Marcus Arvan’s Rightness as Fairness is a highly ambitious book. In fewer than 230 pages, Arvan hopes to demonstrate that we ought to evaluate moral theories in a similar manner to the sciences, that existing moral theories fall short on that evaluation, that moral normativity reduces to instrumental rationality, and that a new theory of rightness as fairness meets the scientific evaluative standards better than any of the alternatives. Garrett Cullity contends that fairness is appropriate impartiality (See Cullity (2004) Chapters 8 and 10 and Cullity (2008)). Cullity deploys his account of fairness as a means of limiting the extreme moral demand to make sacrifices in order to aid others that was posed by Peter Singer in his seminal article ‘Famine, Affluence and Morality’. My paper is founded upon the combination of (1) the observation that the idea that fairness consists in appropriate impartiality is very vague and (2) the (...) fact that psychological studies show the self-serving bias is especially likely to infect one’s judgements when the ideas involved are vague. I argue that Cullity’s solution to extreme moral demandingness is threatened by these findings. I then comment on whether some other theories of fairness are vulnerable to the same objection. This article is on political normativity. It urges scepticism about attempts to reduce political normativity to morality. Modern liberalism leaves a question about how far morality can be accommodated by the form of normativity characteristic of politics. The article casts doubt on whether individual moral norms carry over to collective, for example, political, action, and whether the former ‘trump’ other kinds of reasons in politics. It then sketches an alternative view of politics as an irreducibly collective enterprise. Reasons for acting (...) politically, including the understandings on which perceptions of legitimacy rest, are largely artefacts of the political culture and thus only marginally subject to generic conditions of validity: this is true in particular of liberal acceptability-conditions. Why do political philosophers shy away from politics? Glen Newey offers a challenging and original critique of liberalism, the dominant political philosophy of our time, tackling such key issues as state legitimacy, value-pluralism, neutrality, the nature of politics, public reason, and morality in politics. Analyzing major liberal theorists, Newey argues that liberalism bypasses politics because it ignores or misunderstands human motivation, and elevates academic systembuilding over political realities of conflict and power.

Political disputes over toleration are endemic, while toleration as a political value seems opposed to those of civic equality, neutrality and sometimes democracy. Toleration in Political Conflict sets out to understand toleration as both politically awkward and indispensable. The book exposes the incoherence of Rawlsian reasonable pluralist justifications of toleration, and shows that toleration cannot be fully reconciled with liberal political values. While raison d'état concerns very often overshadow debates over toleration, these debates – for example about terrorism – need (...) not be framed as a conflict between toleration and security. Framing them in this way tends to obscure objectionable behaviour by tolerators themselves, and their reliance on asymmetric power. Glen Newey concludes by sketching a picture of politics as dependent on free speech which, he argues, is entailed by the demands of free association. This paper examines and criticizes the defence of toleration due to John Rawls in Political Liberalism, and similar strategies mobilized in defence of toleration. It argues that the notion of the burdens of judgement, used by Rawls to defend his doctrine of reasonable pluralism, faces incoherence: schematically, either disagreement succumbs to reason, or vice versa. On similar grounds, reasonable disagreement defences of neutrality fail because of a double-mindedness about the relation between private judgements and public reason. This problem arises, it (...) is argued, from an attempt to make private judgements determinative in the formation of political and legal outcomes, even while subjecting the latter’s justification to norms of public reason. Deference to private judgements in political justification tends to countenance sedition, and this applies also to modern liberal attempts such as Rawls’s to ground toleration in private judgements. This paper argues that close personal relationships play an important role in our judgments about what is fair. I start with an explanation of leading theories of fairness, highlighting the potential for further work on the grounds of fairness. Next, I offer an account of close personal relationships as having the ability to generate legitimate and reasonable expectations of one or other party to a judgment about fairness, or both. I show how and when close personal relationships can ground fairness.

Democratic politicians face pressures unknown to the prerogative rulers of the early modern period when toleration was first formulated as a political ideal. These pressures are less often expressed as demands by groups or individuals for the permission of practices they dislike than for their restraint or outright prohibition; tolerant dispositions are less politically clamorous. The executive structure of toleration as a virtue, together with the ‘fact of reasonable pluralism’, make conflicts over toleration peculiarly intractable. Political conflicts are apt to (...) take the form of mutual allegations ofintolerance; indeed, the problem of ‘tolerating the intolerant’, far from being a marginal case, is central to the theory and practice of toleration. Toleration thus exemplifies a category mistake committed in much contemporary political theory, particularly in its contractualist versions: the threshold of the political lies precisely where rational agreement proves impossible. The main prospects for democratic toleration are thus pre-emptive. The main way in which this can happen is by cultivating executive dispositions: in other words, encouraging people to detach themselves from strong evaluative commitments, so that toleration does not become politically contentious to start with. But this involves losses as well as gains. The gains in civil harmony and peace are obvious. The cost for tolerant political actors is alienation from what they have good reason to value. (shrink)

In much of the current academic and public discussion, conspiracy theories are portrayed as a negative phenomenon, linked to misinformation, mistrust in experts and institutions, and political propaganda. Rather surprisingly, however, philosophers working on this topic have been reluctant to incorporate a negatively evaluative aspect when either analyzing or engineering the concept conspiracy theory. In this paper, we present empirical data on the nature of the concept conspiracy theory from five studies designed to test the existence, prevalence and exact form (...) of an evaluative dimension to the ordinary concept conspiracy theory. These results reveal that, while there is a descriptive concept of conspiracy theory, the predominant use of conspiracy theory is deeply evaluative, encoding information about epistemic deficiency and often also derogatory and disparaging information. On the basis of these results, we present a new strategy for engineering conspiracy theory to promote theoretical investigations and institutional discussions of this phenomenon. We argue for engineering conspiracy theory to encode an epistemic evaluation, and to introduce a descriptive expression—such as ‘conspiratorial explanation’—to refer to the purely descriptive concept conspiracy theory. This paper asks whether political justice can be encapsulated by procedures. It examines John Rawls’s tripartite distinction between perfect, pure and imperfect procedural justice, concluding that none gives a satisfactory account of procedural justice. Imperfect procedural justice assumes that there could be an authoritative source of justice other than procedures, while perfect procedural justice takes a double-minded view of procedure-independent standards of justice. That leaves pure procedural justice as an apparently decisionistic mode of deciding which outcomes are just. This at (...) least avoids the confusion between having authoritative procedures and procedure-independent standards that are also purportedly authoritative. However, it is argued that even a political procedure that defines the extension of a term such a ‘justice’ will lack authority over it once its reference is fixed. Since Rawls’s categories of procedural justice are jointly exhaustive, the problem of determining justice via political procedures appears insoluble. (shrink)

Contingency is the presence of non-actualized possibility in the world. Fatalism is a view of reality on which there is no contingency. Since it is contingency that permits agency, there has traditionally been much interest in contingency. This interest has long been embarrassed by the contention that simple and plausible assumptions about the world lead to fatalism. I begin with an Aristotelian argument as presented by Richard Taylor. Appreciation of this argument has been stultified by a question pertaining to the (...) source of necessity and possibility and a closely related one regarding the nature of metaphysics itself. Answering these questions reveals the crucial issue here, to wit, necessity and possibility in a temporal world. This issue is investigated through an important later criticism of Taylor by David Foster Wallace. Wallace’s critique is significant because it brings to the fore the pivotal notion for understanding contingency in a temporal world, that of synchronic possibility, the idea that incompatible states of affairs are possible at a single moment. This notion provides the basis of distinguishing two systematic accounts of truth, modality and time: two metaphysics of contingency. On one account, Taylor’s Aristotelian argument is straightforwardly valid and compelling; on the other, it is fallacious. In closing, I present reasons why the former account, supporting the Aristotelian views of time and truth, is correct and make some comments to ameliorate this conclusion. (shrink)

This article deals with modus vivendi, toleration and power. On the face of it toleration and modus vivendi are in tension with each other, because of the power condition on toleration: that an agent is tolerant only if they have the power to engage in an alternative, non- or intolerant form of behaviour, and this seems to be absent in modus vivendi. The article argues that the scope of the power condition is unclear, but might be thought much more extensive (...) than usually supposed. This becomes clear when the agent’s thoughts are subjected to a counterfactual test, concerning what would occur in their ideal world. However it is in the nature of ideals that they cannot usually be subject to a counterfactual variation here, since they determine the ideal world’s content. The article concludes that only a commitment to the other party’s freedom for its own sake proves robust in the face of counterfactual idealisation, but that it is questionable whether the dispositions that characterise toleration should be subject to so demanding a test. Healthcare providers face enormous pressure to save healthcare resources where possible. In this paper I explore the response that we should allocate resources fairly. What is a fair allocation of healthcare resources for children? First, I consider the luck egalitarianism approach of limiting resources to adult patients who are responsible for their conditions. A luck egalitarian distribution of healthcare resources to adults faces significant problems in application. I maintain that when we consider these problems with a focus on the just (...) distribution of healthcare resources to children, we gain valuable insights into the fairness of healthcare allocation for adults. In this article Glen Newey defends the view that freedom of expression, and specifically free speech, enjoys special status because it is a necessary condition of politics itself. The first political question concerns the terms on which people associate with one another. This requires free speech, because in order to associate, people need to think of themselves as entering into unconstrained agreements and this demands full access to information. He considers different ways in which free speech has been understood (...) and argues that underlying classical liberal defences is a concern to protect the content rather than occasions of speech. He then applies this understanding to toleration. He argues that free speech is prior to toleration, rather than a corollary of it and considers the implications of this view for some recent controversies concerning free speech. (shrink)

For the theorists of crisis, the revolutionary state comes into existence through violence, and due to its inability to provide an authoritative katechon (restrainer) against internal and external violence, it perpetuates violence until it self-destructs. Writing during extreme economic depression and growing social and political violence, the crisis theorists––Joseph de Maistre, Juan Donoso Cortés, and Carl Schmitt––each sought to blame the chaos of their time upon the Janus-faced postrevolutionary ideals of liberalism and socialism by urging a return to pre-revolutionary moral (...) and religious values. They are united by three counterrevolutionary principles, all of which are purported to remedy revolutionary violence: traditional constitutional fidelity, the philosophy of the decision, and opposition to bourgeois liberalism. This essay is followed by the first complete English translation and publication of Donoso’s letter of October 24, 1851, which contains Donoso’s only reference to the “discussing class,” a political entity later popularized by Schmitt in his 1922 work Political Theology. The X-ray and bulk densities of PdIn alloys have been determined at ambient temperature on samples annealed at 1273 and 1373 K and quenched in water-ice mixtures. From these measurements the vacancy concentrations in this intermetallic phase have been obtained as a function of In concentration at these two temperatures. In addition, a generalized thermodynamic model is presented which considers the existence of antisite and vacancy defects on both sublattices without any dilute solution approximations. This model uses three energy parameters, (...) whose values have been obtained for PdIn using the measured vacancy concentrations and the chemical potentials of In. This model is able to describe all the available vacancy data and is suitable for calculating these values at compositions and temperatures when such data are not available. In addition, the model permits the calculation of the concentrations of the minority point defects. It is shown that dilute-solution approximations, which have invariably been used in this kind of modelling, are unsatisfactory. The present results and their analysis confirm that PdIn is a near-triple-defect type of intermetallic and not a near-Schottky type, as has been claimed recently. (shrink)
