This research aims to describe how practicing lawyers perceive ‘plain writing’ in the legal field and to conceptualize this notion through the discourse analysis of these specialists. To do so, a qualitative research framed in the interpretive paradigm has been developed. Specifically, 18 practicing lawyers, from different countries and with different specializations in the practicing of Law, were surveyed. After analyzing the discourse of the interviewed lawyers, eight macro categories accounting for plain language both generally and particularly were identified. The (...) audience was identified as a key element in the production of legal texts which facilitate justice to citizens. Based on our analysis, we conclude with a definition of plain writing. Music can reduce stress and anxiety, enhance positive mood, and facilitate social bonding. However, little is known about the role of music and related personal or cultural variables in maintaining wellbeing during times of stress and social isolation as imposed by the COVID-19 crisis. In an online questionnaire, administered in 11 countries, participants rated the relevance of wellbeing goals during the pandemic, and the effectiveness of different activities in obtaining these goals. Music was found to be the most effective activity (...) for three out of five wellbeing goals: enjoyment, venting negative emotions, and self-connection. For diversion, music was equally good as entertainment, while it was second best to create a sense of togetherness, after socialization. This result was evident across different countries and gender, with minor effects of age on specific goals, and a clear effect of the importance of music in people's lives. Cultural effects were generally small and surfaced mainly in the use of music to obtain a sense of togetherness. Interestingly, culture moderated the use of negatively valenced and nostalgic music for those higher in distress. (shrink)

The -trees allow a compact representation for negation normal forms as well as for a number of reduction strategies in order to consider only those occurrences of literals which are relevant for the satisfiability of the input formula. These reduction strategies are divided into two subsets (meaning- and satisfiability-preserving transformations) and can be used to decrease the size of a negation normal form A (...) at (at most) quadratic cost. The reduction strategies are aimed at decreasing the number of required branchings and, therefore, these strategies allow to limit the size of the search space for the SAT problem. (shrink)

Rationale, aims and objectives Given the increasing prevalence of cataract and demand for cataract extraction surgery, patients must often wait to undergo this procedure. We validated a previously developed priority scoring system in terms of clinical variables, pre-intervention health status, appropriateness of surgery and gain in visual acuity (VA) and health-related quality of life (HRQoL).Methods Explicit prioritization criteria for cataract extraction created by a variation of the Research and Development (RAND) and University of California Los Angeles appropriateness methodology were retrospectively (...) applied to a prospective cohort of 5257 patients on waiting lists to undergo cataract by phacoemulsification at 17 hospitals in Spain. Demographic data, clinical data and data related to surgical technique were collected by trained ophthalmologists. Patients were evaluated by their ophthalmologist before the intervention and 6 weeks afterward. They also completed, by mail, the Visual Function Index (VF-14) before the intervention and 3 months afterward.Results High-priority patients experienced greater improvement in VA and HRQoL than those classified as intermediate or low-priority (P < 0.0001), even after adjusting by VA and the VF-14 score at baseline. The time to intervention was the same for high-priority patients as it was for intermediate and low-priority patients.Conclusions The priority score we developed identified patients most likely to experience the greatest improvements from cataract extraction. Use of this tool could provide a fairer and more rational way to prioritize patients for cataract extraction. (shrink)

This paper is a response to Haze’s brief argument for the falsity of the theory that instantial terms refer arbitrarily, proposed by Breckenridge and Magidor in 2012. In this paper, I characterise instantial terms and outline the theory of arbitrary reference; then I reconstruct Haze’s argument and contend that it fails in its purpose. Haze’s argument is supposed to be a _reductio ad absurdum:_ according to Haze, it proves that a contradiction follows from the most basic tenets of the theory (...) of arbitrary reference. I will argue, however, that the contradiction in question follows not from these tenets, but from the surreptitious use that Haze makes of a self-referential expression. I conclude, consequently, that Haze’s argument is nothing more than an illustration of the well-known fact that self-referential expressions produce paradoxical results. (shrink)

There are compelling reasons to believe that musical works are abstract. However, this hypothesis conflicts with the platitude that musical works are appreciated by means of audition: the things that enter our ear canals and make our eardrums vibrate must be concrete, so how can musical works be listened to if they are abstract? This question constitutes the audibility problem. In this paper, I assess Julian Dodd’s elaborate attempt to solve it, and contend that Dodd’s attempt is unsuccessful. Then I (...) discuss what I take to be the ideal response to the audibility problem, and show that it ultimately fails. I contend, consequently, that the project of construing musical works as audible is disheartening. Accordingly, in my last section, I will argue the audibility problem may be satisfactorily resolved without ascribing audibility to musical works. (shrink)

Jean-Luc Nancy is a prolific thinker, not only because of an abundant body of work—more than a hundred titles—but also and above all because his thought, in the form of an opening, encourages and invites us to think what he himself has not put into question. So it is with the category of “milieu”. This category, of which Georges Canguilhem in his time marked the contemporaneity, is more relevant today than ever. It enables us to think differently about our world, (...) and about what makes the world our world. Who makes the “we,” when we think through the “milieu”? How can we think from the relationship first and not from a primordial subject? How, therefore, can we think of another subjectivity, beyond the reflexive subjectivity of the human? This study aims to show the conditions in which Nancy’s work can contribute in a powerful way to a thought of being-together from an ecosophical point of view. (shrink)

In this paper I suggest that in order to avoid some of the difficulties to which the contemporary discussion on the transcendental arguments has led we must discriminate different ways of understanding the sceptic’s challenge that Kant faces in the Critique of Pure Reason. In the first part, I expound a dilemma into which the Kantian epistemology could fall if we accept the characterization of the transcendental arguments as anti-sceptic arguments. When philosophers consider factors compromising autonomy in consent, they often focus solely on the consent-giver’s agential capacities, overlooking the impact of the consent-receiver’s conduct on the consensual character of the activity. In this paper, I argue that valid consent requires justified trust in the consent-receiver to act only within the scope of consent. I call this the Trust Condition (TC), drawing on Katherine Hawley’s commitment account of trust. TC constitutes a belief that the consent-receiver is capable and willing to act (...) as we expect from them. If such trust is not warranted, I argue, consent lacks the appropriate normative grounds. After establishing TC, I explore its application in the sexual arena, asserting that due to the non-contractual dimensions of sexual activity — such as the dynamic nature of sexual desires and the absence of external factors effectively binding sexual partners to the terms of consent—trust is warranted in sexual consent by means of care. I define care as a special sensitivity and attention toward the partner’s will and discuss how this approach leads to safer intimate relationships in practice. (shrink)

Aunque una filosofía de la esperanza pareciera ser una propuesta del todo contemporánea (Bloch, Fromm, Husserl, Laín, Marcel, Heidegger, Patočka, Stein), sus esbozos tuvieron lugar en el siglo VI a.n.e. El objetivo principal de esta investigación es exponer los ejercicios preliminares en torno a una filosofía de la esperanza en el marco de la controversia de Heráclito con Pitágoras. Desde un enfoque cualitativo, mediante el método histórico hermenéutico, se hizo un análisis de datos. Como muestra tomamos fuentes primarias sobre los (...) Versos dorados de Pitágoras y los Fragmentos de Heráclito y como secundarias las traducciones y comentarios más reconocidos. El instrumento utilizado fue las fichas de trabajo mixtas. Como resultado, se observa que la esperanza es un problema para el pueblo griego, que en los vv. 52-53 de los Versos dorados y en el fragmento 22B 18 DK se encuentra esbozada como problema filosófico, que este se comprende mejor a partir de la crítica de Heráclito a Pitágoras y en relación con otros fragmentos clave del pensamiento del Efesio. La investigación permite concluir que la esperanza no es un tema exclusivo de la teología ni propiamente contemporáneo, sino inicialmente de la filosofía, que encuentra en el debate de Heráclito con Pitágoras sus formulaciones preliminares y un contexto propicio para problematizarla en su comprensión habitual, repensarla a la luz del espíritu del tiempo y resignificarla como forma-de-vida. In this article, we outline a simple and intuitively appealing procedure to derive default priors. The main idea is to regard the choice of such a prior as a formal Bayesian decision problem. We also discuss Jeffreys prior and more generally the reference prior of Bernardo (J R Stat Soc B 41:113–147, 1979) from this standpoint.

Dada la formación filosófica del poeta, se buscó en su obra una reflexión con respecto a las preguntas fundamentales al ser humano y que la filosofía ha intentado responder desde la antigüedad: qué idea del hombre, del mundo y de la existencia hay en su poesía, de tal forma que pudiera establecerse un puente entre la filosofía y la literatura; y derivada de esta última, pero igualmente importante, se (...) indagó por la reflexión estética que allí subyace, su concepción del arte, del artista y particularmente de la poesía. Resumen: El objetivo del presente escrito es analizar una confusión epistemológica recurrente en algunas corrientes filosóficas contemporáneas: el sociologismo, que consiste en establecer juicios acerca de la justificación de la ciencia a partir de sus orígenes históricos. En particular, me interesa revisar sus variantes relativistas, que, en sus formas más radicales, llegan a identificar la pretensión de racionalidad y objetividad de la ciencia con los mecanismos de poder. In this magisterial survey of the Enlightenment, Jonathan Israel returns to the primary texts to offer a major new reinterpretation of the nature and development of the important currents in philosophical thinking, arguing that supposed national enlightenments are of less significance than the rift between conservative and radical thought.

In this paper, I discuss a subset of preferences in which a person desires the fulfillment of a choice they have made, even if it involves the violation of their desires, as in rape fantasies. I argue that such cases provide us with a unique insight into personal autonomy from a proceduralist standpoint. In its first part, I analyze some examples in light of Frankfurt's endorsement theory and argue that even when we cannot endorse a practical decision that involves being (...) violated, we nonetheless regard those cases as instances of autonomy. Therefore, autonomy does not necessarily require endorsement. Instead, I propose that the nature of the relevant highest-order volition dictates the procedure that should be established in one’s desire structure for its fulfillment. In the second part, I discuss how an agent may effectively consent to the violation of their decision by another person. Ordinary consent typically refers to actions but fails to communicate one's higher-order desires or commitments. To address this limitation, I propose a practical tool that accomplishes this by signaling shifts in the normative context where the agents are interacting. (shrink)

There are many important connections between epistemic justification and moral justification. A recent example of such connections is offered by Sosa’s AAA model for the normative evaluation of epistemic performances. In order to count as knowledge, a belief has to be Accurate in attaining the truth, the subject has to be Adroit or competent for such task, and the belief has to be Apt in the sense that the accuracy of the belief has to manifest the adroitness of the subject. (...) In addition, full knowledge would require full-aptness, which is obtained when the aim of aptness is achieved in an apt way. We have here a clear definition of the model. But the application of the model to particular performances is not so clear. Both the identification of a particular performance as a case of epistemic performance and the assessment of its aptness, or full-aptness, are strongly relative to intentional descriptions paying attention to contextual factors and personal aspects. Here is where we can find close proximity with ethics. An epistemic analog to the ethical problem of double effects appears. In our paper, we analyze that problem in detail, extracting some consequences. (shrink)

El presente artículo busca interrogar las formas y mecanismos que adoptan los procesos de politización en los sectores populares chilenos. Para ello, se analiza el caso del comité de vivienda “MPL- Franklin” organizado semanas después del pasado terremoto del 27 de Febrero del 2010. La tesis que se desarrolla versa sobre la necesidad de problematizar la relación entre subjetivación individual y subjetivación colectiva para comprender la politización de las demandas, en principio instrumentales, que articula el movimiento. A partir del concepto (...) de “afección política” se intenta reconstruir el vínculo entre la lucha por la vivienda y las trayectorias individuales de los vecinos miembros del comité. Las preguntas de investigación son las siguientes: ¿cómo se puede explicar la politización de ciertos individuos en un medio social donde la pasividad reina?; ¿cómo se puede comprender la afección de ciertos individuos por la política de cara a una desafección generalizada?
