How should we live? What do we owe to other people? In Goodness and Advice, the eminent philosopher Judith Jarvis Thomson explores how we should go about answering such fundamental questions. In doing so, she makes major advances in moral philosophy, pointing to some deep problems for influential moral theories and describing the structure of a new and much more promising theory. Thomson begins by lamenting the prevalence of the idea that there is an unbridgeable gap between fact and (...) value--that to say something is good, for example, is not to state a fact, but to do something more like expressing an attitude or feeling. She sets out to challenge this view, first by assessing the apparently powerful claims of Consequentialism. Thomson makes the striking argument that this familiar theory must ultimately fail because its basic requirement--that people should act to bring about the "most good"--is meaningless. It rests on an incoherent conception of goodness, and supplies, not mistaken advice, but no advice at all. Thomson then outlines the theory that she thinks we should opt for instead. This theory says that no acts are, simply, good: an act can at most be good in one or another way--as, for example, good for Smith or for Jones. What we ought to do is, most importantly, to avoid injustice; and whether an act is unjust is a function both of the rights of those affected, including the agent, and of how good or bad the act is for them. The book, which originated in the Tanner lectures that Thomson delivered at Princeton University's Center for Human Values in 1999, includes two chapters by Thomson ("Goodness" and "Advice"), provocative comments by four prominent scholars--Martha Nussbaum, Jerome Schneewind, Philip Fisher, and Barbara Herrnstein Smith--and replies by Thomson to those comments. In my contribution to this volume, I (BHS) comment on on the stultifying rhetoric of contemporary analytic moral theory as illustrated in Judith Jarvis Thomson's Tanner Lectures, with particular reference to Thomson's anxieties about the moral relativism exhibited by college freshman and to her efforts--quite strained, in my view, and inevitably unsuccessful--to demonstrate the existence of objective judgments in matters of morality and taste .

THOMSON, Judith Jarvis (1929– ) Judith Jarvis Thomson received her BA from Barnard College in 1950, her MA from Cambridge University in 1956, and a Ph.D. from Columbia University in 1959. Her first teaching position was at Barnard where she was a lecturer from 1955–9, an instructor from 1959–60, and then Assistant Professor from 1960–2. In 1963, she moved to Boston, first as an Assistant Professor at Boston University (1963–4), and then to the Massachusetts Institute of Technology, where (...) she has remained ever since. She became full Professor in 1969, and between 1990 and 1996 held the Laurence S. Rockefeller Chair in Philosophy at MIT. She has received a large number of awards and honours, and contributed in many ways to professional philosophy in America. In 1992, she held the Presidency of the American Philosophical Association (Eastern Division), and in 1999, she gave the Tanner Lectures at Princeton University. She is Chair of the American Philosophical Association's Board of Officers for 2002-5, and gave the Association's Carus Lectures in 2003. She is also widely acknowledged as one of the best teachers of philosophy, and the excellence of the graduate program at MIT is due in no small measure to her influence. Thomson’s philosophical work ranges widely but her main areas of concentration are moral philosophy and metaphysics. In moral philosophy, Thomson has made seminal contributions to all three sub-fields of that discipline, applied ethics, moral theory and metaethics. Recent work on Mary Shepherd has largely focused on her metaphysics, especially as a response to Berkeley and Hume. However, relatively little attention has thus far been paid to the epistemological aspects of Shepherd’s program. What little attention Shepherd’s epistemology has received has tended to cast her as providing an unsatisfactory response to the skeptical challenge issued by Hume. For example, Walter Ott and Jeremy Fantl have each suggested that Shepherd cannot avoid Hume’s inductive skepticism even if she is granted (...) her metaphysics. In this paper, I examine Shepherd’s epistemology and argue that her response to Hume is more successful than the current literature suggests. In particular, I argue that, if Shepherd is granted her metaphysics, she can answer Hume’s demand for a rational justification of ordinary inductive inferences via a deductively justified uniformity principle and an appeal to parsimony. The author considers the way in which psychic life is generated by the social operation of power, and how that social operation of power is concealed and fortified by the psyche that it produces. Power is no longer understood to be 'internalized' by an existing subject, but the subject is spawned as an ambivalent effect of power, one that is staged through the operation of conscience. To claim that power fabricates the psyche is also to claim that there is a (...) fictional and fabricated quality to the psyche. The figure of a psyche that 'turns against itself' is crucial to this study, and offers an alternative to describing power as 'internalized'. Although most readers of Foucault eschew psychoanalytic theory, and most thinkers of the psyche eschew Foucault, the author seeks to theorize this ambivalent relation between the social and the psychic as one of the most dynamic and difficult effects of power. Antigone, the renowned insurgent from Sophocles's _Oedipus,_ has long been a feminist icon of defiance. But what has remained unclear is whether she escapes from the forms of power that she (...) opposes. Antigone proves to be a more ambivalent figure for feminism than has been acknowledged, since the form of defiance she exemplifies also leads to her death. Butler argues that Antigone represents a form of feminist and sexual agency that is fraught with risk. Moreover, Antigone shows how the constraints of normative kinship unfairly decide what will and will not be a livable life. Butler explores the meaning of Antigone, wondering what forms of kinship might have allowed her to live. Along the way, she considers the works of such philosophers as Hegel, Lacan, and Irigaray. If we are going to treat other species so very differently from our own — killing, eating and experimenting on pigs and sheep, for example, but never human beings — then it seems we need to come up with some morally relevant difference between us and them that justifies this difference in treatment. Otherwise it appears we are guilty of bigotry (in just the same way that someone who discriminates on the basis of race or sex is guilty of bigotry). (...) Ever since feminist theory introduced the distinction between sex and gender, the question of what it means to be a woman has preoccupied feminist thought. In ____Gender__ ____Trouble ____ Judith Butler questions whether it is possible to "be" a woman at all or, for that matter, any gender.

This paper attempts to demonstrate Max Scheler’s anticipation of and continued relevance to a burgeoning trend of essence-based accounts of modality, chief among them being Kit Fine’s landmark 1994 “Essence and Modality.” I argue that Scheler’s account of the material a priori not only anticipates the picture of essence-based modality suggested by Fine, but moreover offers resources with the potential to resolve key challenges for the Finean program. In particular, Fine’s account runs into problems in explaining how formal logical necessities (...) are to be grounded in essences, challenges that put pressure on the essentialist to adopt a non-propositional account of the nature of logical principles. I argue that one such account can be found in Scheler’s notion of the material a priori, according to which all necessary propositional truth is grounded in a realm of experientially given yet a priori "phenomenological facts." After showing the general rapprochement between Scheler’s and Fine’s accounts of regional modality, I then turn to address Scheler’s attempt to ground formal logical principles in essences. On Scheler’s picture, propositions expressing formal logical truths are true in virtue of the domain of essences in two senses: In terms of what Scheler calls objective necessity, they are true insofar as they coincide with the essential facts and interconnections shared by all possible regions of being; In terms of what he calls subjective necessity, they are true in virtue of these same essential facts and interconnections insofar as they have become “functionalized” into law-like patterns of cognition. All else being equal, can granting the objective purport of moral experience support a presumption in favor of some form of moral objectivism? Don Loeb (2007) has argued that even if we grant that moral experience appears to present us with a realm of objective moral fact—something he denies we have reason to do in the first place—the objective purport of moral experience cannot by itself provide even prima facie support for moral objectivism. In this paper, I contend against Loeb (...) that granting the objective purport of ordinary moral experience is sufficient to support a defeasible presumption in favor of moral objectivism, and this by constituting non-explanatory, comparative confirmation that incrementally raises the prima facie likelihood that moral facts exist. More specifically, I appeal to a modest confirmation principle shared by Likelihoodists and Bayesieans - namely, the Weak Law of Likelihood - in an effort to show that (i) at a minimum, moral experience establishes a middling scrutable probability for a sufficient but not necessary condition of moral objectivism being true, and that (ii) this moderate probability in turn constitutes evidence that makes it prima facie more probable than not that some form of moral objectivism is true. Since 9/11, citizens of all nations have been searching for a democratic public philosophy that provides practical and inspiring answers to the problems of the twenty-first century. Drawing on the wisdom of past and present pragmatist thinkers, Judith M. A set of qubit channels has a classical representation when it is isomorphic to the convex closure of a group of classical channels. From Crowder and Martin (Proceedings of Quantum Physics and Logic, Electronic Notes in Theoretical Computer Science, 2009), we know that up to isomorphism there are five such sets, each corresponding to either a subgroup of the alternating group on four letters, or a subgroup of the symmetric group on three letters. The book constitutes a reconsideration of her earlier view on gender performativity from Gender Trouble. In this work, the critique of gender norms is clearly situated within the framework of human persistence and survival.

Philosophical treatments of natural kinds are embedded in two distinct projects. I call these the philosophy of science approach and the philosophy of language approach. Each is characterized by its own set of philosophical questions, concerns, and assumptions. The kinds studied in the philosophy of science approach are projectible categories that can ground inductive inferences and scientific explanation. The kinds studied in the philosophy of language approach are the referential objects of a special linguistic category—natural kind terms—thought to refer directly. (...) Philosophers may hope for a unified account addresses both sets of concerns. This paper argues that this cannot be done successfully. No single account can satisfy both the semantic objectives of the philosophy of language approach and the explanatory projects of the philosophy of science approach. After analyzing where the tensions arise, I make recommendations about assumptions and projects that are best abandoned, those that should be retained, and those that should go their separate ways. I also recommend adopting the disambiguating terminology of “scientific kinds” and “natural kinds” for the different notions of kinds developed in these different approaches. (shrink)

Three experiments investigated the processing of the implicature associated with some using a “gumball paradigm.” On each trial, participants saw an image of a gumball machine with an upper chamber with 13 gumballs and an empty lower chamber. Gumballs then dropped to the lower chamber and participants evaluated statements, such as “You got some of the gumballs.” Experiment 1 established that some is less natural for reference to small sets and unpartitioned sets compared to intermediate sets. Partitive some of was (...) less natural than simple some when used with the unpartitioned set. In Experiment 2, including exact number descriptions lowered naturalness ratings for some with small sets but not for intermediate size sets and the unpartitioned set. In Experiment 3, the naturalness ratings from Experiment 2 predicted response times. The results are interpreted as evidence for a Constraint-Based account of scalar implicature processing and against both two-stage, Literal-First models and pragmatic Default models. (shrink)

Reviewing hate speech regulations, anti-pornography arguments, and recent controversies about gay self-declaration in the military, Judith Butler asks whether and how language acts in each of these cultural sites.

In this paper I will examine two responses to the argument from marginal cases; the argument from kinds and the similarity argument. I will argue that these arguments are insufficient to show that all humans have moral status but no animals do. This does not prove that animals have moral status but it does shift the burden of proof onto those who want to maintain that all humans are morally considerable, but no animals are.

Diversity is both an unavoidable aspect of twenty-first century living and a powerful challenge to older philosophical traditions that still assume as normatively universal a set of values, ways of thinking, institutions, and habits of living that emerged within earlier eras of more homogeneous cultures, less developed technologies, and more accepted forms of linguistic, legal, religious, economic, political, and military domination. Within recent years, new styles of philosophical discourse, including deconstruction, postmodernism, feminism, post-colonialism, and critical race theory, have persuasively challenged (...) these universalistic assumptions to reveal the important human differences they marginalize. Experience-based appreciation of the mutually educative potential of diverse standpoints as well as sober concern about the perils of our present times have led many thinkers to look for contemporary forms of pragmatism and cosmopolitanism as hospitable intellectual gathering places for urgently needed cross-difference conversations that may reflect and give substance to shared visions of democratic diversity. The eight authors in this volume engage in cross-difference conversations with other thinkers from earlier periods and other philosophical traditions, as well as with each other, in order to reconstruct pragmatism and cosmopolitanism in ways that are more attuned to our lived experience of diversity as well as our hopes for a diversity-appreciating democratic future.
