From the ethics perspective, “duty of care” is a difficult and contested term, fraught with misconceptions and apparent misappropriations. However, it is a term that clinicians use frequently as they navigate COVID-19, somehow core to their understanding of themselves and their obligations, but with uncertainty as to how to translate or operationalize this in the context of a pandemic. This paper explores the “duty of care” from a legal perspective, distinguishes it from broader notions of duty on professional and personal (...) levels, and proposes a working taxonomy for practitioners to better understand the concept of “duty” in their response to COVID-19. Hibbing et al. argue that the liberal–conservative continuum is (a) universal and (b) grounded in psychological differences in sensitivity to negative stimuli. Our commentary argues that both claims overlook the importance of context. We review evidence that the liberal–conservative continuum is far from universal and that ideological differences are contextually flexible rather than fixed.

Business majors were tested for their attitudes toward the teaching of business ethics in university business education. Respondents indicated that they considered ethics an important part of a business curriculum and that they preferred integrating ethics into a number of different courses rather than taking a separate compulsory or elective ethics course. Ethical business practices were seen by respondents as increasing profit and return on investment and creating a positive work environment and public perception of the organization.

The popular view of non-directive genetic counseling limits the counselor's role to providing information to clients and assisting families in making decisions in a morally neutral fashion. This view of non-directive genetic counseling is shown to be incomplete. A fuller understanding of what it means to respect autonomy shows that merely respecting client choices does not exhaust the duty. Moreover, the genetic counselor/client relationship should also be governed by the counselor's commitment to the principle of beneficience. When non-directive counseling is (...) reexamined in light of both these principles, it becomes clear that there are cases in which counselors should attempt to persuade clients to reconsider their decisions. Such attempts are consistent with non-directive counseling because, while respecting the clients' decision-making authority, they insure that clients act with full knowledge of the moral consequences of their decisions. The extremely popular work of Ken Wilber, unites the best of both western and eastern thought and affirms that the stages of consciousness, more refined than that of the reasoning mind, do exist.

Francis Hutcheson's moral sense theory is the inspiration for both act utilitarianism and a contemporary virtue ethics approach that Michael Slote calls agent‐based virtue ethics. In this essay, I look at other possibilities for ethical theory that spring from Hutcheson's writings and conclude that the landscape of sentimentalist inspired ethics is richer than many realize. I begin this article with a short explanation of Hutcheson's moral sense theory. I explain that Hutcheson proposes and embraces three distinct criteria of moral evaluation, (...) one of which is concerned with the evaluation of motives and two of which are concerned with the evaluation of acts. Act utilitarianism adopts one of the criteria of act evaluation, and Slote's agent‐based virtue ethics adopts the remaining criterion of act evaluation and the criterion of motive evaluation. Then, after pointing out what I believe are shortcomings of Slote's agent‐based virtue ethics, I propose two Hutchesonian inspired theories, each of which is a compromise between act utilitarianism and agent‐based virtue ethics. The first, which I call hypothetical agent‐based virtue ethics, adopts two of Hutcheson's three criteria and is similar structurally to a virtue ethics theory articulated by Rosalind Hursthouse and Linda Zabzebski. The second, which, for lack of a better name, I call Hutchesonian hybridism, adopts all three of Hutcheson's criteria and is a hybrid combination of Slote's actualist agent‐based virtue ethics and hypothetical agent‐based virtue ethics. I argue that both hypothetical agent‐based virtue ethics and Hutchesonian hybridism overcome the shortcomings (pointed out earlier in this essay) of Slote's actualist agent‐based virtue ethics, and that both of these theories are, therefore, worthy of further consideration. Following in Joan Scott's anti-foundationalist footsteps, Linda Zerilli argues for a theory of feminist political judgement not framed in terms of epistemological certainty but assimilated to aesthetic judgement. Tani Barlow criticises Zerilli for not taking adequate account of history in her theory. I analyse the implications of Zerilli's ‘abyssal’ approach to political judgement and Barlow's critique of it. Despite their shared concerns, Zerilli's, Barlow's, and Scott's abyssal approaches struggle to effectively ground the validity of historical analysis and (...) political judgement within a context of plurality and historical difference. All three thinkers focus extensively on discursive and imaginative potential for change while marginalising the role of materiality in the creation of new horizons for women. Incorporating a dynamic account of the materiality of human life into their work would allow them to tie politics and history to an explanation of the role material life plays in constituting plurality, factuality, and historicity. In the field of art history, the white Western male viewpoint, unconsciously accepted as the viewpoint of the art historian, may—and does—prove to be inadequate not merely on moral and ethical grounds, or because it is elitist, but on purely intellectual ones. In revealing the failure of much academic art history, and a great deal of history in general, to take account of the unacknowledged value system, the very presence of an intruding subject in historical investigation, the feminist critique at (...) the same time lays bare its conceptual smugness, its meta-historical naïveté. At a moment when all disciplines are becoming more self-conscious, more aware of the nature of their presuppositions as exhibited in the very languages and structures of the various fields of scholarship, such uncritical acceptance of “what is” as “natural” may be intellectually fatal. Just as Mill saw male domination as one of a long series of social injustices that had to be overcome if a truly just social order were to be created, so we may see the unstated domination of white male subjectivity as one in a series of intellectual distortions which must be corrected in order to achieve a more adequate and accurate view of historical situations. On what basis should we make an epistemic assessment of another’s authority to impart knowledge? Is social identity a legitimate feature to take into account when assessing epistemic reliability? This paper argues that, in some cases, social identity is a relevant feature to take into account in assessing a person’s credibility.

This study investigated whether musical training and bilingualism are associated with enhancements in specific components of executive function, namely, task switching and dual-task performance. Participants belonging to one of four groups were matched on age and socioeconomic status and administered task switching and dual-task paradigms. Results demonstrated reduced global and local switch costs in musicians compared with non-musicians, suggesting that musical training can contribute to increased efficiency in the ability to shift flexibly between mental sets. On dual-task performance, musicians also (...) outperformed non-musicians. There was neither a cognitive advantage for bilinguals relative to monolinguals, nor an interaction between music and language to suggest additive effects of both types of experience. These findings demonstrate that long-term musical training is associated with improvements in task switching and dual-task performance. (shrink)

This volume is an act of talking back, of talking heresy. To reclaim the term “realism,” to maintain the epistemic significance of identity, to defend any version of identity politics today is to swim upstream of strong academic currents in feminist theory, literary theory, and cultural studies. It is to risk, even to invite, a dismissal as naive, uninformed, theoretically unsophisticated. And it is a risk taken here by people already at risk in the academy, already assumed more often than (...) not to be uninformed and undereducated precisely because of their real identities. Of course, identity is today a growth industry in the academy, across the humanities and social sciences, influencing even law and communication studies. The constitutive power of gender, race, ethnicity, sexuality and other forms of identity has, finally, suddenly, been recognized as a relevant aspect of almost all projects of inquiry. However, as I shall discuss in this essay, simultaneous to this academic commodification of identity is an increasing tendency to view identity as politically and metaphysically problematic, some have even said pathological. So on the one hand the theoretical relevance of identities has become visible, while on the other hand many theorists are troubled by the implications of the claim that identity makes a difference. Increasingly, then, the attachment to identity has become suspect. If identity has become suspect, identity politics has been prosecuted, tried, and sentenced to death. To espouse identity politics in the academy today risks being viewed as a member of the Flat-Earth Society. Like “essentialism,” identity politics has become the shibboleth of cultural studies and social theory, and denouncing it has become the litmus test of academic respectability, political acceptability, and even a necessity for the very right to be heard. In contrast, there has been a noticeable thaw regarding the term essentialism. What was once perfunctorily denounced at the start of every paper in feminist theory has recently been tentatively examined by a few theorists for possible signs of validity.. (shrink)

In this paper I make a preliminary analysis of Western (or global North) discourses on sexual violence, focusing on the important concepts of “consent” and “victim.” The concept of “consent” is widely used to determine whether sexual violence has occurred, and it is the focal point of debates over the legitimacy of statutory offenses and over the way we characterize sex work done under conditions involving economic desperation. The concept of “victim” is shunned by many feminists and nonfeminists alike for (...) its apparent eclipse of agency. Putting these concepts into a global framework sheds light on their limitations. Bringing in the debate over the concept “honor crime” reveals contrasting assumptions about the nature of sexual violence. The comparative analysis used in this paper shows how we can avoid universalizing from specific frameworks, but also how we can learn from the discourses elsewhere toward developing an account of commonalities across contexts. Ultimately I argue that in applications to sexual violence, “consent” has intrinsic limitations, “victim” has context-based dangers, and “honor crime” makes both correct as well as incorrect assumptions. Maureen Donnelly has recently argued that directionalism, the view that relations have a direction, applying to their relata in an order, is unable to properly treat certain symmetric relations. She alleges that it must count the application of such a relation to an appropriate number of objects in a given order as distinct from its application to those objects in any other ordering of them. I reply by showing how the directionalist can link the application conditions of any fixed arity (...) relation, no matter its arity or symmetry, and its converse(s) in such a way that directionalism will yield the correct ways in which it can apply. I thus establish that directionalism possesses the same advantage Donnelly's own account of relations, relative positionalism, has over traditional positionalist accounts of relations, which do not properly treat symmetric relations. I then note some advantages that directionalism has over its closest competitors. This includes Donnelly's relative positionalism, since directionalism is not, like relative positionalism, committed to the involvement of relative properties in every irreducibly relational claim. I close by conceding that, as Donnelly notes, directionalism is committed to the primitive relation of order-sensitive relational application. But I don't find this notion as mysterious as Donnelly does. I conclude that, even if one construes this feature of directionalism as a drawback, the two views are at worst at a draw, other things being equal, since this drawback is mitigated by the advantage directionalism has over relative positionalism. Social Postmodernism offers a transformative political vision and addresses the live questions in identity politics. The postmodern focus on race, sexuality and gender is sharpened by integrating the micro-social concerns of the social movements associated with these issues and macro-institutional and cultural analysis. Social Postmodernism brings together leading theorists to explore further the implications for the discourses of feminism, post-Marxian cultural studies, African-American, Gay, Latino/a and postcolonial studies.

Particular conceptions of reconciliation vary across a number of dimensions. As section 1 explains, the kind of relationship at issue in a specific context affects the type of improvement in relations that might be necessary in order to qualify as reconciliation. Reconciliation is widely taken to be a scalar concept. Section 2 discusses the spectrum of intensity along which kinds of improvement in relationships fall, and indicates why, in particular contexts, theorists often disagree about the point along this spectrum that (...) is morally or politically most significant. Section 3 provides an overview of the processes commonly cited as contributing to reconciliation. These processes are often controversial; those praised by some commentators as appropriate and constructive responses to past conflict are dismissed by others as undermining the moral or political conditions for just and peaceful relations. Section 4 concentrates on the relationship between reconciliation and justice. While some see these values as compatible and mutually supporting, others argue that, especially in the immediate wake of conflict, parties must often choose between reconciliation and justice. This essay examines the ethics of boycotting as a social response to injustice or wrongdoing. The boycotts in question are collective actions in which private citizens withdraw from or avoid consumer or cultural interaction with parties perceived to be responsible for some transgression. Whether a particular boycott is justified depends, not only on the reasonableness of the underlying moral critique, but also on what the boycotters are doing in boycotting. The essay considers four possible interpretations of the kind of act (...) in which boycotting consists: the avoidance of complicity, protest speech, social punishment, or social coercion. Each interpretation provides a plausible account of at least some cases of boycotting, yet each raises distinct challenges to justifying boycotting activities. (shrink)
