Electronic information is a vital but complex component in the modern health care system, fueling ongoing efforts to develop a universal electronic health record infrastructure. This innovation creates a substantial tension between two desirable values: the increased quality and utility of patient medical records and the protection of the privacy of the information they contain. This article discusses related U.S. legislation, policy, and law—including the Health Insurance Portability and Accountability Act of 1996. This article offers an inclusive, equilibrium model to (...) conceptualize the spectrum of challenge that this interplay of desirable but oppositional values creates. The model illustrates the relationship between information privacy and information flow, and that between individual and society-level needs, within the resulting impact sectors of individual security, health care priorities, public health effectiveness, and e-health development, while specifying beneficial outcomes for each. More than most information‐gathering professions, journalism depends on authorities as legitimate sources of information. Ironically, the journalistic appeal to authority is used to bolster the credibility of a reporter's story, even though the substitution of authoritative pronouncements for first‐hand investigation makes reporters vulnerable to hoaxes and bias.

We provide a simple and transparent construction of Hrushovski's strongly minimal fusions in the case where the fused strongly minimal sets are vector spaces. We strengthen Hrushovski's result by showing that the strongly minimal fusions are model complete.

Fix an algebraically closed field of characteristic zero and let G be its geometry of transcendence degree one extensions. Let X be a set of points of G. We show that X extends to a projective subgeometry of G exactly if the partial derivatives of the polynomials inducing dependence on its elements satisfy certain separability conditions. This analysis produces a concrete representation of the coordinatizing fields of maximal projective subgeometries of G.

There appears to be a tension between two commitments in liberalism. The first is that citizens, as rational agents possessing dignity, are owed a justification for principles of justice. The second is that members of society who do not meet the requirements of rational agency are owed justice. These notions conflict because the first commitment is often expressed through the device of the social contract, which seems to confine the scope of justice to rational agents. So, contractarianism seems to ignore (...) the justice claims of the severely cognitively impaired. To solve this problem, Martha Nussbaum proposes the capabilities approach. The justifiability condition, on this approach, is met by the idea of overlapping consensus. This essay argues that overlapping consensus cannot meet liberalism’s justifiability condition, nor is it more inclusive of the cognitively impaired. Therefore, we have reason to retain the contract device and look for another way to ensure that liberalism respects the justice claims of all. (shrink)

Abstract:While the medical ethics literature has well explored the harm to patients, families, and the integrity of the profession in failing to disclose medical errors once they occur, less often addressed are the moral and professional obligations to take all available steps to prevent errors and harm in the first instance. As an expanding body of scholarship further elucidates the causes of medical error, including the considerable extent to which medical errors, particularly in diagnostics, may be attributable to cognitive sources, (...) insufficient progress in systematically evaluating and implementing suggested strategies for improving critical thinking skills and medical judgment is of mounting concern. Continued failure to address pervasive thinking errors in medical decisionmaking imperils patient safety and professionalism, as well as beneficence and nonmaleficence, fairness and justice. We maintain that self-reflective and metacognitive refinement of critical thinking should not be construed as optional but rather should be considered an integral part of medical education, a codified tenet of professionalism, and by extension, a moral and professional duty. Existing justifications for exclusionary rules and stays of proceedings in response to pre-trial wrongdoing by police officers and prosecutors are often thought to be counter-productive or disproportionate in their consequences. This article begins to explore whether the concept of standing to blame can provide a fresh justification for such responses. It focuses on a vice related to standing—hypocrisy—and a related vice concerning inconsistent blame. It takes seriously the point that criminal justice agencies, although all part of the State, are in (...) real terms separated from each other, and analyses the so-called separation thesis (or theses). It concludes that hypocrisy and inconsistent blame arguments could plausibly justify exclusion and stays only in relation to lower-level offending, and even there only indirectly. This is in the sense that exclusion and stays are expressions of judicial frustration with other bodies for their failure to take pre-trial wrongdoing seriously. (shrink)

Mix & Stir wants to expand this landscape by bringing to the fore new, recalcitrant, queer, idiosyncratic practices and discourses, theories and topics, methods and concerns that open up ways to approach art from a global perspective. Analogous (...) to a cookery book filled with recipes and instruction, Mix & Stir explores new outlooks on contemporary art from global perspectives. It intends to encourage studying art beyond national constraints, cultural dominances, and hierarchies: a voyage similar to that of culinary discovery. The book brings a variety of tastes and flavours to the table, and breaks new ground by allowing innovative, contrary, queer, idiosyncratic practices and discourses, theories and topics, methods, and concerns to access art in its global dimensions. Researchers, curators and artists with a special interest in this topical issue were invited to present, develop, outline, and contemplate compelling frames of reference, both theoretical and artistic, in order to arrive at a true 'world art studies'. Their contributions are structured in seven thematic fields: Undecidability and Spectatorship, Collectives, Circulations, Exhibitions, Artists at Work, Postcolonial Perspectives, and Deep Art History. We provide a general framework for studying the expansion of strongly minimal sets by adding additional relations in the style of Hrushovski. We introduce a notion of separation of quantifiers which is a condition on the class of expansions of finitely generated models for the expanded theory to have a countable ω-saturated model. We apply these results to construct for each sufficiently fast growing finite-to-one function μ from 'primitive extensions' to the natural numbers a theory T μ of an expansion (...) of an algebraically closed field which has Morley rank 2. Finally, we show that if μ is not finite-to-one the theory may not be ω-stable. (shrink)

More generally, the finite rank expansions of a strongly minimal set obtained by adding a ‘random’ unary predicate are almost strongly minimal and model complete provided the strongly minimal set is ‘well-behaved’ (...) and admits ‘exactly rank k formulas’. This article presents the first systematic typological study of emotional expressions involving body parts at the scale of a continent, namely the Australian continent. The role of body parts in figurative descriptions of emotions, a well-established phenomenon across the world, is known to be widespread in Australian languages. This article presents a typology of body-based emotional expressions across a balanced sample of 67 languages, where we found that at least 30 distinct body parts occur in emotional expressions. The belly is (...) by far the most frequent, and a dozen others also have significant representation. The study shows how the properties of these body parts – e.g., whether they are internal organs or visible facial parts – partly determine which historical scenarios led to their linguistic associations with emotions, and in turn, their semantic and figurative properties. Worte verletzen und kränken. Woher aber kommt diese Verletzungsmacht? Während in der deutschsprachigen Philosophie Sprache meist als Gegenmittel zur Gewalt begriffen wird, hat die US-amerikanische Debatte um "hate speech" gezeigt, dass das Sprechen Gewalt nicht nur androhen oder verhindern, sondern selbst eine Form von Gewaltausübung sein kann. Wie nun sind sprachliche Verletzung, Ausgrenzung und Missachtung zu erklären und zu verstehen? The standard theory of logic programming is not applicable to Prolog programs even not to pure code. Modifying the theory to take account of reality more is the motivation of this article. For this purpose we introduce the ℓ-completion and the inductive extension of a logic program. Both are first-order theories in a language with operators for success, failure and termination of goals. The ℓ-completion of a logic program is a sound and complete axiomatization of the Prolog depth-first search under (...) certain natural conditions; the inductive extension of the ℓ-completion is a suitable theory for proving termination and equivalence of pure Prolog programs with negation.
