Speakers often do not state requests directly but employ innuendos such as Would you like to see my etchings? Though such indirectness seems puzzlingly inefficient, it can be explained by a theory of the strategic speaker, who seeks plausible deniability when he or she is uncertain of whether the hearer is cooperative or antagonistic. A paradigm case is bribing a policeman who may be corrupt or honest: A veiled bribe may be accepted by the former and ignored by the latter. (...) Everyday social interactions can have a similar payoff structure (with emotional rather than legal penalties) whenever a request is implicitly forbidden by the relational model holding between speaker and hearer (e.g., bribing an honest maitre d’, where the reciprocity of the bribe clashes with his authority). Even when a hearer’s willingness is known, indirect speech offers higher-order plausible deniability by preempting certainty, gossip, and common knowledge of the request. In supporting experiments, participants judged the intentions and reactions of characters in scenarios that involved fraught requests varying in politeness and directness. (shrink)

Developmental psychologists have long argued that the capacity to distinguish moral and conventional transgressions develops across cultures and emerges early in life. Children reliably treat moral transgressions as more wrong, more punishable, independent of structures of authority, and universally applicable. However, previous studies have not yet examined the role of these features in mature moral cognition. Using a battery of adult-appropriate cases (including vehicular and sexual assault, reckless behavior, and violations of etiquette and social contracts) we demonstrate that these features (...) also distinguish moral from conventional transgressions in mature moral cognition. Each hypothesized moral transgressions was treated as strongly and clearly immoral. However, our data suggest that although the majority of hypothesized conventional transgressions also form an obvious cluster, social conventions seem to lie along a continuum that stretches from mere matters of personal preference (e.g., getting tattoos or wearing black shoes with a brown belt) to transgressions that are treated as matters for legitimate social sanction (e.g., violating traffic laws or not paying your taxes). We use these findings to discuss issues of universality, domain-specificity, and the importance of using a well-studied set of moral scenarios to examine clinical populations and the underlying neural architecture of moral cognition. The fact that genes and environment contribute differentially to variation in human behaviors, traits and attitudes is central to the field of behavior genetics. Perceptions about these differential contributions may affect ideas about human agency. We surveyed two independent samples (N = 301 and N = 740) to assess beliefs about free will, determinism, political orientation, and the relative contribution of genes and environment to 21 human traits. We find that lay estimates of genetic influence on these traits cluster into (...) four distinct groups, which differentially predict beliefs about human agency, political orientation, and religiosity. Despite apparent ideological associations with these beliefs, the correspondence between mean lay estimates and published heritability estimates for the surveyed traits is large (r = .77). Belief in genetic determinism emerges as a modest predictor of accuracy in these lay estimates. Additionally, educated mothers with multiple children emerge as particularly accurate in their estimates of the genetic contribution to these traits. (shrink)

This paper will argue for the teaching of component skills in philosophy. We can distinguish between complex and component skills. Component skills bear a kind of constitutive relation to complex skills. We observe this distinction at use in standard pedagogies related to activities like sports, music performance, and mathematics. The central thesis is that devoting pedagogical resources to the development of component skills, especially at introductory levels, promotes better learning outcomes with respect to complex philosophical skills. Socratic dialogue is widely recognized as an effective teaching tool inside of the classroom. In this paper I will argue that Socratic dialogue is also a highly effective teaching tool outside of the classroom. I will argue that Socratic dialogue is highly effective outside of the classroom because it is a form of learning based assessment. I will also show how instructors can use technology like email to implement Socratic dialogue as a form of teaching and assessment, and thus offer (...) a viable alternative to traditional assessments like exams and papers. This review examines the final three books in the late Professor Sir Neil MacCormick's series "Law, State and Practical Reason": Rhetoric and the Rule of Law; Institutions of Law: An Essay in Legal Theory; and Practical Reason in Law and Morality . The books represent a monumental accomplishment, providing a restatement of his positions in jurisprudence, while embracing and confronting a remarkable range of traditions and philosophical approaches. Advancing what he terms a "post-positivistic view of law". MacCormick provides "a substantial (...) reworking of ideas [he had] developed over the years". The aim here is to adumbrate and reflect upon some of the themes in the books, with a view to demonstrating the significant and serious contribution which they make to contemporary jurisprudence. Since various themes permeate the books, these are considered broadly in order of the book in which they appear. In particular, such an approach enables us to trace the progression of MacCormick's theory since the publication of his seminal Legal Reasoning and Legal Theory . It is argued that, in many respects, the process can be considered to be one of radical evolution. (shrink)
