This study of the Jewish legal system (the Halakhah) demonstrates that the law embraces every corner of life.

Investigation into the history of the Talmud was sparked by the Karaite rebellion against the authority of the Talmud at the beginning of the eighth century. The most influential work of Talmudic chronology is the Iggeret de-Rav Sherira Gaon , composed in 986, which sought to explain how the Mishnah and the Talmud were compiled, and demonstrate the unbroken chain of the tradition. Maimonides gives a summary of the history of the tradition in his Commentary to the Mishnah. Although Maimonides' (...) reconstruction is an artificial one, with no attempt to verify sources or test their reliability, he stated that the Babylonian Talmud was compiled about one hundred years after the Jerusalem Talmud; in cases of disagreement, therefore, the rulings of the Babylonian Talmud were the ones adopted by the post-Talmudic Halakhah. The French glossators, or Tosafists, argued that a law in the Talmud could be changed when the original circumstances in which it was promulgated were no longer evident. More objective, critical historical accounts have been given by more modern scholars, particularly Yon Tov Lippmann Heller, Jeheil Heilprin, and Hayyim Joseph David Agulai. (shrink)

Objective: Individually, vision and hearing impairments have been linked to higher levels of anxiety and depression. We investigated the effect of dual sensory impairment in a large representative sample of Spanish adults. Methods: Data from a total of 23,089 adults from the Spanish National Health Survey 2017 were analyzed. Self-reported difficulty of seeing and hearing, and depression and chronic anxiety were analyzed. Multivariable logistic regression was assessed for difficulty with vision alone, hearing alone and with difficulty with both, adjusting for (...) gender, age, marital status, living as a couple, education, smoking, alcohol consumption, BMI, physical activity, use of glasses/contact lenses, and hearing aid. Results: Visual difficulty, hearing difficulty, and dual difficulties were all associated with significantly higher odds for depression and for chronic anxiety. Dual sensory difficulty was associated with higher odds ratios for depression and anxiety when compared to either impairment alone. Conclusion: Dual sensory difficulty is associated with significantly higher odds of anxiety and depression when compared to either vision or hearing difficulty alone. Appropriate interventions are needed to address any reversible causes of vision and hearing as well as anxiety and depression in people in these specific groups. (shrink)

This study considers Paul Ricoeur’s theory of discourses within the context of a phenomenology of religion. I focus on the eighth study of La métaphore vive, wherein Ricoeur explores the possibility of interanimation between speculative and poetic discourses. While Ricoeur is willing to consider the interactions between religious and philosophical discourse in a number of essays, he does not develop the further possibility of the interanimation between religious and speculative thought. I take up this unexplored possibility by suggesting that metaphors (...) are capable of slipping between discourses and animating speculative and religious discourses. Specifically, I use Jean-Louis Chrétien’s metaphor of “wounding” as a case study wherein the phenomenal form of paradox defines one meaning of wounding, while another meaning is connected to a poetic expression that refers to our belonging in the world. Together, the two meanings of the metaphor enliven Chrétien’s phenomenology of religion. (shrink)

Il s'avère que des nombreuses lectures sur le problème du mal précèdent et suivent immédiatement la publication des Recherches sur la liberté humaine. La lecture de Jacob Böhme y est attestée; mais il s'agit d'une présentation populaire de la doctrine de Böhme. En fait, l'ouvrage annoté par Schelling est un gros opuscule intitulé Hirtenbrief an die wahren (...) und ächten Freymäurer alten Systems, anonyme paru en 1785, dont le contenu est une « mise en système » de la doctrine de Böhme, c'est-à-dire une rationalisation stricte de cette philosophie. Schelling, lisant cet opuscule en a supprimé tout élément proprement théosophique pour ne garder que le côté spéculatif, sans référence précise à la révélation chrétienne. Il n'y a encore aucune christologie chez Schelling, alors même qu'est présent le schème de la connexion de la liberté et du mal. The Notebook of Schelling concerning his readings in the year 1809 is to be compared with the diary of Schelling in the same year. A number of readings about the problem of evil precedes and succeeds the publication of Untersuchungen über das Wesen der menschlichen Freiheit (1809). The reading of Jacob Böhme is attested in this Notebook; but it is a popular presentation of the boehmist doctrine. It is a fact that Schelling annotated a big opuscule called Hirtenbrief an die wahren und ächten Freymäurer alten Systems, anonymously published in 1785; the contents of this book is a systematisation of the boehmist doctrine, a strict rationalisation of this philosophy. Schelling, studying this opuscule, has suppressed any elements specifically theosophic, and has retained only the speculative elements without any references to the Christian Revelation. There is not yet any christology in Schellingian thinking, even if the scheme of the connexion of liberty and evil is present. Evil is a necessary moment in the Creation, because without it God cannot reveal himself. The evil is the anger of God, suffering and illness; it does not proceed from the man, but it reveals the unhappy melancoly of the created existence. (shrink)

In this article first appeared in 1997, Jean-Louis Chrétien examines the meaning of prayer in Kierkegaard’s writings and existence. By focusing on the difficulties of this task and with meticulous attention to the vast work of the Danish philosopher, Chrétien describes prayer as a tense and agonistic experience, akin to the evangelical struggle between Jacob and the angel. Just like in his well-known phenomenological analysis, “The Wounded Word: Phenomenology of Prayer”, the author identifies in prayer a paradoxical articulation (...) of struggle and peace, gift and endeavour, speaking and listening, through which the human being is profoundly transformed and finally learns to truly say “thank you”. Diauxie is at the origin of research that led Jacques Monod, François Jacob, and André Lwoff to win the Nobel Prize in Physiology or Medicine in 1965 for their description of the first genetic regulatory model. Diauxie is a term coined by Jacques Monod in 1941 in his doctoral dissertation that refers to microbial growth in two phases. In this article, we first examine Monod’s thesis to demonstrate how and why Monod interpreted diauxie as a phenomenon of enzyme inhibition (...) or suppression of adaptive enzymes. We also briefly investigate prior enzyme suppression studies, before Monod’s work, which indicate that he is the first person to observe diauxic growth. Second, we analyse Monod’s post-thesis publications throughout his scientific career, revealing that diauxic inhibition was a significant part of Monod’s scientific activities and greatly fascinated Monod until the end of his life. Paradoxically, Monod’s work and interest on diauxic inhibition are still neglected in historical recounts, focused mostly on Monod’s enzymatic adaptation studies. Indeed, we uncovered a statement by Monod’s colleague, Lwoff, who transformed a quotation from Monod by replacing the word phenomenon with enzymatic adaptation, which we believe has influenced historians. Finally, we offer hypotheses to explain why Lwoff altered Monod’s statement. (shrink)

If Justice Louis Brandeis were alive to witness San Francisco’s recent experiment with universal health care legislation, he might amend his famous characterization of the states as “laboratories of democracy” to include municipalities as well. In San Francisco, where ten percent of residents have no health insurance and where fifteen percent of businesses provide no health coverage for their employees, the Board of Supervisors recently passed the San Francisco Health Care Security Ordinance, which funds a network of primary care (...) services for uninsured residents. While the Ordinance has, in the main, met with general approval, its provision mandating contributions from local businesses that do not meet minimum health spending requirements is the subject of ongoing litigation. The Ninth Circuit Court of Appeals recently ruled in the city’s favor, thereby allowing the spending provision to go forward pending a full appeal on the merits of the case. (shrink)

Treating mathematical science as a distinct cultural entity subject to environmental factors which influence its evolution, the author examines the creation and development of its major concepts since early times.

Empathy remains poorly understood, under-theorized, and subject to conflicting and opportunistic uses. Its systematic role in human experience has not been analyzed and interpreted from top to bottom. In this book, the author attempts to provide such an analysis in the philosophical traditions of hermeneutics, phenomenology, analytic philosophy of language, and psychoanalysis. applying his interpretation of empathy to the philosophical issues of intentionality, the emotions, and the checkered transformations of empathy itself. In doing so the author aims to rescue empathy (...) from the margins of intelligibility and reveal its central role in our understanding of the emotions, the integrity of our relations with others, and human community (“intersubjectivity”). -/- The work draws on both the Anglo-American (“analytic”) tradition of ordinary language philosophy and the continental ones of phenomenology and hermeneutics. This work follows the movement of empathy from the periphery of ethics, aesthetics, and theory of mind to a key place in establishing and maintaining the integrity and emotional equilibrium of dynamic interrelations with other individuals. Beginning with the philosophical infrastructure of the hermeneutics of empathy, this work thoroughly explains the complex architecture of empathy, tracing it downward through the levels of authentic human interrelations, empathy with unexpressed emotions, the empathic penetrability of cognitively impenetrable affect, the first-ever intentional analysis of both the empathizer and the “empathasand” in interrelation, and the hermeneutic infrastructure. The consequences of empathy are exposed in the context of the emotions, cognitive impenetrability, empathy and altruism, and the intentionality of empathy as accessed through language and story telling. Drawing on the multi-method approach of hermeneutics, phenomenology, and story telling, this work demonstrates that empathy forms the foundation for community in ways not clearly appreciated in the on-going debate. In a bootstrap operation that is guided by Heidegger’s call for a “special hermeneutic of empathy,” this work achieves a delicate balancing act of unpacking the rich intellectual traditions from which empathy - the phenomenon itself, not the concept - emerged historically. The result is an exposure of the deep structure of empathy as a fundamentally human capability for creating possibilities of community and human relations. (shrink)

A milestone in the development of post-war Marxist thought.

In The Border between Seeing and Thinking, Ned Block argues that the distinction between perception and cognition should be grounded in representational format. I object that cognition is multifaceted, and includes representations with the same format as some perceptual representations. We can save Block’s view by interpreting it as concerning the border between one elite species of cognition—namely, propositional thought—and everything below it, including perception. But that leaves the border between perception and cognition in general unexplained. To fill this gap, (...) I recommend my stimulus-dependence account of the border and reply to objections Block raises against it. This brings into relief a category of mind that is crucial to understanding human infants and nonhuman animals—namely, nonpropositional cognition, which sits between perception and propositional thought. According to the Generality Constraint, mental states with conceptual content must be capable of recombining in certain systematic ways. Drawing on empirical evidence from cognitive science, I argue that so-called analogue magnitude states violate this recombinability condition and thus have nonconceptual content. I further argue that this result has two significant consequences: it demonstrates that nonconceptual content seeps beyond perception and infiltrates cognition; and it shows that whether mental states have nonconceptual content is largely an empirical matter determined by the (...) structure of the neural representations underlying them. An astonishing volume and diversity of evidence is available for many hypotheses in the biomedical and social sciences. Some of this evidence—usually from randomized controlled trials (RCTs)—is amalgamated by meta-analysis. Despite the ongoing debate regarding whether or not RCTs are the ‘gold-standard’ of evidence, it is usually meta-analysis which is considered the best source of evidence: meta-analysis is thought by many to be the platinum standard of evidence. However, I argue that meta-analysis falls far short of that standard. Different meta-analyses (...) of the same evidence can reach contradictory conclusions. Meta-analysis fails to provide objective grounds for intersubjective assessments of hypotheses because numerous decisions must be made when performing a meta-analysis which allow wide latitude for subjective idiosyncrasies to influence its outcome. I end by suggesting that an older tradition of evidence in medicine—the plurality of reasoning strategies appealed to by the epidemiologist Sir Bradford Hill—is a superior strategy for assessing a large volume and diversity of evidence. Matteo Ricci (1552-1610) was an Italian Jesuit and one of the first Christian missionaries to China in the modern era. He was a genuine polymath—a translator, cartographer, mathematician, astronomer, and musician. Above all, Ricci was a missionary for the gospel. As we briefly examine his 1603 seminal work, The True Meaning of the Lord of Heaven, our hope is that we, as evangelical educators, will perceive some of the deeper principles necessary for our own missionary work among unreached people.

Formal principles governing best practices in classification and definition have for too long been neglected in the construction of biomedical ontologies, in ways which have important negative consequences for data integration and ontology alignment. We argue that the use of such principles in ontology construction can serve as a valuable tool in error-detection and also in supporting reliable manual curation. We argue also that such principles are a prerequisite for the successful application of advanced data integration techniques such as ontology-based (...) multi-database querying, automated ontology alignment and ontology-based text-mining. These theses are illustrated by means of a case study of the Gene Ontology, a project of increasing importance within the field of biomedical data integration. (shrink)

This article analyses 2001 in terms of what I term paleofuturism. Fusing deep future and deep past, this cyclical figure reconciles rational machinic intelligence with diverse repressed temporal layers: archaic cultures, the embryonic state of individuals, and bygone biological and geological eras. In 2001, paleofuturism is nourished by Nietzsche’s Übermensch of the future, reborn as a child, and by Jungian ideas of individuation, the reconciliation with the shadow of the collective unconscious that leads to the black cosmos itself. Further paleofuturist (...) contexts for 2001 are explored in the so-called “ancient astronaut thesis” of science fiction, speculative science, and pseudo-science. Finally, in minimalism and earth art of the late 1960s we meet a structural parallel to 2001’s bypassing of the organic human body, one that bridges the inorganic entropic realities of deep future and deep past. Departing from Duchamp’s advice in 1961 of finding the “com- mon factor” between the non-representative and the representa- tive, translated here into modernism and avant-garde, this article seeks to understand the readymades as objects that have passed metaphorically through Duchamp’s magnum opus, the unfinished Large Glass. More precisely, the readymades are seen as mass-produced utensils that have been stripped bare of their usual function, i.e. their actualization, in order to regain potentiali- ty. Mapping Giorgio Agamben’s interpretation of Herman Melville’s short (...) story Bartleby, the Scrivener onto the readymades, this shrink-to-expand strategy is understood as a skeptical suspen- sion of judgment, epoché, comparable to Bartleby’s polite refusal to work. Moreover, it is seen as equivalent to the down-scaling of dimensionality observed in the Large Glass, where transparency in one go eliminates the representation of spatial circumstances and opens up the objects toward the ever-changing physical surround- ings, thereby exposing more of those 4-dimensional projections, which are normally suppressed in our reduced 3-dimensional per- ception of the world. The need for quantitative measurement represents a unifying bond that links all the physical, biological, and social sciences. Measurements of such disparate phenomena as subatomic masses, uncertainty, information, and human values share common features whose explication is central to the achievement of foundational work in any particular mathematical science as well as for the development of a coherent philosophy of science. This book presents a theory of measurement, one that is "abstract" in that it is concerned with highly general axiomatizations (...) of empirical and qualitative settings and how these can be represented quantitatively. It was inspired by, and represents a generalization and extension of, the last major research work in this field, Foundations of Measurement Vol. I, by Krantz, Luce, Suppes, and Tversky published in 1971. Can we describe certain sonic experiences as “homely,” even when they take place outside of a traditional home-space? While phenomenological accounts of home abound, with writers detailing a rich spectrum of the felt characteristics of the homely including safety, familiarity, and affective “warmth,” there is a scarcity of research into sonic experience that engages with such literatures. With specific interest in the experience of embodied space, I account here for what might be termed feelings of “sonic homeliness” as they emerge (...) during headphone listening. After forming a conceptual model of homeliness that draws from phenomenological philosophy, I investigate its applicability to experiences of headphone listening. Through analysis of primary interview data, I consider how headphones may be said to territorialize space for listeners, analyzing how sonic “boundaries” are experienced in relation to the body, as well as how some listeners describe their experiences as interiorized, comforting, and “wombic.”. Building on Christopher Peacocke’s account of analog perceptual contentand my own account of analog perceptual vehicles, I defend three claims: that theperception of magnitudes often has analog contents; that the perception of magni-tudes often has analog vehicles; and that the first claim is true in virtue of the second—that is, the analog vehicles help to ground the analog contents.

A background assumption in much contemporary political philosophy is that justice is the first virtue of social institutions, taking priority over other values such as beneficence. This assumption is typically treated as a methodological starting point, rather than as following from any particular moral or political theory. In this paper, I challenge this assumption. To frame my discussion, I argue, first, that justice doesn’t in principle override beneficence, and second, that justice doesn’t typically outweigh beneficence, since, in institutional contexts, the (...) stakes of beneficence are often extremely high. While there are various ways one might resist this argument, none challenge the core methodological point that political philosophy should abandon its preoccupation with justice and begin to pay considerably more attention to social beneficence—that is, to beneficence understood as a virtue of social institutions. Along the way, I also highlight areas where focusing on social beneficence would lead political philosophers in new and fruitful directions, and where normative ethicists focused on personal beneficence might scale up their thinking to the institutional case. A stereotype is a belief or claim that a group of people has a particular feature. Stereotypes are expressed by sentences that have the form of generic statements, like “Canadians are nice.” Recent work on generics lends new life to understanding generics as statements involving probabilities. I argue that generics (and thus sentences expressing stereotypes) can take one of several forms involving conditional probabilities, and these probabilities have what I call a naturalness requirement. This is the natural probability theory of (...) stereotypes. Each of the two components of the theory entails a family of fallacies that contributes to the spurious reinforcement of stereotypes: inferential slippage within and between the different generic forms, and inferential slippage from facts about frequencies of group traits to beliefs about natural propensities or dispositions of groups. Empirical research suggests that we often commit these fallacies. Moreover, this theory can referee a vitriolic debate between some psychologists, who hold that stereotypes are always false and stereotyping is always wrong, and other psychologists, who hold that stereotypes are often accurate and stereotyping is often reasonable. According to an influential view, one function of mirror neurons (MNs), first discovered in the brain of monkeys, is to underlie third‐person mindreading. This view relies on two assumptions: the activity of MNs in an observer’s brain matches (simulates or resonates with) that of MNs in an agent’s brain and this resonance process retrodictively generates a representation of the agent’s intention from a perception of her movement. In this paper, I criticize both assumptions and I argue instead that the activity (...) of MNs in an observer’s brain is enhanced by a prior representation of the agent’s intention and that their task is to predictively compute the best motor command suitable to satisfy the agent’s intention. Critics of commodification often claim that the buying and selling of some good communicates disrespect or some other inappropriate attitude. Such semiotic critiques have been leveled against markets in sex, pornography, kidneys, surrogacy, blood, and many other things. Brennan and Jaworski (2015a) have recently argued that all such objections fail. They claim that the meaning of a market transaction is a highly contingent, socially constructed fact. If allowing a market for one of these goods can improve the supply, access or (...) quality of the good, then instead of banning the market on semiotic grounds, they urge that we should revise our semiotics. In this reply, I isolate a part of the meaning of a market transaction that is not socially constructed: our market exchanges always express preferences. I then show how cogent semiotic critiques of some markets can be constructed on the basis of this fact. (shrink)

In 1655 La Peyrère was the first to substantially argue for and popularize polygenism—the view that God created multiple original human mating pairs in separate acts of creation with numerous created before Adam. Positing or rejecting polygenism has been central to modern theorizing about human types and origins. Prominent recent interpreters have maintained that La Peyrère’s polygenism does not imply a hierarchy of human types. This paper reconstructs La Peyrère’s account and, in opposition to the dominant view, argues that his (...) polygenism produces a human species hierarchy. The Adamite species is superior to the Pre-Adamite species in virtue of its material composition, mode of creation, and form. The upshot is that La Peyrère’s theological system posits a proto-racialist conception of human types. (shrink)

Susan Carey's account of Quinean bootstrapping has been heavily criticized. While it purports to explain how important new concepts are learned, many commentators complain that it is unclear just what bootstrapping is supposed to be or how it is supposed to work. Others allege that bootstrapping falls prey to the circularity challenge: it cannot explain how new concepts are learned without presupposing that learners already have those very concepts. Drawing on discussions of concept learning from the philosophical literature, this article (...) develops a detailed interpretation of bootstrapping that can answer the circularity challenge. The key to this interpretation is the recognition of computational constraints, both internal and external to the mind, which can endow empty symbols with new conceptual roles and thus new contents.
