Prior to Kripke's seminal work on the semantics of modal logic, McKinsey offered an alternative interpretation of the necessity operator, inspired by the Bolzano-Tarski notion of logical truth. According to this interpretation, `it is necessary that A' is true just in case every sentence with the same logical form as A is true. In our paper, we investigate this interpretation of the modal operator, resolving some technical questions, and relating it to the logical interpretation of modality and some views in (...) modal metaphysics. In particular, we present an hitherto unpublished solution to problems 41 and 42 from Friedman's 102 problems, which uses a different method of proof from the solution presented in the paper of Tadeusz Prucnal. Restatements of the law are usually considered a uniquely American phenomenon, explained by the complexities and uncertainties of a multi-jurisdictional common law system. They have also been subject to the accusation from legal realists that they are misleading, conservative and formalistic exercises. This review interrogates the role of the restatement in a jurisdiction with a singular common law tradition, focusing on Andrew Burrows’ recent Restatement of the English law of Unjust Enrichment. It compares and contrasts his restatement with previous American (...) restatements and with other types of ‘public statement’ of private Law, such as codes and legal treatises. It concludes that there may be good (and particular) reasons for restating unjust enrichment law in England and that Burrows’ work is unique in its form and purposes. This article’s central thesis is that a restatement can provide an important public platform for intellectual debate and a powerful centripetal force addressing legal fragmentation and uncertainty even in a singular common law jurisdiction. It further suggests that modernist doctrinal enterprises of this type may be more sympathetic to the critical insights of legal realism than is sometimes suggested. (shrink)

I defend the truthmaker approach to counterfactuals against certain objections that Andrew Bacon has made in his paper.

Aristotle famously held that objects are comprised of matter and form. That is the central doctrine of hylomorphism (sometimes rendered “hylemorphism”—hyle, matter; morphe, form), and the view has become a live topic of inquiry today. Contemporary proponents of the doctrine include Jeffrey Brower, Kit Fine, David Hershenov, Mark Johnston, Kathrin Koslicki, Anna Marmodoro, Michael Rea, and Patrick Toner, among others. In the wake of these contemporary hylomorphic theories the doctrine has seen application to various topics within mainstream analytic metaphysics. Here, (...) appeals to form and matter are used to shed light on problems about ontology, personal identity, philosophy of mind, and philosophy of religion. In this paper two paradoxes of infinity are considered through the lens of counterfactual logic, drawing heavily on a result of Fine (2012b). I will argue that a satisfactory resolution of these paradoxes will have wide ranging implications for the logic of counterfactuals. I then situate these puzzles in the context of the wider role of counterfactuals, connecting them to indicative conditionals, probabilities, rationality and the direction of causation, and compare my own resolution of the paradoxes to alternatives inspired by (...) the theories of Lewis and Fine. Here is a quick overview of the paper. Sections 17.1 and 17.2 introduce two paradoxes of infinity that rest on certain principals concerning the logic of counterfactuals. Section 17.3 considers three possible ways to weaken the counterfactual logic that would resolve these paradoxes, and examines three concrete theories of conditionals which make those weakenings — Lewis (1973), Fine (2012a) and Bacon (2015). With the first two theories found wanting, Sect. 17.4 develops my preferred solution in (Bacon, 2015) a little further, and provides some simple models to show that the paradoxes can indeed be resolved in that framework. Understanding a patient’s story is integral to providing ethically supportable and practical recommendations that can improve patient care. Important skills include how to elicit an individual’s story, how to weave different narrative threads together, and how to assist the care team, patients, and caregivers to resolve difficult decisions or moral dilemmas. Narrative approaches to ethics consultation deepen dialogue and stakeholders’ engagement to reveal important values, preferences, and beliefs that may prove critical in resolving care challenges. Recognizing barriers to narrative inquiry, (...) such as patients who are unable or refuse to share their story, is also important. In this article we offer specific steps and guidelines that ethicists can follow to systematically elicit and construct patients’ stories. We provide a case example to illustrate how a narrative approach to ethics consultation illuminates salient ethical issues that may otherwise go unnoticed. We argue that this approach should be part of every consultant’s tool kit. (shrink)

Field theories have been central to physics over the last 150 years, and there are several theories in contemporary physics in which physical fields play key causal and explanatory roles. This paper proposes a novel field trope-bundle (FTB) ontology on which fields are composed of bundles of particularized property instances, called tropes and goes on to describe some virtues of this ontology. One of the key achievements of critical realism has been to expose the modernist myth of universal reason, which holds that authentic knowledge claims must be objectively ‘pure’, uncontaminated by the subjectivity of local place, specific time and particular culture. Wright aims to address the lack of any substantial and sustained engagement between critical realism and theological critical realism with particular regard to: (a) the distinctive ontological claims of Christianity; (b) their epistemic warrant and intellectual legitimacy; and (c) scrutiny of (...) the primary source of the ontological claims of Christianity, namely the historical figure of Jesus of Nazareth. As such, it functions as a prolegomena to a much needed wider debate, guided by the under-labouring services of critical realism, between Christianity and various other religious and secular worldviews. This important new text will help stimulate a debate that has yet to get out of first gear. This book will appeal to academics, graduate and post-graduate students especially, but also Christian clergy, ministers and informed laity, and members of the general public concerned with the nature of religion and its place in contemporary society. This book offers an exciting re-interpretation of Auguste Comte, the founder of French sociology. Following the development of his philosophy of positivism, Comte later focused on the importance of the emotions in his philosophy resulting in the creation of a new religious system, the Religion of Humanity. Andrew Wernick provides the first in-depth critique of Comte's concept of religion and its place in his thinking on politics, sociology and philosophy of science. He places Comte's ideas in the context of post-1789 (...) French political and intellectual history, and of modern philosophy, especially postmodernism. Wernick relates Comte to Marx and Nietzsche as seminal figures of modernity and examines key features of modern and postmodern French social theory, tracing the inherent flaws and disintegration of Comte's system. Our aim in this paper is to extend the semantics for the kind of logic of ground developed in (deRosset and Fine, 2023). In that paper, we very briefly suggested a way of treating universal and existential quantification over a fixed domain of objects. Here we explore some options for extending the treatment to allow for a variable domain of objects.

This paper is concerned with the semantics for the logics of ground that derive from a slight variant GG of the logic of (Fine, 2012) that have already been developed in (deRosset and Fine, 2023). Our aim is to outline that semantics and to provide a comparison with two related semantics for ground, given in (Correia, 2017) and (Kraemer, 2018). This comparison highlights the strengths and difficulties of these different approaches.

A number of philosophers have recently become receptive to the idea that, in addition to scientific or causal explanation, there may be a distinctive kind of metaphysical explanation, in which explanans and explanandum are connected, not through some sort of causal mechanism, but through some constitutive form of determination. I myself have long been sympathetic to this idea of constitutive determination or ‘ontological ground’; and it is the aim of the present paper to help put the idea on a firmer (...) footing - to explain how it is to be understood, how it relates to other ideas, and how it might be of use in philosophy. This chapter explains the basic framework of truthmaker or 'exact' semantics, an approach to semantics that has recently received a growing amount of interest, and discusses a number of different applications within philosophy and linguistics. The idea of truthmaking is the idea of something on the side of the world ‐ a fact, perhaps, or a state of affairs ‐ verifying, or making true, something on the side of language or thought ‐ a statement, perhaps, or a proposition. The chapter (...) focuses on the ultimate truthmakers, on what in the world ultimately makes something true, and the question of how the truthmakers make the statements of our language true is of no great concern. In this paper I explore the pedagogical and political shift marked by the meaning and practice of diversity offered through New Labour education policy texts, specifically, the policy and practice of personalized learning (or personalization). The aim of this paper is to map the ways in which diversity relays and mobilizes a set of neoliberal positions and relationships in the field of education and seeks to govern education institutions and education users through politically circulating norms and values. These norms and (...) values, I want to argue, echo and redeem the kinds of frameworks, applications and rationalities typically aligned with modes of neoliberal or advanced liberal governance, e.g. marketization, monetarization, atomization and deregulation. I conclude the paper by considering how diversity in education renders problematic conventional antinomies of the citizen and consumer, public and private, state and civil society, etc., and forces us to confront the rhizomatic character of contemporary governance and education in the era of neoliberalism. This paper distinguishes two kinds of realist issue -- the issue of whether the propositions of a given domain are factual and the issue of whether they are fundamental. It criticizes previous accounts of what these issues come to and suggests that they are to be understood in terms of a basic metaphysical concept of reality. This leaves open the question of how such issues are to be resolved; and it is argued that this may be done through consideration of (...) what grounds the facts of a given domain, when fundamentality is in question, and what grounds our engagement with the putative facts, when factuality is in question. We discuss the view that a hole is identical to the region of spacetime at which it is located. This view is more parsimonious than the view that holes are sui generis entities located at those regions surrounded by their hosts and it is more plausible than the view that there are no holes. We defend the spacetime view from several objections.

This article addresses a still unsolved puzzle in private law regarding the proper explanation of cases in which courts make substantial awards of damages to claimants whose rights have been infringed, but who appear to have suffered no factual loss in consequence of the infringement. The paradigm examples tend to involve awards of ‘user’, license fee or ‘hypothetical bargain’ damages in cases involving interference with property rights. It suggests that existing explanations of such cases are all unsatisfactory in one or (...) another respect and posits a new and potentially more powerful explanatory thesis, drawing on Hohfeld. Such awards, it argues, compensate right-holders for the loss of legal powers associated with their primary claim-rights—in particular, the loss of powers they are accorded by the law to ‘prevent’ the infringement of certain types of primary claim right ex ante. Legal powers are thus to be regarded as assets or amenities, the loss of which is amenable to monetary compensation. (shrink)

Despite his impressive influence on nineteenth-century philosophy, F. A. Trendelenburg's own philosophy has been largely ignored. However, among Kant scholars, Trendelenburg has always been remembered for his feud with Kuno Fischer over the subjectivity of space and time in Kant's philosophy. The topic of the dispute, now frequently referred to as the ?Neglected Alternative? objection, has become a prominent issue in contemporary discussions and interpretations of Kant's view of space and time. The Neglected Alternative contends that Kant unjustifiably moves from (...) the claim that we have a priori intuitions of space and time to the sceptical conclusion that space and time are exclusively subjective. Most current discussions trace the objection back to Trendelenburg and often use him to motivate the objection. However, to date Trendelenburg's actual arguments and reasons for rejecting the Kantian view of space and time have not been sufficiently uncovered; my goal here is to fill this lacuna. By better understanding what Trendelenburg actually argued, we will be in a better position to assess whether the Neglected Alternative objection against Kant is successful. But in addition, Trendelenburg's own system is of independent philosophical interest, and my work here will shed light on one part of it. (shrink)

In this article, we analyzed the effect of various factors on moral judgment and ethical attitudes of working persons. It was found that the effect of various socio-demographic factors on ethical attitudes varied between the two different categories of ethical issues under study, issues which involve explicit violation of laws vis-à-vis issues which involved social concerns. Our results did not support the implication of Callahan’s hypothesis that males are more sensitive to rule-based ethical issues while women are to issues involving (...) social concerns; it was found that females have a lower acceptability of unethical behaviors related to both categories of issues in Hong Kong, whereas gender effect was not statistically significant in Mainland China. University education also had no significant effect on ethical attitudes. Religion played an important role in affecting ethical attitudes, however, its effect varied with different types of religions; Christianity was found to be most favorable to higher ethical standards, but people of traditional Chinese religion had a higher acceptability of unethical behaviors involving social concerns compared to people with no religion. Our finding also indicated that employees in state-owned enterprises, private employees, employees in foreign-investment firms, and employers in Mainland China all had a higher acceptability of unethical law-breaking behaviors compared to workers in collectives, throwing doubt on the validity of convergence theory in Mainland China. It is argued that there are three main forms of necessity --the metaphysical, the natural and the normative--and that none of them is reducible to the others or to any other form of necessity. In arguing for a distinctive form of natural necessity, it is necessary to refute a version of the doctrine of scientific essentialism; and in arguing for a distinctive form of normative necessity, it is necessary to refute certain traditional and contemporary versions of ethical naturalism.

I propose a new semantics for intuitionistic logic, which is a cross between the construction-oriented semantics of Brouwer-Heyting-Kolmogorov and the condition-oriented semantics of Kripke. The new semantics shows how there might be a common semantical underpinning for intuitionistic and classical logic and how intuitionistic logic might thereby be tied to a realist conception of the relationship between language and the world.

I discuss Yablo’s approach to truthmaker semantics and compare it with my own, with special focus on the idea of a proposition being true of or being restricted to some subject-matter, the idea of propositional containment, and the development of an ‘incremental’ semantics for the conditional. I conclude with some remarks on the relationship between truth-maker approach and the standard possible worlds approach to semantics.

It is my aim in this paper to show that the contemporary assimilation of essence to modality is fundamentally misguided and that, as a consequence, the corresponding conception of metaphysics should be given up. It is not my view that the modal account fails to capture anything which might reasonably be called a concept of essence. My point, rather, is that the notion of essence which is of central importance to the metaphysics of identity is not to be understood in (...) modal terms or even to be regarded as extensionally equivalent to a modal notion. The one notion is, if I am right, a highly refined version of the other; it is like a sieve which performs a similar function but with a much finer mesh. (shrink)

What happens once the rogue rides off into the sunset? This cross-genre essay considers the figure of the rogue’s decline and gradual dismemberment in the face of the pressures of the world. Beginning with the “rogue” digits and other body parts lost by the men who surrounded him in his youth—especially his grandfather—Dobson considers the costs of labour and poverty in rural environments. For him, the rogue is one who falls somehow outside of cultural, social, and political norms—the one who (...) has decided to step outside of the establishment, outside of the corrupt élites and their highfalutin ways. To do so comes at a cost. Turning to the life of writer George Ryga and to the poetry and fiction of Patrick Lane, this essay examines the real, physical, material, and social costs of transgression across multiple works linked to rural environments in Alberta and British Columbia. The essay shows the ways in which very real forms of violence discipline the rogue, pushing the rogue back into submission or out of mind, back into the shadowy past from whence the rogue first came. Resisting nostalgia while evincing sympathy, this essay delves into what is at stake for one who would become a rogue. (shrink)

Confucian ethics as applied to the study of business ethics often relate to the micro consideration of personal ethics and the character of a virtuous person. Actually, Confucius and his school have much to say about the morals of the public administration and the market institutions in a more macro level. While Weber emphasizes the role of culture on the development of the economy, and Marx the determining influence of the material base on ideology, we see an interaction between culture (...) – specifically Confucian business ethics – and the economy. In this paper, we are going to study this interaction in several crucial stages of development of Confucianism.
