On occasions, laws on consent are subject to modification, largely on account of being subject to common law rather than statute—for example, in the UK. Guideline publications such as the UK Department of Health Reference Guide to Consent for Examination or Treatment are intended to provide information for clinicians on when and how to apply current laws in everyday clinical situations. While the extent to which guidelines influence clinician behaviour depends on how much they are read and followed, what is (...) also relevant, and sometimes omitted from consideration, is discussion about underlying philosophical concepts.This paper analyses philosophical weaknesses relating to English laws on consent, the main focus of attention being applied ethics and the rights of adults with incapacity. It draws comparisons between the US and the UK, and advocates changes in English law in order to help rectify weaknesses in patient protection. Discussion includes references to Scottish law, and the use of advance directives, and it voices concerns about over-reliance on “best interests” determinations. The problem is partly one of logical analysis, and what can happen is that best interests determinations fail to show proper respect for adults lacking the capacity to consent to examination or treatment on their own behalf. This is fundamentally a matter of rights, and requires further investigation and appropriate legal remedies in order to respond to ethical deficiencies in English law as it now stands. (shrink)

In exploring corporate perceptions of the business case for supplier diversity, this paper reports on a cross-national study of large purchasing organisations that had introduced, or were in the process of introducing, purchasing initiatives aimed at ethnic minority businesses. The research investigates how LPOs portray the benefits of this form of socially responsible purchasing and suggests a business case construct based on four component elements. It also highlights a number of contextual factors that appear to have shaped business case rationales. (...) There are inconsistencies in the treatment and attitudes of human beings to animals and much confusion in thinking about what are appropriate conditions for using and keeping animals. This article outlines some of these considerations and then proposes guidelines for designing animal management systems. In the first place, the global and local ecological effects of all animal management systems must be considered and an environment designed that will not rock the biospherical boat. The main points to consider are the interrelatedness (...) of living things with each other and the environment, the self-sustaining nature of ecosystems, and the importance of diversity in the stability and maintenance of ecosystems. These can and should be taken into account when assessing animal management. They are illustrated by examples of companion/urban dogs, as well as farm, zoo, and circus animals. The environment must also be considered from the point of view of the ethological needs of the animals. There are two possible approaches to this: (1) the reductionist approach, illustrated by the choice experimental tests; and (2) a holistic, evolutionist approach that concentrates on the degree of behavioral restriction and the identification of distress. The assessment of an animal's ethological needs, and thus the ethological soundness of an environment, must take into account the species needs (communication system, species-specific characteristics of the brain receptors and cognition) and the individual's needs (his past experience). The behavioral effects of domestication and how distress can be assessed are discussed. Different ethical positions toward animals and their treatment are briefly outlined, and it is argued that, provided animals are in ecologically and ethologically sound environments, their use by human beings is ethically acceptable. The animal-human association should be characterized by symbiosis—mutual benefit—rather than a parasitic or exploitative relationship—employer to employee, rather than master to slave. (shrink)

It is widely believed that there must be a conflict between food production and conservation, and that development must be related to economics. Both these beliefs are questioned. It is suggested that ecological agriculture, which includes ethologically and ecologically sound animal management can reduce conflicts between conservation and food production. African elephants are taken as an example illustrating different attitudes to conservation. It is proposed that, rather than developing further the present common conservation attitude of ' wildlife apartheid', the future (...) of elephants in many parts of Africa may rest on bringing them closer to the voters where the welfare of neither the human nor elephant is compromised. Here, they can act as both as workers, and as ' wildlife ambassadors'. This approach needs further research and development, but preliminary results show significant possibilities for reducing these apparently conflicting land use interests in some geographical areas. On one day in 2009, in 38 countries around the world, 4,000 ordinary citizens gathered to discuss the future of climate policy. This project, 'WWViews', was the first-ever global democratic deliberation - an attempt to enable normal people to reach informed decisions on and impact the global policy process.This book, written by the international practitioners and scholars who facilitated the project, analyses the experiences and lessons from this ground-breaking event. Despite the apparent success of the individual deliberations, the recommendations had (...) little impact within the media or the policy process at Copenhagen. The authors examine these successes and failures, and the challenges and opportunities of such deliberative events. Through this they explore important themes for participatory approaches from the local to the global: the role of deliberation within global governance; methodology and practice; participant selection; policy impacts; engaging the media; how policy culture affects deliberation uptake; capacity building and knowledge transfer; process evaluation; content and argumentation analysis; and gender, race and class aspects.The global aims of the WWViews project, along with the opportunity to evaluate the same process in different national and cultural contexts, makes this a hugely valuable and informative study for all those interested in democratic deliberation and environmental governance from the small to the international scale. A century ago, John Dewey remarked that when home changes radically, school must change as well. With home, family, and gender roles dramatically altered in recent years, we are faced with a difficult problem: in the lives of more and more American children, no one is home. The Schoolhome proposes a solution. Drawing selectively from reform movements of the past and relating them to the unique needs of today's parents and children, Jane Martin presents a philosophy of education that (...) is responsive to America's changed and changing realities. As more and more parents enter the workforce, the historic role of the domestic sphere in the education and development of children is drastically reduced. Consequently, Martin advocates removing the barriers between the school and the home--making school a metaphorical "home," a safe and nuturant environment that provides children with the experience of affection and connection otherwise missing or inconsistent in their lives. In this proposition, the traditional schoolhouse where children are drilled in the three Rs is transformed into a "schoolhome" where learning is animated by an ethic of social awareness. At a time when many school reformers are calling for a return to basics and lobbying for skills education and quick-fix initiatives, Martin urges us to reconsider the distinctive legacies of Dewey and Montessori and to conceive of a school that integrates the values of the home with those of social responsibility. With cultural diversity and gender equality among its explicit goals, the schoolhome expands upon Dewey's edict to educate the "whole child," seeking instead to educate all children in the culture's whole heritage. Martin eloquently challenges reformers to reclaim the founding fathers' vision of the nation as a domestic realm, and to imagine a learning environment whose curriculum and classroom practice reflect not merely an economic but a moral investment in the future of our children. A longstanding problem in the teacher workforce, internationally and in the UK, is the continuing and substantial numbers of qualified teachers who leave the profession within five years. This paper uses data collected from a survey to the last five years of teacher education graduates of UCL Institute of Education (IOE) in London, to explore what originally motivated them to teach, and the reasons why they have left or may consider leaving in the future. We discovered that despite claiming to (...) be aware of the challenges of workload before entering teaching, workload was the most frequently cited reason for having left, or for leaving in the future. The data spoke to the reality of teaching being worse than expected, and the nature (rather than the quantity) of the workload, linked to notions of performativity and accountability, being a crucial factor. This paper draws on a substantial new source of data and explores reasons for leaving in the context of reported initial motivation of individuals who have left teaching, individuals who are planning to leave and individuals who are planning to stay in teaching. In _influx & efflux_ Jane Bennett pursues a question that was bracketed in her book _Vibrant Matter_: how to think about human agency in a world teeming with powerful nonhuman influences? “Influx _& _efflux”—a phrase borrowed from Whitman's "Song of Myself"—refers to everyday movements whereby outside influences enter bodies, infuse and confuse their organization, and then exit, themselves having been transformed into something new. How to describe the human efforts involved in that process? What kinds of “I” and “we” (...) can live well and act effectively in a world of so many other lively materialities? Drawing upon Whitman, Thoreau, Caillois, Whitehead, and other poetic writers, Bennett links a nonanthropocentric model of self to a radically egalitarian pluralism and also to a syntax and style of writing appropriate to the entangled world in which we live. The book tries to enact the uncanny process by which we “write up” influences that pervade, enable, and disrupt us. (shrink)

A comforting, gentle introduction to the concept of God for young children.

There has been much discussion about whether traditional epistemology's doxastic attitudes are reducible to degrees of belief. In this paper I argue that what I call the Straightforward Reduction - the reduction of all three of believing p, disbelieving p, and suspending judgment about p, not-p to precise degrees of belief for p and not-p that ought to obey the standard axioms of the probability calculus - cannot succeed. By focusing on suspension of judgment (agnosticism) rather than belief, we can (...) see why the Straightforward Reduction is bound to fail. I argue that, in general, suspending about p is not just a matter of having some specified standard credence for p, and in the end I suggest some ways to extend the arguments that will put pressure on other credence-theoretic accounts of belief and suspension of judgment as well. ABSTRACT This paper examines some arguments which deny the existence of an individual right to remain ignorant about genetic information relating to oneself – often referred to as ‘a right to genetic ignorance’ or, more generically, as ‘a right not to know’. Such arguments fall broadly into two categories: 1) those which accept that individuals have a right to remain ignorant in self‐regarding matters, but deny that this right can be extended to genetic ignorance, since such ignorance may be harmful (...) to others, particularly those to whom one is genetically related (the ‘harm to others objection’) and 2) those which contend that, even if genetic ignorance is only self harming, it is not something to which individuals can rationally or morally claim to have a ‘right’ at all, since they defend their claims on autonomy‐respecting grounds and ignorance is inimical to autonomy (the ‘incoherence objection’). I argue that defenders of a right not to know have some plausible responses to the ‘harm to others objection’, but that in trying to respond to the ‘incoherence objection’, they and their opponents reach an impasse in which both sides are left voicing concerns about the paternalistic implications of the other's point of view. I conclude that defenders of a right not to know would, therefore, advance their position further by analysing it in terms of values other than those of autonomy and rights. (shrink)

Is it possible for postmodernism to offer viable, coherent accounts of ethics? Or are our social and intellectual worlds too fragmented for any broad consensus about the moral life? These issues have emerged as some of the most contentious in literary and philosophical studies. In Renegotiating Ethics in Literature, Philosophy, and Theory a distinguished international gathering of philosophers and literary scholars address the reconceptualisations involved in this 'turn towards ethics'. An important feature of this has been a renewed interest in (...) the literary text as a focus for the exploration of ethical issues. Exponents of this trend include Charles Taylor, Bernard Williams, Iris Murdoch, Cora Diamond, Richard Rorty and Martha Nussbaum, the latter a contributor and a key figure in this volume. This book assesses the significance of this development for ethical and literary theory and attempts to articulate an alternative postmodern account of ethics which does not rely on earlier appeals to universal truths. In this paper we investigate the locus of believability effects in syllogistic reasoning. We identify three points in the reasoning process at which such effects could occur: the initial interpretation of premises, the examination of alternative representations of them (in all of which any valid conclusion must be true), and the “filtering” of putative conclusions. The effect of beliefs at the first of these loci is well established. In this paper we report three experiments that examine whether beliefs have an (...) effect at the other two loci. In experiments 1 and 2 subjects drew their own conclusions from syllogisms that suggested believable or unbelievable ones. In the third experiment they evaluated conclusions that were presented to them. The data show that beliefs both affect the examination of alternative models and act as a filter on putative conclusions. We conclude by showing how some types of problem and some problem contents make the existence of alternative models more obvious than others. (shrink)
