Canada has recently published a new Clinical Practice Guideline on the diagnosis and management of brain death. It states that consent is not necessary to carry out the interventions required to make the diagnosis. A supporting article not only sets out the arguments for this but also contends that ‘UK laws similarly carve out an exception, excusing clinicians from a prima facie duty to get consent’. This is supplemented by the claim that recent court decisions in the UK similarly confirm (...) that consent is not required, referencing two judgements inBattersbee. We disagree with the authors’ interpretation of the law on consent in the UK and argue that there is nothing inBattersbeeto support the conclusion that consent to testing is not necessary. Where there is a disagreement about testing for brain death in the UK, court authorisation is required. (shrink)

Mereological principles are sometimes used to support general claims about the structure and arrangement of objects in the world. I focus initially on one such mereological principle, the weak supplementation principle (WSP). It is not obvious that (WSP) is prescribed by ordinary thinking about parthood. Further, (WSP) is not needed for a fairly strong formal characterization of the part–whole relation. For these reasons, some arguments relying on (WSP) might be countered by simply denying (WSP). In this paper, I focus on three issues intertwined in current debates between endurantists and perdurantists—(i) the dimension of persisting objects, (ii) whether persisting objects have timeless, or only time-relative, parts, and (iii) whether persisting objects have proper temporal parts. I argue that one standard endurantist position on the first issue is compatible with standard perdurantist positions on parthood and temporal parts. I further argue that different accounts of persistence depend on the claims about objects' dimensions and not on the (...) auxiliary claims about parthood and temporal parts. (shrink)

It is often assumed that indeterminacy in mereological relations—in particular, indeterminacy in which collections of objects have fusions—leads immediately to indeterminacy in what objects there are in the world. This assumption is generally taken as a reason for rejecting mereological vagueness. The purpose of this paper is to examine the link between mereological vagueness and existential vagueness. I hope to show that the connection between the two forms of vagueness is not nearly so clear-cut as has been supposed.

This paper provides an axiomatic formalization of a theory of foundational relations between three categories of entities: individuals, universals, and collections. We deal with a variety of relations between entities in these categories, including the is-a relation among universals and the part-of relation among individuals as well as cross-category relations such as instance-of, member-of, and partition-of. We show that an adequate understanding of the formal properties of such relations – in particular their behavior with respect to time – is critical (...) for formal ontology. Non-symmetric relations like loves or between can apply to the same relata in non-equivalent ways. For example, loves may apply to Abelard and Eloise either by Abelard’s loving Eloise or by Eloise’s loving Abelard. On the standard account of relations, different applications of a relation to fixed relata are distinguished by the direction in which the relation applies to the relata. But neither Directionalism nor its most popular rival, Positionalism, offer accounts of differential application that generalize to relations of arbitrary (...) symmetry structure. Here, I develop an alternative account, Relative Positionalism, which distinguishes different applications of a relation to fixed relata in terms of the ways in which the relata are characterized relative to one another. In presenting and defending Relative Positionalism, this paper covers some of the same ground as my [2016], but avoids the latter’s algebraic approach and focuses on interpretative issues—in particular, how to make sense of relative property instantiation—that were not addressed in the earlier paper. According to the prevalent 'sum view' of stuffs, each portion of stuff is a mereological sum of its subportions. The purpose of this paper is to re-examine the sum view in the light of a modal temporal mereology which distinguishes between different varieties of summation relations. While admitting David Barnett's recent counter-example to the sum view, we show that there is nonetheless an important sense in which all portions of stuff are sums of their subportions. We use our summation relations (...) to develop, as an alternative to the sum view, an analysis of stuffs that distinguisher between the ways in which different sorts of stuffs are sums of their subportions. We propose an ontological theory that is powerful enough to describe both complex spatio-temporal processes and the enduring entities that participate therein. For this purpose we introduce the notion a directly depicting ontology. Directly depicting ontologies are based on relatively simple languages and fall into two major categories: ontologies of type SPAN and ontologies of type SNAP. These represent two complementary perspectives on reality and employ distinct though compatible systems of categories. A SNAP (snapshot) ontology comprehends enduring entities such as (...) organisms, geographic features, or qualities as they exist at some given moment of time. A SPAN ontology comprehends perduring entities such as processes and their parts and aggregates as they unfold themselves through some temporal interval. We give an axiomatic account of the theory of directly depicting ontologies and of the core parts of the metaontological fragment within which they are embedded. (shrink)

The relationship between students and higher education is seen to have become increasingly transactional. We approach the study of the student–HE relationship in a novel way, by focusing on students’ behaviour post-university, rather than on student narratives. Conceptually, the article builds on multidimensional views of student engagement and the differentiation between psychological transactional contracts – where students who achieve better academic results are more likely to donate – and relational contracts – where students donate more following engagement in social experiences. Making use of longitudinal data on donation behaviour from over 50,000 alumni from an English university over two decades, we find that while students who get better degree outcomes are more likely to donate, the association between participation in social experiences and donations is much stronger. This questions prevalent transactional models of HE and underlines the limitations of purely consumerist views of the relation between students and higher education institutions, even in the marketized UK context. Standard theories in mereotopology focus on relations of parthood and connection among spatial or spatio-temporal regions. Objects or processes which might be located in such regions are not normally directly treated in such theories. At best, they are simulated via appeal to distributions of attributes across the regions occupied or by functions from times to regions. The present paper offers a richer framework, in which it is possible to represent directly the relations between entities of various types at different levels, (...) including both objects and the regions they occupy. What results is a layered mereotopology, a theory which can handle multiple layers (analogous to the layers of a lasagna) of spatially or spatiotemporally coincident but mereologically non-overlapping entities. In fields such as medicine, geography, and mechanics, spatial reasoning involves reasoning about entities that may coincide without overlapping. Some examples are: cavities and invading particles, passageways and valves, geographic regions and tropical storms. The purpose of this paper is to develop a formal theory of spatial relations for domains that include coincident entities. The core of the theory is a clear distinction between mereotopological relations, such as parthood and connection, and relative location relations, such as coincidence. Newton distinguishes between absolute and relative places. Both types of places endure through time and may be occupied by various objects at various times. But unlike absolute places, each relative place stands in fixed spatial relations with one or more reference objects. Relative plac-es with independent reference objects (e.g. a ship and the earth) may move relative to one another. Relative places, not absolute places, are used to locate objects and track their movements in common-sense reasoning and in disciplines such (...) as biology, engineering, and geology. The decision of the House of Lords in Gillick v West Norfolk Area Health Authority carved out a safe space for competent minors to confidentially access sexual and reproductive health care and advice in the UK. Ireland is one of the few common law jurisdictions that has not endorsed Gillick or a similar mature minor doctrine, nor has it securely legislated for the right to consent of those aged 16 and 17 years. The legal lacuna created by this deficiency has (...) left young persons in Ireland seeking sexual and reproductive healthcare, and the clinicians who provide this, in a challenging place. While this void has been partially filled with policy statements by bodies such as the Irish College of General Practitioners and the Health Service Executive, nonetheless the legal shortcomings leave both a sense of insecurity, and real world difficulties for adolescents seeking to access to sexual and reproductive healthcare. This article discusses the conceptualisation, organisation and philosophical orientation of academic history culture in UK higher education. It problematises the extent to which a dominant history culture in UK universities implies and uncritically reproduces normative understandings about the subject; about its epistemological standing, sociopolitical functions, and the presumed cultural value of the discipline practices that students learn to perform. We suggest that current conceptions of history degree curricula are overly thin and organised around a dominant managerialist discourse of skills, personal (...) development and learning outcomes. In a historicised world, in which history-focused behaviour has a crucial, ideological, affirmatory role, and in which historical narratives have a privileged cognitive function, we argue that it is critical for university history students to be able to deconstruct the processes by which history legitimises itself, and reinforces matrices of power in our societies. The positioning of history in higher education as a form of technocratic managerialism closes down spaces in which students can explore the potential of historical practices as a means of engaging with issues of current sociopolitical and ethical concern. The theory of granular partitions is designed to capture in a formal framework important aspects of the selective character of common-sense views of reality. It comprehends not merely the ways in which we can view reality by conceiving its objects as gathered together not merely into sets, but also into wholes of various kinds, partitioned into parts at various levels of granularity. We here represent granular partitions as triples consisting of a rooted tree structure as first component, a domain satisfying (...) the axioms of Extensional Mereology as second component, and a mapping (called ’projection’) of the first into the second as a third component. We define ordering relations among granular partitions the resulting structures are called partition frames. We then introduce an axiomatic theory which sentences are interpreted in partition frames. The Cayman Turtle Farm is the only facility in the world that commercially produces green sea turtles for human consumption. The CTF has operated at a significant financial loss for much of its 45 years history and is maintained by substantial Cayman Island Government subsidies. These subsidies run into millions of Caymanian dollars and dwarf the funding allocated to The Caymanian Department of Environment to protect its unique biodiversity each year. We argue that it is time for the CTF to (...) terminate its sea turtle ‘farming’ initiative. Supporters argue that the CTF helps to conserve green turtles by providing legal and sustainable turtle meat for local Caymanian consumption. Opponents maintain that farmed turtle meat cannot serve as an effective economically viable substitute, and that the facility potentially harms Caribbean green turtle populations by promoting turtle meat consumption, when other Caribbean nations increasingly prohibit this practice. The CTF’s records demonstrate that commercial production has come at the expense of tens of thousands of sea turtles. We question the ethics of sea turtle farming and argue that the CTF could better contribute to conservation if it transitioned into a rehabilitation, research and education facility . Recommended first steps include prohibiting the sale of sea turtle products to international tourists, engaging with stakeholders, and assessing the true scale of local consumer demand for green turtle meat. This paper identifies the difficulties in confronting novel history from both a rigorous scientific and artistic literary perspectives and suggests a practical reconciliation—in the form of a discussion and metaphorical opening space—between the two apparent poles of historical understanding and their accompanying genres, types, and tropes.

This paper is an adventure of ideas. More specifically, it is a continuation of the adventure of ideas concerning the relations between creativity and logic at the level of being one finds in the work of Whitehead and his interpreters/inheritors. The “argument” of the paper, such as it is, is that ontological creativity may be fruitfully described by two logical functions, one exploding the movement from possibility to actuality, and the other from actuality to possibility. The paper explores both functions, (...) or “senses,” as fruitful ways of understanding ontological creativity, especially within processual thought. The two senses of creativity, the paper also argues, ought to be understood as primitive and inexorably “together.”. (shrink)
