Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. Introducing the moral philosopher and philosophical theologian Donald Mackenzie MacKinnon (1913–1994) is not an easy business. Of course, those who are already familiar with the work of the Scottish Episcopalian from Oban in the Highlands will know this but regard it as a necessary difficulty. It is necessary for two main reasons. Firstly, despite the fact that he is arguably the most influential and important postwar British philosophical theologian, (although many would want to place T. F. Torrance in this category), (...) he remains relatively unknown to theological scholarship outside of those who have in some way had connections with the Universities of Aberdeen and Cambridge, at which MacKinnon had occupied Chairs. Secondly, the intellectual labors of this former Cambridge Norris-Hulse Professor of Divinity are proving to be fruitful for a new generation of theologians (the three scholars involved in this project are examples of this) in a way that saves MacKinnon, at least for a little longer, from being relegated to the fleeting memory of a historical footnote in British intellectual life. What makes the introductory project difficult (and here the term is being used in a rather glib sense, especially with reference to a thinker so deeply immersed in refusing to evade the difficulty emerging from the intractable problems of the surd by offering premature resolutions) is that MacKinnon’s work is so resistant to the quick summary, the pithy statement, or the reductive sound bite. The style of his writing is often allusive and therefore particularly demanding of his audience. (shrink)

John Fleming , later professor in Aberdeen and Edinburgh, made his combative contribution to natural history between 1812 and 1832. As an Edinburgh student he had followed Robert Jameson's ‘Wernerian’ lead. His earliest publications, from 1813, expressed what was to be a lifelong hostility to the work of James Hutton. Yet his own thinking moved increasingly towards a ‘uniformitarian’ as opposed to a ‘catastrophist’ view of earth history. His Philosophy of Zoology embodied criticism of Cuvier. More dramatically, he (...) became embroiled in controversy with Buckland and later with Conybeare. By then the ‘uniformitarian’ hypothesis had been adopted by Lyell, with whom Fleming was in close touch from the mid-1820s. Fleming may have had some grounds for feeling that his priority in advocating uniformitarianism was later overlooked. His History of British Animals included a preface in which he elaborated his earlier hypothesis as to ‘revolutions … in the animal kingdom’ correlated with six geological epochs. Tension had then developed in Fleming's relationship with Jameson, and the early 1830s found him in a mood of increasing frustration. Reconciliation with Buckland and approval by Sedgwick still left ‘the Zoological Ishmael’ feeling that his advancement in the scientific world was blocked, perhaps permanently. In historical perspective Fleming may be seen as a minor but not insubstantial figure in the scientific landscape of the early nineteenth century. (shrink)

Mr Wilson starts by describing the techniques of conceptual analysis. He then gives examples of them in action by composing answers to specific questions and by criticism of quoted passages of argument. In this philosophically sophisticated and historically significant work, John H. Zammito reconstructs Kant's composition of The Critique of Judgment and reveals that it underwent three major transformations before publication. He shows that Kant not only made his "cognitive" turn, expanding the project from a "Critique of Taste" to a Critique of Judgment but he also made an "ethical" turn. This "ethical" turn was provoked by controversies in German philosophical and religious culture, in particular the writings of Johann Herder and (...) the Sturm und Drang movement in art and science, as well as the related pantheism controversy. Such topicality made the Third Critique pivotal in creating a "Kantian" movement in the 1790s, leading directly to German Idealism and Romanticism. The austerity and grandeur of Kant's philosophical writings sometimes make it hard to recognize them as the products of a historical individual situated in the particular constellation of his time and society. Here Kant emerges as a concrete historical figure struggling to preserve the achievements of cosmopolitan Aufkl-rung against challenges in natural science, religion, and politics in the late 1780s. More specifically Zammito suggests that Kant's Third Critique was animated throughout by a fierce personal rivalry with Herder and by a strong commitment to traditional Christian ideas of God and human moral freedom. Man controls and dominates the habitat of most animals, both domestic and wild and there is a need for a pragmatic, workable approach to the problem of reconciling animal welfare with economic forces and the needs of man. It is the author's contention that much of the current philosophical discussion of animal welfare is misdirected now that it is possible to measure to some extent what animals think and feel and how much they can appreciate their quality of life. The (...) book deals with farm animals, pets, wild animals and laboratory animals and dicusses their environmental requirements, fear and stress, their response to pain, injury, disease and death, behaviour and aggression, and the implications of biotechnology and genetic engineering. Finally, the book tries to reconcile reverence for life with the inescapability of killing and reviews the prospects of preserving and enhancing quality of life for animals through legislations, education, economic and moral incentives. No se registraron complicaciones inusuales en el procedimiento ni en lo referente a la salud de la madre. Tres años antes, ensayos clínicos suecos señalan el nacimiento de dos infantes de sexo masculino provenientes de úteros extraídos de donantes vivas, vinculados a las madres. La ciencia había logrado curar el factor de infertilidad (...) uterino absoluto (AUFI por sus siglas en inglés), en mujeres con esta condición. Es importante que, si bien algunos ajustes en el procedimiento dominarán el desarrollo futuro, especialmente en los aspectos clínicos, no debemos olvidar las consideraciones éticas. Por lo anterior, esta revisión documental se centra en cómo se ven los trasplantes de útero de donantes fallecidas dentro de los datos disponibles en tres contextos principales: la antropología del ser humano, la medicina y la sociología, con énfasis en ciertas construcciones culturales de la sociedad liberal moderna. Subyacente al diagnóstico está el hecho de que el útero es un órgano no vital en la fisiología humana, y los trasplantes de útero de donantes fallecidas (DD UTX por sus siglas en inglés) plantean nuevos desafíos en la ética. En esta revisión se presentan los sesgos observados en los datos, las limitaciones de un procedimiento de menos de diez años y las conclusiones a las que llegamos. (shrink)

I argue that incomprehensibility (what the ancient skeptics called acatalepsia) plays a central role in the skepticism of both Bayle and Hume. I challenge a commonly held view (recently argued by Todd Ryan) that Hume, unlike Bayle, does not present oppositions of reason--what Kant called antimonies.

ABSTRACT This article recovers the discussion of the relationship between religion, human nature and happiness in the Scottish Enlightenment physician John Gregory’s (1724–1773) A Comparative View of Human Nature (1765). Through examining Gregory’s best-selling but understudied text, this article explores how the Aberdeen Enlightenment’s own branch of the wider Scottish ‘science of human nature’, centred at the famous Aberdeen Philosophical Society, was as deeply concerned with the study of religion as it was the philosophy of mind. Gregory (...) examined how the purported cultural spread of dogmatic scepticism, associated by the Aberdonians with David Hume, threatened individual happiness and social tranquillity by removing the crutch of religious belief upon which the multitude (though not the philosopher) depended. In doing so, it suggests that the contribution made by physicians to the Scottish Enlightenment’s engagement with religion has been unjustly ignored. (shrink)

This book investigates the central role of reason in Islamic intellectual life. Despite widespread characterization of Islam as a system of belief based only on revelation, John Walbridge argues that rational methods, not fundamentalism, have characterized Islamic law, philosophy and education since the medieval period. His research demonstrates that this medieval Islamic rational tradition was opposed by both modernists and fundamentalists, resulting in a general collapse of traditional Islamic intellectual life and its replacement by more modern but far shallower (...) forms of thought. John Webster provides a major scholarly analysis, the first in any language, of the final sections of the Church Dogmatics. He focuses on the theme of human agency in Barth's late ethics and doctrine of baptism, placing the discussion in the context of an interpretation of the Dogmatics as an intrinsically ethical dogmatics. The first two chapters survey the themes of agency, covenant and human reality in the Dogmatics as a whole; later chapters give a thorough analysis of Church (...) Dogmatics IV/4 and the posthumously published text The Christian Life. A final chapter examines the significance of Barth's work for contemporary accounts of moral selfhood. The book is important not only for a detailed analysis of a neglected part of Barth's oeuvre, but also because it casts into question much of what has hitherto been written about Barth's ethical dogmatics. We present several new studies focusing on “salience effects”—the decreased tendency to attribute knowledge to someone when an unrealized possibility of error has been made salient in a given conversational context. These studies suggest a complicated picture of epistemic universalism: there may be structural universals, universal epistemic parameters that influence epistemic intuitions, but that these parameters vary in such a way that epistemic intuitions, in either their strength or propositional content, can display patterns of genuine cross-cultural diversity.
