As we wrestle with the role and limits of policing, a political philosopher who spent over two decades as a New York City police officer and Vermont chief of police presents a normative account of what it means to police a pluralist democracy. Invoking his vast experience, Brandon del Pozo argues that we all have the prerogative to use force to protect others, but police embody the government's unique duty to do so effectively and with restraint. This article examines the ways in which the self-responsibilized individualism underpinning contemporary concepts of the ideal European citizen, on the one hand (Frericks, 2014), and the inequalities and anti-democratic politics that characterize contemporary neoliberal capitalism, on the other, are co-constituent elements in creating an antipathy to forms of solidarity that are affective as opposed to calculative. The active citizenship framework lacks a full appreciation of the interdependency of the human condition and is antithetical to universalistic, affectively-led forms of solidarity. The (...) deep relationality that is endemic to both social production and reproduction, and that impels an affective, morally-led form of solidarity needs to be recognized academically and intellectually, and politically sustained, if we are to move beyond a narrow, calculative, self-interested vision of solidarity in Europe. The Communicational Theory of Law (CTL) usually differentiates between Legal Sociology and Legal Theory, in the sense that Legal Sociology is concerned with the social validity of the rules and Legal Theory with the formal or legal validity of the rules. It can be argued that both disciplines are two different perspectives of the same empirical reality (legal rules). Also, legal System and social milieu are two closely linked realities; they cannot be separated because they need each other. The Law (...) is the form or order that the social milieu takes, and, at the same time, the social environment provides the ideas, collective representations and other matters that need a legal regulation. For this reason, the epistemological separation between Sociology and Legal Theory must be overcome when the theoretical perspective comes to legal decisions. Thus, the decisional moment becomes the meeting point between the legal System and the social milieu. This is where the concept of the legal System fulfils its main function, as it allows for the dynamism and adaptability of the legal order. The hermeneutic re-elaboration of the normative texts will be the channel through which the social facts and other material elements can inform the meaning or possible interpretations of the rules and institutions of the legal order. This happens primarily by influencing theoretical and doctrinal works of an expository and didactic nature; and secondarily by influencing the decisions of legal operators and courts. This study seeks to explain how the social context influences legal decisions and the formation of the legal System, from a communicational perspective of Law. In order to do so, it will be necessary to set out two epistemological premises of CTL: the semiotic tripartition of the Theory of Law and the legal Order-legal System distinction. (shrink)

However, assessment of the ethics component of business education has not received the same degree of examination as has assessment of the functional areas. Instead, ethics education is often simply assumed to be effective. Is it? The objective of this study is to begin to explore this question by examining the effects of the integration of ethics into a functional area of business education, specifically a management principles course. Gestural viewpoint research suggests that several dimensions determine which perspective a narrator takes, including properties of the event described. Events can evoke gestures from the point of view of a character , an observer , or both perspectives. CVPT and OVPT gestures have been compared to constructed action and classifiers in signed languages. We ask how CA and CL, as represented in ASL productions, compare to previous results for CVPT and OVPT from English-speaking co-speech gesturers. Ten ASL signers described cartoon (...) stimuli from Parrill . Events shown by Parrill to elicit a particular gestural strategy were coded for signers' instances of CA and CL. CA was divided into three categories: CA-torso, CA-affect, and CA-handling. Signers used CA-handling the most when gesturers used CVPT exclusively. Additionally, signers used CL the most when gesturers used OVPT exclusively and CL the least when gesturers used CVPT exclusively. (shrink)

Informed consent is a perennial topic in bioethics. It has given the field a place in clinical practice and the law and is often the starting point for introductory instruction in medical ethics. One would think that nearly everything has been said and done on this well-worn topic.

Through empirical investigation of the Eurozone and Greek debt crisis 2010–12, this article demonstrates how a peak organization of financial firms—the Institute of International Finance —was able to mobilize its members transnationally to secure several key political and economic objectives. At the height of the crisis, large European banking firms were threatened by the prospect of a disorderly Greek default, coercive intervention by governments, and, potentially, a regional banking collapse. In this context, representatives from the IIF entered the policymaking process (...) to facilitate concerted private sector action, assisting EU officials with the negotiation of a substantial and orderly creditor writedown, and cooperating with legal action by the Greek government to sideline a minority of financial firms hostile to the deal. The article shows that the IIF’s disproportionate influence over policymaking was a result of their technical expertise, their ability to recruit individuals with long-standing experience of sovereign debt restructuring from the public and private sector, and the operation of elite revolving-door processes. In contrast to recent studies showing that financial actors are able to exercise more power at the national level by remaining collectively inactive, these findings suggest that, at the transnational level, financial actors can be most effective at securing their preferences when they are well organized and when they coordinate politically on the basis of collective interests. This paper argues for a dilemma: you can accept liberalism or immigration restrictions, but not both. More specifically, the standard arguments for restricting freedom of movement apply equally to textbook liberal freedoms, such as freedom of speech, religion, occupation and reproductive choice. We begin with a sketch of liberalism’s core principles and an argument for why freedom of movement is plausibly on a par with other liberal freedoms. Next we argue that, if a state’s right to self-determination grounds a prima (...) facie right to restrict immigration, then it also grounds a prima facie right to restrict freedom of speech, religion, sexual choice and more. We then suggest that the social costs associated with freedom of immigration are also costs associated with occupational choice, speech and reproduction. Thus, a state’s interest in reducing these costs gives it prima facie justification to restrict not only immigration but also other core liberal freedoms. Moreover, we rebut the objection that, even if the standard arguments for a prima facie right to restrict immigration also support a prima facie right to restrict liberal freedoms generally, there are differences that render immigration restrictions – but not restrictions on speech, religion, etc. – justified all things considered. In closing, we suggest that the theoretical price of supporting immigration restrictions – viz., compromising a commitment to liberal principles – is too steep to pay. (shrink)

This article argues for the utility in conceiving of two distinctive approaches to the structural power of finance—New Structural Power and Traditional Structural Power. While both are crucial to political economy scholarship, this article highlights the intellectual trade-off that is inherent to the adoption of one perspective over the other, and it stresses the explanatory advantages of the TSP perspective specifically. First, it shows how the TSP framework can facilitate an understanding of when policymaker ideas do and do not matter (...) in the exercise of structural power, retaining the concept of “automaticity” in structural power operations. Second, it demonstrates how each framework is custom-built to explain substantively different aspects of the policy process, with TSP research aimed at system-oriented limitation mechanisms and NSP research aimed at agent-oriented selection mechanisms. Third, it contends that TSP formulations must be embedded within a model of functional explanation, which is the best way to gain empirical traction on the most important macrostructural developments in contemporary finance-led capitalism. BackgroundThe globalization of medical science carries for doctors worldwide a correlative duty to deepen their understanding of patients' cultural contexts and religious backgrounds, in order to satisfy each as a unique individual. To become better informed, practitioners may turn to MedLine, but it is unclear whether the information found there is an accurate representation of culture and religion. To test MedLine's representation of this field, we chose the topic of death and dying in the three major monotheistic religions.MethodsWe searched MedLine (...) using PubMed in order to retrieve and thematically analyze full-length scholarly journal papers or case reports dealing with religious traditions and end-of-life care. Our search consisted of a string of words that included the most common denominations of the three religions, the standard heading terms used by the National Reference Center for Bioethics Literature (NRCBL), and the Medical Subject Headings (MeSH) used by the National Library of Medicine. Eligible articles were limited to English-language papers with an abstract.ResultsWe found that while a bibliographic search in MedLine on this topic produced instant results and some valuable literature, the aggregate reflected a selection bias. American writers were over-represented given the global prevalence of these religious traditions. Denominationally affiliated authors predominated in representing the Christian traditions. The Islamic tradition was under-represented.ConclusionMedLine's capability to identify the most current, reliable and accurate information about purely scientific topics should not be assumed to be the same case when considering the interface of religion, culture and end-of-life care. We argue that voluntary mental health registries integrated into the 9-1-1 system, where patients and caregivers can establish a repository of this information, will help fill this information gap by enabling first responders to quickly understand the context of a call for service with a mental health component, and to make better informed decisions. This study aimed to analyze the levels of personal aggression and victimization, ethnic-cultural aggression and victimization, self-esteem, empathy, social skills and gender in adolescents as potential predictors of bullying in Spain and Ecuador. The wide pluricultural sample comprised Secondary Education students from both countries (N = 25190, average age = 13.92, SD = 1.306; NSpain = 14437; NEcuador = 10753), who took part in the study by filling in a self-report. The results revealed that predictive models of bullying for both (...) countries explain 50-70% of variance. A transnational predictive pattern of personal victimization can be observed based on the levels of ethnic-cultural victimization, ethnic-cultural aggression, personal aggression, self-deprecation and affective empathy. A transnational predictive pattern of personal aggression is evidenced depending on the levels of ethnic-cultural aggression, personal victimization, self-deprecation, ethnic-cultural victimization and the fact of being female. We concluded that bullying can largely be predicted by involvement in ethnic-cultural discrimination. These results are discussed, and educational inferences are drawn for prevention. (shrink)

The aim of this study is to characterize the weak discussion about the Human Rights in Franco’s time, not in general, but by testing Vallet de Goytisolo’s works. This author is deeply influenced by the lectures of M. Villey, Parisinian philosopher well-known by his denial of Human Rights. A comparative study of these authors will be done focusing on two - faced aspects : the strength and fragility of their doctrines. Both authors are defined as supporters of the Methodical Realism (...) (Aristotelian-Thomist school), although their arguments and sources are very similar, their purposes and conclusions are different. Juan Vallet does not reject the Human Rights, but he prefers the denomination of ethical-legal principles, that is, moral categories that must guide the legislative and judicial praxis. The root of these ethical-legal principles is the ethical-natural principles extracted at natural order, and the duty of all authority is to adequate his rules to the nature of things, exactly as in Saint Thomas. In Vallet’s works, the theoretical reason for this rejection is that the notion of fundamental right is scientifically unsatisfactory to understand the complexity of the social reality. The practical reason defends that the Civil right should not be confused with the power or faculty of the individual, errors of nominalism, but the origin of these powers is to be found in the context of a particular legal relationship. However, in the end, this catalogue of rights will be not feasible for the citizen, since these rights are at the mercy of the legislator or the judge. They are liable to obey these principles, only morally. (shrink)

Los locos de Arlt no son producto de una desadaptación social, sino de una adaptación a las condiciones alienadas de la sociedad bonaerense por la que circulan. Madness in Los siete locos is the result of an attempt of integration into reality that is experienced by revolutionary characters, to whom that other type of sense is added; one which is openly opposed to the imperial logo that expels individuals who do not let themselves to be disciplined. Thus, in these characters there is an intensification of the insurrection and distinction from those who are disciplined. This allows the exploration of other places/non-places and also helps to map “future settings” appropriate for the emergence of the new society. En este artículo proponemos que la relación entre filosofía y poesía parte de la distinción entre ambas, pero al mismo tiempo asume su inseparabilidad. Su relación consiste en una discordia cordial. Este diálogo entre diferentes solo es posible si existe una afinidad esencial entre las dos. Esa característica común se encuentra en el lenguaje, en el hecho de que tanto la filosofía como la poesía son declaraciones de verdad en sentido ontológico. Su lenguaje no se adecua a una cosa preexistente (...) sino que él mismo pone la cosa y hace ser, o sea, declara la verdad. An emerging literature has begun to document the emotional consequences of everyday executive functions on emotional distress. Little is known, however, about whether this relation is mediated by other variables. A multiple mediation model was proposed to integrate core concepts of daily executive dysfunctions with emotional distress in order to increase understanding of their relationship to psychological well-being and emotional regulation. The working hypothesis was that dimensions of well-being and emotional regulation may be a suitable mediator. It was hypothesized that (...) dimensions of well-being and emotional regulation are a possible mediator between the executive dysfunctions and psychological distress. Participants were 122 undergraduate students from university courses in General Education and Social Education at, the Universidad Complutense de Madrid, with a mean age of 21.76. Results indicate that several dimensions of psychological well-being and emotional reappraisal strategies mediate the relationships between daily executive dysfunctions and psychological distress. El elemento teórico sólo tiene sentido cuando surge de la vida, pero ante todo la teoría sólo vale si vale para vivir. El ser humano para Ortega piensa porque vive, pero lo fundamental es que (...) piensa para vivir. Sólo los pensamientos que se alcanzan viviendo tienen valor para vivir. La meditación filosófica está siempre supeditada a la vida.The principal aim of this work is to think the concept of meditation in the Ortega y Gasset’s philosophy. For Ortega, meditation is the essence of philosophy. To meditate and to philosophize are synonymous. Philosophy isn’t simply theory, but it also implies practice. The theoretical element only makes sense when it arises from life, but above all theory only have value if it have value for life. For Ortega, human being thinks because he lives, but is fundamental that he thinks for life. Only thoughts reached by living have value for life.
