Research on human reasoning has both popularized and struggled with the idea that intuitive and deliberate thoughts stem from two different systems, raising the question how people switch between them. Inspired by research on cognitive control and conflict monitoring, we argue that detecting the need for further thought relies on an intuitive, context-sensitive process that is learned in itself.

This is the penultimate draft of a paper originally presented at the Hart-Fuller at 50 conference, held at the NYU Law School in February 2008. A revised version will appear in the NYU Law Review. The paper seeks to clarify and assess HLA Hart's famous claim that legal positivism somehow involves a 'separation of law and morals.' The paper contends that Hart's 'separability thesis should not be confused with the 'social thesis,' with the 'sources thesis,' or with a methodological (...) thesis about jurisprudence. Hart's thesis denies the existence of necessary (conceptual) connections between law and morality. But that thesis is false: there are many necessary connections between law and morality, some of them conceptually significant. Among these is an important negative connection: law is of its nature morally fallible and morally risky. Lon Fuller emphasised the 'internal morality of law,' the 'morality that makes law possible'. Hart stressed that there is also an immorality that law makes possible. Law's nature is seen not only in its internal virtues, in legality, but also in its internal vices, in legalism. (shrink)

In July, 1939, a celebration was held at Leland Stanford University to commemorate the hundredth anniversary of the discovery that the cell is the basic unit of all living tissue. Today we are beginning to realize and to appreciate the fact that the symbol is the basic unit of all human behavior and civilization.

This study is designed to test the hypothesis that events like the Holly Bough service held in Liverpool Cathedral on the fourth Sunday of Advent that attracts a wide range of participants, including regular churchgoers and occasional (sometimes annual) visitors, contribute significantly to the psychological health and well-being of these participants. At the Holly Bough service held in 2019, a total of 383 participants (139 men, 229 women and 15 individuals who preferred anonymity) completed a recognised measure of (...) psychological health and well-being (the Oxford Happiness Questionnaire) whilst they were waiting for the service to begin and again during a 5-min organ improvisation just before the close of the service. The data demonstrated a significantly higher score on the Oxford Happiness Questionnaire at time 2 than at time 1, suggesting that the experience of the service functioned as an agent of psychological health and well-being. Contribution: Situated within the science of cathedral studies, this paper confirms by means of a repeated-measure study that cathedrals promote psychological health; 383 participants at a Christmas service completed the same well-being measure before and after the service, with a significant increase in scores at time two. There are several forms of the Ontological Argument, but it is more or less fair to say that all hang on the contention that the notion of a perfect being entails the existence of that being, since existence is involved in perfection. My first interest is in the word "perfect." The word, I think, is usually vague but it seems to me that, in the context of the proof, it has a meaning which turns out to be much more pedestrian (...) than we would suspect. The argument, if it is valid, must assert that any perfect being would have to have every possible characteristic. It alleges that existence is a characteristic and it is, of course, over this that most debate has centered. It seems clear, however, that "perfect," as employed in the argument, merely means what we would call "complete" in less august transactions. In some forms of the proof, indeed, this is made somewhat clearer since the expression "greatest possible" being is substituted for "perfect." Ordinarily, no one would be tempted to pass lightly from the notion of "that which is complete" to the notion of "the deity." Both "perfect" and "greatest possible" appear to have moral connotations and "complete" usually does not. The slide, however, is made easier by the recurrent notion that evil is not a positive quality but merely the absence of another positive quality, usually goodness. If this view is held, it certainly does follow that whatever is "complete" must be "perfect" in the moral sense as well as in the other usual senses. It is not, here, my concern to pass judgment on this notion. I am, at the moment, merely trying to trace possible sources of confusion in the argument. (shrink)

Previous research employing Jungian psychological type theory has both demonstrated that Church of England inherited congregations have problems engaging thinking types and suggested that fresh expressions of church have failed to address that problem. Three previous studies, however, have reported higher proportions of thinking types attending cathedral carol services. The present study was designed to check that finding on a larger sample. The Francis Psychological Type Scales were completed by 941 participants at the afternoon Carol Services held in Liverpool (...) Cathedral on Christmas Eve 2019, and the data compared with the profile of 3304 participants within 140 inherited congregations. The present study also found a higher proportion of thinking types among the participants at these carol services. These findings suggest that cathedral carol services may be functioning as fresh expressions of church in a significant way. Further research is needed to explore whether other cathedral services may function in similar ways.CONTRIBUTION: Situated within the science of congregation studies, rooted in psychological type theory and drawing on data from 941 participants at the afternoon Carol Services held in Liverpool Cathedral on Christmas Eve 2019, this study confirms that cathedral carol services at Christmas are more successful than either inherited church or fresh expressions of church in reaching thinking types. The choice, it too often seems, is between laying down our nuclear arms–thus avoiding the moral odium of resting our defence policies on threats to vaporize millions of civilians–but leaving ourselves open to domination by those (...) who do not feel such scruples, and on the other hand, retaining such weapons as long as our potential enemies possess them, constantly maintaining parity with the other side–in other words, proceeding with the arms race. The respective proponents of principle and of prudence typically fail to understand how others can possibly neglect the considerations which loom so large in their own minds. Each has at bottom a deeply held ethical view–that certain means may not be used for any end, or that certain ends are so important that they justify the use of almost any means. The disagreement is so irreconcilable that it spills out from TV studios and newspaper editorial pages on to the streets and the missile bases, and into the courts and the prisons. (shrink)

This comprehensive volume offers a wide-ranging perspective on the stories that art music has told since the start of the 20th century. Contributors challenge the broadly held opinion that the loss of tonality in some music after 1900 also meant the loss of narrative in that music. To the contrary, the editors and essayists in this book demonstrate how experiments in approaching narrative in other media, such as fiction and cinema, suggested fresh possibilities for musical narrative, which composers were (...) quick to exploit. The new conceptions of time, narrative voice, plot, and character that accompanied these experiments also had a significant impact on contemporary music. Multinational corporations (MNCs) have brought attention to the challenges of business ethics in intercultural settings. A lack of understanding regarding cultural pluralism in business ethics education has motivated some scholars to consider a broader lens, one that recognizes the influence of religion (Spalding and Franks 2012). Management awareness of the similarities and differences that stem from deeply held beliefs is essential, as unstated thoughts and feelings caninfluence starting assumptions, even before ethical decision-making processes begin. If deeply entrenched cultural traditions (...) and religious values remain implicit and/or misunderstood, collaborative efforts may be derailed due to an inadvertent lack of respect and understanding. Because many Westerners remain unfamiliar with Muslim-based beliefs, the authors advance business ethics education by offering an overview of business practices in the Middle East. A modeland exercise are presented as tools to promote awareness of cultural perspectives. This platform for understanding will help adult learners see how their personal origins can shape and influence management thought. (shrink)

A sample of 552 first year undergraduate students, attending a universitysector college in Wales specialising in teacher education and liberal arts subjects, completed the Myers-Briggs Type Indicator together with the Francis Scale of Attitude toward Christianity. The data demonstrated that judging types held a more positive attitude toward Christianity than perceiving types. No significant differences in attitude toward Christianity were found between introverts and extraverts, between sensers and intuitives, or between thinkers and feelers.

In matters such as affirmative action or home schooling, rights of ethnic and other minority groups often come into conflict with those of society in a culturally diverse population such as ours. But before considering the dilemmas posed by these issues, we must first ask such basic but important questions as what group rights are and how they intersect with the principles of democracy. This new collection brings together some of today's leading thinkers from the cutting edge of these debates, (...) taking in a broad range of issues confronting philosophers, sociologists, and political scientists. Contributors such as Carl Wellman, Carol Gould, and Rex Martin examine the nature of groups and the conflict between group rights and democracy and also consider case studies depicting current issues in cultural, ethnic, and religious rights. International codes of ethics play an important role in guiding professional practice in developing countries. In the occupational health setting, codes developing by international agencies have substantial import on protecting working populations from harm. This is particularly so under globalisation which has transformed processes of production in fundamental ways across the globe. This article provides an ecological theory of face perception that elucidates the basis of the various perceptions. It then reviews research on first impressions elicited by facial qualities that are associated with fitness, emotion, race, age, and sex, in each case making links to ecological theory. It aims to identify facial qualities that inform social perceptions and reflect the zeitgeist at the time in social psychology. The emphasis is on understanding the cognitive mechanisms engaged in social perception, and this is (...) typically accomplished by providing information about social qualities in lists of trait words. The article demonstrates face perception research pertinent to the detection of socially relevant qualities in faces—attractiveness, emotions, race, age, and sex—as well as associated behavioral affordances, which have typically been assessed by trait ratings. This research addresses the question of whether men and women in sales differ in their ethical attitudes and decision making. The study asked 209 subjects to respond to 20 ethical scenarios, half of which were "relational" and half "non-relational." The study concludes (1) that there are significant ethical differences between the sexes in situations that involve relational issues, but not in non-relational situations, and (2) that gender-based ethical differences change with age and years of experience. Scholars have shown renewed interest in the construct of courage. Recent studies have explored its theoretical underpinnings and measurement. Yet courage is generally discussed in its broad form to include physical, psychological, and moral features. To understand a more practical form of moral courage, research is needed to uncover how ethical challenges are effectively managed in organizational settings. We argue that professional moral courage (PMC) is a managerial competency. To describe it and derive items for scale development, we studied managers (...) in the U.S. military and examined prior work on moral courage. Two methods were used to measure PMC producing a five dimensional scale that organized under a single second-order factor, which we termed overall PMC. The five dimensions are moral agency, multiple values, endurance of threats, going beyond compliance, and moral goals. Convergent and discriminant validity are analyzed by use of confirmatory factor analysis procedures. We conclude by presenting a framework for proactive organizational ethics, which reflects how to support PMC as a management practice. (shrink)

This book marks a total departure from previous studies of the Boxer War. It evaluates the way the war was perceived and portrayed at the time by the mass media. As such the book offers insights to a wider audience than that of sinologists or Chinese historians. The important distinction made by the author is between image makers and eyewitnesses. Whole categories of powerful image makers, both Chinese and foreign, never saw anything of the Boxer War but were responsible for (...) disseminating images of that war to millions of people in China and throughout the world. Leslie Stephen was an English biographer, and a writer on philosophy, ethics and literature. He was educated at Eton, King's College, London, and then Trinity College in Cambridge, where he remained as a fellow and a tutor for his entire career. He was also a keen mountaineer, taking part in first ascents of nine peaks in the Alps. He served as the first editor of the Dictionary of National Biography and in 1871 he became editor of the Cornhill Magazine. (...) During his eleven-year tenure he wrote two successful books on ethics, of which this work, published in 1882, was one. It was widely adopted as a standard textbook on moral philosophy, and became one of the most influential publications on the ideas of evolutionary ethics that had been inspired by Darwin's theory of evolution by natural selection. The modern state claims supreme authority over the lives of all its citizens. Drawing together political philosophy, jurisprudence, and public choice theory, this book forces the reader to reconsider some basic assumptions about the authority of the state. Various popular and influential theories - conventionalism, contractarianism, and communitarianism - are assessed by the author and found to fail. Leslie Green argues that only the consent of the governed can justify the state's claims to authority. This paper is an examination of the concept of recognition and its connection with identity and respect. This is related to the question of how women are or are not adequately recognised or respected for their achievements in sport and whether eliminating sex segregation in sport is a solution. This will require an analysis of the concept of excellence in sport, as well as the relationship between fairness and inclusion in an activity that is fundamentally about bodily movement. I argue (...) that attempts to address the problem of women’s recognition in sport need to do so in ways that neither eliminate sport as a fairness regulated system for developing individual excellence in bodily movement nor that prevent women’s achievement of sporting excellence, with the regard that belongs to them. A psychiatrist who has received international recognition for her research on the neural basis of primate social cognition, Leslie Brothers, M.D., offers here a major argument about the social dimension of the human brain, drawing on both her own work and a wealth of information from research laboratories, neurosurgical clinics, and psychiatric wards. Brothers offers the tale of Robinson Crusoe as a metaphor for neuroscience's classic notion of the brain: a starkly isolated figure, working, praying, writing alone. Perhaps most important, she connects neuroscience, psychiatry, and sociology as never before, showing how our daily interaction creates an organized social world--a network of brains that generates meaningful behavior and thought. Our emotions and our sense of self have no existence outside of a social context. Brothers conducts her argument with grace and style. Two prevalent assumptions in the philosophy of sport literature are that all sports are games and that all games are contests, meant to determine who is the better at the skills definitive of the sport. If these are correct, it would follow that all sports are contests and that a range of sporting activities, including nature sports, are not in fact sports at all. This paper first confronts the notion that sport and games must seek to resolve skill superiority through (...) consideration of sport activities that have no such aim. The reduction of sport to game is also shown to be untenable and due to misunderstanding the point of sport activities, specifically, why people engage in them. This leads to reconsideration of the dominance of an instrumental conception of sport and the pursuit of excellence as anthropomaximising efficiency. The Norwegian tradition of frilutsliv is explored as a counterpoint to both conventional and nature sport. (shrink)

Excellence in sport performance is normally taken to be a matter of superior performance of physical movements or quantitative outcomes of movements. This paper considers whether a wider conception can be afforded by certain kinds of nature based sport. The interplay between technical skill and aesthetic experience in nature based sports is explored, and the extent to which it contributes to a distinction between different sport-based approaches to natural environments. The potential for aesthetic appreciation of environmental engagement is found to (...) be strongly dependent on whether or not environmental engagement is exploited for the end of producing a quantifiable result or enhancing technical skill. It is also argued that an existential rather than spectatorial attitude to aesthetic experience is offered by specifically nature oriented sport. Aesthetic experience achieved in this way is therefore neither passive nor detached, but extends Berleant's concept of participatory environmental aesthetics and underpins both an alternate (wide) conception of excellence in sport activity and a richer experience of aesthetic engagement than more objectivised standpoints. This paper responds to Kevin Krein’s claim in that the particular value of nature sports over traditional ones is that they offer intensity of sport experience in dynamic interaction between an athlete and natural features. He denies that this intensity is derived from competitive conflict of individuals and denies that nature sport derives its value from internal conflict within the athlete who carries out the activity. This paper responds directly to Krein by analysing ‘intensity’ in sport in terms of the (...) relationship between attention and reflection and the interaction between self and environment. I reply directly to Krein’s rejection of self-competition as based on a mischaracterisation of internal struggle and argue that the weighing of incompatible desires does not involve a fragmented self. I argue that the unique intensity to which Krein refers is strongly comparable to the Kantian conception of the sublime and explore how sublime experience fits Krein’s account and outline some serious problems that such an ideal of experience poses for nature sport. Smith, Glass, and Miller have reported a meta-analysis of over 500 studies comparing some form of psychological therapy with a control condition. They report that when averaged over all dependent measures of outcome, psychological therapy is. 85 standard deviations better than the control treatment. We examined the subset of studies included in the Smith et al. metaanalysis that contained a psychotherapy and a placebo treatment. The median of the mean effect sizes for these 32 studies was. 15. There was a (...) nonsignificant inverse relationship between mean outcome and the following: sample size, duration of therapy, use of measures of outcome other than undisguised self-report, measurement of outcome at follow-up, and use of real patients rather than subjects solicited for the purposes of participation in a research study. A qualitative analysis of the studies in terms of the type of patient involved indicates that those using psychiatric outpatients had essentially zero effect sizes and that none using psychiatric inpaticnts provide convincing evidence for psychotherapeutic effectiveness. The onty studies clearly demonstrating significant effects of psychotherapy were the ones that did not use real patients. For the most part, these studies involved small samples of subjects and brief treatments, occasionally described in quasibeliavioristic language. It was concluded that for real patients there is no evidence that the benefits of psychotherapy are greater than those of placebo treatment. (shrink)

Most empirical research examining physician views on physician-assisted suicide has used quantitative methods to characterize positions and identify predictors of individual attitudes. This approach has generated limited information about the nature and depth of sentiments among physicians most impassioned about PAS. This study reports qualitative data provided by 909 physicians as part of a larger survey regarding attitudes toward and experiences with PAS and palliative care. Emergent themes illustrate important clinical, social, and ethical considerations in this area. The data illustrate (...) the diverse and ardent responses that PAS evokes among certain physicians. The role of physicians' personal values is central to discussions about legalization of PAS. Polarized views such as those expressed by physicians in this study are not likely to be reconciled, thereby constraining the development of public policy regarding PAS. (shrink)

The psychologist Leslie Farber, who died in 1981, has been revered as one of the most astute observers of the human condition and a writer of penetrating wisdom. His essays, on topics as diverse as the pornographic anguish of jealousy and the despair of psychotherapy, were collected in 1966 (The Ways of the Will) and 1976 (Lying, Despair, Jealousy, Envy, Sex, Suicide, Drugs, and the Good Life) and have been out of print for nearly twenty years. Based partly on (...) his experiences as a therapist, but more importantly on his special insight, Dr. Farber's observations provide us with a unique glimpse into ourselves that is frequently startling, but in the end always consoling.
