This Korean study replicated a previously published American study. The conceptual framework and method combined ethical enquiry and phenomenology. The research questions were: (1) What is nursing students’ experience of ethical problems involving nursing practice? and, (2) What is nursing students’ experience of using an ethical decision-making model? The participants were 97 senior baccalaureate nursing students, each of whom described one ethical problem and chose to use one of five ethical decision-making models. From 97 ethical problems, five content categories emerged, (...) the largest being health professionals (69%). The basic nature of the ethical problems was the students’ experience of conflict, resolution and rationale. Using an ethical decision-making model helped 94% of the students. A comparison of the Korean and American results yields important implications for nursing ethics education, practice and research. (shrink)

A preference method probed infants` perception of object motion on an inclined plane. Infants viewed videotaped events in which a ball rolled downward (or upward) while speeding up (or slowing down). Then infants were tested with events in which the ball moved in the opposite direction with appropriate or inappropriate acceleration. Infants aged 7 months, but not 5 months, looked longer at the test event with inappropriate acceleration, suggesting emerging sensitivity to gravity. A further study tested whether infants appreciate that (...) a stationary object released on an incline moves downward rather than upward; findings again were positive at 7 months and negative at 5 months. A final study provided evidence, nevertheless, that 5-monthold infants discriminate downward from upward motion and relate downward motion in videotaped events to downward motion in live events. Sensitivity to certain effects of gravity appears to develop in infancy. (shrink)

Experiments using a preferential looking method, a perceptual judgment method, and a predictive judgment method investigated the development, from 7 months to 6 years of age, of sensitivity to the effects of gravity and inertia on inanimate object motion. The experiments focused on a situation in which a ball rolled off a flat surface and either continued in linear motion (contrary to gravity), turned abruptly and moved downward (contrary to inertia), or underwent natural, parabolic motion. When children viewed the three (...) fully visible motions, both the preferential looking method and the perceptual judgment method provided evidence that sensitivity to inertia developed between 7 months and 2 years, and that sensitivity to gravity began to develop after 3 years. When children predicted the future location of the object without viewing the motions, the predictive judgment method provided evidence that sensitivity to gravity had developed by 2 years, whereas sensitivity to inertia began to develop only at 5±6 years. These findings suggest that knowledge of object motion develops slowly over childhood, in a piecemeal fashion. Moreover, the same system of knowledge appears to be tapped both in preferential looking tasks and in judgment tasks when children view fully visible events, but a different system may underlie children's inferences about unseen object motions. Halal means permissible or lawful in Arabic and is applied to both the religious and daily life of Muslims. Islamic Law Shariah requires Muslims to consume halal products only. But with the expansion of supply chains around the world and the development of many new products, Muslim consumers have found it difficult to confirm whether food is halal or not. Also, as many foods are produced in non-Muslim countries and exported to Muslim countries, interest in halal certification in non-Muslim countries (...) is increasing. With several Islamic countries strengthening their halal certification regulation for import in recent years, there is no accurate information on whether halal certification is necessary to export to Muslim countries or the Islamic State, and is lack of clear study of the definition of the Islamic State. Therefore, in this research, we will investigate the constitution and food import regulations of the Organization for Islamic Cooperation member states, called the Union of Islamic States, to study the definition of Islamic State and whether halal certification is necessary for food exports. BackgroundAlthough the Life-Sustaining Treatment (LST) Decision Act was enforced in 2018 in Korea, data on whether it is well established in actual clinical settings are limited. Hospital-acquired pneumonia (HAP) is a common nosocomial infection with high mortality. However, there are limited data on the end-of-life (EOL) decision of patients with HAP. Therefore, we aimed to examine clinical characteristics and outcomes according to the EOL decision for patients with HAP.MethodsThis multicenter study enrolled patients with HAP at 16 referral hospitals retrospectively from (...) January to December 2019. EOL decisions included do-not-resuscitate (DNR), withholding of LST, and withdrawal of LST. Descriptive and Kaplan–Meier curve analyses for survival were performed.ResultsOf 1,131 patients with HAP, 283 deceased patients with EOL decisions (105 cases of DNR, 108 cases of withholding of LST, and 70 cases of withdrawal of LST) were analyzed. The median age was 74 (IQR 63–81) years. The prevalence of solid malignant tumors was high (32.4% vs. 46.3% vs. 54.3%, P = 0.011), and the ICU admission rate was lower (42.9% vs. 35.2% vs. 24.3%, P = 0.042) in the withdrawal group. The prevalence of multidrug-resistant pathogens, impaired consciousness, and cough was significantly lower in the withdrawal group. Kaplan–Meier curve analysis revealed that 30-day and 60-day survival rates were higher in the withdrawal group than in the DNR and withholding groups (log-rank P = 0.021 and 0.018). The survival of the withdrawal group was markedly decreased after 40 days; thus, the withdrawal decision was made around this time. Among patients aged below 80 years, the rates of EOL decisions were not different (P = 0.430); however, mong patients aged over 80 years, the rate of withdrawal was significantly lower than that of DNR and withholding (P = 0.001).ConclusionsAfter the LST Decision Act was enforced in Korea, a DNR order was still common in EOL decisions. Baseline characteristics and outcomes were similar between the DNR and withholding groups; however, differences were observed in the withdrawal group. Withdrawal decisions seemed to be made at the late stage of dying. Therefore, advance care planning for patients with HAP is needed. (shrink)

Hypothalamic and ovarian GnRH mRNA and pituitary LH~ mRNA levels were determined by respective RNA-blot hybridizations, and ovarian GnRH and estradiol contents and serum LH levels were measured by respective radioimmunoassays. Three animal models such as 1) PMSG-treated, 2) PMSG and heG-treated immature rats and 3) proestrous stage of adult rats were used. Immature rats (25-days old) were administered with PMSG (10 iu) at 10:00 hand 48 h later with heG (10 iu) to induce ovulation. In the PMSG-injected model, hypothalamic GnRH mRNA levels were markedly augmented about 9-fold at 50 h, and pituitary LH mRNA 3-fold at 52 h after PMSG administration. Serum LH levels were increased to the preovulatory surge levels at 56 h, and ovarian GnRH mRNA levels were augmented 4-fold at 60 h after PMSG injection. Administration of heG also induced a marked enhancement in ovarian GnRH mRNA levels in comparison to the values shown in both intact and PMSGtreated rats at 52 hand 54 h, respectively. In the proestrous stage of normal adult rats, pituitary LH~ mRNA levels were peaked at 16:00 h. The preovulatory LH surge was evident at 4 h before increment in ovarian GnRH mRNA levels as shown in PMSG-treated rats. The present study clearly showed the sequential increase in hypothalamic GnRH mRNA, pituitary LH~ mRNA and ovarian GnRH mRNA levels, indicating that ovarian GnRH may play a possible role in the control of follicular maturation and the ovulation process. This dissertation proposes a new working model of reductionism for biology and a new concept of the gene based on the new reduction model. My project aims to help biologists and philosophers understand what reductionism in biology really is, or, should be. Historical debates about reductionism testify us that the classical reduction model, i.e., Ernest Nagel's bridge-law model, offers us neither an appropriate ontological reductionism nor a reductive explanation about biological phenomena. Casting doubts on the received view of the layered (...) hierarchical model of ontology, I suggest that many interesting biological properties be construed as second-order functional properties and their first-order realizers. Providing for reduction finely-analyzed biological properties, I offer a new model for reductionism in biology - localized functional reductionism - which evolved from Jaegwon Kim's view of reductionism presented for the problems of mental causation. My localized functional reductionism shows that a localized functional property is reduced to its base/structural property. I emphasize that researchers in biology do not deal with abstract general properties but always localized, structure-specific biological properties. A localized functional property and the structure-specific biological property as its base property are what we are interested in and this is what makes biological properties appropriate for research and meaningful for philosophical discussion. The localized functional reduction model, which is actually a case of token reduction model, integrates the fine-grained ontological hierarchies of both macro/micro-levels and higher/lower-orders, and it also synthesizes functional reductionism and token identity thesis. In my localized functional reductionism, functional biological properties are not eliminated but they exist with their own causal powers and true explanatory powers. I also argue that the gene, construed as a second-order functional property, must be understood as gene expression network-specific. The gene, when it is realized on a given occasion, is reduced to, and is identical with, one of its genomic realizers on the given occasion, that is, the gene expression network. A new dynamic approach to the concept of the gene as the gene expression network vindicates reductionism. (shrink)

Philosophers ask just whose expression, if anyone’s, we hear in lyric poetry. Walton provides a novel possibility: it’s the reader who “uses” the poem (just as a speech giver uses a speech) who makes the language expressive. But worries arise once we consider poems in particular social or political settings, those which require a strong self-other distinction, or those with expressions that should not be disassociated from the subjects whose experience they draw from. One way to meet this challenge is (...) to consider the poem expressive of a plural subject, which frees us from looking for a particular individual whose voice we hear in the work, whether she be fictional or actual. Some lyrics give voice to a group whose experience is attended to in the work. This may be done through a posited fictional speaker, but the ontology of the speaker is shown to be less important. Attending to a group whose concerns are voiced allows us to explain how poems can manage to address our-worldly concerns even when lacking actual persons whose expressions we encounter in the poems. The present paper traces the trajectory of the development of Husserl’s phenomenology from its incipient eidetic phase over the transcendental to the lifeworld-phenomenological, and ascertains that, in spite of all their complexities, the idea of Zu den Sachen selbst is the very objective of all those ‘phenomenological’ investigations. The search after the ‘immediately given’ (Vorgegebenheiten) finally discovers that the concrete cultural life-worlds are the authentically ‘immediately pre-given’ and all kinds of knowledge and sciences (higher cultural configurations) are nothing but idealizations (...) of those floor-like concrete life-worlds. Phenomenology previously as rigorous first science is now re-oriented as phenomenology as rigorous (i.e., transcendental) regional studies. Transcendental regional studies (i.e., life-world phenomenology), I’d like to argue, is the very key to the resolution of the ambiguities of the concept of life-world as well as the key to the understanding of the vague future direction of phenomenological philosophizing that Husserl himself left open. Xenophobia is conceptually distinct from racism. Xenophobia is also distinct from nativism. Furthermore, theories of racism are largely ensconced in nationalized narratives of racism, often influenced by the black-white binary, which obscures xenophobia and shelters it from normative critiques. This paper addresses these claims, arguing for the first and last, and outlining the second. Just as philosophers have recently analyzed the concept of racism, clarifying it and pinpointing why it’s immoral and the extent of its moral harm, so we will (...) analyze xenophobia and offer a pluralist account of xenophobia, with important implications for racism. The Halfers claim that she ought to assign 1/2 to H at that moment. The Thirders argue that she ought to assign 1/3 to H then. Meanwhile, Pettigrew defended a new chance-credence coordination principle, called the “Evidential Temporal Principle” (ETP), in a (...) recent edition of his book. In this paper, I provide a novel argument against the Halfer view and a partial defense of the Thirder view, respectively based on ETP. In addition, I generalize ETP to what I call the “Evidential Centered Principle,” which links one’s credences in centered propositions with their objective chances. (shrink)

An observation of Hume’s has received a lot of attention over the last decade and a half: Although we can standardly imagine the most implausible scenarios, we encounter resistance when imagining propositions at odds with established moral (or perhaps more generally evaluative) convictions. The literature is ripe with ‘solutions’ to this so-called ‘Puzzle of Imaginative Resistance’. Few, however, question the plausibility of the empirical assumption at the heart of the puzzle. In this paper, we explore empirically whether the difficulty we (...) witness in imagining certain propositions is indeed due to claim type (evaluative v. non-evaluative) or whether it is much rather driven by mundane features of content. Our findings suggest that claim type plays but a marginal role, and that there might hence not be much of a ‘puzzle’ to be solved. (shrink)

지역학에서 회자되는 ‘지역’의 개념은 상당히 모호한 것으로 알려져 있다. 따라서 본 논문에서는 첫째, 후설의 생활세계의 개념을 ‘지역’이라 간주하고 ‘지역’의 개념을 현상학적으로 그려내면서 그것의 구조를 ‘지평’과 ‘시간성’으로 파악해낸다. 둘째, 긍정심리학자 칙센트미하이의 이론을 끌어들여, 그러한 지역의 구조는 플로우(행복)의 초월론적 조건이라고 해석한다. 마지막으로 이런 논의를 통해 ‘지역’과 ‘행복’은 불가분의 관계에 놓여 있음을 밝히면서, ‘행복한 지역’의 개념을 수립한다. 더군다나 이런 ‘행복지역학’은 어떤 지역이라도 ‘행복한 지역’으로 탈바꿈시킬 수 있는 실제적 가이드라인을 제시하는데, 이것은 기존의 도시계획에서는 찾아볼 수 없는 것이다.

ABSTRACTIt is an unprecedented task to interpret Husserl’s transcendental phenomenology as a fundamental philosophy of happiness. Although happiness has been discussed in many psychologies, Csikszentmihalyi’s positive psychology defines happiness as “flow”, a psychic state of ongoing immersion guided by intrinsic motivations and rewards. In this paper, I interpret our transcendental consciousness as a radical “flow” maker and claim that in our transcendental life, happiness is what we ourselves are. Then, I propose this not only as an appeal to a change (...) of attitude for happiness, but also as a deep hermeneutics of the mental skills and activity designs suggested by positive psychology. In this way, worldly happiness dictums can be profoundly re-examined. Understood as such, Husserl’s transcendental phenomenology leaves us the task of how to make a concrete form of qualitative or hermeneutical research on happiness out of it. (shrink)

Structural injustice broadly refers to objectionable outcomes produced by generally accepted social structures for members of particular social groups. But theorists of structural injustice have said relatively little about why certain outcomes are objectionable, and many theorists suggestively connect structural injustice to a worry about oppression without explaining their precise normative concerns. I provide a normative analysis of structural injustice that addresses this gap and clarifies its connection to oppression. On this view, there are two kinds of structural injustice, each (...) grounded in a distinct moral concern. One is a freedom-based concern for how social structures harmfully constrain members of a social group, depriving them of the means to develop and exercise their capacities. The other is an equality-based concern for how social structures subordinate a social group to others in hierarchies of power, standing, and esteem. By disentangling these concerns, this account shows that our social structures contain multiple kinds of injustice that do not necessarily travel together; some social groups experience unfreedom without being subordinated to others, and indeed their unfreedom is intertwined with their dominant position over subordinated groups. Furthermore, against prevailing philosophical accounts, this analysis shows that there are good reasons to understand oppression primarily as an issue of inequality rather than an issue of unfreedom. Sudden enlightenment is awakening to be attained all at once. Hyun-Eung, a Korean Buddhist monastic, has proposed a new interpretation that sudden enlightenment is the revolutionary awakening of the dynamical and indivisible structure of cognitive subject and objects. I argue that Hyun-Eung’s ‘revolutionary enlightenment’ is achieved through a ‘paradigm shift’ in Thomas Kuhn’s sense as presented in his The Structure of Scientific Revolutions. Enlightenment is obtained when one’s essentialist and realist worldview is replaced, through a revolutionary change of paradigm shift, (...) by a new perspective based on the Buddhist teaching of dependent arising and emptiness. Prior to enlightenment, each person views oneself as a separate and independent individual who has her own essence. However, when our perspective on self and the world changes with the understanding of dependent arising and emptiness, it becomes clear that no one and nothing can exist independently of conditions. Everything comes into existence, abides, and passes out of existence only in dependence on conditions. Sudden enlightenment requires a revolutionary change in one’s perspective of self and the world. I conclude that this concept of revolutionary enlightenment aptly explains the features of sudden enlightenment. (shrink)

This paper presents a summary and discussion of an assignment that asked students about the impact of Large Language Models on their college education. Our analysis summarizes students’ perception of GPT-3, categorizes their proposals for modifying college courses, and identifies their stated values about their college education. Furthermore, this analysis provides a baseline for tracking students’ attitudes toward LLMs and contributes to the conversation on student perceptions of the relationship between writing and philosophy.

Does the seller of a house have to tell the buyer that the water is turned off twelve hours a day? Does the buyer of a great quantity of tobacco have to inform the seller that the military blockade of the local port, which had depressed tobacco sales and lowered prices, is about to end? Courts say yes in the first case, no in the second. How can we understand the difference in judgments? And what does it say about whether (...) the psychiatrist should disclose to his patient's girlfriend that the patient wants to kill her? Kim Lane Scheppele answers the question, Which secrets are legal secrets and what makes them so? She challenges the economic theory of law, which argues that judges decide cases in ways that maximize efficiency, and she shows that judges use equality as an important principle in their decisions. In the course of thinking about secrets, Scheppele also explores broader questions about judicial reasoning--how judges find meaning in legal texts and how they infuse every fact summary with the values of their legal culture. Finally, the specific insights about secrecy are shown to be consistent with a general moral theory of law that indicates what the content of law should be if the law is to be legitimate, a theory that sees legal justification as the opportunity to attract consent. This is more than a book about secrets. It is also a book about the limits of an economic view of law. Ultimately, it is a work in constructive legal theory, one that draws on moral philosophy, sociology, economics, and political theory to develop a new view of legal interpretation and legal morality. This book is part of the growing field of practical approaches to philosophical questions relating to identity, agency and ethics--approaches which work across continental and analytical traditions and which Atkins justifies through an explication of how the structures of human embodiment necessitate a narrative model of selfhood, understanding, and ethics.

Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

I defend pretence hermeneutic fictionalism against the Autism Objection. The objection is this: since people with autism have no difficulty in engaging with mathematics even if they cannot pretend, it is not the case that engagement with mathematics involves pretence. I show that a previous response to the objection is inadequate as a defence of the kind of pretence hermeneutic fictionalism put forward as a semantic thesis about the discourse in question. I claim that a more general response to the (...) Autism Objection is to deny the premise that people with autism cannot pretend. To motivate this response, I appeal to psychological studies suggesting that people with autism can understand pretence and they can pretend under certain conditions. Finally, I provide explanations for why it is the case that people with autism do not have a problem with engaging in mathematics whereas they have so much difficulty with other kinds of figurative language and pretence.
