The article offers a critical assessment of an article on "Corporate Legitimacy as Deliberation" by Guido Palazzo and Andreas Scherer in this journal. We share the concern about the precarious legitimacy of globally active corporations, infringing on the legitimacy of democracy at large. There is no quarrel with Palazzo/Scherer's diagnosis, which focuses on the consequences of globalization and ensuing challenges for corporate social responsibilities. However, we disagree with the "solutions" offered by them. In a first step we refute the idea (...) of a legitimacy of morals, maintaining that morality is a premodern mode of creating legitimacy. Even worse, moral is becoming a dangerous commodity under conditions of fundamental global disagreements and antagonisms. We secondly refute the concept of the "politicized corporation", maintaining that Palazzo/Scherer disregard the consequences of functional differentiation of modern societies and, in particular, disregard the wisdom of political restraint and constitutional guarantees for the autonomy of different spheres of society. Finally, we refute a seemingly romantic notion of deliberation, maintaining that deliberation and deliberative democracy is a worthy idea, which, however, has no place in the real world of globalized contexts. On the other hand, we also find enough common ground and common concern with Palazzo/Scherer to validate a fruitful discourse. (shrink)

Philosophen Delphi im Konlexl einer mehrfigurigen Stiftung p. 407-433 Zu den prominentesten Skulpturenfunden in Delphi zâhlt die Statue des sog. Philo sophen (Inv. 1819). Sie fand Aufnahme in die wichtigsten Handbûcher griechischer Plas- tik, obwohl weder Datierung noch Deutung oder gar ursprunglicher Aufstellungszusam- menhang geklàrt sind. Meist wird sie mit stilistischen Argumenten um 250 v. Chr. datiert, ausgelôst durch die hypothetische und falsche Zuweisung an das ebenfalls ungedeutete und (...) undatierte (hâufig aber um die Mitte des 3. Jhs. angesetzte) «Hufeisenmonument» westlich der Daochosgruppe durch L. Lerat. Wie die Neuuntersuchung zeigen kann, ist der « Philosoph » Bestandteil einer mehrfîguren Stiftung gewesen. Die Forschung hat gera- dezu «vergessen», daB er zusammen mit zwei weiteren Statuen, einer weiblichen bekleide- ten (Inv. 1817) und einer ebenfalls langgewandeten mânnlichen (Inv. 1820) gefunden wurde. Technische Indizien belegen den Werkstattzusammenhang, die drei Figuren waren auch zusammen aufgestellt. Sie rechneten zu einer u.U. noch grôBeren (môglicher- weise ist die nackte mànnliche Figur Inv. 1793 zugehôrig) um 300 v. Chr. oder in den ersten Jahrzehnten des 3. Jhs. im Nordsektor des Heiligtums geweihten Gruppe. Das Portràt, der Statuen- und Gewandtypus charakterisieren den « Philosophen » als bûrgerlichen alten Mann — fur die Deutung als wirklicher Philosoph gibt es kein stich- haltiges Argument. Die Frauenfigur lehnt sich ebenfalls an das Darstellungsrepertoire weiblicher Sterblicher (etwa auf attischen Grabreliefs) an. Die dritte Statue bezeugt einen seit dem Strengen Stil gelàufîgen Dionysos-Typus. Als Stifter kommt ein dionysischer Technit oder Chorege in Frage. Auf jeden Fall handelt es sich um ein Familienmonu- ment, das Portràts von mindestens zwei Verwandten prâsentierte und den Gott, dem es geweiht war, in das Ensemble miteinbezog. (shrink)

The problem of free will as it is know in Western philosophical traditions is hardly known in China. Considering how central the problem is in the West, this is a remarkable fact. We try to explain this, and we offer insights into discussions within Chinese traditions that we think are related, not historically but regarding the issues discussed. Thus we introduce four central Chinese concepts, namely: (1) xīn 心 (heart, heart-mind), (2) xìng 性 (human nature, characteristic tendencies, inborn capacity), (3) (...) mìng 命 (lifespan, fate, command, allotment, endowment), and (4) zìrán 自然 (self-so, so of itself, nature, spontaneity), and we indicate how these concepts and their discussions can be related to discussions on free will. Abstract‘Critique’ means the questioning judgement of human actions, particularly with reference to a criterion of judgement that is inseparable from the judged state of affairs but is dependent on a decision of the person judging. Informative judgements of a state of affairs contain two relevant components, one concerned with recognition of the objects of judgment, the other concerned with their evaluation. This evaluation is not directly extractable from that state of affairs, but the quality of the evaluation does depend in (...) part upon the quality of its explanation. Thus, when the content-description is flawed, the evaluation is affected by the flawed description. The phrase ‘the domestication of critique’ refers to the successful attempts that have been made to cause critics to neglect the truth claims of the judgement in favour of normative dominant interests. Domesticated critique is not concerned with the testing but rather with the justification or interpretation of a state of affairs. Domesticated critique does not depend on the quality of the argument but rather on whether the critique succeeds in legitimating dominant interests and immunising them against undomesticated critique. The educational relevance of the domestication of critique lies in the fact that a critical education which is domesticated will alleviate the need for overt repression on the part of dominant interests in favour of a particular view of the world and replace it with the semblance of a critical attitude that in fact reinforces the existing order through apparently rational means. Education based on domesticated critique can have no radical implications. (shrink)
