Automated legal reasoning and its application in smart contracts and automated decisions are increasingly attracting interest. In this context, ethical and legal concerns make it necessary for automated reasoners to justify in human-understandable terms the advice given. Logic Programming, specially Answer Set Programming, has a rich semantics and has been used to very concisely express complex knowledge. However, modelling discretionality to act and other vague concepts such as ambiguity cannot be expressed in top-down execution models based on Prolog, and in (...) bottom-up execution models based on ASP the justifications are incomplete and/or not scalable. We propose to use s(CASP), a top-down execution model for predicate ASP, to model vague concepts following a set of patterns. We have implemented a framework, called s(LAW), to model, reason, and justify the applicable legislation and validate it by translating (and benchmarking) a representative use case, the criteria for the admission of students in the “Comunidad de Madrid”. mRNA synthesis in all organisms is performed by RNA polymerases, which work as nanomachines on DNA templates. The rate at which their product is made is an important parameter in gene expression. Transcription rate encompasses two related, yet different, concepts: the nascent transcription rate, which measures the in situ mRNA production by RNA polymerase, and the rate of synthesis of mature mRNA, which measures the contribution of transcription to the mRNA concentration. Both parameters are useful for molecular biologists, but they (...) are not interchangeable and they are expressed in different units. It is important to distinguish when and where each one should be used. We propose that for functional genomics the use of nascent transcription rates should be restricted to the evaluation of the transcriptional process itself, whereas mature mRNA synthesis rates should be employed to address the transcriptional input to mRNA concentration balance leading to variation of gene expression. El presente trabajo intenta dilucidar los caracteres centrales de la incorporación del legado de Marx en la obra de León Rozitchner. La hipótesis que articula el escrito define al marxismo como una matriz de inteligibilidad que permite una continuidad y una persistencia en los tópicos centrales de la filosofía del autor argentino. En particular, me centraré en los períodos de juventud y madurez de León Rozitchner, para verificar la forma en que las múltiples transformaciones de su filosofía con el paso (...) del tiempo, mantienen una cohesión posibilitada por su marxismo, entendido como un marco teórico jamás abandonado. Se pondrá de relieve la manera en que algunas apropiaciones juveniles del legado marxista (como, por ejemplo, la noción de “ser social”) son resignificadas a partir de las transformaciones y las distancias que adquiere Rozitchner en su propia lectura de Marx, para finalizar en la elaboración novedosa de un “materialismo ensoñado”. The authors consider the nature of explanatory models in the social sciences in order to suggest ways in which conceptual systems differ. They suggest that, in many cases, theorists, researchers and clinicians can utilize insights from rival models in building their own models, without sacrificing the integrity of their own work.

Este no es un libro de filosofía, ni de astrología, ni de esoterismo. No hay en él ninguna pretensión más allá de la simple expresión de un recorrido intelectual y vital, de una búsqueda y un encuentro. Desde este punto de vista se intentan exponer tres esferas distintas del ser y del conocer, de forma separada pero con las oportunas referencias cruzadas, y manteniendo siempre la jerarquía que las diferencia. La primera de ellas es la que aquí se considera como (...) un tipo de exoterismo, es decir, un ámbito externo de considerar las cosas (en referencia a los dos siguientes): la filosofía; con la razón como facultad analítica y reflexiva por excelencia, pretende buscar las razones de ciertas problemáticas mediante el pensamiento discursivo. Y el tercero y último es aquel dominio correspondiente a la Metafísica integral, en el sentido profundo que apunta hacia la Trascendencia misma, como núcleo de toda forma espiritual; se presentará aquí desde el esoterismo tradicional en la línea de los trabajos de René Guénon, pero principalmente desde la tradición más reciente (la islámica) y la considerada por muchos más primordial (la hindú). In this paper, we analyze the legal situation regarding physician-assisted suicide in the world. Our hypothesis is that the prohibitive stance on physician-assisted suicide in most societies in the world today seems to be related to our moral attitudes toward suicide. This brings us to a discussion about life itself. We claim that the total lack of legal protection for physician-assisted suicide from international organizations and most countries in the world lies in a philosophical assumption that supports much of our (...) common beliefs about what life really is. This assumption states that life must be thought of as not belonging exclusively to the individual. We argue that this assumption is a misconception that can be heard in the debate on suicide. Consequently we endorse a different conception of life which tends to favor a pro-choice stance towards suicide and assisted death in general. This position takes the patient’s decision about when to die more seriously. We conclude that there is no reason why physician-assisted suicide does not deserve legal protection as an individual right to die under international law. (shrink)

El filósofo mexicano Emilio Uranga (1921-1988) es recordado por su Análisis del ser del mexicano (1952) y por su labor como periodista político y asesor de López Mateos, Díaz Ordaz, Echeverría y López Portillo. Es posible tender un puente entre los dos aspectos, gracias a su concepción ontologizante de la Revolución Mexicana, leitmotiv de su producción teórica.

The first form of the inside-outside dichotomy appears as a self-encapsulated system with an active border. These systems are based on two complementary but asymmetric processes: constructive and interactive. The former physically constitute the system as a recursive network of component production, defining an inside. The maintenance of the constructive processes implies that the internal organization also constrains certain flows of matter and energy across the border of the system, generating interactive processes. These interactive processes ensure the maintenance of the (...) constructive processes thus specifying a meaningful outside. Upon this basic form of identity formation, the evolutionary and historical domain is open for the emergence of a whole hierarchy and ecology of insides and outsides. These which mutually subsume and collaborate in the maintenance of the essential inside-outside dichotomy that defines the conditions of possibility of the subjects and the worlds they generate. Recent research in philosophy of science has shown that scientists rely on a plurality of strategies to develop successful explanations of different types of phenomena. In the case of biology, most of these strategies go far beyond the traditional and reductionistic models of scientific explanation that have proven so successful in the fundamental sciences. Concretely, in the last two decades, philosophers of science have discovered the existence of at least two different types of scientific explanation at work in the biological (...) sciences, namely: mechanistic and structural explanations. Despite the growing evidence about the radically different nature of these two types of explanation, no inquiry has been conducted to date to determine the ontological reasons that might underlie these differences, nor the way in which these types of explanations can be systematically related with each other. Here, we aim to cover this gap by connecting this plurality of research strategies with the existence of emergent levels of reality. We argue that the existence of these different—and apparently incompatible—explanatory strategies to account for biological phenomena derives from the existence of “ontological jumps” in nature, which generate different regimes of causation that in turn demand the development of different explanatory frameworks. We identify two of these strategies—mechanistic modelling and network modelling—and connect them to the existence of two ontological regimes of causation. Finally, we relate them with each other in a systematic way. In this vein, our paper provides an ontological justification for the plurality of explanatory strategies that we see in the life sciences. (shrink)

Ethical issues are very relevant in the field of women’s, gender and/or feminist studies. The aim of this article is to highlight the ethical challenges faced by the authors in their research process, with specific reference to two projects on gender and disasters in which they have been involved. In general, we try to avoid sexist bias throughout the complete research process, from the definition of the objectives themselves to the methodology design, where we ensure diversity in the selection of (...) participants in order to take into consideration the variety of voices present in society, especially those of women. Also, when developing our research, we take into account the power relationships involved, both between those who participate in the fieldwork and with the researchers themselves. To counteract the effects of such relations, we have considered people’s wellbeing and the humanization of the whole process. Finally, when it comes to the dissemination of the results and their transfer to society at large, we follow the same principles and actively integrate the people involved. Considering these issues benefits the research process and makes the resultant knowledge more ethical and socially useful, in addition to promoting more egalitarian gender relations. (shrink)

En el presente artículo se pretende poner en relación la noción de kénosis, sobre la que se configura esencialmente la concepción hermenéutica de la religión en Gianni Vattimo, con la pretensión emancipatoria que surge del nihilismo hermenéutico. Para ello rastrearemos esa concepción hermenéutica de la verdad que ya no nos violenta, a partir de la cual se estructura la religión del pensamiento débil. Además, constataremos cómo la concepción hermenéutica de la metafísica, aparte de presentarse como clave de la secularización, permitirá (...) identificar la salvación con la interpretación. Sobre estos presupuestos generales de su filosofía Vattimo anuncia la venida de Jesús como fenómeno hermenéutico. Tendremos que preguntarnos finalmente si las posibilidades de este planteamiento trágico de la kénosis se llevan hasta sus últimas consecuencias con el anuncio sociopolítico de una emancipación de corte hermenéutico. This paper develops a largely neglected parallel between prudence and population ethics. Prudence is generally understood to be concerned with the balancing of well-being over time. How, precisely, well-being ought to be balanced over time, however, is a fervently debated question. I argue that developing a standard guiding such evaluations is exceedingly challenging. This is due to an often overlooked fact about prudence, namely that it shares a structural similarity with population ethics: In both contexts, we assess the comparative value (...) of populations of personstages/people, which may vary in number and level of well-being. Based on this analogy, I show that the development of an adequate theory of prudence runs into very similar impossibility results as obtain in population ethics. In particular, I prove that Arrhenius’ fifth impossibility theorem can be applied to prudence. I develop and compare four possible answers to this challenge. First, I discuss the possibility of accepting the very repugnant conclusion intrapersonally. Second, I present and further develop Donald Bruckner’s Minimax Regret approach, which gives up Transitivity. Third, I apply Jacob Nebel’s Lexical Threshold View to prudence and critically evaluate it. Lastly, I introduce what I call the Negative Lexicality View, which is based on Lexical Threshold View but overcomes some of its problems. (shrink)

Cotnoir’s gappy solution to the traditional paradox of unrestricted omnipotence does not extend to a Curry-like version of the paradox. In this paper, we show that it does extend to it.

In the wake of corporate ethical scandals that have harmed millions of employees and investors, there has been an increase in the number of works written in the last decade, which aim to answer one apparently simple question: what causes unethical behavior, and what can we do, if anything, to prevent similar transgressions in the future? The extensive research around this question is the best proof of its real complexity as the challenge of disentangling the background of ethical behavior has (...) obvious academic and practical interest. This study aims to take a further step toward that goal. Much research has noted the impact of multiple aspects of organizational contexts on individuals’ ethical behavior. However, studies that analyze the impact of organizational learning capability (OLC) on employees’ ethical behavior are few and far between. This was the first aim of this study. The second centered on gaining a deeper understanding of the relationship between OLC and ethical behavior by analyzing the mediating role of employability and organizational commitment. We tested our hypotheses through a structural equation methodology applied to a sample of 641 workers from 166 Spanish consultancy firms and found a positive, direct relationship between OLC and employability, OLC and organizational commitment, employability and organizational commitment, and organizational commitment and ethical behavior. En las investigaciones sobre fisiología cardiovascular desarrolladas por William Harvey es posible distinguir entre dos teorías que responden a preguntas diferentes. La primera de ellas, que denominamos teoría del movimiento circular de la sangre, intenta dar una respuesta al problema sobre la cantidad de sangre que se mueve dentro del sistema. La segunda pretende dar cuenta de las causas de que la sangre se mueva y la denominamos teoría de las causas del movimiento de la sangre. En este trabajo, presentamos (...) una reconstrucción estructuralista de la primera de éstas, y mostramos que posee todos los componentes considerados esenciales para cualquier teoría, de acuerdo con la concepción estructuralista de la ciencia. El problema de la adopción (Padró, 2015), según el cual es imposible adoptar una lógica, sugiere la idea de que la práctica de inferir es conceptualmente prioritaria a la lógica entendida como teoría. Este problema representa un desafío para la concepción antiexcepcionalista de la lógica, que entiende a los principios lógicos como meras hipótesis o como creencias sujetas a revisión. Desde nuestra perspectiva, el principal problema de esta concepción ha sido dejar abierta la pregunta sobre la naturaleza de la práctica (...) de inferir. Sin embargo, nos parece completamente posible responder esta pregunta dentro del marco teórico antiexcepcionalista. En este trabajo desarrollamos una concepción naturalista de la práctica de inferir que viene a llenar el vacío dejado por el antiexcepcionalismo tradicional; y a su vez responde al desafío lanzado por el problema de la adopción. Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance).
