This paper considers this issue from a different vantage point: How does gender intersect with (...) the moral duty to disclose genetic information? Scholars have argued that gender is partly comprised of distinct assignments and assumptions of responsibility. Thus, there is a danger that gendered patterns of socialization will make women feel that they should take primary responsibility for disclosing genetic information to others. This article explores issues of responsibility and disclosure of risk information by drawing on an empirical study of women and men who have undergone genetic testing for hereditary breast/ovarian cancer. The research study suggests that disclosure of genetic information is a gendered activity, with both the benefits and burdens of this task falling primarily on women. It also illustrates that when disclosure is understood contextually, it is a far more complicated matter than when viewed through a theoretical lens. Numerous issues confront women's healthcare today, among them the medicalization of women's bodies, cosmetic genital surgery, violence against women, HIV, perinatal mental health disorders. This volume uniquely explores such difficult topics and others at the intersection of clinical practice, policy, and bioethics in women's health care through a feminist ethics lens. As ethics services have become more integrated into healthcare organizations, the controversy regarding the possible professionalization of healthcare ethics practices has re-emerged. Some of the debate focuses on whether healthcare ethics practice possesses the attributes of a ‘true profession.’ This study examines the history of the professions and the relevance of this historical material, as well as sociological insights, for contemporary concerns. It explores whether the mismatch between traditional models of professional knowledge and the knowledge foundation for healthcare ethics is (...) at the core of these concerns. It also takes the position that given the role healthcare ethics plays in assisting patients, families, healthcare providers, and others with complex moral decisions it is important to work towards developing standards that can be used to guide and evaluate the work. Potential conflicts between the roles of physicians and researchers have been described at the theoretical level in the bioethics literature (Czoli, et al., 2011). Physicians and researchers are generally in mutually distinct roles, responsible for patients and participants respectively. With increasing emphasis on integration of research into clinical settings, however, the role divide is sometimes unclear. Consequently, physician–researchers must consider and negotiate salient ethical differences between clinical– and research–based obligations (Miller et al, 1998). This paper explores the subjective experiences and (...) perspectives of 30 physician–researchers working in three Canadian paediatric settings. Drawing on qualitative interviews, it identifies ethical challenges and strategies used by physician–researchers in managing dual roles. It considers whether competing obligations could have both positive and adverse consequences for both physician–researchers and patients. Finally, we discuss how empirical work, which explores the perspectives of those engaged in research and clinical practice, can lead the way to understanding and promoting best practice. (shrink)

Rumination is a maladaptive form of emotion regulation associated with psychopathology. Research with adults suggests that rumination covaries with diurnal cortisol rhythms, yet this has not been examined among adolescents. Here, we examine the day-to-day covariation between rumination and cortisol, and explore whether trait rumination is associated with alterations in diurnal cortisol rhythms among adolescent girls. Participants provided saliva samples 3 times per day over 3 days, along with daily reports of stress and rumination, questionnaires assessing trait rumination related to (...) peer stress, and diagnostic interviews assessing depression and anxiety. Greater rumination than usual during the day was associated with lower cortisol awakening responses the following morning, but this effect was not significant after accounting for wake time and an objective measure of adherence to the saliva sampling protocol. Trait rumination was associated with lower average cortisol levels at waking and flatter diurnal slopes, accounting for wake time, protocol compliance, and other factors. These patterns may help to explain why rumination is related to the development of psychopathology. (shrink)

In this article we report the findings of a randomised control clinical trial that assessed the impact of a Philosophy for Children program and replicated a previous study conducted in Scotland by Topping and Trickey. A Cognitive Abilities Test was administered as a pretest and a posttest to randomly selected experimental groups and control groups. The students in the experimental group engaged in philosophy lessons in a setting of structured, collaborative inquiry in their language arts classes for one hour per (...) week for a number of weeks. The control group received the standard language arts curriculum in that one hour. The study found that the seventh grade students who had experienced the P4C program showed significant gains relative to those in the seventh grade control group at a high level of statistical significance, but the eighth grade students in the experimental group did not show such gains over the eighth grade control group. It was discovered that the seventh grade teachers started the program early in the school year and continued it for a period of 22 to 26 weeks, while the eighth grade teachers started much later and used the program for only 4 to 10 weeks. Our findings suggest that the P4C program must involve students in activities for a significant period of time before the program shows results, but that a meaningful impact on students’ cognitive abilities can be achieved in about 24 weeks of lessons, less than half the time evidenced by the study by Topping and Trickey. This paper tests a model of corporate social responsiveness capabilities in an industry setting. It seeks to understand whether corporate social responsiveness can be a source of competitive advantage for a given company in an industry where participants face similar constraints and issues.

This issue considers the ethics of a healthcare provider intervening into a patient’s genitalia, whether by means of cutting or surgery or by ‘mere’ touching/examination. Authors argue that the permissibility of such actions in the absence of a relevant medical emergency does not primarily turn on third-party judgments of expected levels of physical harm versus benefit, or on related notions such as extensiveness or invasiveness; rather, it turns on the patient’s own consent. To bolster this argument, attention is drawn to (...) the status of the genitals as ‘intimate’ anatomy—a status that is not fully erased by being in a medical context. In this editorial, we draw on the work of Talia Mae Bettcher on ‘intimate agency’ to explore why unconsented interventions into the genitalia may constitute a distinctive sort of personal violation compared to unconsented contact with various other parts of the human body. In their feature article, Marit van der Pijl and colleagues1 argue it is unethical for healthcare providers to perform unconsented episiotomies on persons in labour. In particular, they suggest that, outside of certain rare emergencies in which, for example, the person giving birth is incapacitated1 and the procedure cannot be delayed until consent becomes possible without introducing a significant risk of serious harm (call these ‘medically necessary’2 procedures), ‘presumed consent’ is the incorrect standard to apply. Instead, they stress that, especially when a proposed intervention involves a person’s genital, sexual or reproductive organs, the need to obtain their explicit consent in advance of proceeding must be honoured. As the authors note, the broader social significance of our genitalia—widely regarded as ‘private’ anatomy—is not erased by being in a medical context (see also 2–4). The coronavirus disease-2019 (COVID-19) has caused shortages of life-sustaining medical resources, and future waves of the virus may cause further scarcity. The Yale New Haven Health System developed a triage protocol to allocate scarce medical resources during the COVID-19 pandemic, with the primary goal of saving the most lives possible, and a secondary goal of making triage assessments and decisions consistent, transparent, and fair. We outline the process of developing the protocol, summarize the protocol, and discuss the major ethical challenges (...) encountered, along with our answers to the challenges. These challenges include (1) the role of age and chronic comorbidities; (2) evaluating children and pregnant patients; (3) racial, ethnic, and socioeconomic disparities in health; (4) prioritization of healthcare workers; and (5) balancing clinical judgment versus protocolized assessments.We conclude with a review of the limitations of our protocol and the lessons learned. We hope that a robust public discussion of such protocols and the ethical challenges they raise will result in the fairest possible processes, less need for triage, and more lives saved during future waves of the pandemic and similar public health emergencies. Dix ans apres la mort de Hans Jonas, qu'en est-il de la reception de sa philosophie? L'incroyable succes qu'elle connut s'explique par l'actualite d'un de ses themes principaux: la necessite d'une responsabilite nouvelle a l'egard des generations futures. Mais la reception largement negative que provoqua sa vulgarisation dans les domaines de l'ethique envireonnementale ou de la bioethique ne laisse pas de masquer le fondement de cette philosophie et les conditions memes de la mise en place des thematiques nouvelles qui retinrent (...) d'abord l'attention. S'alimentant a des sources tantot cachees, tantot eclectiques, elle s'est developpee au cours de plusieurs periodes dont le philosophe lui-meme disait ne pas voir ce qu'elles avaient en commun... Susceptible d'etre abordee par des voies multiples, cette oeuvre reste encore un defi pour le penseur et l'historien de la philosophie qui veulent la prendre au serieux et qui sont soucieux de la reconstruire et d'en lever tous les mysteres. Les prédications eckhartiennes qui nous sont parvenues, sont au nombre d’environ 100 en latin, et de 120 en moyen haut allemand. La critique situe la plus grande partie de ces prédications allemandes dans la dernière décennie de la vie d’Eckhart. Mais son intérêt pour la prédication est présent dans son œuvre dès le début et accompagne toute sa carrière. En particulier, ce qui caractérise son travail homilétique par rapport aux maîtres en théologie, ses contemporains, semble bien être l’usage de la (...) langue vulgaire et le soin particulier apporté à la mise en forme littéraire et à la publication de ces prédications. D’où la question posée : pourquoi cet intérêt pour l’usage de la langue vulgaire? L’attention dans cette étude se concentre donc sur les prédications allemandes et à ce propos sont traités deux arguments qui paraissent particulièrement significatifs. Le premier se concentre sur la nécessité de leur recontextualisation liturgique. En effet, l’aspect liturgique a été complètement occulté dans l’édition critique et la littérature. Le second se manifeste par la nécessité d’explorer le caractère littéraire des prédications, qui ne sont pas de fait “reportées” par des auditeurs (-trices), mais ont été rédigées et publiées par les soins de l’auteur lui-même. Enfin il faut noter comme caractéristique de l’homilétique eckhartienne, le lien essentiel entre locutio emphatica et discours démonstratif (« natiurlîche rede ») : l’examen de quelques textes tirés de la Défense d’Eckhart (1326) tente d’éclairer ce concept. La manière dont la sociologie rend compte d’artifications récentes semble supposer l’existence d’une frontière stable ou stabilisée entre art et non-art à partir de l’émergence moderne de la catégorie des « beaux-arts ». Les études sociologiques concluent par ailleurs au caractère rare et marginal des cas de désartification. En relisant trois paragraphes de la troisième Critique, ce texte vise à introduire des nuances sur ces deux points : le xviii e siècle n’a pas produit de consensus sur une liste « (...) arrêtée » des beaux-arts et certaines désartifications historiques ont atteint des disciplines qui servirent de modèles dans l’émergence même de la catégorie des beaux-arts. This special issue marks the culmination of Hypatia's twenty-fifth anniversary year. We kicked off the celebration of Hypatia's quarter century as an autonomous journal with a conference, "Feminist Legacies/Feminist Futures," which drew close to 150 attendees—a capacity crowd, and more than twice what we'd expected in the planning stages! The conference provided an opportunity to reflect on how Hypatia came to be and how it has shaped feminist philosophy.

Un essai récent de Rochlitz s'inscrit dans le débat actuel sur l'art contemporain en s'efforçant légitimement de rétablir le spectateur dans son droit au jugement. Ce faisant, il propose des critères de reconnaissance et d'appréciation de l'oeuvre qui prétendent, entre autres, échapper aux limites de l'esthétique kantienne qualifiée de subjectiviste. En évoquant des tentatives, analytique et phénoménologique , de traiter de l'oeuvre contemporaine, et en les confrontant aux critères avancés par Rochlitz, on cherche à mettre en évidence les échos kantiens (...) communs à toutes ces approches pour appeler à éviter les interprétations trop étroites de la troisième Critique, et montrer qu'elle nourrit le questionnement sur l'art d'aujourd'hui et peut encore ouvrir des pistes fructueuses à cet égard.A recent essay by Rochlitz contributes to the current debate about contemporary art by justifiably trying to restore the spectators in their right to judge. By so doing, he proposes, for acknowledging and appraising the works of art, standards which claim more particularly to avoid the limits of Kant's aesthetics, supposedly subjectivistic. By refering to analytic and phenomenological approaches to contemporary artworks, and by confronting these approaches to the criteria proposed by Rochlitz, the present paper is an attempt to bring to light the echoes of Kant throughout all those approaches, in order to avoid a too restrictive interpretation of the third Critique, and in order to demonstrate that the current interrogation about art still lives upon Kant, who keeps opening fruitful ways of research. Avec son ouvrage Visionnaires et prophétesses balkaniques du xxe siècle, Galina Valtchinova a ouvert un champ nouveau dans les sciences humaines en Bulgarie, celui de l’anthropologie religieuse. C’est un ouvrage qui fait date ; aussi n’est-il pas inutile de le présenter au public francophone, fût-ce douze ans après sa parution. Le fait religieux n’était pas un sujet d’étude bienvenu sous le régime communiste (1944-1989), où l’athéisme constituait au contraire un domaine politico-scientifique...

L’angle sous lequel Kant aborde le jugement esthétique (de goût) est transcendantal, il s’agit d’établir la possibilité qu’un tel jugement soit de validité universelle et nécessaire. On est donc loin d’une perspective historique sur les arts que développera Hegel. Cependant, les conditions de possibilité recherchées sont celles de jugements appartenant à l’expérience d’individus humains et à celle de l’humanité au cours des siècles. C’est sur la présence de cet aspect temporel du jugement réfléchissant esthétique et de la production des beaux-arts (...) dans la première partie de la troisième Critique et sur ses enjeux que se centre le propos de ce texte. Kant est un interlocuteur fréquent et majeur de Hans Jonas. Il l?est assurément en philosophie pratique. Il lui est à la fois un repoussoir et un modèle à cet égard. Le Kant de la première Critique n?est pas non plus absent de l??uvre de Jonas, et il ne l?est pas, en particulier, du Phénomène de la vie , même s?il y est présent de manière assez sporadique. Mais un Kant dont l?absence est notable dans ce projet de biologie philosophique qui (...) entend rétablir, contre les sciences modernes, les droits du concept de finalité, c?est le Kant de la troisième Critique et singulièrement celui qui s?attelle à l?étude du jugement téléologique. Le titre de la Critique de faculté de juger n?est pas mentionné. Cette absence peut faire question et elle donne un angle d?attaque pour interroger le statut du projet jonassien dans le Phénomène de la vie . De manière abrupte : cette absence n?autorise-t-elle pas à penser que le projet est simplement précritique ? Quel autre sens pourrait-on donner à cette absence, et de quels indices dispose-t-on à cet égard ? Détecte-t-on, à seconde vue, une présence implicite de Kant ? On se contentera de poser ici quelques jalons dans l?instruction de ce dossier. Et l?on se gardera bien de prétendre à quelque démonstration que ce soit. Retournons donc à l?énoncé du projet de Jonas, et d?abord, inévitable­ment, à un très bref rappel des thèses kantiennes, pour baliser. (shrink)

L’article s’efforce de mettre en évidence certains traits saillants de l’interprétation par Victor Basch en 1896 de l’esthétique kantienne. Pour ce faire, il se centre sur le thème qu’il juge central du sentiment esthétique et, particulièrement, sur la critique qu’il propose de la thèse de Kant sur la possibilité d’une valeur universelle du jugement esthétique, valeur qui reste néanmoins seulement subjective (sans objectivité). L’article soutient que l’approche par Basch de cette question témoigne du caractère empiriste de ses options ontologico-épistémologiques.
