In Brazil, the normative landscape around advertising is complex, not the least because of limitations inherent to dispute resolution mechanisms. Focusing on unhealthy food and beverages, this case study identifies some challenges and opportunities around advertising restrictions, including in relation to freedom of speech.

Grammatical gender processing during language production has classically been studied using the so-called picture-word interference (PWI) task. In this procedure, participants are presented with pictures they must name using target nouns while ignoring superimposed written distractor nouns. Variations in response times are expected depending on the congruency between the gender values of targets and distractors. However, there have been disparate results in terms of the mandatory character of an agreement context to observe competitive gender effects and the interpretation of the (...) direction of these effects in Romance languages, this probably due to uncontrolled variables such as animacy. In the present study, we conducted two PWI experiments with European Portuguese speakers who were asked to produce bare nouns. The percentage of animate targets within the list was manipulated: 0, 25, 50, and 100%. A gender congruency effect was found restricted to the 0% list (all targets were inanimate). Results support the selection of gender in transparent languages in the absence of an agreement context, as predicted by the Gender Acquisition and Processing (GAP) hypothesis (Sá-Leite et al.,2019), and are interpreted through the attentional mechanisms involved in the PWI paradigm, in which the processing of animate targets would be favored to the detriment of distractors due to biological relevance and semantic prioritization. Depuis qu'elles existent, les sciences dites exactes se prétendent différentes des autres savoirs. Comment comprendre cette prétention? Faut-il, à la manière des épistémologues anglo-saxons ou de Karl Popper, tenter d'identifier les critères qui la justifient? Peut-on, suivant le modèle nouveau des études sociales des sciences, y voir une simple croyance? Ce livre propose un dépassement fructueux de l'opposition, apparemment irréconciliable, entre ces deux approches des sciences. Et si la tension entre objectivité scientifique et croyance était justement constitutive des sciences, enjeu (...) des pratiques inventées et réinventées par les scientifiques? Réussir à parler des sciences avec humour, sans en faire un objet de vénération, ni de dénonciation, en restant au plus proche de la passion des scientifiques, tel est ici le pari d'Isabelle Stengers. Mais ce livre ne se limite pas à un discours sur les sciences. Il s'agit bien plutôt de prolonger l'histoire de leur invention. Comment comprendre les liens multiples entre la science et les pouvoirs qui la mobilisent aujourd'hui? Comment concevoir les rapports entre science, expertise et démocratie? La nouveauté de L'invention des sciences modernes est de faire de ces différents problèmes intellectuels, pratiques et politiques les enjeux du processus par où pourrait s'inventer et se renouveler l'identité même des sciences. “Moorean Dogmatist” responses to external world skepticism endorse courses of reasoning that many people find objectionable. This paper seeks to locate this dissatisfaction in considerations about epistemic responsibility. I sketch a theory of immediate warrant and show how it can be combined with plausible “inferential internalist” demands arising from considerations of epistemic responsibility. The resulting view endorses immediate perceptual warrant but forbids the sort of reasoning that “Moorean Dogmatism” would allow. A surprising result is that Dogmatism’s commitment to immediate epistemic (...) warrant isn’t enough to avoid certain standard arguments for skepticism about the external world. (shrink)

A Constituição Brasileira de 1988, assim como boa parte das Constituições contemporâneas, abriga uma espécie normativa que a doutrina denomina Princípios Constitucionais. Até recentemente, pouca atenção era conferida às normas principiológicas, seja por parte da doutrina e da jurisprudência. Hoje, são elas alvo de acirrados debates no meio acadêmico, mais precisamente no que concerne ao seu grau de eficária e concretização. Os autores trazem, aqui, subsídios para a discussão, procurando encontrar instrumentos e mecanismos aptos a concretizá-los em sua plenitude.

Biobanks correspond to different situations: research and technological development, medical diagnosis or therapeutic activities. Their status is not clearly defined. We aimed to investigate human biobanking in Europe, particularly in relation to organisational, economic and ethical issues in various national contexts. Data from a survey in six EU countries were collected as part of a European Research Project examining human and non-human biobanking. A total of 147 institutions concerned with biobanking of human samples and data were investigated by questionnaires and (...) interviews. Most institutions surveyed belong to the public or private non-profit-making sectors, which have a key role in biobanking. This activity is increasing in all countries because few samples are discarded and genetic research is proliferating. Collections vary in size, many being small and only a few very large. Their purpose is often research, or research and healthcare, mostly in the context of disease studies. A specific budget is very rarely allocated to biobanking and costs are not often evaluated. Samples are usually provided free of charge and gifts and exchanges are the common rule. Good practice guidelines are generally followed and quality controls are performed but quality procedures are not always clearly explained. Associated data are usually computerised. Biobankers generally favour centralisation of data rather than of samples. Legal and ethical harmonisation within Europe is considered likely to facilitate international collaboration. We propose a series of recommendations and suggestions arising from the EUROGENBANK project. (shrink)

How can a collective pay attention virtuously? Imagine a group of scientists. It matters what topics they pay attention to, that is, which topics they draw to the foreground and take to be relevant, and which they leave in the background. It also matters which aspects of an investigated phenomenon they foreground, and which aspects they leave unnoticed in the background. If we want to understand not only how individuals pay attention of this kind virtuously, but also collectives, we first (...) need a framework to understand virtuous collective agency. A result of this article will be that virtuous collective action depends on the collective being institutionalized. At the same time, we have to think of the constituents of the collective in terms of practical identities (as opposed to individuals). This is what enables us to understand how a collective can acquire the stability required for virtue, and how we don’t end up with a summative account of group virtue, respectively. It will be argued that collectives only have the required stability in their actions when their commitments are habitualized in the form of institutionalized procedures. An Aristotelian understanding of virtue distinguishes between commitment, inclination, and action. Only when a subject’s inclination is fully lined up with her commitment, do we arrive at the required stability (of character) for virtuous action. In the case of individuals, to build up an appropriate inclination consists in an inscribing of the commitment into the feelings and body of the subject. If a commitment is fully ‘embodied’ in this sense, it has formed the individual’s inclination accordingly. How can one make sense of this in the case of collective subjects? This article tries to show that for collectives, the embodiment of commitment (the forming of the fitting inclinations) consists in creating policies, procedures, and rules that stabilize the acting according to the commitment, irrespective of the motivation of each individual involved in the collective. Hence, embodiment of commitment, in the case of collectives, is institutionalization. The article then explores what this requirement of institutionalization means for collective attention. The illustration will draw on a distinction between focused and open-minded attention. It will be shown that for either case – focused and open-minded – in order for a collective to pay attention virtuously, it needs to have its commitments institutionalized. (shrink)

Participation of the Public in Science: Towards a New Kind of Scientific Practice Participation of the public in science has been the object of an increasing number of social and political philosophical studies, but there is still hardly any epistemological study of the topic. While it has been objected that involvement of the public is a threat to the integrity of science, the apparent indifference of philosophers of science seems to testify to its lack of relevance to conceptions of scientific (...) activity. I argue both that it is not a threat to science and that it is relevant to philosophy of science by showing that it constitutes a new kind of epistemic practice. Two main objections to the idea that the involvement of non-scientists, with their situated perspective and contextual values, can form an epistemic practice will be addressed: the first bears on the epistemic potentialities of the cooperation between scientist and non-scientists; the second on the possibility that this cooperation takes the form of a practice. The body of this paper is devoted to tracing out some aspects of the development of the idea of conscience in the Church of England in the late seventeenth and early eighteenth centuries. Surely, it may seem, a subject of limited interest to the readers of this journal! Yet I hope they will find otherwise. I chose to describe this phase of the history of conscience in the West because it illustrates a decisive shift in ideas about conscience which has (...) occurred in many Western cultures besides England's: the belief that the individual ought in many cases to seek the aid of others in forming his moral judgments gives way to the belief that he ought to be self‐reliant in such matters. A knowledge of this shift can advance the philosophical understanding of the idea of conscience and the work to be done in the comparative study of conscience ‘East‘and ‘West.'. (shrink)

This examination of a fundamental but often neglected aspect of the intellectual history of early modern Europe brings together philosophers, historians and political theorists from Great Britain, Canada, the United States, Australia, France and Germany. This memorial to Latour is not an appraisal of his fifty-year research career but the report of a traveling companion with a story to share about the apparent lack of continuity, the sudden, unapologetic, unprincipled changes of position, with which he surprised or scandalized his colleagues and readers. In the first place, was he a sociologist, an anthropologist, a philosopher? Though he did not make lasting commitments of that kind, he did make deeper ones that did not change—above all, never (...) to explain anything in terms of something more general and, thus, never to accept the position of judge. To follow Latour's problematic changes—sometimes referred to as his “versatility”—demands that we follow the changes of the very terms of the problems that his basic commitment bound him to confront. From the 1980s, when his work dealt with technoscientific progress, to the years of his growing concern with political ecology, and finally to his recognition of the oncoming climate chaos, dizzying leaps were entailed by his resistance to the temptation of judging. Involved in, but never the cause of, various of his leaps, Stengers describes her friend as responding, perforce, to changing times, rather than as behaving like a theorist thinking mainly of his image, reputation, and career. La hagiografía medieval tenía una importante función didáctica. Estos relatos fueron muy útiles para la Iglesia ya que permitían transmitir valores, modelos de conducta e ideas complejas a los feligreses. En este trabajo de investigación exploraremos tres obras hagiográficas en verso redactadas en distintas zonas de la Península Ibérica durante el siglo XIII, protagonizadas por tres santas que representan modelos diferentes (mártires, religiosas y penitentes). A través de este estudio comparativo hemos podido observar que, más allá de los tópicos asociados (...) a cada modelo de santidad, los valores transmitidos como ejemplo de “buenas cristianas” se repiten en todos ellos como condición necesaria para que la mujer alcanzase la salvación eterna: mantenimiento de la virginidad, castidad, penitencia y purga del pecado. Así, podemos concluir que la hagiografía femenina plenomedieval tuvo un importante papel en la transmisión y asentamiento de las ideas del clero respecto a lo femenino, cargadas de una evidente misoginia. Quais abordagens foram construídas a partir desse conceito? Qual a sua relação com a educação e com os espaços escolar e expositivo? O artigo em tela pretende refletir, por meio de pesquisa bibliográfica, sobre essas questões ao revisitar o conceito de catarse a partir de autores como Aristóteles, Vigotski, Jauss e, em especial, (...) Experimental activity is traditionally identified with testing the empirical implications or numerical simulations of models against data. In critical reaction to the ‘tribunal view’ on experiments, this essay will show the constructive contribution of experimental activity to the processes of modeling and simulating. Based on the analysis of a case in fluid mechanics, it will focus specifically on two aspects. The first is the controversial specification of the conditions in which the data are to be obtained. The second is conceptual (...) clarification, with a redefinition of concepts central to the understanding of the phenomenon and the conditions of its occurrence. (shrink)

Dual process theory proposes clusters of features that form two dichotomous groups in cognition. One standing internal issue is defining what the reference of these two dichotomous groups could be in the mind or brain. Does dual process theory speak of two systems, types, minds, modes, kinds or just metaphors? A particular common answer is that differences in clusters of features are evidence of different underlying systems, often called system 1 and system 2. However, the suggestion to abandon the ‘system’ (...) terminology is now common in the literature, but the consequences of doing so need to be addressed. This work reviews and critically discusses previous suggestions. (shrink)

Making reason and revelation agree, notably by defining the former’s subordination to the latter, was one of the main concerns of European Medieval scholasticism; and from the tension between the weight of scriptural authority and the aspiration to the independence of rational inquiry finally emerged in Europe a philosophical field free of any allegiance to a revealed discourse – or at least pretending to be so – and castigating the old “scholastic method”. In India, by way of contrast, the philosophical (...) field has remained essentially scholastic inasmuch as most philosophical systems never ceased to acknowledge scripture (āgama) as a means of valid knowledge, and even often asserted its supremacy over reason and experience. Yet, just as European scholasticism cannot be reduced to the image of it that has prevailed since Descartes, the relationship between scriptural authority and rational enquiry in India is much more complex than might appear at first sight. It is first and foremost in order to defend their respective scriptures that various Indian religious currents chose to engage in philosophical debates; but this apologetic intention paradoxically led their champions to set aside scriptural authority. The paper points out this strange process of philosophical emancipation, born of apologetic concerns and nourished by them; and by comparing two apparently diametrically opposed definitions of the relationship between reason and revelation – that of the Buddhist Dharmakīrti, and that of the Śaiva nondualist Utpaladeva –, it aims at showing that although the Indian philosophical field never acquired the autonomy (real or proclaimed) that has characterized Western philosophy from the 17th century onwards, it grew in a constant creative tension between the acceptance and rejection of scriptural authority. The article is built in twelve remarks posing and arguing the “choice of not to”: not to enter the systematics of Joas’ essay and Joas’ thought about what he conceives as “the powers of the sacred”. The discussion is based on the introduction to the book and the preface to its French translation, remaining in a multidisciplinary references field, external to the Joasian systematics. It is not about the terms of the debate, nor about the debate concerning the Weber’s concept (...) of disenchantment and its reception. On the contrary, all along the threshold pages of Joas’ essay, the argument consolidates its discussing exteriority, without seeking or claiming to invalidate Joas’ thesis. The choice of not to, as a way of thinking attempted here, is closer to the Taubesian “discordant accord” figure, than that of the Weberian “elective attraction”, which, moreover, Joas takes over in his own way. What is at stake is not to subscribe to the anachronistic invalidation of a modern self-understanding that was effective, which indeed does not solve the question of thinking how it is outdated today. It is also not to subscribe to think the extreme effective plurality of the religions on the bases of two unifying notions, the political and the (in fact too particular) notion of “sacred”. This paper aims 1) to introduce the notion of theoretical story as a resource and source of constraint for the construction and assessment of models of phenomena; 2) to show the relevance of this notion for a better understanding of the role and nature of values in scientific activity. The reflection on the role of values and value judgments in scientific activity should be attentive, I will argue, to the distinction between models and the theoretical story that guides and constrains (...) their construction. The aim of scientific activity is to develop understanding of phenomena, and something that serves this aim and contributes to the development of understanding has a cognitive value. Cognitive values are the features that something that plays a role in scientific activity should have so that it can serve its aim. I will focus my attention on the features of the theoretical story and of the models. (shrink)

O presente artigo tem por objetivo mostrar, desde a psicanálise freudiana, um caminho possível que a leva ao encontro da filosofia de orientação fenomenológica. Em O eu e o isso, de 1923, Sigmund Freud emprega uma nova noção pouco explorada na literatura psicanalítica: o eu-corpo. O escopo de nossa análise delimita-se à interpretação e à explicitação da noção de eu-corpo tal como esta foi apresentada por Freud, confrontando-a com a fenomenologia em Merleau-Ponty e Michel Henry. Para tanto, propomos uma análise (...) em quatro tempos. Inicialmente, evidenciaremos o entendimento de Freud sobre o modelo de psicologia originada em Brentano que tem como um de seus desdobramentos a fenomenologia. Depois, mostraremos como a concepção do isso, segundo o próprio texto de Freud, foi determinante para que ele formulasse uma revisão da primeira tópica e a incorporasse em uma segunda tópica. Por fim, nas últimas duas partes, examinaremos o tratamento dado por Merleau-Ponty e Michel Henry à questão do corpo. Concluímos que é possível o encontro entre a psicanálise e a fenomenologia via a noção de eu-corpo freudiano; contudo, tal condução implicará reformulações em teses centrais da psicanálise. (shrink)

One variety of love is familiar in everyday life and qualifies in every reasonable sense as a reactive attitude. ‘Reactive love’ is paradigmatically (a) an affectionate attachment to another person, (b) appropriately felt as a non-self-interested response to particular kinds of morally laudable features of character expressed by the loved one in interaction with the lover, and (c) paradigmatically manifested in certain kinds of acts of goodwill and characteristic affective, desiderative and other motivational responses (including other-regarding concern and a desire (...) to be with the beloved). ‘Virtues of intimacy’ as expressed in interaction with the lover are agent-relative reasons for reactive love, and like other reactive attitudes, reactive love generates reasons in its own right. Within a broad conception of the virtues, reactive love sheds light on the reactive attitudes more generally. (shrink)

In the wake of the 2008 global financial crisis, an important conceptual battleground for democratic theorists ought to be, it would seem, the capitalist firm. We are now painfully aware that the typical model of government in so-called investor-owned companies remains profoundly oligarchic, hierarchical, and unequal. Renewing with the literature of the 1970s and 1980s on workplace democracy, a few political theorists have started to advocate democratic reforms of the workplace by relying on an analogy between firm and state. To (...) the extent that a firm is an organization comparable to the state, it too ought to be ruled along democratic lines. Our paper tests the robustness of the analogy between firm and state by considering six major objections to it: the objection from a difference in ends, the objection from shareholders’ property rights, the objection from worker’s consent, the objection from workers’ exit opportunities, the objection from workers’ expertise, and the objection from the fragility of firms. We find all of these objections wanting. While the paper does not ambition to settle the issue of workplace democracy at once, our goal is to pave the way for a more in-depth study of the ways in which firms and states can be compared and the possible implications this may have for our understanding of the nature of managerial authority and the governance of firms. The Global Workspace Theory (GWT) proposed by Bernard Baars (1988) along with Daniel Dennett’s (1991) Multiple Drafts Model (MDM) of consciousness are renowned cognitive theories of consciousness bearing similarities and differences. Although Dennett displays sympathy for GWT, his own MDM does not seem to be fully compatible with it. This work discusses this compatibility, by asking if GWT suffers from Daniel Dennett’s criticism of what he calls a “Cartesian Theater”. We identified in Dennett 10 requirements for avoiding the Cartesian Theater. (...) We believe that some of these requirements are violated by GWT, but not all, hence there is partial incompatibility with MDM, and it is nonsense to answer if GWT is or is not a Cartesian Theater. However, by asking such question we conclude that the issues around this discussion involve fuzzy claims about degrees of consciousness and we show how the Neuro-Astroglial Interaction Model (NAIM) is fit for solving such conceptual issues. Dual Process Theory is currently a popular theory for explaining why we show bounded rationality in reasoning and decision-making tasks. This theory proposes there must be a sharp distinction in thinking to explain two clusters of correlational features. One cluster describes a fast and intuitive process, while the other describes a slow and reflective one. A problem for this theory is identifying a common principle that binds these features together, explaining why they form a unity, the unity problem. To solve (...) it, a hypothesis is developed combining embodied predictive processing with symbolic classical approaches. The hypothesis, simplified, states that Type 1 processes are bound together because they rely on embodied predictive processing whereas Type 2 processes form a unity because they are accomplished by symbolic classical cognition. To show that this is likely the case, the features of Dual Process Theory are discussed in relation to these frameworks. (shrink)

In the last thirty years, a relatively large group of cognitive scientists have begun characterising the mind in terms of two distinct, relatively autonomous systems. To account for paradoxes in empirical results of studies mainly on reasoning, Dual Process Theories were developed. Such Dual Process Theories generally agree that System 1 is rapid, automatic, parallel, and heuristic-based and System 2 is slow, capacity-demanding, sequential, and related to consciousness. While System 2 can still be decently understood from a traditional cognitivist approach, (...) I will argue that it is essential for System 1 processing to be comprehended in an Embodied Embedded approach to Cognition. (shrink)

Due to the currently insufficient consideration of task fitness and task coordination for task allocation in collaborative customized product development, this research was conducted based on the analysis of collaborative customized product development process and task allocation strategy. The definitions and calculation formulas of task fitness and task coordination efficiency were derived, and a multiobjective optimization model of product customization task allocation was constructed. A solution based on adaptive genetic algorithm was proposed, and the feasibility and effectiveness of the task (...) allocation algorithm were tested and verified using a 5-MW wind turbine product development project as example.
