In this article, I demonstrate that recruitment of hoplites under the katalogos system was not defined simply by the state's capacity to coerce citizens into taking up arms; rather, publication of the names of citizens chosen for military service is a practice that reflects the complementary ethics of egoistic, rivalrous competition and communitarian duty that animated the democratic polis.

The power of the positive moral emotions to uplift and transform people has long been known, but not by psychologists. In 1771, Thomas Jefferson's friend Robert Skipwith wrote to him asking for advice on what books to buy for his library, and for his own education. Jefferson sent back a long list of titles in history, philosophy, and natural science. But in addition to these obviously educational works, Jefferson advised the inclusion of some works of fiction. Jefferson justified this (...) advice by pointing to the beneficial emotional effects of great fiction: [E]very thing is useful which contributes to fix us in the principles and practice of virtue. When any... act of charity or of gratitude, for instance, is presented either to our sight or imagination, we are deeply impressed with its beauty and feel a strong desire in ourselves of doing charitable and grateful acts also. On the contrary when we see or read of any atrocious deed, we are disgusted with its deformity and conceive an abhorrence of vice. Now every emotion of this kind is an exercise of our virtuous dispositions; and dispositions of the mind, like limbs of the body, acquire strength by exercise. (shrink)

This is a response to the nine commentaries on our target article “Unlimited Associative Learning: A primer and some predictions”. Our responses are organized by theme rather than by author. We present a minimal functional architecture for Unlimited Associative Learning that aims to tie to together the list of capacities presented in the target article. We explain why we discount higher-order thought theories of consciousness. We respond to the criticism that we have overplayed the importance of learning and underplayed (...) the importance of spatial modelling. We decline the invitation to add a negative marker to our proposed positive marker so as to rule out consciousness in plants, but we nonetheless maintain that there is no positive evidence of consciousness in plants. We close by discussing how UAL relates to development and to its material substrate. (shrink)

Christian List has recently constructed a novel formal framework for representing the relationship between free will and determinism. At its core is a distinction between physical and agential levels of description. List has argued that, since the consequence argument cannot be reconstructed within this framework, the consequence argument rests on a ‘category mistake’: an illicit conflation of the physical and agential levels. I show that an expanded version of List’s framework allows the construction of a cross-level consequence (...) argument. (shrink)

There is increasing interest in using neuro-stimulation devices to achieve an ergogenic effect in elite athletes. Although the World Anti-Doping Authority does not currently prohibit neuro-stimulation techniques, a number of researchers have called on WADA to consider its position on this issue. Focusing on trans-cranial direct current stimulation as a case study of an imminent so-called ‘neuro-doping’ intervention, we argue that the emerging evidence suggests that tDCS may meet WADA’s own criteria for a method’s inclusion on its list of (...) prohibited substances and methods. We begin by surveying WADA’s general approach to doping, and highlight important limitations to the current evidence base regarding the performance-enhancing effect of pharmacological doping substances. We then review the current evidence base for the safety and efficacy of tDCS, and argue that despite significant shortcomings, there may be sufficient evidence for WADA to consider prohibiting tDCS, in light of the comparable flaws in the evidence base for pharmacological doping substances. In the second half of the paper, we argue that the question of whether WADA ought to ban tDCS turns significantly on the question of whether it is compatible with the ‘spirit of sport’ criterion. We critique some of the previously published positions on this, and advocate our own sport-specific and application-specific approach. Despite these arguments, we finally conclude by suggesting that tDCS ought to be monitored rather than prohibited due to compelling non-ideal considerations. (shrink)

Task unrelated thought (TUT) refers to thought directed away from the current situation, for example a daydream. Three experiments were conducted on healthy participants, with two broad aims. First, to contrast distributed and encapsulated views of cognition by comparing the encoding of categorical and random lists of words (Experiments One and Two). Second, to examine the consequences of experiencing TUT during study on the subsequent retrieval of information (Experiments One, Two, and Three). Experiments One and Two demonstrated lower levels of (...) TUT and higher levels of word-fragment completion whilst encoding categorical relative to random stimuli, supporting the role of a distributed resource in the maintenance of TUT. In addition the results of all three experiments suggested that experiencing TUT during study had a measurable effect on subsequent retrieval. TUT was associated with increased frequency of false alarms at retrieval (Experiment One). In the subsequent experiments TUT was associated with no advantage to retrieval based on recollection, by manipulating instructions at encoding (Experiment Two), and/or at retrieval (Experiment Three). The implications of the results of all three experiments are discussed in terms of recent accounts of memory retrieval and conscious awareness. (shrink)

What is the relationship between sounds and time? More specifically, is there something essentially or distinctively temporal about sounds that distinguishes them from, say, colors, shapes, odors, tastes, or other sensible qualities? And just what might this distinctive relation to time consist in? Apart from their independent interest, these issues have a number of important philosophical repercussions. First, if sounds are temporal in a way that other sensible qualities are not, then this would mean that standard lists of paradigm secondary (...) qualities offered by Locke, Galileo, and other modern philosophers — lists which include colors, odors and sounds without any significant distinctions — overlook significant metaphysical differences. This, in turn, would threaten to undermine the coherence of the modern understanding of secondary qualities itself. Moreover, a number of authors have recently urged that the essential temporality of sounds makes it impossible to understand sounds as properties (except on a trope theory of properties; see note 3). If true, and given the more or less universal view that colors are properties, this last conclusion would make potentially inapplicable to sounds much of the comparatively well-developed philosophical taxonomy and apparatus that has arisen in philosophical disputes over the status of colors (for presentations of this taxonomy and apparatus see, for example, Byrne and Hilbert (2003); Cohen (2008b)).1 Therefore, the conclusion that sounds are distinctively temporal would be a serious blow to hopes for a theoretically unified treatment of the sensory qualities.2 For all these reasons, quite a lot seems to hang on the question of the temporality of sounds. Epistemologists often offer theories of justification without paying much attention to the variety and diversity of locutions in which the notion of justification appears. For example, consider the following claims which contain some notion of justification: B is a justified belief, S's belief that p is justified, p is justified for S, S is justified in believing that p, S justifiably believes that p, S's believing p is justified, there is justification for S to believe that p, there is justification (...) for S's believing p, and S has a justification for believing that p. In addition to these passive uses of the notion of justification, there are active uses as well: S justified his belief in p, believing e justifies believing p, etc. The syntactic variety involves semantic difference as well. For example, the proposition S has a justification for believing that p does not entail that S believes p, whereas the proposition S justifiably believes that p does entail that S believes p. Our ultimate goal is to show that this diversity is only superficial by arguing that there is a basic kind of justification. On the way, however, we shall argue that there are three central uses of a notion of justifica- tion in the above list: propositional justification (as in p is justified for S), personal justification (as in S is justified in believing that p) and doxastic justification (as in S's believing p is justified). Our preliminary argument will be that the multiplicity above can be explained in terms of these three locutions, and the substance of our argument will be to show that one of these three is the basic kind of justification. Success in this task will thereby justify, at least in part, the practice of contem- porary epistemologists. Our conclusions, however, shall not be of much comfort to contemporary epistemology, for the way in which the apparent diversity in the uses of the notion of justification is eliminated undermines much of recent epistemology. Though I find the project significant and unprecedented in this way, I am not convinced that it is entirely successful, and I will try to explain here the grounds of my concern. We can begin with Greco’s list of requirements for an adequate theory of knowledge, and the relationship he sees between simple reliabilism and his own theory, agent reliabilism.

Background There are numerous ethical challenges that can impact patients and families in the health care setting. This paper reports on the results of a study conducted with a panel of clinical bioethicists in Toronto, Ontario, Canada, the purpose of which was to identify the top ethical challenges facing patients and their families in health care. A modified Delphi study was conducted with twelve clinical bioethicist members of the Clinical Ethics Group of the University of Toronto Joint Centre for Bioethics. (...) The panel was asked the question, what do you think are the top ten ethical challenges that Canadians may face in health care? The panel was asked to rank the top ten ethical challenges throughout the Delphi process and consensus was reached after three rounds. Discussion The top challenge ranked by the group was disagreement between patients/families and health care professionals about treatment decisions. The second highest ranked challenge was waiting lists. The third ranked challenge was access to needed resources for the aged, chronically ill, and mentally ill. Summary Although many of the challenges listed by the panel have received significant public attention, there has been very little attention paid to the top ranked challenge. We propose several steps that can be taken to help address this key challenge. (shrink)

Clinical trials of novel agents often present several layers of ethical challenge. Because time and resources for ethical and safety review are limited, how investigators, IRBs, and regulators allocate attention to a trial's various safety dimensions itself represents a critical ethical question. In what follows, I use the example of a Parkinson's disease gene transfer trial to show how risks involving unknown probabilities or outcomes (ambiguity), might sometimes draw attention away from risks that involve known probabilities or outcomes. This potentially (...) undermines the goal of ‘systematic and nonarbitrary analysis of risk’ during ethical review. To counteract the possible effects of such attention biases, I propose that reviewers develop ‘cognitive aids’ like lists and, where appropriate, set aside time to discuss non-ambiguous risks. I also propose further research for addressing and understanding how attention allocation, emotion, and ambiguity influence ethical decision-making. (shrink)

The COVID-19 pandemic has coincided with the proliferation of ethical guidance documents to assist public health authorities, health care providers, practitioners and staff with responding to ethical challenges posed by the pandemic. Like ethical guidelines relating to infectious disease that have preceded them, what unites many COVID-19 guidance documents is their dependency on an under-developed approach to bioethical principlism, a normative framework that attempts to guide actions based on a list of prima facie, unranked ethical principles. By situating them (...) in relation to the key philosophical debates concerning bioethical principlism, we aim to explore the limits and limitations of pandemic ethical guidance documents as, specifically, ethics documents – documents that fulfil the functions of ethics as a fundamentally normative discipline. This means not only determining whether such ethical guidance documents can, in principle, provide adequate action guidance and action justification, but also, more importantly where pandemics are concerned, determining whether they support consistent decision making and transparent processes of justification. Having highlighted the problems with merely furnishing ethical guidelines with substantive ethical content in terms of principles and values, we argue that organizations that develop these documents should, instead, focus on the procedural dimensions of action guidance and action justification, which extend to questions regarding the make-up of the committees, panels and groups that develop such guidelines, the public transparency of justifications for specific pandemic-related advice or interventions and the development of explicit procedures for transparent and consistent decision making. The National Health Service (NHS) in the UK is currently facing a significant waiting list backlog following the disruption of the COVID-19 pandemic, with millions of patients waiting for elective surgical procedures. Effective treatment prioritisation has been identified as a key element of addressing this backlog, with NHS England's delivery plan highlighting the importance of ensuring that those with ‘the clinically most urgent conditions are diagnosed and treated most rapidly’. Indeed, we describe how the current clinical guidance on prioritisation (...) issued by The Federation of Surgical Specialty Associations serves this aim. However, whilst there are strong reasons to prioritise elective surgery in accordance with clinical need, we argue that it would be a mistake to assume that prioritisation in accordance with clinical need requires only a clinical or scientific judgement. The understanding of clinical need that we choose to employ in a prioritisation system will be grounded by some key ethical judgements. Moreover, we may also have to make trade-offs between addressing clinical need, safeguarding equality, and achieving other benefits. As the UK faces up to the backlog, it is important that surgical prioritisation guidelines enshrine a broad range of values that we believe ought to determine access to care in non-emergency circumstances. Our analysis suggests that the current approach to prioritisation is not a sufficiently nuanced way of balancing the different moral values that are operative in this context. (shrink)

Mental states differ from most other entities in the world in having semantic or intentional properties: they have meanings, they are about other things, they have satisfaction- or truth-conditions, they have representational content. Mental states are not the only entities that have intentional properties - so do linguistic expressions, some paintings, and so on; but many follow Grice, 1957 ] in supposing that we could understand the intentional properties of these other entities as derived from the intentional properties of mental (...) states. Of course, accepting this supposition leaves us with a puzzle about how the non-derivative bearers of intentional properties could have these properties. In particular, intentional properties seem to some to be especially difficult to reconcile with a robust commitment to ontological naturalism - the view that the natural properties, events, and individuals are the only properties, events, and individuals that exist. Fodor puts this intuition nicely in this oft-quoted passage: " I suppose that sooner or later the physicists will complete the catalogue they've been compiling of the ultimate and irreducible properties of things. When they do, the likes of _spin_, _charm_, and _charge_ will perhaps appear upon their list. But _aboutness_ surely won't; intentionality simply doesn't go that deep.... If aboutness is real, it must be really something else. " Some philosophers have reacted to this clash by giving up one of the two views generating the tension. The Confucian tradition, which places the virtue of ren or fellow feeling at its heart as a ‘gateway’ to the more concrete virtues of common Western parlance, offers a potential antidote to the excesses of a Western business ethics which, even after its recent academic reembrace of the Aristotelian tradition, in practice still too often instrumentalises virtue in the service of a ‘rational’ or ‘reasonable’ constraining of the profit motive. The deeper, intrinsic ‘ethos’ promised by a Confucian approach also finds (...) its echo in the West in the work of Hans Küng’s Weltethos project, led today on the business ethics front by Klaus Leisinger and Claus Dierksmeier. This paper explores a dilemma at the heart of the World Ethos movement seen from the twin peaks of the World Ethics Institute at Peking University and the Weltethos Institut at the University of Tübingen: namely, whether a business ethics culture accustomed to thinking in terms of CSR-esque lists of corporate values, virtues or principles can best be reformed via documents like the UN Global Compact, the 2010 Global Economic Ethic Manifesto, or even the UN Sustainable Development Goals, or whether a more radical, revolutionary quest for an inner ‘ethos’, to be lived and experienced by self-cultivating individuals engaged in business all over the world regardless of background, ought somehow to be undertaken parallel to these endeavours. The authors outline possible steps towards such a transformation of the management community’s understanding of virtue, without, however, dismissing the contribution of traditional, dilemma-oriented Western thinking about applied ethics in general, and business ethics in particular. This thousand-page book contains one third of the text of Samuel Pepys's diary, along with maps, a chronology, a glossary of archaic words, and an unusually helpful index, The diary, written in commercial short-hand, spans the 1660s, a decade in which power passed from the Roundheads to Charles II, London was ravaged by plague and then by fire, the English repeatedly fought the Dutch, and Pepys grew to be one of the most important civil servants in the land ("the father (...) of the English Navy", according to some). The diary, which I know only in this abridged version, has given me more sheer pleasure than any other book I have ever read. Writing for himself alone, Pepys had no sense of posterity looking over his shoulder with judgments about public, historic importance. He selected things for inclusion in the diary purely on the basis of how they struck him. This grand subjectivity would be fatal in a dull or passive or insensitive writer, but in Pepys it makes the work fresh and vibrant, constantly surprising, unlike anything else in literature. Even when describing an "important" scene, he is still his natural self and gives touches of his own behaviour, like this at the King's coronation: But so great a noise, that I could make but little of the Musique; and endeed, it was lost to everybody. But I had so great a list to pissse, that I went out a little while before the King had done all his ceremonies.... Not just his behavior, but also his reactions. (shrink)

Jonathan Aldred shares our desire to promote a reconciliation between social choice theory and deliberative democracy in the interests of a more comprehensive and compelling account of democracy.1 His comments on some details of our analysis – specifically, our use of Arrow’s conditions of universal domain and independence of irrelevant alternatives – give us an opportunity to clarify our position. His discussion of the independence condition in particular identifies some ambiguity in our exposition, and as such is useful. We (...) are less impressed by the way Aldred characterizes the overall terms of the reconciliation we propose. We believe that his argument on this matter should be resisted because it provides deliberative democrats with a bad excuse to dismiss social choice theory altogether, which is surely not what he intends. Stein Tibetan 724 was earlier identified as a list of virtues of the Buddha Amitābha. A new reading of the document and identification of its Chinese source allow its re-identification instead as a list of the virtues of invoking the Buddha Amitābha in a loud voice. The article offers a corrected transcription of the manuscript, presents and examines possible sources, and suggests the most plausible proximate original for the Tibetan translation, briefly exploring the practice of loud invocation as (...) a Buddhist practice in medieval Dunhuang. SeitzThe SBCS is one of more than two dozen scholarly societies that have been formally recognized by the American Academy of Religion as a “Related Scholarly Organization.” The pattern for many years has been for the SBCS to hold its annual meeting in conjunction with the annual meeting of the (...) AAR. On the Friday before the AAR’s annual meeting begins, the board meets in the morning and early afternoon, followed by an AAR-advertised session late that afternoon. On Saturday, another paper session or panel is followed by the annual members meeting.The Friday business meeting included reports from each of the SBCS officers and award committees. Guy McCloskey gave the treasurer’s report, which was unanimously accepted. He concluded his service on the board with this meeting, and in January was replaced as treasurer by Denise Yarbrough. The journal report by Wakoh Shannon Hickey and Denise Yarbrough, along with an extended discussion of the overall state of the journal, dealt with issues related to SBCS’s long-term relationship with the University of Hawai‘i Press and the current issue; the Society is working to sign a new memorandum of understanding with the Press. Another topic for discussion included outreach (website, Facebook page) and the need to reach potential new members. SBCS communicates with its whole membership through biannual newsletters. The newsletter is now distributed electronically, with hard copies available at the annual meeting. The decision was made to update the website. The nominating committee reported that three members (Brown, Seitz, Tanaka) will conclude their [End Page 185] terms as board members, but all three will remain on because they serve in other capacities. The Graduate Student Award Committee reported that despite several interesting submissions it did not choose a paper this year. The SBCS board typically has a graduate student representative (currently Glenn Willis).The Saturday members meeting on November 23 was called to order at 11:40 a.m. The nominating committee proposed a slate, which was unanimously approved. John Makransky was elected to the vice-presidency, and Sallie King, Judith Simmer-Brown, and Abraham Velez were chosen as board members. Elizabeth Harris, president of the European Network of Buddhist-Christian Studies, reported that the papers from their 2011 conference at Liverpool Hope University, titled “Hope a Form of Delusion? Michael Rose’s Zukünftige Generationen in der heutigen Demokratie: Theorie und Praxis der Proxy-Repräsentation (Future Generations in Today’s Democracy: Theory and Practice of Proxy Representation) is an ambitious and fascinating work. It provides a new conceptualisation of the representation of future generations and it also delivers the most extensive empirical study of institutions for the representation of future generations available to date. The book is based on Rose’s PhD thesis at the Heinrich Heine University, Düsseldorf, Germany, and is 516 pages long (...) (excluding an extensive bibliography, list of sources and appendices). A third of the thesis is devoted to short case studies of a total of 29 institutions which are presented in a catalogue format, allowing this section to be used as an encyclopaedia. Ojectives Low energy hip fractures are one of the greatest causes of morbidity and mortality in orthopaedics. This study aims to evaluate written consent forms with respect to basic standards as set out in the Good Practice in Consent Initiative. In particular the stated risks and benefits of each procedure were assessed. Methods 100 consecutive consent forms were reviewed prospectively. The stated procedure, side and complications were recorded. Appropriate signature and legibility was assessed. 13 consultant orthopaedic surgeons were surveyed to (...) identify what risks and benefits they thought should be stated. Results Of 100 consent forms, 31 were for patients who are unable to consent. All 100 consent forms were correctly filled in with patient details and signed. 98% were legible. All stated the side of the operation. The number of complications listed per form ranged from 4 to 11. Infection, bleeding and thromboembolic complications were stated in the majority of consent forms. In total, 30 different complications were recorded; some were only stated once. Discussion and Conclusions This work suggests consent forms are completed well with respect to patient identifiers, legibility and procedure. The variability of complications stated is vast. We suggest standard pre-printed consent forms containing risks and benefits should be used as this may improve standards of informed consent. This has also been recently supported by the British Orthopaedic Association. (shrink)

The International Holocaust Remembrance Alliance (IHRA) developed a ‘Working Definition of Antisemitism’ in 2016. Whilst the definition has received a significant amount of media attention, we are not aware of any comprehensive philosophical analysis. This article analyses this definition. We conclude that the definition and its list of examples ought to be rejected. The urgency to do so stems from the fact that pro-Israel activists can and have mobilised the IHRA document for political goals unrelated to tackling antisemitism, notably (...) to stigmatise and silence critics of the Israeli government. This causes widespread self-censorship, has an adverse impact on freedom of speech, and impedes action against the unjust treatment of Palestinians. We also identify intrinsic problems in the way the definition refers to criticism of Israel similar ‘to that leveled against any other country’, ambiguous wording about ‘the power of Jews as a collective’, lack of clarity as to the Jewish people’s ‘right to self-determination’, and its denial of obvious racism. We consider alternative definitions and prefer one like the Oxford English Dictionary (OED) definition, ‘hostility to or prejudice against Jews’, with the addition of the words ‘as Jews’. We recognise that the Jerusalem Declaration on Antisemitism (JDA) can play a useful purpose in illustrating the shortcomings of the IHRA definition. However, we do not advocate promoting it as the prime international definition. Indeed, we question the efficacy of using complex new definitions to combat racism against Jews or other groups, and instead advocate combatting it through collective action across societies. This article introduces a non-Anglophone concept of gong qi as a metaphor for ‘corporation’. It contributes an endogenous perspective from a Sino-Japanese organizational context that enriches mainstream business ethics literature, otherwise heavily reliant on Western traditions. We translate the multi-layered meanings of gong qi based on analysis of its ideograms, its references into classical philosophies, and contemporary application in this Japanese multinational corporation in China. Gong qi contributes a perspective that sees a corporation as an inclusive and virtuous social entity, (...) and also addresses the elusive, implicit, and forever evolving nature of organizational life that is rarely noticed. We propose gong qi can be applied in other organizations and wider cultural contexts to show a new way of seeing and understanding business ethics and organization. Rather than considering virtue as a list of definable individual qualities, we suggest that the metaphor of gong qi reveals how virtue can be experienced as indeterminate, yet immanently present, like the substance of emptiness. This, then allows us to see the virtue of immanence, the beauty of implicitness, and hence, the efficacy of gong qi. (shrink)

There is now a rapidly expanding population of interlinked developmental biology databases on the World Wide Web that can be readily accessed from a desk‐top PC using programs such as Netscape or Mosaic. These databases cover popular organisms (Arabidopsis, Caenorhabditis, Drosophila, zebrafish, mouse, etc.) and include gene and protein sequences, lists of mutants, information on resources and techniques, and teaching aids. More complex are databases relating domains of gene expression to embryonic anatomy and these range from existing text‐based systems for (...) specific organs such as kidney, to a massive project under development, that will cover gene expression during the whole of mouse embryogenesis. In this brief article, we review selected examples of databases currently available, look forward to what will be available soon, and explain how to gain access to the World Wide Web. (shrink)

This paper performs a critical analysis of Irving Gottesman’s 1991 “Figure 10,” which lists the lifetime risks of developing schizophrenia among the relatives of people diagnosed with schizophrenia. Figure 10, which has been cited in numerous psychiatry and abnormal psychology textbooks, is almost always discussed in support of important genetic influences on schizophrenia. However, the pooled results in Figure 10 can also be explained by environmental factors. Moreover, the risk percentages Gottesman reported are derived from biased research designs, some of (...) which are based on implausible theoretical assumptions, while some results are not included. It is concluded that a closer look at the studies used to compile Figure 10 might lead psychiatrists, psychologists, and genetic researchers to decide that, in addition to problems in schizophrenia adoption research and the ongoing failure to find postulated “schizophrenia genes,” the evidence supporting a genetic basis for schizophrenia is far weaker than is currently believed. 1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a (...) basis for generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

It is often argued that higher-level special-science properties cannot be causally efficacious since the lower-level physical properties on which they supervene are doing all the causal work. This claim is usually derived from an exclusion principle stating that if a higher-level property F supervenes on a physical property F* that is causally sufficient for a property G, then F cannot cause G. We employ an account of causation as difference-making to show that the truth or falsity of this principle is (...) a contingent matter and derive necessary and sufficient conditions under which a version of it holds. We argue that one important instance of the principle, far from undermining non-reductive physicalism, actually supports the causal autonomy of certain higher-level properties. (shrink)

Philosophers have argued about the nature and the very existence of free will for centuries. Today, many scientists and scientifically minded commentators are skeptical that it exists, especially when it is understood to require the ability to choose between alternative possibilities. If the laws of physics govern everything that happens, they argue, then how can our choices be free? Believers in free will must be misled by habit, sentiment, or religious doctrine. Why Free Will Is Real defies scientific orthodoxy and (...) presents a bold new defense of free will in the same naturalistic terms that are usually deployed against it. -/- Unlike those who defend free will by giving up the idea that it requires alternative possibilities to choose from, Christian List retains this idea as central, resisting the tendency to defend free will by watering it down. He concedes that free will and its prerequisites—intentional agency, alternative possibilities, and causal control over our actions—cannot be found among the fundamental physical features of the natural world. But, he argues, that’s not where we should be looking. Free will is a “higher-level” phenomenon found at the level of psychology. It is like other phenomena that emerge from physical processes but are autonomous from them and not best understood in fundamental physical terms—like an ecosystem or the economy. Train crashes cause, on average, a handful of deaths each year in the UK. Technologies exist that would save the lives of some of those who die. Yet these technical innovations would cost hundreds of millions of pounds. Should we spend the money? How can we decide how to trade off life against financial cost? Such dilemmas make public policy is a battlefield of values, yet all too often we let technical experts decide the issues for us. Can philosophy help (...) us make better decisions? What does it mean to be disadvantaged? Is it possible to compare different disadvantages? What should governments do to move their societies in the direction of equality, where equality is to be understood both in distributional and social terms? Linking rigorous analytical philosophical theory with broad empirical studies, including interviews conducted for the purpose of this book, Wolff and de-Shalit show how taking theory and practice together is essential if the theory is to be rich enough to be applied to (...) the real world, and policy systematic enough to have purpose and justification. The book is in three parts. Part 1 presents a pluralist analysis of disadvantage, modifying the capability theory of Sen and Nussbaum to produce the 'genuine opportunity for secure functioning' view. This emphasises risk and insecurity as a central component of disadvantage. Part 2 shows how to identify the least advantaged in society even on a pluralist view. The authors suggest that disadvantage 'clusters' in the sense that some people are disadvantaged in several different respects. Thus identifying the least advantaged is not as problematic as it appears to be. Conversely, a society which has 'declustered disadvantaged' - in the sense that no group lacks secure functioning on a range of functionings - has made considerable progress in the direction of equality. Part 3 explores how to decluster disadvantage, by paying special attention to 'corrosive disadvantages' - those disadvantages which cause further disadvantages - and 'fertile functionings' - those which are likely to secure other functionings. In sum this books presents a refreshing new analysis of disadvantage, and puts forward proposals to help governments improve the lives of the least advantaged in their societies, thereby moving in the direction of equality. Suppose that the members of a group each hold a rational set of judgments on some interconnected questions, and imagine that the group itself has to form a collective, rational set of judgments on those questions. How should it go about dealing with this task? We argue that the question raised is subject to a difficulty that has recently been noticed in discussion of the doctrinal paradox in jurisprudence. And we show that there is a general impossibility theorem that that (...) difficulty illustrates. Our paper describes this impossibility result and provides an exploration of its significance. The result naturally invites comparison with Kenneth Arrow's famous theorem (Arrow, 1963 and 1984; Sen, 1970) and we elaborate that comparison in a companion paper (List and Pettit, 2002). The paper is in four sections. The first section documents the need for various groups to aggregate its members' judgments; the second presents the discursive paradox; the third gives an informal statement of the more general impossibility result; the formal proof is presented in an appendix.
