This paper was given as a keynote address at the international conference on Ethics of Intellectual Property Rights and Patents held in Warsaw, Poland on April 23–24, 2004. The address was the introductory presentation to the important topic of protecting individuals who participate in research as research subjects.

This is another volume in the Modern Studies in Philosophy, a series of anthologies under the general editorship of Prof. Amelie Oksenberg Rorty, which present contemporary interpretations and evaluations of the works of major philosophers. This volume, consisting of a collection of papers by an impressive gallery of scholars, offers a plurality of perspectives on Spinoza. Each interpretation conflicts with some other; yet each illuminates some aspect of the subject. All the papers reflect the "tensions" and "conflicts" which make for (...) very exciting and rewarding reading. Norwegian health professionals, elderly people and family members experience ethical problems involving end-of-life decision making for elders in the context of the values of Norwegian society. This study used ethical inquiry and qualitative methodology to conduct and analyze interviews carried out with 25 health professionals, six elderly people and five family members about the ethical problems they encountered in end-of-life decision making in Norway. All three participant groups experienced ethical problems involving the adequacy of health care for elderly Norwegians. Older (...) people were concerned about being a burden to their families at the end of their life. However, health professionals wished to protect families from the burden of difficult decisions regarding health care for elderly parents at the end of life. Strategies are suggested for dialogue about end-of-life decisions and the integration of palliative care approaches into health care services for frail elderly people. (shrink)

Is "living together" in a marriage-like relationship compatible with the feminist ideal of individual self-development? Paradoxically, while the structure and social-historical context of marriage-like relationships seems in fundamental conflict with the goal of autonomous self-development, the development of individuality also seems to be better fostered by living with a significant other in a committed relationship than by living alone. This paradox is resolved through the suggestion of a three-stage account of self-development: inauthenticity, autonomous being oneself, and autonomous being with others. (...) At the third stage, living together in a marriage-like relationship is one social format in which autonomous relating to others is possible. Unless the partners have attained the second stage, however, such a relationship will be destructive rather than conducive to individuality. (shrink)

The United States, unlike most developed countries, continues to use the marital couple as the taxable unit for its income tax. This continued use of the marital unit— like its original establishment —rests on cultural preferences. This Article suggests that the roles of marriage, religion and taxation in America are essential factors in America’s retention of the marital unit. Part I examines the distinctive contribution marriage — especially the traditional single-earner breadwinner marriage — makes to the political life of the (...) country. Part II explores the similar role of religion. Part III describes some congressional efforts over the past two decades to aid, ostensibly, married couples through the income tax. Part IV concludes that although these actions have not been the most effective or efficient means of helping married couples, they nevertheless serve an important expressive purpose. Tax has been the arena for many political issues since the founding of the nation. Consequently, congressional actions and rhetoric regarding the income tax’s "marriage penalty" reinforce the marital unit/joint return and reaffirm — even if only symbolically — a national commitment to marriage as instrumental to American democracy. Further, I argue that other areas of identity theory are ultimately dependent upon this first area. No theory of how, two, a "thing" is individuated ; of how, three, a "thing"; is identically the same as another "thing"; or of how, four, a "thing" is the same thing over time or through change, can possibly be adequate unless it first tackles the question of what the "thing" in question is or may be. ;In this dissertation, I have attempted to exlore (...) the range of theoretical responses to each of the four groups of questions, ; to show the roots of the inadequacies of these responses in Aristotelian essentialism and in Locke's notion of identity as rooted in "beginnings"; and, finally, to present Buchler's concept of identity in order to show both that it is grounded in an adequate metaphysics and that the conception of identity he offers, grounded in the categories he employs, provides a perfectly adequate conceptual tool for the analysis of all four areas which should be covered by an identity theory. In my final chapter I undertake to perform such an analysis and thus to develop a Buchlerian theory of identity. ;I argue throughout the dissertation, that one cannot offer satisfactory theoretical clarification of what I take to be the first and most general sense of identity, involving "picking-out" or "naming," unless one has an adequate notion of the "things" being "picked-out" . Such an adequate notion of "thing" is available only in a general metaphysical theory which must itself be adequate. ;In this dissertation I broadly examine contemporary literature on identity and find considerable difficulty with various attempts to resolve a range of identity problems. I then undertake an exploration of the roots of these difficulties in the classic Aristotelian discussions and in the classic modern formulation of John Locke. Finally, through an analysis of the metaphysics of Justus Buchler, I suggest that the development of a Buchlerian discussion of identity provides both adequate categorial clarification of the concept of identity and directions for the pursuit of fruitful resolutions to specific identity problems. Marsilio Ficino commended his translation of the Phaedrus to his soul mate Iohannes Bessarion because in that dialogue Plato sought from God spiritual beauty. "When this gold was given to Plato by (...) God, it shone in him most brilliantly, because he was so pure in heart." The epithet "pure in heart" is not literally Ficino's diction: he wrote "in his Platonic bosom perfectly clean" (Platonico in sinu utpote mundissimo). 1 Although this philological variant insinuates his full meaning, the modern translation conveys his essential import. Ficino and Bessarion were both scholars and priests, convinced of the compatibility of Platonism with Christianity. The recipient of the letter, Bessarion, had defended the Phaedrusvigorously against protestations that, for promoting the criminal activity of pederasty, it was an obscene work of unchaste philosophy. "Love," he declared, "leads many to beatitude." 2 Ficino emphasized that "no one can attain beatitude, which consists in divine contemplation, unless he loves God ardently." 3 To that end he translated the complete works of Plato into Latin with commentaries. He also composed a speculative Theologia platonica. The pair would have approved of the application to Plato of the gospel promise "Blessed are the pure of heart [hoi katharoi t¯e kardia], for they shall see God" (Matt. 5:8). Was this promise not already fulfilled in Plato, even before Jesus' pronouncement? Did not Socrates in the Phaedrus soar to the vision of God in his myth of the charioteer, where among privileged souls he peered over the rim of intelligible being to behold the divine processional and true being? The [End Page 41] myth figured the recollection of the soul's primordial state of innocence, "when we were pure ourselves," and, beholding "the beatific vision," were initiated into its "most blessed" mystery. 4 Bessarion cited the passage defensively, declaring Socrates' speech "most holy." 5The beatitudes, from which "pure of heart" derived, emphatically comprised the opening discourse of Jesus' Sermon on the Mount. Jesus blessed the poor in spirit, the mourners, the meek, those hungry and thirsty for righteousness, the merciful, the pure of heart, the peacemakers, and those persecuted for righteousness. He pronounced a corresponding good for each type (Matt. 5:1-10). The first four beatitudes promised reversals for the unfortunate; the second four, eschatological rewards for the virtuous. 6 Ficino personalized the beatitudes. He applied them in a letter to an archbishop to his own contrasting status as a priest "of humble fortune." Indicating his slight financial means, he affirmed obedience to his lot, even contentment with his meager possessions. He then wielded the divine reversal of human judgment, so startling in the beatitudes, against his enemies. "I am certainly content with few possessions, even though I am often held in contempt by many; for these many ought to be deemed of little worth. Blessed are the poor in spirit. Blessed are the peacemakers." 7Ficino also philosophized the beatitudes. He argued in Theologia platonica that, although the celestial realm was usually considered fiery, it could be earthy, as poets imagined the Elysian Fields. Jesus' beatitude promising the possession of the earth to the meek was proof. Ficino expounded the nine grades of celestial beatitude as a belief shared by Platonists and Christians. He assigned these grades to varying degrees and combinations of three ends: the fear of divine power, the search for wisdom, and the love of good, which ultimately transformed the soul. This elaborate division Ficino compared to Jesus' beatitudes. "I think that this mystery is signified in the gospel, where the divine oracle nine times calls his disciples blessed, because through nine grades of merit, with God leading, the nine heavens are sought blessedly through nine degrees of contemplation." What kind of turn is the turn to ethics? A Right turn? A Left turn? A wrong turn? A U-turn? Ethics is back in literary studies, philosophy, and political theory. Where critiques of universal man and the autonomous human subject had, in recent years, produced a resistance to ethics in many fields of scholarship, today these critiques have generated a crossover among disciplines and led to theories and practices that see and do ethics otherwise. The decentering of the subject, the (...) contributors to this volume suggest, has brought about a recentering of the ethical. The philosophers, political theorists, literary critics and physician whose essays are collected here bring the particularities of their disciplines and training to a vital complex of questions. Many of these authors express concerns that the turn to ethics is a turn away from politics towards moralism. All ultimately conclude, however, that such concerns, rather than leading away from ethics, have helped to reinvigorate the intellectual field in the present moment. Scholars explore from many fresh angles the interweavings of two of the richest strands of human culture-music and esotericism-with examples from the medieval period to the modern age. Music and esotericism are two responses to the intuition that the world holds hidden order, beauty, and power. Those who compose, perform, and listen to music have often noted that music can be a bridge between sensory and transcendent realms. Such renowned writers as Boethius expanded the definition of music to encompass not (...) only sounded music but also the harmonic fabric of human and cosmic life. Those who engage in pursuits called "esoteric," from ancient astrology, magic, and alchemy to recent and more novel forms of spirituality, have also remarked on the relevance of music to their quests. Esotericists have composed music in order to convey esoteric meaning, performed music to create esoteric influences, and listened to music to raise their esoteric awareness. The academic study of esotericism is a young field, and few researchers have probed the rich interface between the musical and esoteric domains. In Explorations in Music and Esotericism, scholars from numerous fields introduce the history of esotericism and current debates about its definition and extent. Can an assessment of individuals’ narcissism help explain the quality of a respondent’s ethical judgment? How is the relationship between religiosity and ethical judgment moderated by the effects of narcissism? With a sample of 385 undergraduate business majors, this study uses a taxonomic approach to examine the effects of intrinsic and extrinsic religiosity as well as orthodox Christian beliefs on ethical judgment. Three distinct clusters were identified: Skeptics, Nominals, and Devouts. Surprisingly, of the three clusters, Nominals and Devouts were the (...) only groups impacted by narcissism, although Skeptics overall demonstrate the worst ethical judgment. (shrink)

This paper examines the foreign direct investment decision from an ethical perspective, and considers the moral agency involved in such decisions, with emphasis upon the corporate decision-maker. Historical capital allocation models once regarded as both financially and ethically normative are shown to be deficient in today's environment. Work of modern western philososphical and theological ethicists is included in analyses of the applicability of selected ethical approaches or metaphors to multinational foreign direct investment decisions and the corporate manager's role and responsibility (...) as corporate decision-maker and moral agent. The ethical perspectives reviewed can serve as an aid to the individual manager's determination of what constitutes a responsible exercise of decision-making power. (shrink)

I argue that Irigaray's linguistic research is not merely supplementary to her theoretical writing, but, in its depiction of sexed linguistic “styles,” illuminates Irigaray's call for a new syntax. I show the effect of this research on her analysis of the unconscious meaning of interrogative expressions. 1 address the question of Irigaray's standing as a social scientist and argue that attention to her method reveals her positive program in this domain.

Es geht in dem vorliegenden Band um die Rehabilitierung der theoretischen Neugierde für jenes Millennium, das wir Mittelalter nennen. Was heißt es, eine theoretische Einstellung einzunehmen? Gibt es kulturelle Unterschiede oder einen Bedeutungswandel hinsichtlich der curiositas? Was sind die bevorzugten Gegenstandsbereiche der theoretischen Neugier? Hierbei prallen zwei Einstellungen aufeinander: die curiositas als fehlgeleitete und im Grunde eitle und schädliche Neugier oder als ein Naturverlangen, das ein anthropologisches Existential darstellt. Ausgehend vom Wortfeld der theoretischen Neugierde wird die Dialektik und longue durée (...) der curiositas in ihren historischen und systematischen Zusammenhängen thematisiert. An die Stelle von normativen Wertungen treten zeitlich und räumlich weitgespannte Untersuchungen, die dazu beitragen, die begriffliche, motivische und konzeptionelle Entfaltung der theoretischen Neugier im Spannungsfeld theoretischer, kultureller, institutioneller und religiöser Determinanten zu verfolgen und damit zugleich aus der epochenfixierten Engführung zu befreien. Der historische Blick zeigt uns wie in einem Laboratorium die zentrale Idee wie auch die Perspektivenvielfalt der theoretischen Neugierde. (shrink)
