This Article argues that a universal approach to age discrimination promotes justice (including intergenerational justice) and efficiency. As explained herein, legal regimes regulate age discrimination in employment in various ways. While some regimes create specific anti–age discrimination legislation, others ban most kinds of employment discrimination, including age discrimination, in a general way. These latter promote a universal approach to age discrimination. The current Article explores the theoretical justifications for either a particularistic or a universal approach to age discrimination. Since Eveland and Shah published their seminal study on the impact of social networks on media bias perceptions in the US, little has been researched about the interpersonal antecedents of hostile media perceptions. In this study we address this gap by investigating the role of safe, or like-minded, political discussions on individuals’ likelihood to perceive media as hostile. We use survey data from more than 5,000 individuals in Germany. Our findings reveal that like-minded discussions increase one’s likelihood to perceive media (...) as hostile; yet, only among those more politically engaged and ideologically on the left. Justification logics are constructive analogues of modal logics. They are often used as epistemic logics, particularly as models of evidentialist justification. However, in this role, justification (and modal) logics are defective insofar as they represent justification with a necessity-like operator, whereas actual evidentialist justification is usually probabilistic. This paper first examines and rejects extant candidates for solving this problem: Milnikel’s Logic of Uncertain Justifications, Ghari’s Hájek–Pavelka-Style Justification Logics and a version of probabilistic justification logic developed by Kokkinis et al. The historical context of this project is situated at the intersection of post-Kantian European philosophy and American Pragmatism as it concentrates on the works of Friedrich Nietzsche and John Dewey. Nietzsche and Dewey are two of the most significant figures in post-Kantian value theory, and they cast a long shadow both within and beyond the philosophical discussion. The focal point of this project however is not merely to draw historical parallels between Nietzsche's and Dewey's views, but rather to work out (...) the common space that is created and shared by these figures within the realm of value theory. By weaving together the thought of Nietzsche and Dewey it explores their common contextual outlook regarding the sources of values; a view which presents an important challenge to traditional philosophical ways of thinking about values. ;Traditional ways thinking about values are essentialist. They emphasize detachment from the contingencies of context. In contrast Nietzsche and Dewey stress the thoroughly contextual nature of values systems. They show that values have to do with concrete social and historical situatedness and not with an abstract or universal world. Noting the complex interrelationships between different domains of values, they dispute the idea that beliefs about what is valuable can be grounded by reference to absolute givens or a-historical principles. This is part of what makes their conception of values non-foundational . More specifically, Nietzsche's and Dewey's brand of contextualism can be characterized as being both interpretive and naturalistic. (shrink)

Employee mobility is a phenomenon that challenges workplace ethics. This paper argues that despite on‐going attempts by management and consultants to build and install employee loyalty, and despite the complexity of relationships between employees and their organization, employee mobility remains a common phenomenon in today’s market. Courts, at least Israeli courts, perceive the employee–employer relationship as almost purely contractual and thus strive to protect workers first, often ignoring deeper commitments such as loyalty. There are certain remarks in Culture and Value in which Wittgenstein writes about Jews and about what he describes as their ‘Jewish mind’. In these remarks he appears to be trying to make a distinction between two different spiritual forces which operate in Western culture and which give rise to two different types of artists and works of art. On one side of the divide are Jews and works of art imbued with Jewish spirit. On the other side are men (...) of culture and works of art which exhibit a non-Jewish spirit. Among the various remarks made in this context, he offers the following thoughts about the spiritual nature of Jews, their mentality, character and artistic achievements: ‘You get tragedy when a tree, instead of bending, breaks. Tragedy is something un-Jewish’ . Following Renan he writes: ‘The Semitic races have an unpoetic mentality, which heads straight for what is concrete’ . This, he explains, is because Jews are attracted by ‘pure intellectualism’. ‘I think it would be possible now to have a form of theatre played in masks. The characters would simply be stylized human types.’ ‘Masked theatre is anyway the expression of an intellectualistic character. And for the same reason perhaps it is a theatrical form that will attract only Jews’ . ‘The Jew is a desert region, but underneath its thin layer of rock lies the molten lava of spirit and intellect’ . ‘It is typical for a Jewish mind to understand somebody else's work better than that person understands it himself.’ But intellect, it seems, is not a mental attribute providing for genius and true creative powers. ‘Amongst Jews “genius” is found only in the holy man. Even the greatest of Jewish thinkers is no more than talented. … It might be said that the Jewish mind does not have the power to produce even the tiniest flower or blade of grass; its way is rather to make a drawing of the flower or blade of grass which has grown in the soil of another's mind and to put it into a comprehensive picture. What intelligent person has never pondered the meaning of life? For Yuval Lurie, this is more than a puzzling philosophical question; it is a journey, and in this book he takes readers on a search that ranges from ancient quests for the purpose of life to the ruminations of postmodern thinkers on meaning. He shows that the question about the meaning of life expresses philosophical puzzlement regarding life in general as well as personal concern about one’s own life in (...) particular. Lurie traces the emergence of this question as a modern philosophical quandary, riddled with shifts and turns that have arisen over the years in response to it. _Tracking the Meaning of Life _is written as a critical philosophical investigation stretching over several traditions, such as analytic philosophy, phenomenology, and existentialism. It maps out a journey that explores pivotal responses to this question, drawing especially on the thought of Tolstoy, Wittgenstein, Sartre, and Camus and exploring in depth the insights these thinkers offer regarding their own difficulties concerning the meaning of life. This article explores two examples of non-visibility as a way of describing the specificity of contemporary surfaces of visualization. The two cases are the disappearance of Malaysia Airlines Flight 370, the scheduled passenger flight from Kuala Lumpur to Beijing, which lost contact with air traffic control on 8 March 2014 at 01:20 MYT, and the 276 Nigerian girls who went ‘missing’ at about the same time. The analysis is developed through an exploration of these examples in terms of the patterning (...) of vision produced in recursive relations, or relations of feedback with the environment. We argue that changes in the organization of this feedback, which we describe as ‘rendition’, equip contemporary observers with both the capacity to see ‘close up at a distance’ and the capacity to be situated adjacent, next to or ‘beside from above’. Wittgenstein on the Human Spirit provides a new understanding of Wittgenstein’s discourse as an insightful philosophy of culture, pursued through self-reflection. It offers an edifying perspective on the conceptual underpinnings of culture as a shared expressive spiritual form of life. The ideas investigated in it are highly relevant for discussions in philosophy, aesthetics, anthropology, and cultural studies. The book embraces three studies: The Spirit of Jews, The Spirits of Culture and Civilization, and The Common Spirit of Human Beings. The first (...) discusses Wittgenstein's remarks about Jews, focusing on their place within his philosophical thinking, self-reflection, and European discourse about culture and Jews. It shows how overcoming the anti-Semitic attitude implicit in them set off the major change in his philosophy. The second discusses Wittgenstein’s reflections on the “deterioration of culture” in the modern period, showing how they are related to his remarks about following rules. The third discusses Wittgenstein’s insights regarding the symbolic nature of myth, magic and religion. It suggests that modern human beings and those of ancient cultures possess a common expressive spiritual nature. BackgroundThe Freedom of Information Act (FOIA) provides access to unreleased government records that can be used to enhance the transparency and integrity of biomedical research. We characterized FOIA requests to Department of Health and Human Services (HHS) agencies, including request outcomes, processing times, backlogs, and costs.MethodsUsing HHS FOIA annual reports, we extracted data on the number of FOIA requests received and processed by HHS agencies between 2008 and 2017, as well as request outcomes. Processing times were reported in three time (...) increments, < 1–20, 21–60, or 61+ days, and trends in backlog status were also described. Information about costs and fees collected were aggregated.ResultsBetween 2008 and 2017, 69.6% of 530,094 HHS FOIA requests were received by the Centers for Medicare and Medicaid Services (CMS), 18.9% by the Food and Drug Administration (FDA), and 11.6% by all other HHS agencies. During this period, CMS processed 374,728 requests, FDA 114,938, and other HHS agencies 61,890. CMS and FDA reduced backlogged requests by 9396 (89.7%) and 4289 (65.3%), respectively, leaving backlogs of 1081 and 2279 requests at the end of 2017. CMS fully or partially granted 60.3% of requests whereas FDA fully or partially granted 72.4%. Of all requests to CMS, 82.0% were considered simple and 18.0% complex; 82.2% of simple requests and 54.9% of complex requests were processed in 20 days, and 5.6% and 29.9% were processed in 61+ days. In contrast, 60.2% of requests to FDA were considered simple and 39.8% complex; 28.8% of simple requests and 9.0% of complex requests were processed in 20 days, and 58.3% and 81.5% were processed in 61+ days. The costs to HHS associated with FOIA requests totaled $446.4 million ($809 per processed request), increasing from $28.1 million ($423 per request) in 2008 to $53.3 million ($1544 per request) in 2017. In total, HHS collected $8.5 million in fees (1.9% of total costs).ConclusionsFOIA is frequently used to obtain information about HHS and its agencies. With growing costs, minimal fees collected, and lengthy processing times, HHS agencies’ FOIA programs might be made more efficient through greater proactive record disclosure. (shrink)

In social and cultural theory, topology has been used to articulate changes in structures and spaces of power. In this introduction, we argue that culture itself is becoming topological. In particular, this ‘becoming topological’ can be identified in the significance of a new order of spatio-temporal continuity for forms of economic, political and cultural life today. This ordering emerges, sometimes without explicit coordination, in practices of sorting, naming, numbering, comparing, listing, and calculating. We show that the effect of these practices (...) is both to introduce new continuities into a discontinuous world by establishing equivalences or similitudes, and to make and mark discontinuities through repeated contrasts. In this multiplication of relations, topological change is established as being constant, normal and immanent, rather than being an exceptional form, which is externally produced; that is, forms of economic, political and cultural life are identified and made legible in terms of their capacities for continuous change. Outlining the contributions to this Special Issue, the introduction discusses the meaning of topological culture and provides an analytic framework through which to understand its implications. Aczel's theory of hypersets provides an interesting alternative to the standard view of sets as inductively constructed, well-founded objects, thus providing a convienent formalism in which to consider non-well-founded versions of classically well-founded constructions, such as the "circular logic" of [3]. This theory and ZFC are mutually interpretable; in particular, any model of ZFC has a canonical "extension" to a non-well-founded universe. The construction of this model does not immediately generalize to weaker set theories such as the theory of admissible (...) sets. In this paper, we formulate a version of Aczel's antifoundation axiom suitable for the theory of admissible sets. We investigate the properties of models of the axiom system KPU - , that is, KPU with foundation replaced by an appropriate strengthening of the extensionality axiom. Finally, we forge connections between "non-wellfounded sets over the admissible set A" and the fragment L A of the modal language L ∞. (shrink)

This paper defines and explores the properties of several effectivizations of the structure of surreal numbers. The construction of one of previously investigated systems, the metadyadics, is shown to be effectively equivalent to the construction of the surreals in L ω 1 CK. This equivalence is used to answer several open questions concerning the metadyadics. Results obtained seem to indicate that the metadyadics best capture the notion of a recursive surreal number.

There have been many attempts during the history of applied ethics that have tried to develop a theory of moral reasoning. The goal of this paper is to explicate one aspect of the debate between various attempts of offering a specific method for resolving moral dilemmas. We contrast two kinds of deliberative methods: deliberative methods whose goal is decision-making and deliberative methods that are aimed at gaining edifying perspectives. The decision-making methods assessed include the traditional moral theories like utilitarianism and (...) Kantianism, as well as second order principles, such as principlism and specified principlism. In light of this assessment, we suggest taking a closer look at two perceptive models, casuistry and particularism. These models are used for dealing with moral dilemmas that provide for edifying perspectives rather than decision-making. These perceptive models, though less scientific and not as good at prescribing an action, are more human in the sense that they enrich our moral sensibilities and enhance our understanding of the meaning of the situation. Human beings are a cultural species. This predicament enables them to take on many different cultural identities, all of which transcend the bounds of natural behavior of other species. To contemplate this predicament through philosophy is to reflect on such questions as, What makes cultural forms of life possible? What is encompassed in them? What lies at their core? What distinguishes them from natural forms of life? What brings them about, sustains, and causes them to change? Philosophical answers to these (...) questions predate abstract ways of thinking, as they are sometimes embedded in ancient mythical and religious narratives. Such is the story told in the first three chapters of the book of _Genesis_ in the Bible, revealing how human beings became the cultural beings that they are. This study suggests how that ancient and most celebrated story in the literature of the West may be read as harboring insightful philosophical observations on the cultural nature of human beings. It first focuses on the very concept of cultural forms of life, revealing its complicated conceptual links to natural forms of life. It then offers an interpretive framework for reading mythical, symbolic narratives. Using these ideas, it provides a philosophical reading of the Biblical narrative, disclosing it to harbor a metaphysically oriented conception of nature and two insightful philosophical overviews of the cultural nature of human beings. Both overviews endow human beings with an ability to manipulate nature, but in different ways: the first by subjugating parcels of nature to human will; the second by subjugating human beings themselves to a value-laden conception of things and ethical forms of life. Thus, human beings are portrayed as natural creatures possessed of a cultural nature that enables them to transform nature and recreate themselves through their unique cultural predicament. (shrink)

Former Chief Justice of the King's Bench Sir John Fortescue (c.1395-c.1477) was a key Lancastrian figure. In the first half of the 1470s he presented the Yorkist King Edward IV with his work, The Governance of England. Many scholars have analysed this work as part of the so-called 'English tradition' of constitutional and political theory and as representative of the age of the Wars of the Roses. Only rarely did they contextualize the Governance within the framework of parliamentary politics. As (...) shown in this article, Fortescue in the Governance was both warning the Yorkist regime against dangers to its legitimacy and offering means of resolving these dangers. In all of these concerns Fortescue was in tune with parliamentary politics, where similar concerns were manifest. One of the means through which Fortescue was offering to alleviate the danger of imminent corruption of the constitutional regime in England was through his own legal prestige. (shrink)

Basic human rights are supposed to protect people from abuse and harm. They are the means whereby we protect our humanity. One would expect, therefore, that basic human rights would be valid and sacred in any context, including industrial relations. However, the complexity of the employee–employer relationship obscures this issue, and it is not clear whether such rights can be protected or whether they are valid in the context of industrial relations. Since rights are relational, they are preconditioned on the (...) special nature of the relationship between employee and employer. Hence, the specific meaning that these rights have in industrial relations cannot be grounded in the notion of human rights as such, but rather depends on the special relationships between employers and employees. Though much legislation has been passed to regulate the relationship between employees and employers, the issues surrounding this relationship remain one of the most debated topics in business ethics. Our paper focuses specifically on the right to equal pay and the right to privacy. With respect to the right to property, the paper examines whether there is a conflict between general human rights and the fundamental right of employers to their property. The Israeli legislature has responded to this conflict by enacting ‘protective laws’ that legally outline and mandate certain human rights. Under these laws, employees are prevented and prohibited from waiving the rights granted to them by law, even if employed in private industries. Despite this legislative effort, market forces are at times stronger, and consequently some basic rights are not fully applied or implemented. (shrink)

The purpose of this article is to propose an ethical framework for software engineers that connects software developers’ ethical responsibilities directly to their professional standards. The implementation of such an ethical framework can overcome the traditional dichotomy between professional skills and ethical skills, which plagues the engineering professions, by proposing an approach to the fundamental tasks of the practitioner, i.e., software development, in which the professional standards are intrinsically connected to the ethical responsibilities. In so doing, the ethical framework improves (...) the practitioner’s professionalism and ethics. We call this approach Ethical-Driven Software Development, as an approach to software development. EDSD manifests the advantages of an ethical framework as an alternative to the all too familiar approach in professional ethics that advocates “stand-alone codes of ethics”. We believe that one outcome of this synergy between professional and ethical skills is simply better engineers. Moreover, since there are often different software solutions, which the engineer can provide to an issue at stake, the ethical framework provides a guiding principle, within the process of software development, that helps the engineer evaluate the advantages and disadvantages of different software solutions. It does not and cannot affect the end-product in and of-itself. However, it can and should, make the software engineer more conscious and aware of the ethical ramifications of certain engineering decisions within the process. (shrink)

Wittgenstein's remarks on the nature of culture presuppose a view according to which there is an important difference between culture and civilization. This view aligns his thinking to that of the Romantic tradition in philosophy. It also leads him to perceive ?the disappearance of a culture? in our time. In many of his remarks on art and certain artists he expresses this view by attempting to clarify the different ways in which the spirit of man is manifested in modern times (...) (in arts, science, and industry) as opposed to how it is manifested in an age of culture. This article undertakes to describe and explain the remarks which lead him to this view. It then considers whether Wittgenstein was, in fact, correct in his evaluation regarding the disappearance of a culture. (shrink)

The Israeli approach to advertising consists of two complementary sets of norms, legal norms and moral‐ethical norms. Advertising legislation demands honest disclosure. The Israeli legislator refrains from intervening in fundamental rights such as freedom of expression, free trade, occupation, and liberty of contract in advertising. However, there are also few interventions to prevent phenomena that are dangerous or abusive, especially to groups needing protection. The Israeli courts do try to apply moral considerations in cases tried by them, but living up (...) to moral responsibilities is different from complying with legal obligations. Advertisers in Israel have a(i) Treatise(r), consisting of ten ethical guidelines, which neither sums up advertising ethics in its entirety nor is legally binding. Sociological and psychological features of the culture need to be examined in order to spell out what truth and honesty in advertising actually mean in this society, and the manner in which these values are practised. Lacking sanctions in public law against misleading consumers or manipulation based on false facts, consumers must find remedy in civil actions which rely on moral and ethical rules. (shrink)
