In this paper we analyze some of the major difficulties of informed consent. We consider insufficient to base IC on the principle of autonomy. We must not forget that the patient may be in a situation of extreme vulnerability and the good doctor should assume a degree of commitment and responsibility with his/her decisions. Our aim is to introduce the ethics of responsibility of Levinas in practice and theory of IC in order to generate a beneficent medical practice in which (...) the supervision and overseeing of the patient do not undermine his/her autonomy. We start from an understanding of the human person as a communicative and symbolic reality. We emphasise the more subjective aspect of education, as showing the best of the person (educere) by creatively appropriating the treasures of history (educare). With these premises, we approach narratives that are surprising for the heterodoxy (resistance) they manifest, with respect to the social reality in which they were written, in the 1st century, in which they were written. In this approach it becomes evident that (...) the interruption of the silence of women, which appears in these narratives, shows the radical value of the human personal reality, opening an egalitarian educational space. Corporate, Social, Ethical and Environmental Reporting should ideally discharge the accountability of an organisation to its stakeholders. Voluntary reporting has been characterised by a dearth of neutral and objective information such that the advocates of SEER recommend that it be made compulsory. Their underlying rationale is that legally specified disclosure requirements and enforcement mechanisms will enhance the quality of such reporting. This paper sets out to explore how realistic this scenario actually is, in view of the conflicting interpretations in the (...) literature on this subject. To that end, a survey of the reporting patterns of 78 of the largest Spanish companies between 2001 and 2003 examines the extent of their compliance with the ICAC-2002 standard, which obliged them to make environmental disclosures in their financial statements. The results suggest that progressive and improved regulation could increase the volume and quality of SEER disclosures. They also suggest, however, that persistent non-compliance means that the problems associated with voluntary disclosure still exist. Finally, through an impression management perspective, the study reveals, the diverse strategies, ranging from dismissal to concealment, that are employed by companies to avoid transparency. As regulation improves and enforcement expectations rise, it becomes more difficult to dismiss compulsory reporting norms. As a result, some firms engage in more complex concealment strategies to attain corporate legitimacy, depriving stakeholders of regulatory information. The latter point serves to reconcile apparently contradictory explanations in the literature as to whether legitimacy theory might explain partial compliance with SEER regulation. (shrink)

The present work proposes reflecting on the historical fact as a determinant of present life and, therefore, of the destiny of men, peoples, and civilizations. Considering what Nietzsche raised in the Second Untimely Consideration, history can be narrated in a monumental, antiquarian, or critical way. These constitute ways of living the present and one’s destiny. This paper investigates experimentally the effects of communication in distinct games with complete information. We design four games resulting from the interaction between two incentive elements: strategic complementarity and coordination. These incentive elements allow to analyse the use of cheap talk as an efficiency-enhancing and coordinating device. We implement a restricted communication protocol in repeated settings with fixed partners. Our findings provide robust evidence about how cheap talk interacts with incentives to explain strategic behaviour in a dynamic way. As expected, (...) cheap talk increases efficiency under complementarity incentives, and the coordination level under coordination incentives. As novelty, the use of limited communication in repeated interactions has led to identify specific time-varying message profiles as the most effective messages in the coordination games. While the content of messages is explained by the complementarity incentives, faithfulness to credible messages is determined by the coordination incentives. (shrink)

In a range of peace process scenarios, the expert’s knowledge has become a fundamental tool for generating information systems as a mechanism for the storage and circulation of data. These information artifacts are supposed to faithfully document situations of human rights violations and contribute to the design of public policy and the construction of collective memory. Following Latour’s (1993) original coinage of the term coproduction, this paper analyzes how the Inter-Institutional System of Information for Justice and Peace (SIIJYP)1 was designed (...) to define victims of war and means of reparation from the State in Colombia. From an actor network theory perspective, we explain how victimizers become the main beneficiaries of the application of the SIIJYP. To comprehend this unintended social impact of the technological artifact and how it becomes an artifact that functions as an aseptic mediator of the historical-judicial truth, and the policy of transitional justice, we examine the relations between human and nonhuman actors, how information is collected, organized, hierarchized, and negotiated, as well as the consequences of the technical and legal construction of the notion of victims of war. From an early age, exposure to a spoken language has allowed us to implicitly capture the structure underlying the succession of speech sounds in that language and to segment it into meaningful units. Statistical learning, the ability to pick up patterns in the sensory environment without intention or reinforcement, is thus assumed to play a central role in the acquisition of the rule-governed aspects of language, including the discovery of word boundaries in the continuous acoustic stream. Although extensive evidence has (...) been gathered from artificial languages experiments showing that children and adults are able to track the regularities embedded in the auditory input, as the probability of one syllable to follow another syllable in the speech stream, the developmental trajectory of this ability remains controversial. In this work, we have collected Event-Related Potentials while 5-year-old children and young adults were exposed to a speech stream made of the repetition of eight three-syllable nonsense words presenting different levels of predictability to mimic closely what occurs in natural languages and to get new insights into the changes that the mechanisms underlying auditory statistical learning might undergo through the development. The participants performed the aSL task first under implicit and, subsequently, under explicit conditions to further analyze if children take advantage of previous knowledge of the to-be-learned regularities to enhance SL, as observed with the adult participants. These findings would also contribute to extend our knowledge of the mechanisms available to assist SL at each developmental stage. Although behavioral signs of learning, even under explicit conditions, were only observed for the adult participants, ERP data showed evidence of online segmentation in the brain in both groups, as indexed by modulations in the N100 and N400 components. A detailed analysis of the neural data suggests, however, that adults and children rely on different mechanisms to assist the extraction of word-like units from the continuous speech stream, hence supporting the view that SL with auditory linguistic materials changes through development. Spain’s Roma community has its own cultural and moral values. These values influence the way in which end-of-life decision-making is confronted. The objective of this study was to explore the perspective of Roma women on end-of-life decision-making. It was a qualitative study involving thirty-three Roma women belonging to groups for training and social development in two municipalities. We brought together five focus groups between February and December 2012. Six mediators each recruited five to six participants. We considered age and care (...) role to be the variables that can have the most influence on opinion regarding end-of-life decision-making. We considered the discussion saturated when the ideas expressed were repeated. Data analysis was carried out according to five steps: describing, organizing, connecting, corroborating/legitimating, and representing the account. The main ideas gleaned from the data were as follows: the important role of the family in end-of-life care, especially the role of women; the large influence of community opinion over personal or family decisions, typical of closed societies; the different preferences women had for themselves compared to that for others regarding desired end-of-life care; unawareness or rejection of advance directives. Roma women wish for their healthcare preferences to be taken into account, but “not in writing.” The study concluded that the success of end-of-life healthcare in Roma families and of their involvement in the making of healthcare decisions depends upon considering and respecting their idiosyncrasy. While punishment is a longstanding object of philosophical scrutiny, other controversial aspects of the justice system, such as policing, have flown under the radar. In this paper, we consider possible reasons why philosophers interested in crime and punishment have neglected policing. We make the case for a broader account of the political morality of the justice system, with a particular emphasis on policing. We sketch the outlines of an egalitarian version of such a theory, highlighting parallels between policing and the (...) welfare state. Finally, we turn to recent calls for police abolition. Evaluating such radical claims requires, we argue, going beyond the traditional confines of the philosophy of punishment and considering a more holistic and interdisciplinary theory of criminal justice. Research has found that both cisgender and transgender androphilic males (i.e., males sexually attracted to and aroused by other adult males) have female-typical occupational preferences when compared with gynephilic males (i.e., males sexually attracted to and aroused by adult females). Moreover, whereas cisgender androphilic males’ occupational preferences tend to be intermediate between those of gynephilic men and androphilic women, transgender androphilic males tend to have occupational preferences that are more similar to androphilic women. No study has directly compared both types (...) of androphilic males within the same culture. The present study investigated occupational preference and its relation to childhood sex-atypical behavior (CSAB), among gynephilic men (_n_ = 208), androphilic women (_n_ = 138), and cisgender (_n_ = 132) and transgender (_n_ = 129) androphilic males from the Istmo region of Oaxaca, Mexico, where androphilic males are recognized as third gender, _muxes_. The study found large sex differences in occupational preferences (_d_ = 2.80). Furthermore, both cisgender _muxe nguiiu_ (_d_ = 2.36) and transgender _muxe gunaa_ (_d_ = 3.44) reported having more sex-atypical occupational preferences compared with men. However, _muxe gunaa_ reported higher female-typical occupational preferences than women (_d_ = 0.59) and _muxe nguiiu_ (_d_ = 0.57), whereas _muxe nguiiu_ and women did not differ (_d_ = 0.08). These findings are consistent with the conclusion that sex-atypical occupational preferences are a cross-culturally universal aspect of male androphilia. Finally, CSAB was associated with sex-atypical occupational preferences among all participants. These findings suggest that a developmental continuity exists between childhood and adulthood sex-atypicality. (shrink)

Such criteria are the main analytical elements to differentiate scientific discourses from those who are not and the ones who pretend to be. In relation to those, pseudoscience and law are treated, to finally conclude with the exposition of the case of Daubert v. Merrill Dow Pharmaceuticals, in which a judicial process defined (...) demarcation criteria. En el presente artículo se analiza las posibilidades de la teoría de las Representaciones Sociales (RS) para, desde la perspectiva de los sujetos, analizar los elementos cognitivos implicados y socialmente construidos que sustentan las acciones de gestión micro y macro institucional, y de coordinación entre varias municipalidades de un mismo territorio, lo que la literatura de gestión denomina trabajo asociativo o asociativismo. Mental body-representations are highly plastic and can be modified after brief exposure to unexpected sensory feedback. While the role of vision, touch and proprioception in shaping body-representations has been highlighted by many studies, the auditory influences on mental body-representations remain poorly understood. Changes in body-representations by the manipulation of natural sounds produced when one's body impacts on surfaces have recently been evidenced. But will these changes also occur with non-naturalistic sounds, which provide no information about the impact produced by or (...) on the body? Drawing on the well-documented capacity of dynamic changes in pitch to elicit impressions of motion along the vertical plane and of changes in object size, we asked participants to pull on their right index fingertip with their left hand while they were presented with brief sounds of rising, falling or constant pitches, and in the absence of visual information of their hands. Results show an "auditory Pinocchio" effect, with participants feeling and estimating their finger to be longer after the rising pitch condition. These results provide the first evidence that sounds that are not indicative of veridical movement, such as non-naturalistic sounds, can induce a Pinocchio-like change in body-representation when arbitrarily paired with a bodily action. Bourrat and Griffiths :33, 2018) have recently argued that most of the evidence presented by holobiont defenders to support the thesis that holobionts are evolutionary individuals is not to the point and is not even adequate to discriminate multispecies evolutionary individuals from other multispecies assemblages that would not be considered evolutionary individuals by most holobiont defenders. They further argue that an adequate criterion to distinguish the two categories is fitness alignment, presenting the notion of fitness boundedness as a criterion that (...) allows divorcing true multispecies evolutionary individuals from other multispecies assemblages and provides an adequate criterion to single out genuine evolutionary multispecies assemblages. A consequence of their criterion is that holobionts, as conventionally defined by hologenome defenders, are not evolutionary individuals except in very rare cases, and for very specific host-symbiont associations. This paper is a critical response to Bourrat and Griffiths’ arguments and a defence of the arguments presented by holobiont defenders. Drawing upon the case of the hologenomic basis of the evolution of sanguivory in vampire bats, I argue that Bourrat and Griffiths overlook some aspects of the biological nature of the microbiome that justifies the thesis that holobionts are evolutionarily different to other multispecies assemblages. I argue that the hologenome theory of evolution should not define the hologenome as a collection of genomes, but as the sum of the host genome plus some traits of the microbiome which together constitute an evolutionary individual, a conception I refer to as the stability of traits conception of the hologenome. Based on that conception I argue that the evidence presented by holobiont defenders is to the point, and supports the thesis that holobionts are evolutionary individuals. In this sense, the paper offers an account of the holobiont that aims to foster a dialogue between hologenome advocates and hologenome critics. (shrink)

The purpose of this paper aims to unravel the ideological strategy that rises from the well-celebrated epistemic rigor of neoclassical economic thought. From the Economics Nobel Price Paul Krugman’s popularized connotation naming to "freshwater" economists as those fervent followers of the most orthodox academic creed, we will expose the logical inconsistency and empirical implausibility of such thought’s underlying assumptions: perfect competence and equilibrium’s approaching. From a critical analysis that will be conducted from each of those mentioned assumptions, we will argued (...) that the neoclassical thought is an ideological strategy subverting reality’s principles, overcoming "artificially" those relevant deficiencies and limitations of its theoretical approach. A lo largo de este trabajo se intenta desvelar la estrategia ideológica que emana del celebrado rigorismo epistémico del pensamiento neoclásico de economía. Desde la connotación popularizada por el Nobel Paul Krugman a los economistas de "agua dulce" como aquellos fervientes seguidores del credo académico más ortodoxo, expondremos la incoherencia lógica e imposibilidad empírica de los supuestos fundamentales de su pensamiento: competencia perfecta y aproximación al equilibrio. Desde un examen crítico que irá conduciéndose por cada uno de tales supuestos, resolveremos cómo el marco neoclásico no es más que una estrategia ideológica que subvirtiendo los principios de lo real consigue superar solo "artificialmente" las importantes deficiencias y limitaciones de su marco teórico. Ezequiel Rojas is recognized as one of the most important Colombian utilitarian thinkers of the nineteenth century. His writings, however, have been ignored or underestimated by philosophy historians in Colombia who read them from the perspective of European history of philosophy, class struggles or partisan issues —a reading which ignores the manner of local writings. The present text offers instead a reflection on the notion of “science” in Rojas’ philosophical works emphasizing the practice of localized “exercise of writing”, and thus (...) provides a comprehensive view of his works as part of Colombian history of philosophy. We deal with situations incongruent with our automatic response tendencies much better right after having done so on a previous trial than after having reacted to a congruent trial. The nature of the mechanisms responsible for these sequential congruency effects is currently a hot topic of debate. According to the conflict monitoring model these effects depend on the adjustment of control triggered by the detection of conflict on the preceding situation. We tested whether these conflict monitoring processes can operate implicitly (...) in an implicit learning procedure, modulating the expression of knowledge of which participants are not aware. We reanalyze recently published data, and present an experiment with a probabilistic sequence learning procedure, both showing consistent effects of implicit sequence learning. Despite being implicit, the expression of learning was reduced or completely eliminated right after trials incongruent with the learned sequence, thus showing that sequential congruency effects can be obtained even when the source of congruency itself remains implicit. Contemporary biological research has suggested that some host–microbiome multispecies systems (referred to as “holobionts”) can in certain circumstances evolve as unique biological individual, thus being a unit of selection in evolution. If this is so, then it is arguably the case that some biological adaptations have evolved at the level of the multispecies system, what we call hologenomic adaptations. However, no research has yet been devoted to investigating their nature, or how these adaptations can be distinguished from adaptations at the (...) species-level (genomic adaptations). In this paper, we cover this gap by investigating the nature of hologenomic adaptations. By drawing on the case of the evolution of sanguivory diet in vampire bats, we argue that a trait constitutes a hologenomic adaptation when its evolution can only be explained if the holobiont is considered the biological individual that manifests this adaptation, while the bacterial taxa that bear the trait are only opportunistic beneficiaries of it. We then use the philosophical notions of emergence and inter-identity to explain the nature of this form of individuality and argue why it is special of holobionts. Overall, our paper illustrates how the use of philosophical concepts can illuminate scientific discussions, in the trend of what has recently been called metaphysics of biology. (shrink)

Symbiosis plays a fundamental role in contemporary biology, as well as in recent thinking in philosophy of biology. The discovery of the importance and universality of symbiotic associations has brought new light to old debates in the field, including issues about the concept of biological individuality. An important aspect of these debates has been the formulation of the hologenome concept of evolution, the notion that holobionts are units of natural selection in evolution. This review examines the philosophical assumptions that underlie (...) recent proposal of the hologenome concept of evolution, and traces those debates back in time to their historical origins, to the moment when the connection between the topics of symbiosis and biological individuality first caught the attention of biologists. The review is divided in two parts. The first part explores the historical origins of the connection between the notion of symbiosis and the concept of biological individuality, and emphasizes the role of A. de Bary, R. Pound, A. Schneider and C. Merezhkowsky in framing the debate. The second part examines the hologenome concept of evolution and explores four parallelisms between contemporary debates and the debates presented in the first part of the essay, arguing that the different debates raised by the hologenome concept were already present in the literature. I suggest that the novelty of the hologenome concept of evolution lies in the wider appreciation of the importance of symbiosis for maintaining life on Earth as we know it. Finally, I conclude by suggesting the importance of exploring the connections among contemporary biology, philosophy of biology and history of biology in order to gain a better understanding of contemporary biology. Given one conception of biological individuality (evolutionary, physiological, etc.), can a holobiont – that is the host + its symbiotic (mutualistic, commensalist and parasitic) microbiome – be simultaneously a biological individual and an ecological community? Herein, we support this possibility by arguing that the notion of biological individuality is part‐dependent. In our account, the individuality of a biological ensemble should not only be determined by the conception of biological individuality in use, but also by the biological characteristics of the part (...) of the ensemble under investigation. In the specific case of holobionts, evaluations of their individuality should be made either host‐relative or microbe‐relative. We support the claim that biological individuality is part‐dependent by drawing upon recent empirical evidence regarding the physiology of hosts and microbes, and the recent characterization of the ‘demibiont’. Our account shows that contemporary disagreements about the individuality of the holobiont derive from an incorrect understanding of the ontology of biological individuality. We show that collaboration between philosophers and biologists can be very fruitful in attempts to solve some contemporary biological debates. (shrink)

According to the cohabitation account, all the persons that result from a fission event cohabit the same body prior to fission. This article concerns a problem for this account. Suppose Manuel and Jimena are suffering from an equally painful migraine. Unlike Jimena, however, Manuel will undergo fission. Assuming you have a spare painkiller, whom should you give it to? Intuitively, you have no more reason to give it to one or the other. The problem is that the cohabitation account suggests (...) otherwise. According to the account, there are two persons cohabiting Manuel’s body, in which case you should arguably give them the pill, since doing so alleviates the pain of more beings. One response argues that the two persons cohabiting Manuel’s body share one pain. El artículo recorre la obra de Rodolfo Kusch posicionando sus principales propuestas en la construcción de tres enfoques convergentes en su filosofía. El primer enfoque está relacionado con la fenomenología y la cultura. El segundo enfoque se refiere a la influencia de la antropología y el cuestionamiento por el símbolo. El tercer enfoque despliega una aproximación filosófico-política. Estos enfoques permiten introducir tres “horizontes de pregunta” principalmente relacionados con el método, con lo popular y con lo indígena, que son expuestos como (...) asuntos centrales en toda su obra. Estos “horizontes de pregunta” buscan comprender los alcances de la filosofía de Kusch y su contribución al pensamiento filosófico americano. This paper analyses the work of Rodolfo Kusch remarking his main philosophical proposals through three correlated perspectives. The first perspective refers to phenomenology and culture. The second focuses on the influence of anthropology and the problem of symbols. The third posits a political-philosophical approximation. These perspectives operate interdependently as the background for Kusch’s philosophy and allow us to introduce three “questioning horizons” related to the method, the popular and the indigenous as the central issues of his philosophical work. Thus, these “questioning horizons” build a platform to understand Kusch’s philosophy and his contribution to the Latin American philosophy. (shrink)

El propósito de este artículo es desarrollar una relectura al mecanicismo moderno. Esto implica que una adecuada comprensión de este consiste, ante todo, en considerarlo como un proyecto antes que un sistema doctrinal consolidado. Para ello se toma como eje la filosofía de Leibniz, la cual, a diferencia del cartesianismo, identifica las inconsistencias que implica concebir el mecanicismo como un sistema filosófico completo, principalmente al pretender justificar mecánicamente el mundo natural, esto es, a partir de la figura, el tamaño y (...) el movimiento. Todo lo anterior no implica un rechazo completo del mecanicismo por parte de Leibniz, sino que permite concebirlo como un medio para desarrollar su filosofía, proponiendo una complementariedad entre la causa final y la causa eficiente. de este modo, el mecanicismo es reubicado como un problema metodológico para la ciencia natural antes que como un problema metafísico. This article aims to develop a second reading to the modern mechanicism. This implies that an appropriate understanding of mechanicism consists, above all, in considering it as a project, instead of a consolidated doctrinal system. To do so, we take Leibniz's philosophy as our building blocks, since unlike the Cartesianism, it does identify the inconsistencies implied when we conceive mechanicism as a complete philosophical system, mainly under the pretension to justify the natural world mechanically, that is, based on the figure, size and movement. It does not imply that Leibniz rejects entirely mechanicism, but allows us to understand it as a mean to develop his philosophy, proposing a complementary relationship between final cause and efficient cause. This way, mechanicism is re-posed as a methodological issue for the natural science instead of a metaphysical issue. (shrink)
