The article reflects on the silence and apparent passivity of many women priests in the current debate on their representation in the episcopate of the Church of England. The author locates such inactivity in clergy women's fear of militancy, and the absence, in their expression of vocation hopes, of an agenda for the transformation of ecclesial structures. The legal provi sions defining their priesthood, and the lack of organizational strategy to equip them for leadership, foster professional tension and uncertainty as (...) to status and development. Women clergy seem surprisingly ignorant of the debt owed to Christian feminists and their role in the promotion of women's ordination; this needs to be remedied. Unless they support one another, and so inform themselves as to speak out responsibly and courteously for fresh understandings and exercises of authority that are viable for the pre sent, their ordination as priests brings no radical change to the institutional Church, in which their opponents remain articulate and active in dissent. Cloth, $42.50.This important book is an interpretation and defense of Rousseau's theory of moral education, in which the author explains and justifies Rousseau's ideas about what virtue is, why it is important, and how it can be cultivated.Briefly, this is (...) his reading: in advanced societies, people come to possess intense and incoherent passions, enflamed by amour-propre, which set them at odds with themselves and with each other, making bourgeois existence unsatisfying and exploitive. To create a better life, people must learn to restrain their desires in a way that promotes their own happiness; they must be taught virtue, which Reisert defines as, "the strength of character to rule over one's passions, so that one can make oneself do what one knows one ought to do" (8). Finally, the best model for the moral educator is not ruler to ruled, but friend to friend.The book is both a defense of this interpretation of Rousseau, and a defense of Rousseau's social and psychological theory itself, most notably against Aristotle, Locke, and Buffon. While the two lines of argument do not go together seamlessly, Reisert offers a number of contributions to Rousseau scholarship and to social thought, especially as it intersects with liberal political theory. He divides the work into two parts. The first explains Rousseau's theory of human nature and his diagnosis of the ills of society. The second interprets and defends his ideas about how to remedy that condition through the cultivation of virtue by means of friendship. The final chapter discusses the importance of virtue for contemporary liberal politics.The first half of the book, on Rousseau's "physics of the soul," touches on self-love, pity, vanity, and conscience. For some reason, Reisert limits his discussion largely to the meaning of amour-propre in the second Discourse and Emile to the exclusion of other issues and other books. Even so, he gives an interesting interpretation of amour-propre, and how it leads to the restless, banal misery that both authors think is characteristic of modern life.The problems of this section come when Reisert attempts to defend Rousseau. He argues that his theory of human nature is to be preferred because it answers questions that others cannot, such as how essentially asocial beings have come to live in societies. Yet, this question and some others he discusses come into being only because of Rousseau's own assumptions, for example that people are asocial in the first place. So, Rousseau's ability to solve puzzles that exist only on the basis of his own principles cannot be taken as evidence for those principles without begging the question.The second half of the work is more innovative. Reisert makes two basic arguments: that only virtue can alleviate the dissatisfactions of bourgeois existence; and that only the relationship of friendship can bring about this "education to virtue" (141). The first is less controversial given that he defines virtue simply as the power to restrain irrational desires for the sake of happiness; yet he goes on to make an interesting distinction between the virtue of Socrates who does not have irrational desires to begin with, and that of Emile who has them but can control them.The most original part of the book is his argument that only the relationship of friendship can foster virtue. He says that the amour-propre which makes people miserable also makes them resistant to efforts to improve their character. "A friend," on the other hand, "can, through force of personality and the power of example, exert a potent influence on his friend without thereby provoking resistance or inspiring resentment" (171). He gives a fascinating account of how a friend can be a kind of better self through whose eyes one sees the source of one's own dissatisfaction and the need for virtue to make life enjoyable. The proofs of the existence of God in part 4 of Descartes’s Discourse on Method may yet surprise us. These arguments appear to be crafted with such ambiguity that their deeper import has rarely been suspected. This essay proposes that, in spite of the text’s conventional appearance, Descartes exposes the error of scholastic metaphysics, namely, that it mistakes the perfectibility of the human mind for a transcendent perfect being. Superficially, the thinker’s “idea of a more perfect being” serves to ground (...) the traditional theology; but surreptitiously, this idea refers to human possibility and supplies the metaphysical basis for scientific progress, freed from theology altogether. This ironic result is obtained not by speculating on Descartes’s irony directly, but by submitting the “idea of a more perfect being” itself to the Cartesian test of truth and falsehood. Deconstruction both by its friends and enemies has come to be associated with a set of cliches that completely misunderstands its ethical aspiration. It is particularly within the field of law that we can see the ethical force of deconstruction, and also illuminate its concrete and practical importance. In The Philosophy of the Limit Drucilla Cornell examines the relationship of deconstruction to questions of ethics, justice and legal interpretation. She argues that renaming deconstruction "the philosophy of the limit" will (...) allow us to be more precise about what deconstruction actually is philosophically and hence to articulate more clearly its significance for law. Cornell explores the ethical and juridical significance of the so-called postmodern rebellion against metaphysics. A shared ethical rebellion links philosophers as different as Theodor Adorno, Jacques Derrida, Jacques Lacan, and Emmanuel Levinas. Together they present a new ethical configuration, new in its difference from both the critical social theory of J$u$urgen Habermas and the analytic jurisprudence of Nagel and Rawls. A key aspect of this newness is the centrality given to the relationship between questions of ethics and sexual difference. Cornell argues that the appeal of Lacan's analysis to feminists is that it helps to explain the profound hold the gender hierarchy has over Western culture, including its theories of political transformation. Under a Lacanian analysis the law of gender identity will be replicated in the laws of an existing legal system. This means that we cannot hope to sustain legal reforms unless the gender hierarchy is challenged. Cornell examines Derrida's position on the significance of the gender hierarchy in philosophy and explores its ethical and political importance. Derrida's intervention against legal positivism has important implications for the legal reforms necessary to protect marginalized groups. His emphasis on the limit, she argues, is crucial to thosewhose well-being and very lives may depend on legal transformation, women and homosexuals, for example. In an important contribution to legal philosophy, Cornell explores the affinities of Derrida's writings with recent liberal analytic jurisprudence. She also explores the differences. Comparing Rawls's and Derrida's accounts of justice, she argues that Derrida gives greater attention to the necessary utopian moment in his insistence on maintaining the divide between law, established norms, and justice. Cornell's focus on the importance of the limit and the centrality of the gender hierarchy allows her to offer a view of jurisprudence different from both critical social theory and analytic jurisprudence. As we watch the long-fought-for civil rights of women systematically overturned, we have reason to think about how the connections she makes shed light on an underlying truth of our social, political, and legal reality. This essay defends the possibility of preemptive forgiving, that is, forgiving before the offending action has taken place. This essay argues that our moral practices and emotions admit such a possibility, and it attempts to offer examples to illustrate this phenomenon. There are two main reasons why someone might doubt the possibility of preemptive forgiving. First, one might think that preemptive forgiving would amount to granting permission. Second, one might think that forgiving requires emotional content that is not available prior (...) to wrongdoing. If, however, preemptively forgiving is genuinely possible—as this essay hopes to illustrate—then this fact has implications for our understanding of both relational normativity and the nature of forgiveness. A 62-year-old female with Huntington’s disease presented after a suicide attempt. Her advance directive stated that she did not want intubation or resuscitation, which her family acknowledged and supported. Despite these directives, she was resuscitated in the emergency department and continued to state that she would attempt suicide again. Her suicidality in the face of a chronic and advancing illness, and her prolonged consistency in her desire to take her own life, left careproviders wondering how to provide ethical, respectful care (...) to this patient. Tension between the ethical principles of autonomy and beneficence is central in this case. The patient’s narrative demonstrated that her suicide was an autonomous decision, free from coercion or disordered thinking from mental illness. Beneficence then would seem to necessitate care aligned with the patient’s desire to end her life, which created ethical uneasiness for her family and careproviders. The case highlights several end-of-life ethical considerations that have received much recent attention. With ongoing discussions about the legalization of aid in dying across the country, caregivers are challenged to understand what beneficence means in people with terminal illnesses who want a say in their death. This case also highlights the profound moral distress of families and careproviders that arises in such ethically challenging scenarios. (shrink)

In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. In the late ‘80s, I started to rethink my objections to her on that basis and found that she was, among the feminist theorists I had read, perhaps the most versed in philosophy and that her engagement with philosophy was a curious mixture of both loyalty and aggression. That struck me as a feminist critical practice, a critical reading practice that I could learn from, and from that point on, highly influenced by both Drucilla’s work and Naomi Schor’s work [see Schor], I started to read her quite thoroughly.PC:Is this kind of relationship that she has with the philosophers she reads a sexual relationship? I am thinking of some of the sexualized terms you just used: loyalty and aggression.JB:Yes, there is no doubt that there is an eros of a certain kind, usually the kind that frightens me, quite frankly. I think Carolyn Burke has made this argument that Irigaray [End Page 19] has a romance with the philosophers [see Burke]. I think she has a certain masochistic-sadistic erotic engagement with the philosophers.EG:Do you think it is sado-masochistic?JB:Well, I think it was much more aggressive in Speculum of the Other Woman than it became in An Ethics of Sexual Difference. There, I think there is an engagement that is still very difficult, but at least there is evidence of a more loving engagement.PC:I hope that we can return to the question of love at the end. Is this the kind of relationship that you have to her texts?JB:No, I’m probably too frightened. [Everybody laughs.] And I don’t engage them that closely, probably because I find it frightening to be in that particular knot. She doesn’t actually have a chapter in any of my books. I think I can’t quite devote a chapter to her....EG:No, but you devote large sections of chapters....JB:That’s true, but I can’t stay there for a prolonged period of time [laughs], whatever that’s worth.EG:I’d like to come back to this later, because I think it is a really interesting... One of the strongest strands in Nancy's philosophy is an attempt to rethink community and the very idea of the social in a way that does not ground these ideas in some individual subject or subjectivity.
