi en 1662. It is sometimes held that rules of inference determine the meaning of the logical constants: the meaning of, say, conjunction is fully determined by either its introduction or its elimination rules, or both; similarly for the other connectives. In a recent paper, Panu Raatikainen argues that this view—call it logical inferentialism—is undermined by some “very little known” considerations by Carnap (1943) to the effect that “in a definite sense, it is not true that the standard rules of inference” themselves suffice (...) to “determine the meanings of [the] logical constants” (p. 2). In a nutshell, Carnap showed that the rules allow for non-normal interpretations of negation and disjunction. Raatikainen concludes that “no ordinary formalization of logic [... ] is sufficient to ‘fully formalize’ all the essential properties of the logical constants” (ibid.). We suggest that this is a mistake. Pace Raatikainen, intuitionists like Dummett and Prawitz need not worry about Carnap’s problem. And although bilateral solutions for classical inferentialists—as proposed by Timothy Smiley and Ian Rumfitt—seem inadequate, it is not excluded that classical inferentialists may be in a position to address the problem too. Modality is a category of linguistic meaning having to do with the expression of possibility and necessity. A modalized sentence locates an underlying or prejacent proposition in the space of possibilities. Sandy might be home says that there is a possibility that Sandy is home. Sandy must be home says that in all possibilities, Sandy is home. The counterpart of modality in the temporal domain should be called “temporality”, but it is more common to talk of tense and aspect, the (...) prototypical verbal expressions of temporality. Together, modality and temporality are at the heart of the property of “displacement” that enables natural language to talk about affairs beyond the actual here and now. (shrink)

This paper presents a sequential search model where consumers look for several products and multiproduct …rms compete in prices. In such a multiproduct search market, both consumer behavior and …rm behavior exhibit di¤erent features from the single-product case: a consumer often returns to previously visited …rms before running out of options; and prices can decrease with search costs and increase with the number of …rms. The framework is then extended in two directions. First, by introducing both single-product and multiproduct searchers, (...) the model can explain the phenomenon of countercyclical pricing, i.e., prices of many retail products decline during peak-demand periods. Second, by allowing …rms to use bundling strategies, the model sheds new light on how bundling a¤ects market performance. In a search environment, bundling tends to reduce consumer search intensity, which can soften competition and reverse the usual welfare assessment of competitive bundling in a perfect information setting. Many philosophers and psychologists argue that out everyday ability to predict and explain the actions and mental states of others is grounded in out possession of a primitive 'folk' psychological theory. Recently however, this theory has come under challenge from the simulation alternative. This alternative view says that human beings are able to predict and explain each other's actions by using the resources of their own minds to simulate the psychological aetiology of the actions of the others. This book and (...) the companion volume Folk Psychology: The Theory of Mind Debate together offer a richly woven fabric of philosophical and psychological theory, which promises to yield real insights into the nature of our mental lives. Of course, although this view on meaning was the prevailing one for almost a century, many of the people who initiated the enterprise of logical semantics, including people like Frege and Wittgenstein, had an open eye for all that it did not catch. However, the logical means which Frege, Wittgenstein, Russell, and the generation that succeeded them, had at their disposal were those of classical mathematical logic and set-theory, and these indeed are not very suited for an analysis of other (...) aspects of meaning than those which the slogan covers. A real change in view then had to await the emergence of other concepts, which in due course became available mainly under the influence of developments in computer science and cognate disciplines such as artificial intelligence. And this is one of the reasons why it took almost a century before any serious and successful challenge of the view that meaning equals truthconditions from within logical semantics could emerge. The phrase 'beyond historicism' is usually associated with Bielefeld historians like Hans Ulrich Wehler and Jürgen Kocka, who attempted to turn the study of history into a social science, but a better candidate would be the sociologist Niklas Luhmann, who happened to teach as well in Bielefeld during the 1970's and 1980's. Luhmann had little affinity with the project of his colleagues from the history department. He took the opposite view that the social sciences suffered from a naive enlightenment view (...) and should become more history minded. Like the historicists of the early nineteenth century Luhmann was indirectly inspired by the philosophy of Leibniz. Although Luhmann's theory of social systems may seem miles away from the daily interests of most historians, it can be interpreted as an Aufhebung of historicism. This will be demonstrated for two important concepts, the autopoietic system which incorporates the historicist notion of individuality and the concept of second order observation which can be read as an abstract redescription of what historicists meant by the historical method. ABSTRACT Because of the existence of severely defective humans it is commonly held that whatever consideration is due to all humans is also due to many other animals, and that therefore speciesism, or the readiness to prefer the interest of humans to those of other animals, is unjustified. After criticism of this reasoning a ‘naturalised’ speciesism, acknowledging, for example, the affinities between species, is articulated and defended. A key to this defence is the separation of the task of specifying morally (...) significant differences between humans and other animals from the task of justifying the extension of consideration to defective humans. The conclusion is that more traditional vices than speciesism are chiefly to blame for the shabby treatment of animals by humans. (shrink)

This book explores a question central to philosophy--namely, what does it take for a belief to be justified or rational? According to a widespread view, whether one has justification for believing a proposition is determined by how probable that proposition is, given one's evidence. In this book this view is rejected and replaced with another: in order for one to have justification for believing a proposition, one's evidence must normically support it--roughly, one's evidence must make the falsity of that proposition (...) abnormal in the sense of calling for special, independent explanation. This conception of justification bears upon a range of topics in epistemology and beyond. Ultimately, this way of looking at justification guides us to a new, unfamiliar picture of how we should respond to our evidence and manage our own fallibility. This picture is developed here. Die ersten Überlegungen zu diesem Text entstanden bereits im Wintersemester 1994/95, als ich noch am Otto-Suhr-Institut der Freien Universität Berlin gearbeitet habe. Die wissenschaftlich äu­ ßerst anregende Atmosphäre und die stets spannenden Seminardis­ kussionen, für die ich mich noch einmal herzlich bedanken möch­ te, bilden den impliziten Grundstein meiner demokratietheoreti­ schen Überlegungen. Die äußeren Begleitumstände des Schreibens waren dagegen leider nicht durchgängig erfreulich.
