Aims and background: The present work assessed the impact of two decrees on ethics committees in Italy, aimed at bringing the national laws on the conduct of clinical trials into line with the rest of the EC, and regulating and facilitating not-for-profit research.Material and methods: Prospectively collected data from an Italian multicentre study were examined with respect to the ethics review process. Administrative and time elements of the review process were audited. Main outcome measures were time between the application submission (...) and the ethics committee definitive opinion, type and number of application submission forms, number of ethics committees that refused fee exemption, and time between the ethics committee approval and the administrative authorisation.Results: A total of 134 local research ethics committees were approached. Application submission procedures and application forms varied greatly; paper submission was mandatory. The median time from submission to approval was 72 days. Only two LRECs refused the fee exemption. The median time from LREC approval to administrative agreement was 50 days and only 9.6% of local authorities came to a verbal agreement with the sponsor.Conclusions: Italian LRECs are still not sufficiently efficient in complying with the Directive 2001/20/EC requirement . Better coordination of LRECs work is needed although the optimal level of coordination between them is still not known. In the meantime, national guidelines are needed concerning the application of Directive 2001/20/EC. The behaviour of Italian LRECs towards not-for-profit research was excellent although only the fee exemption was requested. (shrink)

Resumo: O presente artigo tem como objetivo propor uma hipótese para superação das críticas feitas por Robert Nozick e Michael Sandel à teoria da justiça de John Rawls, no que concerne à necessidade de se considerar aspectos históricos e práticos, na formulação de princípios na posição original. Para tanto, é preciso analisar inicialmente as correntes filosóficas do liberalismo, do libertarianismo e do comunitarismo, a fim de fundar as bases necessárias ao desenvolvimento do estudo. Na sequência, será apresentada a teoria da (...) justiça de John Raws, seguida das críticas formuladas pelo libertário Robert Nozick, no que se refere à necessidade de se levar em conta o princípio histórico. Nozick comprova, por meio do exemplo de Wilt Chamberlain, como aspectos históricos podem alterar as estruturas pré-estabelecidas pelas teorias de estado final. Após, serão examinados os apontamentos feitos por Michael Sandel, especialmente no que concerne ao individualismo metodológico. Sandel também chama a atenção para o fato de que, para garantir efetividade aos princípios, é preciso que os indivíduos se utilizem de sua experiência e das particularidades da comunidade e de seus integrantes. Ao final, será sugerida uma proposta de superação das críticas dirigidas a Rawls, mediante a relativização da abstração da posição original.: The present article aims to overcome the criticisms made by Robert Nozick and Michael Sandel of John Rawls’ theory of justice, specifically with regard to the need for considering historical and practical aspects in the formulation of principles in the original position. We first analyze the philosophical currents of liberalism, libertarianism, and communitarianism, in order to lay the foundations necessary for the development of the study. Next, Rawls’ theory of justice is presented, followed by the critique made by the libertarian Robert Nozick of the need to consider the historical principle. Nozick proves, through the example of the American basketball player Wilt Chamberlain, how historical aspects can alter structures that are pre-established by theories of final state. Michael Sandel’s observations are then analyzed, especially with regard to methodological individualism. Sandel draws attention to the fact that to ensure the effectiveness of principles, individuals need to draw on their experience and on the particularities of the community and its members. Finally, a proposal is made for overcoming the criticisms directed at Rawls; this is achieved by relativizing the abstraction of the original position. (shrink)

Inicialmente, o texto indaga sobre o significado do exercício do filósofo social; pretende também localizar as origens do debate moderno sobre ‘subjetividade’ no pensamento filosófico e social. As idéias norteadoras de Kant, se situam na confluência e na disjunção entre razão (conhecimento) e subjetividade (moral). A partir dessa referência, o debate entre alguns pensadores considerados como pós-modernos (Badiou e Zizek), por um lado, e por outro Castoriadis que recusa esta nomenclatura, vão derivando idéias novas sobre ‘sujeito’ e ‘verdade’. Esse debate (...) não é sem conseqüências para a teoria sociológica que assume para si o desafio de introduzir a categoria de ‘sujeito’ em seus cânones (Touraine). As reflexões de Stengers servem também para questionar e aproximar as práticas da produção do conhecimento e dos discursos científicos. Finalmente, restam desafios para se pensar teorias e práticas sócio-ambientais à luz desses conceitos apresentados ao longo do texto. (shrink)

Parte-se da idea de que as territorialidades contra-hegemônicas no mundo rural são resultantes de um duplo processo de aprendizagem e/ou adaptación: um interno ao próprio território, resultante da coevolução entre ecosisstemas e comunidades, e outro externo e entre territórios –o que envolve os processos de territorialização do capital sobre territórios tradicionais. Estas dinâmicas adaptativas dos territórios tradicionais e alternativos são expressas em hibridismos de práticas e representações sociais modernas e tradicionais acerca dos atributos reprodutivos da natureza: a fertilidad da natureza (...) nos territórios tradicionais subsume a reprodutibilidade do complexo socioambiental, ao passo que o imaginário de natureza na cultura científica moderna subsume a produtividade objetivada dos ecossistemas. Em outros termos, trata-se de interpretar narrativas e políticas de natureza. De fato, o entendimiento da complexidade da reprodução socioterritorial da agricultura e pesca tradicionais e alternativas (como aquelas da agricultura familiar de base ecológica) subsume, portanto, a indissociabilidade dos aspectos objetivos e subjetivos acerca da reprodutibilidade de sistema produtivo lato sensu, ou seja, dos condicionantes geoecológicos locais, dos valores e simbolismos tradicionais, que são sintetizados nas estratégias de adaptação e resiliência das comunidades rurais frente aos projetos de (re)territorialização do Capital sobre aqueles territórios contra-hegemônicos. The theory is presented that the sexual process is a repair mechanism which maintains redundancy within the sub-structure of hierarchical, self-reproducing organisms. In order to keep the problems within mathematically tractable limits , a simple model is introduced: a wheel with 6 spokes, 3 of them vital and 3 redundant, symbolizes the individual . Random accidents destroy spokes; the wheels replicate at regular cycles and engage periodically in pairing and repair phases during which missing spokes are copy-reproduced along the intact (...) spokes of the partner wheel.The hierarchical structure of such a system is analysed and an ‘autonomous unit’ is defined: this is the unit of minimal hierarchical complexity which is capable of perpetuating autonomously all higher and all lower levels of the hierarchy; this is the central unit of selection.Four basic, physical parameters are isolated which determine the essential features of any eucaryotic life cycle: 1. The number of levels of the hierarchy ; 2. the relation between the phases of replication and repair ; 3. the duration of potential repair ; 4. the position of the sexual partners within the hierarchy .The evaluation of fitness components is considered in relation to trends of reproductive patterns in evolution. Islamic ethics in the light of Koranic teachings.

Boltzmann's gas model representing the second law of thermodynamics is based on the improbability of certain molecular distributions in space. Maxwell argued that a hypothetical ‘being’ with the faculty of seeing individual molecules could bring about such improbable distributions, thus violating the law of entropy. However, it appears that to render the molecules visible for any observer would increase the entropy more than the demon could decrease it, hence ‘Maxwell's Demon cannot operate’ . In the study presented here Maxwell's Demon (...) is interpreted in a general way as a biological observer system within systems which can upset thermodynamic probabilities provided that the relative magnitudes between observer system and observed system are appropriate.Maxwell's Demon within Boltzmann's Gas Model thus appears only as a special case of inappropriate, relative magnitude between the two systems. A simple model, illustrating the transition from a population of free swimming, solitary cells to one consisting of small colonies serves as a basis to discuss the evolution of the cooperative group. The transition is the result of a mutation of the dynamics of cell division, delayed cell separation leads to colonies of four cells. With this mutation cooperative features appear, such as synchronised cell divisions within colonies and coordinated flagellar function which enables the colony to swim in definite directions. (...) The selective advantages under given, environmental conditions are defined and the periods necessary for complete allelic replacement in small populations are calculated for asexual and sexual reproduction. The assumption of a steady-state population during allelic substitution is critically considered, particularly under conditions of competition. It is shown that density-dependent population control must operate in the process of selection. Sexual reproduction slows down the rate of selection even though all cells dre haploid. This phenomenon can be explained in general terms of `organizational dominance', where individual units coordinate the function of their neighbours which may be of a different allelotype.Cooperativity is pointed out as an a priori systemic feature which resides in the sub-units of systems, group formation and coordination appears thus as an almost inevitable event. A particular type of system described as ‘closed cycle of positive fitness interaction’ is discussed in more detail. It has the remarkable feature that its members cannot compete with each other; selection takes place between whole cycles .Gonium has a wide spectrum of `somatic plasticity' which enables it to assume various colonial configurations depending on physiological and environmental conditions. This feature can be explained as the result of dynamic flexibilities on the macro-molecular level. The particular relationship between the vast, molecular complexity and the relative simple dynamics of the cell cycle must lead eventually to the genetic fixation of an environmentally induced phenotype.
