In contrast to the traditional view of Kant as apure retributivist, the recent interpretations ofKant's theory of punishment (for instance Byrd's)propose a mixed theory of retributivism and generalprevention. Traditional liberalism's blindness to cultural concerns has often come under fire, while so‐called “liberal multiculturalism” has made it its business to take a good look at the place of culture within liberal law. According to them, cultural minorities should be recognized. In my opinion, however, their proposals, in fact, almost entirely preclude the possibility that cultural minorities would receive recognition within liberal society. In what follows, I explain my view of these matters and, above all, argue for a more vital (...) understanding of cultural minorities. Sie gilt zudem als die reifste und elaborierteste Darstellung des Standpunkts seiner Jenaer Wissenschaftslehre, in der die praktische Vernunft in die Rolle des hochsten Prinzips der Philosophie ruckt. Dieser kooperative Kommentar ermoglicht dem Leser, die Argumentation des Textes Schritt fur Schritt (...) nachzuvollziehen und dadurch zu einem vertieften Verstandnis dieses zentralen Textes des Deutschen Idealismus zu gelangen. Against the background of early modernism - a period that justified punishment by general deterrence - Kant is usually thought to represent a radical turn towards retributivism. For Kant, and later for Fichte and Hegel, a just punishment respects the humanity inherent in the criminal, and serves no external ends - it is instituted only because the criminal deserves it. In this original study, Jean-Christophe Merle uses close analysis of texts to show that these philosophers did not in fact hold (...) a retributivist position, or even a mixed position; instead he traces in their work the gradual emergence of views in favour of deterrence and resocialisation. He also examines Nietzsche's view that morality rests on the rejection of retribution. His final chapter offers a challenge to the retributivist position, and a defence of resocialisation, in the context of current legal theory and practice concerning the punishment of crimes against humanity. This volume presents an extended version of the contributions presented at the workshop "Kant's Concept of Law" held at the 26th World Congress of the International Association for Philosophy of Law and Social Philosophy (IVR) in 2013. It handles issues of applied legal philosophy in Kant's Doctrine of Right such as ownership, the alleged right of necessity, the right of resistance and the right of revolution. With each of these applied issues, the focus lies, on the one hand, on the (...) relationship between the principles a priori of law and of the duties of rights, as well as their normative requirements - for instance, the duty of independence from the coercion by others - and, on the other hand, empirical situations and their pressing demands. Thus, this volume illustrates how Kant concretely conceives of the doctrine of "first metaphysical of the doctrine of right" as supplying "the immutable principles for any giving of positive law". Each essay of this volume not only undertakes a careful and original interpretation of Kant's theses, but also offers a critical assessment. (shrink)

Une première observation aboutit à l’hypothèse suivante : l’exclamation se caractérise par un surcroît d’expressivité qui donne de la saillance à un énoncé ou à un fragment d’énoncé. La motivation de l’exclamation peut se trouver en amont, en aval, et/ou à l’intérieur d’un énoncé. L’exclamation est compatible avec tout type d’énoncé, comme modulation énonciative marquée qui s’oppose toujours à une variante non exclamative. On s’interroge sur l’affinité entre exclamation et (...) émotion ; entre exclamation et hiatus par rapport à une attente ; entre exclamation et haut degré, entre exclamation et pluri-modalité. Hoy en día la mayoría de los teóricos liberales o no consideran el tema de un derecho general a la inmigración o simplemente lo rechazan. Esto contradice no sólo la doctrina tradicional del derecho natural, sino también principios actuales de justicia tales como el principio de la diferencia postulado por Rawls. En el presente artículo se propone el siguiente experimento mental: comparar la situación imaginaria en la que la inmigración proveniente del Tercer Mundo estuviera permitida sin restricciones, pero en la (...) que no hubiera ninguna prestación social o asistencial para los inmigrantes, con la situación actual en la que aunque la inmigración está muy limitada, las prestaciones sociales y asistenciales habituales se encuentran aseguradas para los inmigrantes. Contra la opinión predominante hoy en día, la suerte de los peor situados parece ser en la situación actual claramente peor que en la situación imaginaria. Teorías liberales como la rawlsiana deben superar esta inconsistencia entre sus principios de justicia y su posición con respecto a la cuestión de la inmigración y decidirse por una cuestión más coherente. Zumal behandelt Fichte dabei keineswegs eine Anwendung des Notrechts, in der ein Eigentum auf dem Spiel steht: bei den (...) À luz da secularização da sociedade, que marcou a época moderna e a contemporânea e, sobretudo, com a larga difusão do ateísmo, trata-se de discutir a questão do mal, mostrando, por um lado, que a crença em Deus poderia atribuir uma importância cada vez maior à questão do mal, mas, por outro, poder-se-ia esperar, à luz da influência do ateísmo, que o mal assumisse uma significação inédita, ou seja, o deslocamento da questão do mal, exclusivamente, à perspectiva moral. Neste artigo, (...) fala-se não de um mundo sem religião nem sem divino nem sem divindades. Fala-se de um mundo sem Deus, no singular, limitando-se o autor a tratar de uma só das religiões monoteístas e a filosofia que ela inspirou, a saber, o Cristianismo, ainda que sem fazer distinções entre suas diferentes confissões. Partindo, pois, do pressuposto de que o mal é a única coisa que Deus não criou, o autor mostra que os filósofos, inspirados no Cristianismo, consideraram que não seria possível ser virtuoso e dizer-se ateu ao mesmo tempo, a não ser pagando o preço de uma contradição. A teoria da justiça política de Hóffe, fundamentada na justiça comutativa, sustenta que a fundamentação de normas de sociedade, na comunidade discursiva, pela Ética do Discurso de Apel e Habermas, é apenas uma fundamentação derivada, posto que a comunidade discursiva — necessariamente pressupõe direitos humanos A Ética do Discurso afirma, por sua vez, que direitos humanos podem: ser legitimados somente através de discursos. Este artigo sustenta que a pressuposição normativa para ambas - a comunidade discursiva e o princípio de justiça (...) comutativa — é que todos cos seres humanos têm o direito de partilhar o mundo. Somente sob essa premissa da justiça distributiva, pode haver parceiros que exercem reciprocidade e participantes de discurso, que também têm algo sobre o que têm de decidir conjuntamente. (shrink)

Die Berechtigung und Angemessenheit von Strafen ist ein Zentralproblem jeder Staats- und Gesellschaftsphilosophie. Die vorliegende Abhandlung befasst sich mit den Vergeltungstheorien (Retributivismus) und den Theorien der Generalprävention und erarbeitet in einer Kombination von Spezialprävention und Resozialisierung einen eigenen Standpunkt, aus dem sich ein Plädoyer für einen die Würde des Menschen respektierenden Umgang mit Verbrechern herleitet.
