Home-dialysis has clear health, societal and economic benefits yet service usage is low (...) despite efforts to realign resources and educate individuals. Current research on the determinants of modality selection is superficial and insufficient to capture the complexities embedded in the process of dialysis modality selection. Predictors of home-dialysis selection and the effect of chronic kidney disease educational programmes provide a limited explanation of this experience. A re-conceptualization of the problem is required in order to fully understand this process. The epistemology and ontology of critical realism guides our knowledge and methodology particularly suited for examination of these complexities. This approach examines the deeper mechanisms and wider determinants associated with modality decision making, specifically who chooses home dialysis and under what circumstances. Until more is known regarding dialysis modality decision making service usage of home dialysis will remain low as interventions will be based on inadequate epistemology. (shrink)

Satz posed the term "legal gerrymandering for human interest," referring to the redrawing of the natural baseline of protections for other animals to further human use of them. One of the domains where this exists most clearly is in scientific research on animal models. An animal model is sufficiently like humans in anatomy, physiology, or psychology to be used in research considered too harmful or risky for humans. This article explores the life and work of Emma Goldman to formulate a radical critique of intimacy. Goldman’s theory of sexual freedom and revolutionary love offers a feminist vision that challenges contemporary debates concerning uses of the language of feminine desire. Goldman appealed to ideals of feminine instinct and feminine desire in order to challenge the conventional meanings attached to femininity in her day. Her views on marriage, love, sexuality and the feminine are analysed alongside her writings on her own (...) personal experience, in order to illuminate the continuing paradoxes feminists face in regard to definitions and experiencesof femininity. One of the mammalian groups absent from the Finlay et al. study is cetaceans (dolphins, whales, and porpoises). Inclusion of cetaceans would be useful for assessing the generalizability of the authors' conclusions. Recent findings suggest dolphins may differ from the general pattern observed by Finlay et al. I encourage Finlay and her colleagues to include developmental neurobiological data on cetaceans, when available.

Smith et al. propose that the most parsimonious explanation for identical responses of humans and nonhumans under the same conditions is not always the simplest cognitive explanation but could be the one that has the most logical consistency across species. The authors provide convincing evidence and a reasonable argument for declarative consciousness as a shared psychological property in humans, monkeys, and dolphins.

This book is one of the definitive accounts of Steiner-Waldorf education by the founder of the first Waldorf School in the UK. In clear and insightful terms, Cecil Harwood presents the heart of this unique approach to children's development, learning and wellbeing as a much-needed antidote to modern educational methods. Some bioethicists argue that conscientious objectors in health care should have to justify themselves, just as objectors in the military do. They should have to provide reasons that explain why they should be exempt from offering the services that they find offensive. There are two versions of this view in the literature, each giving different standards of justification. We show these views are each either too permissive (i.e. would result in problematic exemptions based on conscience) or too restrictive (i.e. would (...) produce problematic denials of exemption). We then develop a middle ground position that we believe better combines respect for the conscience of healthcare professionals with concern for the duties that they owe to patients. Our claim, in short, is that insofar as objectors should have to justify themselves, they should have to do it according to the standard that we defend rather than according to the standards that others have developed. Scholarly learning as engagement with beauty. Three evocative images of aesthetic experience come to light in the essays by Custodero, Hansen, and Neumann. From the musical play of children conducting imaginary orchestras to the vocational aspirations of adults who gaze through telescopes or study paintings at Chicago's Art Institute, aesthetic experience spans a range of activities (...) and ages. No matter the setting or moment, aesthetic experience vitalizes our lives with meaning and joy. Why this is so and what difference this makes for education emerge as overarching concerns in this set of papers. Addressing these issues, the authors articulate a number of commonthemes and reach similar conclusions about the nature and value of aesthetic experience.I want to identify and analyze key ideas that run throughout these essays. Doing so deepens our appreciation of the authors' insights and underscores the importance of the project they undertake. I also want to examine three questions that the essays suggest but do not develop. Exploring these questions, I hope to further enrich our understanding of aesthetic experience and its place in education.First and foremost, aesthetic experience for all three authors integrates multiple ways of knowing and enables individuals to perceive connections that they might otherwise overlook. This volume expands the concept and role of the schema, with three goals in mind: 1) to outline the continuing issues in the schema concept as the legacy of Kant's concept and analysis, 2) to show that Kant's challenges resulted in successful but truncated views of the schema and its functions, 3) to reconstruct Otto Selz's schema concept by proposing an alternative. The basis and scope of Selz's schema were intended to yield a more complete follow-up to Kant's challenges. Sel'z concepts-'anticipatory schema,' 'coordinate relations,' and 'knowledge complex'-are more inclusive and psychologically dynamic than those of the influential but reductionist theorists: Piaget, Bartlett, and Craik. Harwood Fisher explores Sel'z ideas in past, present, and future temporal contexts. His predecessors' and his contemporaries' ideas influenced him. Abstract:Shareholders’ relationship to the firm is a central theme in corporate governance, yet the investors’ perspective has been virtually ignored in governance research. This paper attempts to explain the previously unexplored role of trust in the investor decision-making process. The proposed model suggests that trust acts as the antecedent of the risk variable in existing investor decision-making models. Stock ownership involves both financial and ethical risk, which by definition requires some level of implicit trust in management and the market.

Recent, groundbreaking work in neuroscience has illuminated sex differences that could have a profound impact on business organizations. Distinctions between the sexes that may have previously been presumed to be due to “nurture” may now also be demonstrably related to “nature.” Here, we report recent neuroscience findings related to males’ and females’ brain structures and brain chemistry, along with the results of recent neuroeconomic studies. We learn not only that male and female brains are structured differently, but also that different (...) portions of their brains are used for the same tasks, often leading to identical conclusions. Neuroeconomic studies also demonstrate that the effects of hormones—most notably, oxytocin and testosterone—urge males and females to both think and behave differently in ethical situations. We suggest that examination of these new results could benefit six areas of business ethics research: trust, moral decision-making, organizational justice, moral development, the ethic of care, and female management styles. We conclude with a discussion of the implications of these findings for business practice, suggesting that it may be ethical to allow men and women to be treated differently in the workplace: such treatment may be advantageous not only for the workers’ firms, but also for the workers themselves. BackgroundMedical aid in dying was introduced in Quebec in 2015. Quebec clinical guidelines recommend that MAiD be approached as a last resort when other care options are insufficient; however, the law sets no such requirement. To date, little is known about when and how requests for MAiD are situated in the broader context of decision-making in end-of-life care; the timing of MAiD raises potential ethical issues.MethodsA retrospective chart review of all MAiD requests between December 2015 and June 2017 at two (...) Quebec hospitals and one long-term care centre was conducted to explore the relationship between routine end-of-life care practices and the timing of MAiD requests.ResultsOf 80 patients requesting MAiD, 54% received the intervention. The median number of days between the request for MAiD and the patient’s death was 6 days. The majority of palliative care consults came less than 7 days prior to the MAiD request and in another 25% of cases occurred the day of or after MAiD was requested. 35% of patients had no level of intervention form, or it was documented as 1 or 2 at the time of the MAiD request and 19% were receiving life-prolonging interventions.InterpretationWe highlight ethical considerations relating to the timing of MAiD requests within the broader context of end-of-life care. Whether or not MAiD is conceptualised as morally distinct from other end-of-life options is likely to influence clinicians’ approach to requests for MAiD as well as the ethical importance of our findings. We suggest that in the wake of the 2015 legislation, requests for MAiD have not always appeared to come after an exploration of other options as professional practice guidelines recommend. (shrink)

ITC technologies have come to comprehensively represent images and expectations of the future. Hopes of ongoing progress, economic growth, skill upgrading and possibly also democratisation are attached to new ICTs as well as fears of totalitarian control, alienation, job loss and insecurity. Currently, with the terms "Industry 4.0." and ‘Fourth Industrial Revolution”, public institutions, private institutions, and literature refer to the inchoate transformation of production of goods and services resulting from the application of a new wave of technological innovations: interconnected (...) collaborative robots; machine learning; Artificial Intelligence; 3D printers connected to digital development software; simulation of interconnected machines; integration of the information flow along the value chain; multidirectional communication between manufacturing processes and products. According to the main representations of Industry 4.0. by private and public institutions, its effects are expected to be mainly positive, for what regards productivity, economic opportunities and the future of work. The positive potentials now attributed to the new cycle of innovation evoke and expand those attributed to the previous waves of innovation linked to ITC technologies, and, even before, to the transition from Fordism to Post-Fordism. However, these transformations have so far not achieved any of the promises they raised. Improvements for workers in terms of work conditions, work performance and work relationships cannot be determined by any technical innovation in itself, being technological innovation always socially shaped. Industry groups engage in venue shifting when they seek to overturn or alter restrictive regulations imposed by one political venue through another. A critical step in this process is resolving uncertainties surrounding the preference of the targeted venue and the nature of the relevant policy proposal. While existing studies emphasize a long-term trial-and-error process of policy learning, we focus on nascent industries and argue that ventures seek other information sources to resolve these uncertainties quickly. In particular, nascent industry groups are (...) likely to perceive that the targeted venue will support their policy proposal if the targeted venue is ideologically distant from the venue that has enacted the restrictive regulations, if the targeted venue has recently supported other nascent industry groups’ similar policy proposals, or if the industry groups themselves are more exposed to industry peers’ success in promoting the same policy proposal in other jurisdictions. Under these conditions, the industry groups invest more to influence the targeted venue in response to restrictive regulations enacted by other venues. We find support for our theory by examining how from 2013 to 2019 the small unmanned aircraft systems industry trade associations in the United States lobbied state governments to nullify local regulations. Recent research indicates that among young women, Blacks have lower employment rates than whites. Evidence is provided about whether young Black women's lower employment rates stem from structural features of the labor market, discrimination, or changing family or individual characteristics. Data show that Black women exit full-time employment at higher rates because they are more likely to be laid off, to leave because they work in temporary/seasonal jobs, and to leave for other reasons. Structural features of the labor market are (...) key in explaining Black women's higher rates of lay-offs, exits from temporary/seasonal work, and exits for other reasons. Individual characteristics and discrimination play a role in Black women's higher rates of lay-offs and exits for other reasons while family characteristics are important in explaining Black women's higher rates of leaving temporary/seasonal work and leaving for other reasons. Evidence suggests that Black women's higher exit rates are indicative of disadvantage in the labor market. (shrink)

Unconsented intimate exams on men and women are known to occur for training purposes and diagnostic reasons, mostly during gynecological surgeries but also during prostate examinations and abdominal surgeries. UIEs most often occur on anesthetized patients but have also been reported on conscious patients. Over the last 30 years, several parties—both within and external to medicine—have increasingly voiced opposition to these exams. Arguments from medical associations, legal scholars, ethicists, nurses, and some physicians have not compelled meaningful institutional change. Opposition is (...) escalating in the form of legislative bans and whistleblower reports. Aspiring to professional and scientific detachment, institutional consent policies make no distinction between intimate exams and exams on any other body part, but patients do not think of their intimate regions in a detached or neutral way and believe intimate exams call for special protections. UIEs are found to contribute to moral erosion and moral distress of medical students and compromise the sacred trust between the medical community and the general public. This paper refutes the main arguments in favor of the status quo, identifies a series of harms related to continuing the current practice, and proposes an explicit consent policy for intimate exams along with specific changes to medical school curriculum and institutional culture. Because patients are the rights-holders of their bodies, consent practices should reflect and uphold patient values which call for explicit consent for intimate exams. (shrink)

This article compares Hannah Arendt's famous essay on Adolf Eichmann's trial in Israel in 1961 to Simone de Beauvoir's little studied piece, "An Eye for an Eye," on the trial of Robert Brasillach in France in 1945. Arendt and Beauvoir each determine the complicity of individuals acting within a political order that seeks to eliminate certain forms of otherness and difference, but come to differing conclusions about the significance of the crimes. I explain Beauvoir's account of ambiguity, on which she (...) draws in her judgment of Brasillach and elaborates in her 1948 Ethics of Ambiguity, ana measure it against Arendt's account of Eichmann's thoughtlessness and its effects on the destruction of conditions of worldly plurality. Linking the failure of ethical judgment on the part of individuals to prior systemic political conditions, Beauvoir helps us recognize struggles over the meaning of bodies and conditions of inequality as central to politics. Corporate governance and finance are dynamic academic fields that offer myriad opportunities for business ethics analysis. Within the corporate governance triad in recent years, shareholders have increased their power over boards of directors and executives through both regulation and movements to change corporate by-laws. The impact of board characteristics on firm performance has proven elusive, leading to questions concerning board processes and individual director beliefs and behaviors. At the same time, CEOs have lost considerable power, leaving many struggling to regain (...) their control and maintain their compensation levels, while others adopt a stewardship approach to their posts. In the field of finance, the recent financial debacle has led to a reexamination of financial regulation and of the fundamental nature and purpose of the industry. This paper addresses the problem of our relative lack of understanding in other areas of human morality by applying a recently developed construct—moral approbation—to illuminate the link between moral judgment and moral action. Working in and around the ‘chain of command’: power relations among nursing staff in an urban nursing homeBy most accounts, the discipline of nursing enjoys considerable hegemony in US nursing homes. Not surprisingly, the ethos of this setting is influenced, in large part, by nursing’s value system. This ethos powerfully impacts both the residents who live in nursing homes and the staff who work there. Using ethnographic methods, this project explored power relations among nursing assistants and nurses in an urban (...) nursing home in the United States. Factors contributing to tensions among nursing staff were the stigma attached to nursing homes and those who work in them, as well as the long history of class conflict and power struggles within the discipline of nursing. The latter struggles, in turn, reflected nursing’s quest for professional status in the face of medicine’s hegemony over health‐care. Ultimately, these factors coalesced to produce a local work environment characterized by conflict — and by aides’ resistance to nurses’ domination. (shrink)
