The phenomenological starting point of this paper is the world of the bioethical subject, the person engaged in moral deliberation about practices of intervention on living bodies. This paper develops a perspective informed by the hermeneutic tradition in phenomenology, approaching bioethical thinking as situated within specific contexts of meaning and conceptuality, frameworks through which the phenomena of the world are interpreted and made sense of by the reasoning subject. It focuses on one dimension of the hermeneutic world of contemporary bioethics, (...) that of the relation between bioethics and biological science. This paper shows how taking a phenomenological-hermeneutic perspective can highlight an important but often overlooked way in which biology helps to structure spaces of bioethical sense-making, with substantive consequences for moral judgement. Bioscientific discourse provides us with interpretive resources for making sense of the living world around us and within us. Different interpretive resources reflect different assumptions about the ontology of living beings, humans included. Since, as is argued here, judgements about moral significance in bioethics can depend upon suppositions about the ontology of life, the way that scientific discourse interpretively constitutes the phenomena of life as intentional objects can thereby channel moral thinking in particular ways. The central thesis of this paper is that critical engagement with this ‘hermeneutics of biology’ is vital for contemporary bioethics. To illustrate, the paper explores the hermeneutic constitution of the genome and its relationship to issues of human identity in the context of genetic technology. Alternative interpretations of the genome—as ‘programme’ or as ‘developmental resource’—differently shape bioethical reasoning in this context. Choices of description in bioscience are in this way partly ethical questions, questions about how we ought to comport ourselves towards each other and the living world beyond. (shrink)

This paper re-constructs Plato's ‘philosophy of geometry’ by arguing that he uses a geometrical method of hypothesis in his account of the cosmos’ generation in the Timaeus. Commentators on Plato's philosophy of mathematics often start from Aristotle's report in the Metaphysics that Plato admitted the existence of mathematical objects in-between ( metaxu) Forms and sensible particulars ( Meta. 1.6, 987b14–18). I argue, however, that Plato's interest in mathematics was centred on its methodological usefulness for philosophical inquiry, rather than on questions (...) of mathematical ontology. My key passage of interest is Timaeus’ account of the generation of the primary bodies in the cosmos, i.e. fire, air, water and earth ( Tim. 48b–c, 53b–56c). Timaeus explains the primary bodies’ origin by hypothesising two right-angled triangles as their starting-point ( arkhê) and describing their individual geometrical constitution. This hypothetical operation recalls the hypothetical method which Socrates introduces in the Meno (86e–87b), as well as the use of hypotheses by mathematicians which is described in the Republic (510b–c). Throughout the passage, Timaeus is focussed on explicating the bodies in terms of their formal structure, without however considering the ontological status of the triangles in relation to the physical world. This chapter describes how the core principles of generative linguistics, which were outlined by Chomsky in the 1950s and 1960s, yielded a research methodology whose core features guarantee quick and fruitful syntactic research. Although generative linguistics is predominantly a syntax‐focused program, the methodology is intended for use in all linguistic subfields. The discovery that the establishment of a nonlocal dependency rests on hierarchical relations between words and phrases rather than on linear relations represents a watershed moment for generative syntax. The (...) ubiquity of gaps in natural language has prompted extensive research into the precise status of gaps and whether all gaps have the same status. The chapter also discusses the enduring discoveries made about the hierarchical syntactic structures on which nonlocal dependencies are instantiated. It focuses on so‐called gaps or empty categories, which frequently feature as members in nonlocal dependencies. (shrink)

THE book which Eudoxus of Cnidos was stated by some to have translated from the Egyptian is entitled in the manuscripts of Diog. Laert. 8. 89, a reading which R. D. Hicks retains in his Loeb edition. It was retained also in the edition of C. Gabr. Cobet and in the Tauchnitz edition ; so also H. S. Long in O.C.T.. Egyptian religion was richly theriolatrous. But does it proffer a suggestion of ‘Dialogues of Dogs’? The contrary belief is suggested (...) by the proposal of various emendations. (shrink)

A model of copyright protection under which the law’s attention is directed towards a dematerialized, malleable essence (‘originality’, ‘labour and skill’ or ‘creativity’) has gradually evolved in the UK. This model has come to regulate all fundamental questions concerning the scope and attribution of rights. Nevertheless, until very recently, some aspects of copyright doctrine have remained incompatible with this dominant model. In certain situations, rather than focusing purely on an abstract property, the law has continued to limit a copyright owner’s (...) powers by reference to the boundaries of the material form within which a protected work is first recorded. It is argued here that, while apparently inconsistent, this approach has served an important function in justifying judicial resistance to expansionist pressures in the law. Since 2009, however, this pragmatic, focus-shifting system has been destabilized by the copyright jurisprudence of the Court of Justice. The Court’s judgments in Infopaq International A/S v Danske Dagblades Forening and subsequent cases have dramatically accelerated the pace of copyright harmonization. As a result, it is possible that UK courts may be obliged to adopt a more consistently dematerialized system of copyright law and our courts may have been deprived of tools previously employed to resist unduly broad claims to copyright protection. Recent studies by Stephanie West have appreciably advanced our understanding of this rather difficult poet. For the passages where Lycophron surprisingly presents phases of Roman history she cogently adduces a later poet, a ‘Deutero-Lycophron, …to be sought among the artists of Dionysus (...) in southern Italy’. Since its founding in 1943, Medievalia et Humanistica has won worldwide recognition as the first scholarly publication in America to devote itself entirely to medieval and Renaissance studies. Since 1970, a new series, sponsored by the Modern Language Association of America and edited by an international board of distinguished scholars and critics, has published interdisciplinary articles. Triads and Trinity examines three possible areas of impact: Judaism, the religion of Egypt, and various Greek traditions. Whereas a pluralistic concept of God was inherited by Judaism, it eventually accepted a firm monotheism.
