The constitutional monarchy of present-day Britain hardly seems the same sort of institution as fourteenth-century feudal kingdoms, but Dante’s Monarchia (c. 1313) and Walter Bagehot’s The English Constitution (1872) share fundamental assumptions about what the purpose and strengths of monarchy are. In the Monarchia, Dante lays out the essential attributes of monarchy that endure even today: authority, impartiality, and unity. Dante values and promotes monarchy as final arbiter of conflicts, sole just judge without cupidity, and unifying will. More than 550 (...) years later, Bagehot, despite his distrust concerning the Crown’s actual effectiveness, conceives of monarchy in surprisingly similar terms. The monarch is ‘the regulating wheel of our Constitution’, an authority outside and above partisan politics, and the ‘dignified’, ‘intelligible’, unifying element of government. In both cases, the monarch functions as the government’s source of impartial, unifying authority – whether monarch or Parliament ultimately wields that authority. The broad outlines of monarchy are surprisingly similar for both writers, suggesting a basic continuity in the conceptualization of monarchy from the fourteenth to the nineteenth century (and beyond) and an abiding store of reserve symbolism within the monarchic concept that writers, thinkers, and politicians throughout those centuries are able to tap at will. I would have preferred that the Special Section on Children as Organ Donors had focused on the donation of a specific organ because morally relevant differences are obscured when the subject is discussed in general terms. The donation of a lobe of liver and peripheral blood or bone marrow stem cells does not result in the permanent loss of vital tissue because these organs regenerate; however, a kidney does not regenerate and its donor loses a vital organ permanently. Liver tissue (...) and peripheral blood or bone marrow stem cells are typically required to save a life, but, because most patients with end-stage renal disease can be kept alive on dialysis, the donation of a kidney is rarely life saving. Also, donor risk is organ specific; for example, it is more dangerous to donate a lobe of liver than it is to donate peripheral blood or bone marrow stem cells. (shrink)

Daniel and Frances Howard-Snyder suggest that it is possible for an omnipotent being, Jove, to create randomly a world from a continuum of ever more perfect possible worlds. They then go on to argue that Jove could be characterized as morally unsurpassable despite creating a surpassable world. I raise a number of problems for the view that Jove could be characterized as morally unsurpassable when he creates (randomly or not) a surpassable world.

Logic, the tradition has it, is normative for reasoning. But is that really so? And if so, in what sense is logic normative for reasoning? As Gilbert Harman has reminded us, devising a logic and devising a theory of reasoning are two separate enterprises. Hence, logic's normative authority cannot reside in the fact that principles of logic just are norms of reasoning. Once we cease to identify the two, we are left with a gap. To bridge the gap one would (...) need to produce what John MacFarlane has appropriately called a bridge principle, i.e. a general principle articulating a substantive and systematic link between logical entailment and norms of reasoning. This is Harman's skeptical challenge. In this paper I argue that Harman's skeptical challenge can be met. I show how candidate bridge principles can be systematically generated and evaluated against a set of well‐motivated desiderata. Moreover, I argue that bridge principles advanced by MacFarlane himself and others, for all their merit, fail to address the problem originally set forth by Harman and so do not meet the skeptical challenge. Finally, I develop a bridge principle that meets Harman's requirements as well as being substantive. (shrink)

This chapter introduces inferential role semantics (IRS) and some of the challenges it faces. It also introduces inferentialism and places it into the wider context of contemporary philosophy of language. The chapter focuses on what is standardly considered both the most important test case for and the most natural application of IRS: logical inferentialism, the view that the meanings of the logical expressions are fully determined by the basic rules for their correct use, and that to understand a logical expression (...) is to use it in accordance with the appropriate rules. It discusses some of the benefits of logical inferentialism, chiefly with regard to the epistemology of logic, and considers a number of objections. The chapter critically examines Robert Brandom's inferentialism about linguistic and conceptual content in general. Finally, it considers a number of general objections to IRS and possible responses on the inferentialist's behalf. (shrink)

Epistemic utility theory is generally coupled with veritism. Veritism is the view that truth is the sole fundamental epistemic value. Veritism, when paired with EUT, entails a methodological commitment: norms of epistemic rationality are justified only if they can be derived from considerations of accuracy alone. According to EUT, then, believing truly has epistemic value, while believing falsely has epistemic disvalue. This raises the question as to how the rational believer should balance the prospect of true belief against the risk (...) of error. A strong intuitive case can be made for a kind of epistemic conservatism – that we should disvalue error more than we value true belief. I argue that none of the ways in which advocates of veritist EUT have sought to motivate conservatism can be squared with their methodological commitments. Short of any such justification, they must therefore either abandon their most central methodological principle or else adopt a permissive line with respect to epistemic risk. (shrink)

The problem of free will as it is know in Western philosophical traditions is hardly known in China. Considering how central the problem is in the West, this is a remarkable fact. We try to explain this, and we offer insights into discussions within Chinese traditions that we think are related, not historically but regarding the issues discussed. Thus we introduce four central Chinese concepts, namely: (1) xīn 心 (heart, heart-mind), (2) xìng 性 (human nature, characteristic tendencies, inborn capacity), (3) (...) mìng 命 (lifespan, fate, command, allotment, endowment), and (4) zìrán 自然 (self-so, so of itself, nature, spontaneity), and we indicate how these concepts and their discussions can be related to discussions on free will. Philosophers of mathematics commonly distinguish between explanatory and non-explanatory proofs. An important subclass of mathematical proofs are proofs by induction. Are they explanatory? This paper addresses the question, based on general principles about explanation. First, a recent argument for a negative answer is discussed and rebutted. Second, a case is made for a qualified positive take on the issue.

BackgroundThe terminal illness of late-stage Alzheimer’s and related dementias is progressively cruel, burdensome, and can last years if caregivers assist oral feeding and hydrating. Options to avoid prolonged dying are limited since advanced dementia patients cannot qualify for Medical Aid in Dying. Physicians and judges can insist on clear and convincing evidence that the patient wants to die—which many advance directives cannot provide. Proxies/agents’ substituted judgment may not be concordant with patients’ requests. While advance directives can be patients’ last resort (...) to attain a peaceful and timely dying consistent with their lifelong values, success depends on their being effective and acceptable. A single flaw can provide opponents justification to refuse the directive’s requests to cease assisted feeding.AimThis article considers 24 common advance directive flaws in four categories. Process flaws focus on how patients express their end-of-life wishes. Content flaws reflect drafters’ selection of conditions and interventions, and how they are described. Inherent flaws can make advance directives unacceptable to authorities concerned about premature dying. Strategies are needed to compel physicians to write needed orders and to prevent third parties from sabotaging these orders after they are implemented. The article includes excerpts from “dementia-specific” directives or supplements that exemplify each flaw—mostly from the US and Europe. No directive critiqued here included an effective strategy to resolve this long-debated bioethical conflict: the past directive requests “Cease assisted feeding” but the incapacitated patient apparently expresses the desire to “Continue assisted feeding.” Some opponents to the controversial request, cease assisted feeding, use this conflict as a conceptual wedge to practice hard paternalism. This article proposes a protocol to prevent this conflict from emerging. These strategies may prevent authorities from requiring patients to fulfill authorities’ additional clinical criteria as a prerequisite to honor the requests in patients directives.ConclusionThis critique of flaws may serve as a guide to drafting and to selecting effective and acceptable advance directives for dementia. It also poses several bioethical and clinical questions to those in authority: Does your paternalistic refusal to honor patients’ wishes respect their self-determination? Protect vulnerable patients from harm? Force patients to endure prolonged suffering? Violate the principles of bioethics? Violate the very foundation of patient-centered care? (shrink)

In a series of recent papers, Corine Besson argues that dispositionalist accounts of logical knowledge conflict with ordinary reasoning. She cites cases in which, rather than applying a logical principle to deduce certain implications of our antecedent beliefs, we revise some of those beliefs in the light of their unpalatable consequences. She argues that such instances of, in Gilbert Harman’s phrase, ‘reasoned change in view’ cannot be accommodated by the dispositionalist approach, and that we would do well to conceive of (...) logical knowledge as a species of propositional knowledge instead. In this paper, we propose a dispositional account that is more general than the one Besson considers, viz. one that does not merely apply to beliefs, and claim that dispositionalists have the resources to account for reasoned change in view. We then raise what we take to be more serious challenges for the dispositionalist view, and sketch some lines of response dispositionalists might offer. (shrink)

ABSTRACT:Technological advances introduce the possibility that, in the future, firms will be able to use big-data analysis to discover and offer consumers their individual reservation price. This can generate some interesting benefits, such as a better state of affairs in terms of equality of both welfare and resources, as well as increased social welfare. However, these benefits are countered by considerations of relational equality. This article takes up the market-failures approach as its basis to demonstrate what is wrong with using (...) big data to personalize prices. The article offers an improvement to the market-failures approach and argues that what is wrong with using big data to personalize prices is that it unfairly undermines consumers’ ability to benefit from the market, which is the very point of having a market. Almost 60,000 people in the United States with end stage renal disease are waiting for a kidney transplant. Because of the scarcity of organs from deceased donors live kidney donors have become a critical source of organs; in 2001, for the first time in recent decades, the number of live kidney donors exceeded the number of deceased donors. The paradigm used to justify putting live kidney donors at risk includes the low risk to the donor, the favorable risk-benefit ratio, the (...) psychological benefits to the donor, altruism, and autonomy coupled with informed consent; because each of these arguments is flawed we need to lessen our dependence on live kidney donors and increase the number of organs retrieved from deceased donors. An "opting in" paradigm would reward people who agree to donate their kidneys after they die with allocation preference should they need a kidney while they are alive. An "opting in" program should increase the number of kidneys available for transplantation and eliminate the morally troubling problem of "organ takers" who would accept a kidney if they needed one but have made no provision to be an organ donor themselves. People who "opt in" would preferentially get an organ should they need one at the minimal cost of donating their kidneys when they have no use for them; it is a form of organ insurance a rational person should find extremely attractive. An "opting in" paradigm would simulate the reciprocal altruism observed in nature that sociobiologists believe enhances group survival. Although the allocation of organs based on factors other than need might be morally troubling, an "opting in" paradigm compares favorably with other methods of obtaining more organs and accepting the status quo of extreme organ scarcity. Although an "opting in" policy would be based on enlightened self-interest, by demonstrating the utilitarian value of mutual assistance, it would promote the attitude that self-interest sometimes requires the perception that we are all part of a common humanity. Much recent work on empathy assumes that one cannot give non-question-begging reasons for empathizing with others. In this article I argue that there are epistemic reasons for cultivating empathy. After sketching a brief general account of empathy, I proceed to argue that empathic information is user-friendly, fostering the achievement of widely held cognitive goals. It can also contribute to social knowledge and the satisfaction of democratic ideals. The upshot of my analysis is that there are strong, but defeasible, epistemic reasons (...) for empathizing with others. (shrink)
