The United States Court of Appeals for the Eighth Circuit held that ERISA did not preempt a Minnesota tort claim alleging fraud and negligent misrepresentation against primary-care physicians who failed to disclose their financial incentives to minimize specialist referrals. The original action was filed in state court after the plaintiff's husband died of heart failure, alleging that his family doctors had assured him that referral to a cardiologist was unnecessary. The plaintiff filed a wrongful death suit against the doctors, their (...) clinic, and her husband's HMO. Her complaint against the HMO alleged that certain financial incentives built into the HMO-physician contract were designed to minimize referrals to specialists. Angesichts der Finanz- und Wirtschaftskrise fragt die habituelle Unternehmensethik neu nach dem Fundament der Wirtschafts- und Unternehmensethik. Sie begreift sich als kritische Weiterentwicklung werteorientierter Ansatze in der Wirtschafts- und Unternehmensethik. Habituelle Unternehmensethik reflektiert nicht in erster Linie auf formale Strukturen von Systemprozessen, sondern auf die inneren Strukturen, die das Handeln einer naturlichen oder juristischen Person pragen. Habituelle Unternehmensethik vermittelt die Einsicht, dass der Markt von Voraussetzungen lebt, die er selbst nicht garantieren kann. Wirtschafts- und Unternehmensethik durfen und konnen sich nicht (...) vollstandig von den Werten der Alltagsethik dispensieren. Durch diese Ruckbindung wird Unternehmensethik als Anerkennungspraxis einsichtig und uberwindet damit den unbegrundeten Verdacht einer vom Alltagsleben abgekoppelten Parallelwelt. Die sozialisatorische Wirkung eines unternehmenstypischen Habitus ist bislang in Philosophie und Sozialwissenschaften nicht in den Blick genommen worden; hier schlieat dieser Band eine Lucke. In recent years, a dramatic increase in the study of infrastructure has occurred in the social sciences and humanities, following upon foundational work in the physical sciences, architecture, planning, information science, and engineering. This article, authored by a multidisciplinary group of scholars, probes the generative potential of infrastructure at this historical juncture. Accounting for the conceptual and material capacities of infrastructure, the article argues for the importance of paradox in understanding infrastructure. Thematically the article is organized around three key points (...) that speak to the study of infrastructure: ruin, retrofit, and risk. The first paradox of infrastructure, ruin, suggests that even as infrastructure is generative, it degenerates. A second paradox is found in retrofit, an apparent ontological oxymoron that attempts to bridge temporality from the present to the future and yet ultimately reveals that infrastructural solidity, in material and symbolic terms, is more apparent than actual. Finally, a third paradox of infrastructure, risk, demonstrates that while a key purpose of infrastructure is to mitigate risk, it also involves new risks as it comes to fruition. The article concludes with a series of suggestions and provocations to view the study of infrastructure in more contingent and paradoxical forms. (shrink)

Works in science and technology studies have repeatedly pointed to the importance of the visual in scientific practice. STS has also explicated how embodied practice generates scientific knowledge. I aim to supplement this literature by pointing out how sound and hearing are integral aspects of experimentation. Sound helps define how and when lab work is done, and in what kinds of spaces. It structures experimental experience. It affords interactions between researchers and instruments that are richer than could be obtained with (...) vision alone. And it is a site for tacit knowledge, providing a resource for the replication of results, and the transmission of knowledge, and the construction of social boundaries within instrumental communities. This paper follows the history of an object. The purpose of doing so is to come to terms with a distinctive kind of research object – which we are calling a ‘test object’ – as well as to chronicle a significant line of research and technology development associated with the broader nanoscience/nanotechnology movement. A test object is one of a family of epistemic things that makes up the material culture of laboratory science. Depending upon the case, it can have variable (...) shadings of practical, mathematical and epistemic significance. Clear cases of test objects have highly regular and reproducible visible properties that can be used for testing instruments and training novices. The test object featured in this paper is the silicon 7×7, a particular surface configuration of silicon atoms. Research on this object over a period of several decades has been closely bound up with the development of novel instruments for visualizing atomic structures. Despite having little direct commercial value, the Si 7×7 also has been a focal object for the formation of a research community bridging industry and academia. It exhibits a complex structure that became a sustained focus of observation and modelling. Our study follows shifts in the epistemic status of the Si 7×7, and uses it to re-examine familiar conceptions of representation and observation in the history, philosophy and social study of science. In October of 2002, Rick Smalley, Nobel laureate chemist at Rice University, was pondering what to say to a Congressional Hispanic Science and Literacy Forum hearing in Harlingen, Texas. Smalley used the opportunity to craft an all-encompassing justification for science's importance in the modern world-a justification so persuasive and broad it could be presented to any audience on any occasion. Indeed, variants of his talk have since been given some 200 times, from Dallas to Dubai.

BioDwelling is an arts-led research project that brings ethical concerns of culture, gender and multispecies relationality from the feminist technosciences into direct conversation with the emerging field of biotechnological architecture (bio-architecture). Working within a multi-disciplinary bio-architecture research group, we develop a practice-led methodology to facilitate the exploration of questions that arise when we begin to engineer more-than-human dwelling spaces. In this article we give a brief overview of the work of the Hub for Biotechnology in the Built Environment (HBBE) and (...) the Responsible Interactions research theme, which outlines the project context. We go on to describe the BioDwelling methodology and introduce three arts-led interventions that draw on feminist science and cultural theory to invite reflections on the ethical implications of working with living materials to build (or grow?) spaces in which humans intend to live. We conclude with a summary of the project to date, reflections on methods and possible next steps. (shrink)

The historiography on American science and technology in the 1970s is still small, yet there are already three distinct strands of work: studies of countercultural scientists, portrayed as enacting or advocating ‘groovy’ research; studies of the politically polarized debate pitting conservative and libertarian ‘cornucopianists’ against environmentalists and modelers forecasting resource scarcity; and studies of the early commercialization of technoscience (e.g., biotechnology) that took off in the 1980s. Left out, I argue, are a class of ‘square scientists’ with little sympathy for (...) the counterculture, and yet open to (even eager for) a new kind of science oriented to the same problems activists said they wanted science to solve: pollution, mass transit, housing, biomedicine, disability technologies, pedagogical machines, etc. Square scientists at places like NASA and Texas Instruments adapted military-industrial-academic templates to a wide variety of socially ‘relevant’ topics in the 1970s. Yet square scientists still looked to the military-industrial complex for allies, rather than to countercultural colleagues. This potential middle ground remained excluded – contributing, in large part, to the failure of schemes to reorient US R&D to civilian social problems, and to the invisibility of the squares in today's historical accounts. We examine the role of socio-demographic factors on consumers’ pro-environmental behavior –a subset of ethical behavior and analyze its implications in an emerging market, with a sample study from India. Multivariate analysis of variance was performed as research method. Results show that males display higher PEB than their female counterparts. Married consumers score more on PEB than single. Mid-age consumers also score high on PEB than young and old-age consumers. Furthermore, highly educated consumers are more pro-environmentalist than graduates and post-graduates. (...) The novelty of this study is that centers on the use of demographic variables interactively in order to form microsegments. For instance, married men score more on PEB scale than unmarried men and women and prefer green channels even more. On the contrary, unmarried women display no hesitation in paying more for energy-efficient goods compared to married men and unmarried men. Marketers may aim in setting such PEBs as the moral standards among consumers being an easily identifiable segment as their prime target. (shrink)

Existing research on the financial implications of corporate social responsibility (CSR) for firms has predominantly focused on positive aspects of CSR, overlooking that firms also undertake actions and initiatives that qualify as negative CSR. Moreover, studies in this area have not investigated how both positive and negative CSR affect the financial risk of firms. As such, in this research, the authors provide a framework linking both positive and negative CSR to idiosyncratic risk of firms. While investigating these relationships, the authors (...) also analyze the moderating role of financial leverage of firms. Overall, analysis of secondary information for firms from multiple industries over the years 2000–2009 shows that CSR has a significant effect on the idiosyncratic risk of firms, with positive CSR reducing risk and negative CSR increasing it. Results also show that the reduction in risk from positive CSR is not guaranteed, with firms having high levels of financial leverage witnessing lower idiosyncratic risk reduction. (shrink)

With the increasing number of people living with HIV/AIDS and the escalating costs of health care, there is an increasing demand for informal caregiving in the community. Currently, much emphasis is placed on individuals who are living with HIV/AIDS (in terms of the provision of social, psychological and economic support), but very little attention has been paid to the well-being and quality of life of informal caregivers. Lack of support and care for caregivers may have a negative impact on the (...) quality of care and effective services for individuals living with HIV/AIDS. This paper is based on findings from a qualitative study that explored major sources of stress associated with caregiving among informal caregivers in a village in the southern part of Botswana. The paper suggests that informal caregivers are an integral part of the continuum of care. As a result, they need to be nurtured and supported for the betterment of those both infected and affected by HIV/AIDS. The paper concludes by discussing the implications for further research, policy and programme development. (shrink)
