Friedrich Schleiermacher (1768–1834) hat die Ethik als Theorie der Strukturen und Formen der geschichtlichen Welt konzipiert. Seine Entwürfe dieser „Wissenschaft von den Prinzipien der Geschichte“, die im Zusammenhang mit Vorlesungen ausgearbeitet und erst nach seinem Tod veröffentlicht worden sind, haben für seine Philosophie wie für seine Theologie grundlegende Bedeutung.

Um nun Kant von diesen idealistischen Vereinnahmungen zu befreien und ihn ihrem eigenen Projekt wieder anzunähern, versucht nun Kolmer, diese Strukturähnlichkeit dadurch einzuschränken und zu differenzieren, daß sie auf der einen Seite die heutigen Theorien der Philosophiehistorie generell unter Hegelismus-Verdacht stellt (es handle sich um implizite „Theorien der geschichtlichen Vernunft"), auf der anderen aber den Graben zwischen Hegel und Kant tiefer zieht (ganz anders die Konstanzer Dissertation von Jung-Min Kang, Philosophische Philosophiegeschichte von 1998.) Dafür muß man aber bei der Kant-Exegese wegen der geringen Textbasis relativ weit ausholen und die Konfrontation mit Hegel auf allgemeinere geschichtsphilosophische Theoreme verlagern. Die Autorin übersieht dabei großzügig, daß diese sich nicht ohne weiteres auf die spezielle Programmatik der Philosophiegeschichte übertragen lassen, weswegen es hier des öfteren zu interpretatorischen Schnellschüssen und Oberflächlichkeiten kommt. Daß aber ein Buch, das für „historische Bildung" und für eine vorurteilslose („nichtkonzeptualistische") „Arbeit an den Texten" (82) plädiert - die monistisch-idealistische Philosophiegeschichtsphilosophie sei der kompensatorische Versuch, „mit allen Texten, die man nicht selbst verfaßt hat, grundsätzlich schon fertig zu sein, noch bevor man sie gelesen hat" (399) - darüberhinaus eine gewisse Schlampigkeit im Umgang mit den interpretierten Schriften an den Tag legt, entzieht dem Plädoyer für die anti-spekulative „literarische Einstellung zu Texten" (81) das historistisch-philologische Fundament. So will die Autorin auf S. 333 die Sicht Kants auf den vorkritischen Zustand der Philosophie u.a. mit einem Zitat aus Kants Streit der Fakultäten [End Page 446] belegen, wo („A 44") die Rede sei vom „Krieg, d.i. We investigate the impact of informal arguments on judgments about thought experiment cases in light of Deutsch and Cappelen’s mischaracterization view, which claims that philosophers’ case judgments are primarily based on arguments and not intuitions. If arguments had no influence on case judgments, this would seriously challenge whether they are, or should be, based on arguments at all—and not on other cognitive sources instead, such as intuition. In Experiment 1, we replicated Wysocki’s (Rev Philos Psychol 8(2):477–499, 2017) pioneering study on (...) a Gettier-style case, and we confirmed that the informal arguments used by him had no significant effect. However, we also included an improved argument for ascribing knowledge, which did have a significant effect even in Wysocki’s original design. We therefore followed up with Experiment 2 on three Gettier-style cases, where we used a more natural dialogical format for presenting both case descriptions and informal arguments. Overall, we found a clear impact of prima facie good pro and con arguments on case judgments. The issue of argument impact is thus no obstacle to arguing about thought experiments. (shrink)

Algorithmic predictions are promising for insurance companies to develop personalized risk models for determining premiums. In this context, issues of fairness, discrimination, and social injustice might arise: Algorithms for estimating the risk based on personal data may be biased towards specific social groups, leading to systematic disadvantages for those groups. Personalized premiums may thus lead to discrimination and social injustice. It is well known from many application fields that such biases occur frequently and naturally when prediction models are applied to (...) people unless special efforts are made to avoid them. Insurance is no exception. In this paper, we provide a thorough analysis of algorithmic fairness in the case of insurance premiums. We ask what “fairness” might mean in this context and how the fairness of a premium system can be measured. For this, we apply the established fairness frameworks of the fair machine learning literature to the case of insurance premiums and show which of the existing fairness criteria can be applied to assess the fairness of insurance premiums. We argue that two of the often-discussed group fairness criteria, independence (also called statistical parity or demographic parity) and separation (also known as equalized odds), are not normatively appropriate for insurance premiums. Instead, we propose the sufficiency criterion (also known as well-calibration) as a morally defensible alternative that allows us to test for systematic biases in premiums towards certain groups based on the risk they bring to the pool. In addition, we clarify the connection between group fairness and different degrees of personalization. Our findings enable insurers to assess the fairness properties of their risk models, helping them avoid reputation damage resulting from potentially unfair and discriminatory premium systems. New data-driven technologies yield benefits and potentials, but also confront different agents and stakeholders with challenges in retaining control over their data. Our goal in this study is to arrive at a clear picture of what is meant by data sovereignty in such problem settings. To this end, we review 341 publications and analyze the frequency of different notions such as data sovereignty, digital sovereignty, and cyber sovereignty. We go on to map agents they concern, in which context they appear, (...) and which values they allude to. While our sample reveals a considerable degree of divergence and an occasional lack of clarity about intended meanings of data sovereignty, we propose a conceptual grid to systematize different dimensions and connotations. Each of them relates in some way to meaningful control, ownership, and other claims to data articulated by a variety of agents ranging from individuals to countries. Data sovereignty alludes to a nuanced mixture of normative concepts such as inclusive deliberation and recognition of the fundamental rights of data subjects. (shrink)

Die Studie untersucht die Entstehung der modernen Philosophiegeschichte, wie sie sich im Übergang vom Barock zur Aufklärung als philosophische Disziplin innerhalb des gelehrten Diskurses der historia literaria konstituierte. Die Auffassung, daß Philosophie ein Produkt menschlicher Verstandestätigkeit sei und mit dem Denken der Griechen beginne, erweist sich dabei als Resultat eines Traditionsbruchs, mit dem die entstehende Aufklärung sich vom christlichen Aristotelismus der Schulphilosophie sowie von den platonisch-hermetischen Spekulationen der Schwärmer und Pansophen absetzte. In der Umbruchphase zwischen Barock und Aufklärung entsteht so (...) der moderne philosophiegeschichtliche Kanon, der sich fundamental von der zuvor gültigen historischen Logik der Wissenschaftsgeschichte unterscheidet. Die Geschichte der Philosophie wird nun nicht länger als Sammelbecken unterschiedlich perfekter Ausformulierungen einer archetypischen Weisheit verstanden, sondern im Kontext der 'Entdeckung der geschichtlichen Welt' als ein kontingenter temporaler Prozeß menschlicher Wissenschaftsentwicklung begriffen. Wie es zu dieser Entdeckung der Philosophiegeschichte kam und worin ihre wissenschaftsgeschichtlichen Implikationen bestehen, ist Gegenstand der Darstellung, die gegenüber der bisherigen Forschung verstärkt die Interdependenzen zwischen theologischem, philosophischem, rechts- und literärgeschichtlichem Diskurs berücksichtigt. L’interactivité est communément perçue comme la marque caractéristique des technologies digitales et, par extension, de différentes formes de fictions, de médias ou d’œuvres numériques – de la littérature hypertextuelle et des jeux vidéo au net art. On peut toutefois s’interroger sur le sens précis qu’il convient de donner à cette notion, ainsi que sur les promesses auxquelles elle est souvent associée. À défaut de pouvoir cerner un concept unique et maxi-englobant d’interactivité, nous suggérons qu’il est plus profitable de tenter d’identifier (...) des types et des degrés d’interactivité. Nous tentons de montrer pourquoi cette théorie pluraliste et gradualiste est plus attrayante que d’autres approches développées dans la littérature récente. Nous mettons enfin cette conception à l’épreuve du jeu vidéo, en montrant qu’elle permet de réévaluer le rôle que joue l’interactivité dans ce médium, mais qu’elle met aussi au jour les limitations inhérentes des fictions interactives que l’on y trouve. According to the expressivist objection, laws that only allow assisted dying for those suffering from certain medical conditions express the judgement that their lives are not worth living. I have recently argued that an autonomy-based approach that legally allows assisted suicide for all who make an autonomous request is a way to avoid the expressivist objection. In response to this, Thomas Donaldson has argued that rather than avoiding the expressivist objection, an autonomy-based approach extends this objection. According to Donaldson, this (...) is because helping a person achieve a goal requires endorsement of that goal. In this reply, I show that Donaldson misunderstands the target of the expressivist objection: it is not aimed at an individual’s attitude towards another person’s death but rather at a legal regulation. Moreover, helping someone end their life does not necessarily require endorsing this goal—instead, respect for a person’s autonomous choice can be another reason for providing assisted suicide. Donaldson also assumes that the autonomy-based approach requires doctors to accept autonomous requests for assisted dying. Yet, this approach merely makes it legal for individuals (not necessarily only doctors) to provide assisted suicide to autonomous persons but does not require anyone to do so. (shrink)

Être vu, nu, par un chat ; essayer de savoir quel effet cela fait d’être une chauve-souris ; penser les modes de cohabitation et de compagnonnage que nous formons avec les animaux, en dépit de toutes les violences que nous leur faisons subir, constituent autant d’expériences de pensée limites qui ont ponctué le discours philosophique sur l’animalité au xxe siècle. Il n’est pas étonnant que Cora Diamond fasse un cas de toutes ces expériences : ce qu’elle nomme « une difficulté (...) de la réalité », c’est-à-dire un point d’achoppement entre la pensée et ce qu’elle essaye de saisir, le réel, qui est susceptible de nous faire perdre nos concepts. Je me propose dans ce texte d’explorer les voies de cette difficulté, qui sont souvent des voies contournées ou des déviations. L’idée est aussi de réfléchir aux moyens dont la philosophie dispose pour affronter cette difficulté, sans dénégation et sans déviation. (shrink)

Historian Dmitry Peretolchin quotes several of my publications on the creation and application of political technologies in the United States in his program about Saul Alinsky on the House of Cards podcast on the Den TV channel. An advertisement for the conference "Russian World Against the Global Reich" was inserted into this broadcast. This article: analyzes the statements of the podcast about Alinsky and his main ideas; showes that the main source of Alinsky's political technologies is the experience of professional (...) revolutionaries in Russia and that they in no way confirm the idea of a global Reich; describes the political technology that Alexander Prokhanov and his media complex uses to implement the Fifth Empire project, which is currently merged with the ideology of the Russian World; analyzes the ideological orientation of the House of Cards podcast and the Picture of the World club on the Den channel. The articles illustrates how the authors of the podcast are working to substantiate the propaganda direction of the media complex. The article also aims to show that political technologies, in particular, technologies of co-organization continue to develop and be implemented in countries with different political systems and can be applied to various types of social movements. In discourses on digitization and the data economy, it is often claimed that data subjects shall beownersof their data. In this paper, we provide a problem diagnosis for such calls fordata ownership: a large variety of demands are discussed under this heading. It thus becomes challenging to specify what—if anything—unites them. We identify four conceptual dimensions of calls for data ownership and argue that these help to systematize and to compare different positions. In view of this pluralism of data ownership (...) claims, we introduce, spell out and defend a constructive interpretative proposal: claims for data ownership are charitably understood as attempts to call for theredistributionof material resources and the socio-culturalrecognitionof data subjects. We argue that as one consequence of this reading, it misses the point to reject claims for data ownership on the grounds that property in data does not exist. Instead, data ownership brings to attention a claim to renegotiate such aspects of thestatus quo. (shrink)

If nature is by definition the object of the natural sciences, then the dichotomy ‘natural’ versus ‘chemical’, held by both chemists and nonchemists, suggests an idiosyncrasy of chemistry. The first part of the paper presents a selective historical analysis of the main notions of nature in chemistry, as developed in early Christian views of chemical crafts, alchemy, iatrochemistry, mechanical philosophy, organic chemistry, and contemporary drug research. I argue that the dichotomy as well as quasi-moral judgments of chemistry have been based (...) on static and teleological notions of nature throughout history and that chemists, unlike physicists, have neglected the dynamic notion of nature. According to the ‘expertise defence’, experimental findings suggesting that intuitive judgments about hypothetical cases are influenced by philosophically irrelevant factors do not undermine their evidential use in (moral) philosophy. This defence assumes that philosophical experts are unlikely to be influenced by irrelevant factors. We discuss relevant findings from experimental metaphilosophy that largely tell against this assumption. To advance the debate, we present the most comprehensive experimental study of intuitive expertise in ethics to date, which tests five well- known biases of (...) judgment and decision-making among expert ethicists and laypeople. We found that even expert ethicists are affected by some of these biases, but also that they enjoy a slight advantage over laypeople in some cases. We discuss the implications of these results for the expertise defence, and conclude that they still do not support the defence as it is typically presented in (moral) philosophy. (shrink)

Kripke's objections to descriptivism may be modified to apply to Scott Soames's pragmatic account from his book Beyond Rigidity. Further, intuitions about argument-validity threaten any theory in the vicinity of Soames's.

This open access book presents an ethical approach to utilizing personal medical data. It features essays that combine academic argument with practical application of ethical principles. The contributors are experts in ethics and law. They address the challenges in the re-use of medical data of the deceased on a voluntary basis. This pioneering study looks at the many factors involved when individuals and organizations wish to share information for research, policy-making, and humanitarian purposes. Today, it is easy to donate blood (...) or even organs, but it is virtually impossible to donate one’s own medical data. This is seen as ethically unacceptable. Yet, data donation can greatly benefit the welfare of our societies. This collection provides timely interdisciplinary research on biomedical big data. Topics include the ethics of data donation, the legal and regulatory challenges, and the current and future collaborations. Readers will learn about the ethical and regulatory challenges associated with medical data donations. They will also better understand the special nature of using deceased data for research purposes with regard to ethical principles of autonomy, beneficence, and justice. In addition, the contributors identify the key governance issues of such a scheme. The essays also look at what we can learn in terms of best practice from existing medical data schemes. (shrink)

This paper provides an overview of the development of Jewish studies in Germany since reunification. After a brief historical review of the subject in the nineteenth century with the development of modern Reform Judaism and the science of Judaism created by Jewish religious and secular scholars, it focuses on the development of the past thirty years, in which not only the Jewish community but also Jewish studies have increased in importance. The growth of the Jewish community was largely due to (...) immigration from the Soviet Union, but also partly to young Israelis who moved to Berlin. In line with these different backgrounds, a new interest in diaspora research emerged. The paper also deals with the difference between German Jewish studies and those of most other countries, where Jewish studies are mainly designed by Jewish scholars. (shrink)

Si l’abandon du point de vue du spectateur suppose que nous œuvrons, en tant que locuteurs et producteurs d’outils symboliques, à la forme du monde que nous habitons, et si l’amélioration de ces outils (...) est à notre portée, il s’agit d’imaginer des améliorations qui conduisent à des transformations efficaces, à la fois cognitivement et politiquement. Cet article entraîne la théorie goodmanienne du worldmaking du côté de l’ingénierie conceptuelle. En dernière analyse, il entreprend de montrer ce que l’ingénierie conceptuelle aurait à gagner à redéployer la théorie goodmanienne de la projectibilité (degrés de projectibilité, implantation, projectibilité héritée). Ce débat, comme cela a déjà été noté dans un certain nombre de publications récentes, est en fait hanté par une question sceptique, qui fut posée à la photographie dès son invention : si l’image photographique s’excepte du régime traditionnel de la représentation et si elle est bien le résultat d’une prise de vue automatique, en quel sens pouvons-nous encore dire qu’elle (...) est artistique? Il me semble que le concept goodmanien d’exemplification permet de répondre au défi lancé par le sceptique. J’essaie de montrer pourquoi. Plus encore, je m’emploie à montrer comment le concept goodmanien d’exemplification pourrait s’accommoder assez bien de la spécificité du médium photographique. (shrink)
