Opposition to inducement payments for research subjects is an international orthodoxy amongst writers of ethics committee guidelines. We offer an argument in favour of these payments. We also critically evaluate the best arguments we can find or devise against such payments, and except in one very limited range of circumstances, we find these unconvincing.

ABSTRACT Critical realist thought has theorised convincingly that epistemic relativism is constellationally embedded in ontological realism which in turn necessitates judgemental rationality. In social science, judgemental rationality involves acting upon plausible decisions about competing points of view. However, the tools for doing this are, as yet, under-articulated. This paper addresses this absence by articulating triangulation and depth-reflexivity as two tools for doing judgemental rationality in empirical research. It draws on the experiences of a diverse team working on an international comparative (...) research project on conversion to Islam in prisons. It demonstrates how epistemic and relational gaps between researchers and research subjects can be bridged by mobilising the ‘laminated’ properties and personal attributes of a diverse research team that factors in attributes that are absent as well as those present. The biographical experiences of the team are analyzed in a variety of intersecting dimensions: faith, ethnicity/ethno-culture, gender, class and professionality. (shrink)

ABSTRACT This article proposes a theoretical framework for thinking systematically about Muslim males’ involvement in criminality, derived from the philosophy of critical realism. This theoretical framework is deployed to explore primary data from life story interviews with 17 Muslim male offenders in a way that explains the role of structural and cultural factors, as well as individual agency, in participants’ involvement in crime at a range of ‘emergent’ ontological levels. As well as factors in common with offending by young males (...) generally, such as absent role models at home, experiences of socio-economic marginalization, the presence of hypermasculine hegemonic masculinities on the street and an inadequate experience of school, ‘unserious’ religion and ‘religious’ justifications for involvement in crime are factored into the ontology of the male Muslim offender as rendering some young Muslim males particularly vulnerable to offending. This paper provides a series of reflections on making the case to senior leaders for the introduction of clinical ethics support services within a UK hospital Trust at a time when clinical ethics committees are dwindling in the UK. The paper provides key considerations for those building a case for clinical ethics support within hospitals by drawing upon published academic literature, and key reports from governmental and professional bodies. We also include extracts from documents relating to, and annual reports of, (...) existing clinical ethics support within UK hospitals, as well as extracts from our own proposal submitted to the Trust Board. We aim for this paper to support other ethicists and/or health care staff contemplating introducing clinical ethics support into hospitals, to facilitate the process of making the case for clinical ethics support, and to contribute to the key debates in the literature around clinical ethics support. We conclude that there is a real need for investment in clinical ethics in the UK in order to build the evidence base required to support the wider introduction of clinical ethics support into UK hospitals. Furthermore, our perceptions of the purpose of, and perceived needs met through, clinical ethics support needs to shift to one of hospitals investing in their staff. Finally, we raise concerns over the optional nature of clinical ethics support available to practitioners within UK hospitals. (shrink)

The paper defends the permissibility of paying inducements to research subjects against objections not covered in an earlier paper in Bioethics. The objections are that inducements would cause inequity, crowd out research, and undesirably commercialize the researcher‐subject relationship. The paper shows how these objections presuppose implausible factual and/or normative claims. The final position reached is a qualified defence of freedom of contract which not only supports the permissibility of inducements but also offers guidance to ethics committees in dealing with practical (...) problems that might arise if inducements are offered. This article makes the case for a contemporary philosophy of Islam to help Muslims surmount the challenges of postmodernity and to transcend the hiatuses and obstacles that Muslims face in their interaction and relationships with non-Muslims. It argues that the philosophy of critical realism so fittingly underlabours for the contemporary interpretation, clarification and conceptual deepening of Islamic doctrine and practice as to suggest and necessitate the development of a distinctive Islamic critical realist philosophy, social and educational theory and world-view, specifically (...) suited for this purpose. The cladistic species concept proposed by Ridley (1989) rests on an undefined notion of speciation and its meaning is thus indeterminate. If the cladistic concept is made determinate through the definition of speciation, then it reduces to a form of whatever species concept is implicit in the definition of speciation and fails to be a truly alternative species concept. The cladistic formalism advocated by Ridley is designed to ensure that species are monophyletic, that they are objectively real entities, and that (...) they are individuals. It is argued that species need not be monophyletic in order to be real entities, and that ancestor-descendant relations are not the only relations that confer individuality on entities. The species problem is recast in terms of a futile quest for a definition of that single kind of entity to which the term species should uniquely apply. (shrink)

The philosophy of metaReality and, in particular, ideas of transcendence can ‘underlabour’ for the re-enchantment of Islamic praxis, ethics and law by helping to uncover in a systematic, non-arbitrary way the spiritual objectives inherent in the basic beliefs, practices and obligations of Islam. The commonly accepted elements of the Islamic legal pathway, such as the obligation of marriage, far from being inhibiting, can help humans access the dialectical pulse of freedom and the emancipatory meaning inherent tendentially in human relationships. The Theory Theory (TT) versus Simulation Theory (ST) debate is primarily concerned with how we understand others’ mental states. Theory theorists claim we do this using rules that are akin to theoretical laws, whereas simulation theorists claim we use our own minds to imagine ourselves in another’s position. Theorists from both camps suggest a consideration of individuals with autism spectrum disorders (ASD) can help resolve the TT/ST debate (e.g., Baron-Cohen 1995; Carruthers 1996a; Goldman 2006). We present a three-part argument that (...) such research has so far been inconclusive and that the prospects for studies of ASD to resolve the debate in the near future remain uncertain. First, we discuss evidence indicating that some individuals with ASD can perform effectively on tests of mental state understanding, which questions what ASD can tell us regarding theorising or simulation. Second, we claim that there is compelling evidence that domain-general mechanisms are implicated in mental state reasoning, which undermines how ASD might inform the TT/ST debate given that both theories appeal to domain-specific mindreading mechanisms. Third, we suggest that neuroscientific evidence for an assumed role of the mirror neuron system in autism also fails to arbitrate between TT and ST. We suggest that while the study of ASD may eventually provide a resolution to the TT/ST debate, it is also vital for researchers to examine the issues through other avenues, for example, by examining people’s everyday counterfactual reasoning with mental state scenarios. According to Hart’s concept of law one of the distinctive characteristics of a legal order is that it is sustainable on the basis of official acceptance alone. Can we go further and say that law is morally risky in the sense that it is endemically liable to become alienated from its subjects? On the basis of Hart’s weak formulation of acceptance there is nothing to suppose that acceptance and (an absence of) alienation are connected. However, on closer inspection, this weak (...) formulation is defective, failing to account for the normative and collective aspect of the law qua social norm. Pursuing a stronger notion of acceptance as a critical reflective attitude does establish a link between acceptance and (an absence of) alienation, but it fails to establish that the legal regime is, by its nature, endemically alienating in a way that a pre-legal regime is not. It does, however, help to explain why any official-centred picture of the legal regime is problematic in terms of accounting for law’s normativity. Whether alienation materializes, it is concluded, depends on the social and political factors that condition our attitude towards the law rather than on the nature of law as such. (shrink)

The multistep pathway of eukaryotic gene expression involves a series of highly regulated events in the nucleus and cytoplasm. In the nucleus, genes are transcribed into pre‐messenger RNAs which undergo a series of nuclear processing steps. Mature mRNAs are then transported to the cytoplasm, where they are translated into protein and degraded at a rate dictated by transcript‐ and cell‐type‐specific cues. Until recently, these individual nuclear and cytoplasmic events were thought to be primarily regulated by different RNA‐ and DNA‐binding proteins (...) that are localized either only in the nucleus or only the cytoplasm. Here, we describe multifunctional proteins that control both nuclear and cytoplasmic steps of gene expression. One such class of multifunctional proteins (e.g., Bicoid and Y‐box proteins) regulates both transcription and translation whereas another class (e.g., Sex‐lethal) regulates both nuclear RNA processing and translation. Other events controlled by multifunctional proteins include assembly of spliceosome components, spliceosome recycling, RNA editing, cytoplasmic mRNA localization, and cytoplasmic RNA stability. The existence of multifunctional proteins may explain the paradoxical involvement of the nucleus in an RNA surveillance pathway (nonsense‐mediated decay) that detects cytoplasmic signals (premature termination codons). Cladistic analyses are based on the distinction between primitive and derived character states (hypotheses of the polarity of evolutionary transformations) and a complete reliance on only derived character state distributions as bona fide evidence of holophyletic assemblages of taxa. The cladistic premise that only derived character state distributions provide evidence of holophyly is reconsidered and shown to be both unjustified and inconsistent with the desire or methodological prescription of using all the available evidence. Cladistic techniques are here viewed primarily as (...) methods for the ordering of character states so that they may be differentially weighted. The problem of assigning realistic differential weight to primitive and derived character state distributions is briefly discussed. One possible use of primitive character state distributions as evidence of holophyly that is largely free of the problem of weight is proposed. Many kinds of multifunctional regulatory proteins have been identified that perform distinct biochemical functions in the nucleus, the cytoplasm, or both. Here we describe the recent discovery by Hall et al. (2004)1 of a new type of multifunctional protein: a metabolic enzyme that doubles as a transcription factor. This enzyme, Arg5,6, functions as a catalytic enzyme in ornithine biosynthesis and also binds and regulates the promoters of nuclear and mitochondrial genes. Despite a long and venerable tradition, the material constitution almost disappeared from constitutional scholarship after the Second World War. Its marginalisation saw the rise of a normative and legalistic style in constitutional law that neglected the role of social reality and political economy. This paper suggests philosophical foundations for mixed methods research based on the philosophy of critical realism. In particular, it suggests that the critical realist idea of the primacy of ontology helps bridge the apparent paradigmatic gap between qualitative and quantitative research. It illustrates this foundational idea by showing why and how a multi-disciplinary team used a mixed methods approach to understand the significance of religion in prison through a multi-site study of religious conversion to Islam in prison and how this (...) gives a better account than a single method approach. The mixed method research design used in the project sets out a new way of mapping and understanding religious conversion and differences within a faith group that draws on the emancipatory potential of critical realist thought. The moral and political thought of Herbert Spencer is usually associated with some form of evolutionism. This is unsurprising, since Spencer himself thought of his ideas as founded on evolutionary theory. But it is regrettable, because no one believes in Spencer's form of evolutionism any more, and even if they did, they would not think that it supported his views in the way that he confidently believed. And so Spencer has been largely neglected since his death. His libertarianism is thought (...) to be without foundation, and so few have thought it worth study. But in this paper I try to show that Spencer's moral and political conclusions can be based on some of the non-evolutionary arguments that he offered. Although these arguments are not entirely compelling, they have force in a way that his evolutionary claims do not. (shrink)

Feng et al. now report a new function for UPF1—it is an E3 ubiquitin ligase that specifically promotes the decay of a key pro-muscle transcription factor: MYOD. UPF1 achieves this through its RING-like domain, which confers ubiquitin E3 ligase activity. Feng et al. provide evidence that the ability of UPF1 to destabilize MYOD represses myogenesis. In the future, it will be important to define (...) other protein substrates of UPF1-driven ubiquitination and to determine whether this biochemical activity is responsible for some of UPF1's previously defined biological functions, including in development and stress responses. One of the pressures placed upon researchers is the process of ethics review. This frequently provides considerable conflict. The process of review of student projects of little inherent risk is identical to that of their more senior colleagues. In this article I propose that we should be more tolerant of design problems within student research if the overall risk is minimal in order that the student can learn about the process of carrying out research.The frequency and content of papers discussing (...) research ethics review in specialist,1 professional2 3 and lay4 press suggests that many senior researchers find the process challenging. The opinion most frequently expressed is that research ethics committees work to an imprecise set of rules and represent a barrier to significant pieces of clinical research. In particular, specific criticism has been aimed at the review of student research5–8 and the difficulties that students and their supervisors face.In ethics committees we usually police research very carefully, monitoring the detail of projects, including how participants will be selected, what data will be collected, how it will be handled and how the research is funded in addition to the adequacy of the consent process and information that underlies it. My experience as a member of NHS REC and governance committees and, more particularly, coordinator of student research, is that National Research Ethics Service REC usually apply the same standards to student research with little inherent risk as to complex phase 1 studies with significant risk. Guidance in the standard operating procedures for NHS REC is at best unhelpful and at worst supportive of this view. …. (shrink)

When phylogenetic trees constructed from morphological and molecular evidence disagree (i.e. are incongruent) it has been suggested that the differences are spurious or that the molecular results should be preferred a priori. Comparing trees can increase confidence (congruence), or demonstrate that at least one tree is incorrect (incongruence). Statistical analyses of 181 molecular and 49 morphological trees shows that incongruence is greater between than within the morphological and molecular partitions, and this difference is significant for the molecular partition. Because the (...) level of incongruence between a pair of trees gives a minimum bound on how much error is present in the two trees, our results indicate that the level of error may be underestimated by congruence within partitions. Thus comparisons between morphological and molecular trees are particularly useful for detecting this incongruence (spurious or otherwise). Molecular trees have higher average congruence than morphological trees, but the difference is not significant, and both within- and between-partition incongruence is much lower than expected by chance alone. Our results suggest that both molecular and morphological trees are, in general, useful approximations of a common underlying phylogeny and thus, when molecules and morphology clash, molecular phylogenies should not be considered more reliable a priori. Current discussions on the utilization of information technologies for agriculture, place emphasis on the collection and processing of information on the farm, through the introduction and use of computers as management support in process control and database management. However, because of farm management's dependency on outside information support for the production control and market engagement, the communication of information and the improvement of its efficiency is of similar, if not greater, importance. This article, therefore, places its main focus on the (...) communication aspect. It provides a classification for “on-farm” communication patterns and highlights, using this classification, a number of European experiences with videotex applications in agriculture. It argues that new information technologies may open the way for new approaches to farm-related communication, and thus for a major change in farm management practices. For this progression to occur, its development and application should base itself upon the basic communication patterns that have evolved in practice, and reflect the actual use of information in agriculture. Recent decades have witnessed an increase in lesbian, gay, bisexual, transgender, queer and intersex visibility in the British media. Increased representation has not been equally distributed, however, as bisexuality remains an obscured sexual identity in discourses of sexuality. Through the use of diachronic corpus-based critical discourse analysis, this study seeks to uncover how bisexual people have been represented in the British press between 1957 and 2017. By specifically focusing on the discursive construction of bisexuality in The Times, the results reveal (...) how bisexual people are represented as existing primarily in discourses of the past or in fiction. The Times corpus also reveals significant variation in the lexical meaning of bisexual throughout the 60 years in question. These findings contribute to contemporary theories of bisexual erasure which posit that bisexual people are denied the same ontological status as monosexual identities, that is, homosexuality and heterosexuality. Wilkinson (1991a) developed arguments that the distributions of primitive character states may delimit clades, and proposed a method that exploited the evidence of primitive character state distributions for inferring clades. Whiting and Kelly (1995) presented a critique of these ideas, arguing that they are logically incoherent and that the method does not succeed in its aims. This critique severely misrepresents the original arguments and the method, and amounts to no more than an attack on a straw man.

This paper makes some observations for assessing faith-based social services from a sociological perspective. More specifically, it examines internal factors like the theology of the group and external factors, the political context, for understanding a Pentecostal approach in the USA. Observations are made from the Los Angeles Dream Center, a Pentecostal ministry, which is also a model for other Dream Centers throughout the world. The central argument is twofold: Pentecostals offer a unique holistic approach to mission and second, a sociological (...) approach which takes seriously the theology of a group as well as its social context provides an optic for assessing similarities and differences among faith-based social services. The Le Quesne test of character compatibility uses pairwise comparisons of characters to detect homoplasy in phylogenetic character data. If a pair of characters fails this test we can conclude that a minimum of a single extra step is required by the pair of characters. The rationale of the Le Quesne test is extended to comparisons of triplets of characters. The triplet homoplasy test can reveal that that there is a minimum of four extra steps across a triplet of characters (...) and thus that there are at least two extra steps associated with one of the characters. The triplet homoplasy test can thus detect higher orders of homoplasy than can be detected by the pairwise Le Quesne test. The possibility of quartet and other higher-order homoplasy tests is discussed. The utility of higher-order homoplasy tests is discussed. It is suggested higher-order homoplasy tests have potential uses analogous to the uses of the Le Quesne test, particularly with respect to data exploration. (shrink)

The films The Bling Ring, Spring Breakers, and Drive, were all dismissed for their depthlessness. This article argues that we need to explore the depths and variety of their engagement with surface in order to fully appreciate what these films are trying to say. The article proposes that these films in fact employ three different “strategies” of surface engagement, in and through their aesthetics; The Bling Ring relies on a sense of “skimming”, Spring Breakers engages ideas of “drifting”, while Drive (...) promotes a sense of “gliding” or “coasting”. Analysis of these strategies of surface aesthetics reveals that the films make dialectic categories of depth and surface, sign and meaning, form and content, indistinguishable, and it is precisely in doing so that they offer complex critique on the crimes they display, and the state of our current hyper-mediated and networked world. There is strong opposition in bioethics to paying research subjects. This paper, building on earlier work, gives arguments on behalf of the permissibility of payment. It develops an analogy between payment to research subjects. And payment and regulation in the labour market Few seriously oppose payment in the labour market, and the reasons to allow payment carry over to payment to research subjects. The paper then considers and rejects an alleged disanalogy, that research is special in that it involves subjects’ (...) bodies. At greater length, it assesses the argument from the gift relationship: that the value of giving is good reason not to extend market norms into research. This argument has some force in pointing out the unattractiveness of some market motivations, but those who offer it usually overlook the coordination advantages of the market. Still, the gift relationshp argument against payment has something going for it, which is more than can be said for virtually all the other major anti-payment arguments. (shrink)

Zusammenfassung Im illegalen Nierenhandel werden Verkaufer oft uber den Tisch gezogen, sie werden genotigt, es wird ihnen angemessene medizinische Betreuung vorenthalten und sie werden uber die Gefahren und die Illegalitat der Nierenentnahme in die Irre gefuhrt. Die Empfanger bezahlen oft fur qualitativ schlechte Operationen sowie ungesunde oder unpassende Nieren. Einige Autoren argumentieren, es sei die Illegalitat, die dieses Leid und dieses Unrecht verursachen, nicht der Handel an sich. Sie argumentieren, die Legalisierung von Nierenverkaufen wurde das Leid verringern. Dieses Leidensverringerungsargument ist (...) es, das in diesem Aufsatz entwickelt und untersucht wird. Es werden zunachst die ethischen und empirischen Bestandteile einer utilitaristischen Version von Leidensverringerung dargelegt. Und es wird erklart, wie eine Legalisierung das Leiden auf Schwarzmarkten vermutlich verringern wurde, aber auch, warum wir nicht wissen, wie die Legalisierung das Angebot an Organen oder die Anzahl leidvoller Transaktionen auf ‘weisen Markten’ beeinflussen wurde. Kurz gesagt, wir konnen nicht sicher sein, dass seine Legalisierung das Leiden insgesamt verringern wurde. Dennoch versucht dieser Aufsatz zu zeigen, dass die Argumentation zugunsten von einer Legalisierung gestarkt werden kann, wenn man dem utilitaristischen Hauptanliegen des aggregierten Wohlergehens etwas hinzufugt. Den besonderen Anliegen der am schlechtesten Gestellten und dem Unrecht des Verkaufsakts kann man durch Legalisierung besser gerecht werden als durch Kriminalisierung. Das Leidensverringerungsargument entscheidet diese Debatte uber die Legalisierung des Organhandels zwar nicht, aber es ist entscheidender als Kritiker bislang zugestehen wollten. (shrink)
