I. EXECUTIVE SUMMARY The MRCT Center Post-trial Responsibilities: Continued Access to an Investigational Medicine Framework outlines a case-based, principled, stakeholder approach to evaluate and guide ethical responsibilities to provide continued access to an investigational medicine at the conclusion of a patient’s participation in a clinical trial. The Post-trial Responsibilities (PTR) Framework includes this Guidance Document as well as the accompanying Toolkit. A 41-member international multi-stakeholder Workgroup convened by the Multi-Regional Clinical Trials Center of Brigham and Women’s Hospital and Harvard University (...) (MRCT Center) developed this Guidance and Toolkit. Project Motivation A number of international organizations have discussed the responsibilities stakeholders have to provide continued access to investigational medicines. The World Medical Association, for example, addressed post-trial access to medicines in Paragraph 34 of the Declaration of Helsinki (WMA, 2013): “In advance of a clinical trial, sponsors, researchers and host country governments should make provisions for post-trial access for all participants who still need an intervention identified as beneficial in the trial. This information must also be disclosed to participants during the informed consent process.” This paragraph and other international guidance documents converge on several consensus points: • Post-trial access (hereafter referred to as “continued access” in this Framework [for terminology clarification – see definitions]) is the responsibility of sponsors, researchers, and host country governments; • The plan for continued access should be determined before the trial begins, and before any individual gives their informed consent; • The protocol should delineate continued access plans; and • The plan should be transparent to potential participants and explained during the informed consent process. -/- However, there is no guidance on how to fulfill these responsibilities (i.e., linking specific responsibilities with specific stakeholders, conditions, and duration). To fill this gap, the MRCT Center convened a working group in September of 2014 to develop a framework to guide stakeholders with identified responsibilities. This resultant Framework sets forth applicable principles, approaches, recommendations and ethical rationales for PTR regarding continued access to investigational medicines for research participants. Rorty’s Philosophy and the Mirror of Nature presents the most thorough and sustained critique of Western epistemology and foundationalism in the second half of the twentieth Century. The work deconstructs philosophy as an autonomous discipline generating a “neutral matrix” to assess knowledge, truth, and rationality, offering philosophical analyses of the mind-body distinction, representation, reference, and truth, and ultimately the concept of knowledge as a “mirror of nature.” The deconstruction of Cartesian dualism undermines the mind as the immaterial ground of absolute (...) certainty; the deconstruction of the Kantian empirical-transcendental distinction destroys the transcendental realm as philosophy’s uniquely accessible and founding domain. Émile Durkheim remains one of the most controversial, and deeply misunderstood, classics of social theory. His work differs from the dominant version of sociology that has essentially accepted the modernist self-description of contemporary societies; and it contradicts the individualism that has come to dominate the social sciences. In der deutschen Geistesgeschichte wurde seit Hegel und Hölderlin die Geschichte als tragischer Prozess verstanden. Ein Drama wie die Antigone des Sophokles sollte als das vollkommenste Werk der Kunst die griechische Deutung des Miteinanders der Menschen und der Götter zeigen. Hegel legte aber dar, dass die Antigone mit den Reigen ihrer Chöre auf einer modernen Bühne nicht aufführbar sei. Doch zehn Jahre nach seinem Tod dirigierte sein Hörer Felix Mendelssohn-Bartholdy in Potsdam und Berlin seine Vertonung der Antigone. Hölderlins Sophokles-Übertragungen erhielten (...) eine harte Kritik; im Zeitalter des Expressionismus griff man aber auf ihre ausdrucksvolle Sprache zurück. Als nach den Zerstörungen des Zweiten Weltkriegs gleich ein weiterer Krieg drohte, brachte Carl Orff seine Vertonung von Hölderlins Antigonä auf die Bühne. Martin Heidegger, der selber das erste Standlied der Antigone übersetzt und ausgelegt hatte, gratulierte Orff bei einer Münchener Aufführung zur 'Wiedererweckung der antiken Tragödie'. Bertolt Brecht stellte seine Bearbeitung der Antigone gegen Orffs Mythisierung. Als man diese Bearbeitung im Oktober 1989 in Ost-Berlin spielte, bejubelte das Publikum Antigones Wort an Kreon: 'Weniger (Menschen) sind es (in der DDR) geworden, seit du herrschst'. Auch in den Ruinen von Kabul wurde Antigone gezeigt. John Cranco brachte ein Antigone-Ballett ein, als er das Stuttgarter Ballett zum Weltruhm führte. Ein Maler wie Werner Scholz, einst durch die Brücke beeinflusst, zeigte Antigone auf Ölbildern. Dabei ging es, wie Hans-Georg Gadamer formulierte, nicht mehr um die überlebensgroßen Erscheinungen der Götter Homers. Schon die tragische Bühne und dann das gemalte Bild zeigten den Geschlagenen und Leidenden als den ganz menschlichen Menschen. So führt Antigones Tragödie die Menschen vor ihr Schicksal und zeigt, was Geschichte ist. (shrink)

This paper gives a first theoretical formulation to a religious phenomenon which has not received much attention in philosophical discourse so far despite appearing in different highly heterogeneous religions. Vicarious religious ordinance refers to cases in which a living or deceased fully mature human being is knowingly or unknowingly assigned a religious affiliation without their consent or the consent of their dependents. I shall first offer three real-world examples of vicarious religious ordinance from Mormonism, Islam, and Shintoism and then raise (...) some normative concerns. I suggest (i) that vicarious religious ordinance does not fit neatly into current debates about religious epistemology, especially the recent debate on religious disagreement. I argue (ii) that normative questions as to why vicarious religious ordinance elicits indignation in its ‘victims’ is not easily explained through adducing similar examples. This paper aims to motivate further coordinated research on this topic. (shrink)

Some video games are said to be philosophical. Despite video games having received some attention in academic philosophy, that contention has not been sufficiently addressed. This paper investigates in what sense video games might be properly called “philosophical”. To this end, I utilize Wittgenstein’s distinction between saying and showing to get into view how some video games might be properly called philosophical. This leads to two senses of being philosophical: a conventional sense of expressing philosophy through propositions, i.e., through saying, (...) and a sense of being genuinely philosophical by expressing philosophical thought through showing. I argue that the conventional sense is not sufficient to call video games philosophical, leaving the question whether there are video games which satisfy the conditions of being genuinely philosophical. I furthermore contend that there are at least some examples of video games which qualify as being philosophical, e.g., Papers, Please and The Stanley Parable. (shrink)

While shame and embarrassment have received significant attention in philosophy and psychology, cringe (also sometimes called ‘vicarious embarrassment’ and ‘vicarious shame’) has received little thought. This is surprising as the relatively new genre of cringe comedy has seen a meteoric rise since the early 2000s. In this paper, I aim to offer a novel characterization of cringe as a hostile social emotion which turns out to be closer to disgust and horror than to shame or embarrassment, thus disclosing ‘vicarious shame’ (...) and ‘vicarious embarrassment’ to be misnomers. The closing part offers an explanation as to why cringe and cringe comedy in particular have become recently more relevant: cringe allows one to express hostility and disgust (often at other forms of life) in a nonviolent manner which fits perfectly well within the permissible boundaries of tolerance set up in liberal Western democracies since the second half of the 20th century. Is Naturalism Coherent? Naturalism is the philosophical orthodoxy of the late 20th and early 21st century. However, the content of naturalism is unclear. I aim to demonstrate that naturalism cannot be formulated coherently. I offer two main arguments. First, naturalism presupposes the unity of science thesis; but the unity of science thesis has come under serious attack. But even if the naturalist successfully entitles herself to the unity of science thesis, naturalism is still subject to an argument from incoherence. First, (...) I reconstruct naturalism as the conjunction of a methodological and ontological theme. The ontological theme of naturalism states that only those things truly exist which can be accounted for by physical science. The methodological theme asserts that “philosophy is continuous with science”. While this can be interpreted in different ways, it is often taken to state that philosophy should only make statements that can be countenanced by the standpoint of science. Second, I demonstrate that this common construal has the underlying tacit assumption of the unity of science. The unity of science claims that: the entities and laws of the special sciences can be reduced to a master science, commonly identified as physics. Third, I briefly rehearse two lessons from Fodor and Horgan. Fodor convincingly argued against the inter-level reducibility of special science laws to the laws of physics. Horgan´s argument starts with the observation that a sensible version of reductive physicalism has to be cashed out in terms of supervenience. He then goes on to argue that no available conception of supervenience captures the reductive ambitions of physicalism. Hence, the naturalist simply cannot entitle herself to an uncontroversial notion of the unity of science that is presupposed by naturalism. However, and fourth, even if the naturalist can establish the unity of science thesis, it is subject to an argument from incoherence. I take a cue from the coherence problem of the “empiricist criterion of meaning” in logical positivism, and apply it to the naturalist doctrine. The methodological commitment states that in philosophy only those claims can be made which are countenanced from the standpoint of the natural sciences. This is the standard for philosophical practice set by naturalism. And naturalism is itself a philosophical thesis. However, both commitments of naturalism fall short of this standard. The ontological commitment states that, in effect, the only things that really exist are those entities that are accepted and posited by physics. But this claim itself does not qualify as a piece of natural science since it transcends the bounds of what natural science investigates. Similarly, the methodological commitment cannot be countenanced from the standpoint of natural science. The claim that philosophical practice should only include statements that can be countenanced from the standpoint of natural science, is itself not a statement that is countenanced by natural science. Since this standard was set by naturalism qua methodological commitment, I conclude that naturalism turns out to be an incoherent doctrine. Two opposed movements of thought threaten philosophy as an autonomous practice from the inside: scientific naturalism and quietism. Naturalism (qua methodological thesis) threatens to turn philosophy into a mere ancilla of the sciences, quietism understood as the prescription to remain silent in philosophy would not countenance any more "positive" philosophy. This book reconstructs naturalism and quietism such that it becomes clear naturalism does have the potential to end philosophy as an autonomous practice and that quietism, correctly understood, does not. To (...) this end, this book provides arguments against the prevailing orthodox status of naturalism and a heterogenous reading of Wittgenstein's metaphilosophical quietism as the rejection of a certain kind of theories in philosophy, namely quasi-scientific theories. Academic dishonesty among students is not confined to the dynamics of the classrooms in which it occurs. The institution has a major role in fostering academic integrity. Ways that institutions can have a significant impact on attitudes toward and knowledge about academic integrity as well as reducing the incidence of academic dishonesty are described. These include the content of an effective academic honesty policy, campus-wide programs designed to foster integrity, and the development of a campus-wide ethos that encourages integrity.

To understand better why evidence of student cheating is often ignored, a national sample of psychology instructors was sampled for their opinions. The 127 respondents overwhelmingly agreed that dealing with instances of academic dishonesty was among the most onerous aspects of their profession. Respondents cited insufficient evidence that cheating has occurred as the most frequent reason for overlooking student behavior or writing that might be dishonest. A factor analysis revealed 4 other clusters of reasons as to why cheating may be (...) ignored. Emotional reasons included stress and lack of courage. Difficult reasons included the extensive time and effort required to deal with cheating students. Fear reasons included concern about retaliation or a legal challenge. Denial reasons included beliefs that cheating students would fail anyway and that the worst offenders do not get caught. The reasons why instances of academic dishonesty should be proactively confronted are presented. (shrink)

The efforts of some institutional review boards (IRBs) to exercise what is viewed as appropriate oversight may contribute to deceit on the part of investigators who feel unjustly treated. An organizational justice paradigm provides a useful context for exploring why certain IRB behaviors may lead investigators to believe that they have not received fair treatment. These feelings may, in turn, lead to intentional deception by investigators that IRBs will rarely detect. Paradoxically, excessive protective zeal by IRBs may actually encourage misconduct (...) by some investigators. The authors contend that, by fostering a climate in which investigators perceive that they receive fair and unbiased treatment, IRBs optimize the likelihood of collegial compliance with appropriate participant protections.
