Rural queer studies, viewed through the lens of relational agriculture, offer critiques of heteropatriarchal norms in farming and highlight strategies used by queer farmers to manoeuvre discrimination and thrive in rural areas. This paper responds to recent calls for further scrutiny of the experiences of gender and sexually underrepresented groups in community-supported agriculture (CSA). It investigates the empowerment of rural queer people in CSA Guadiana, South Portugal, through the experiences of 12 queer members. I collected data through participant observation, semi-structured (...) interviews and a focus group and analysed them through open coding, followed by focused coding. Results indicate that CSA Guadiana, despite not originally designed for this purpose, facilitates various forms of empowerment and active engagement among queer members, particularly influenced by the leadership of queer producers and recurrent gatherings in queer-owned farmland. Three key lessons of queer empowerment in CSA Guadiana emerge from the analysis and contribute to debates on the politics of recognition, queer community action and visibility in the rural context: (i) self-confidence to perform queerness may be restricted to a selective rural community; (ii) partnerships between producers and co-producers may enable reciprocal queer empowerment; and (iii) queer leadership in agri-food community action may quietly represent gender and sexual diversity in the countryside. These findings offer the rural queer literature novel insights into the complexities, contradictions and limitations of empowerment experienced by queer farmers, artisanal food producers and consumers in a rural CSA. Community-supported agriculture (CSA) initiatives are spaces where diverse work relations are performed. From a postcapitalist perspective, these initiatives attempt to create alternative-capitalist and non-capitalist work relations next to capitalist ones. While analyses of work relations in CSA abound, it remains uncertain how such diversification is made possible and how it is shaped by the micro-politics of and power relations in these initiatives. This paper addresses this gap by analysing how power shapes transformations to postcapitalist work relations in CSA. It provides (...) substantial empirical evidence of multiple manifestations of power enabling or constraining postcapitalist work relations through a comparative case study of three CSA initiatives in Portugal. Results show that while CSA creates postcapitalist work relations that are non-alienated, non-monetised and full of care, they insufficiently unmake unbalanced power relations established in capitalist work relations. This paper argues that, when establishing postcapitalist work relations, the selected CSA initiatives could benefit from actively deconstructing internal hierarchies, de-centralising decision-making power from farm owners and addressing oppressive power relations that are ossified in their local and cultural context. Academic research studies examining the ethical attitudes and behaviors of salespeople have produced several frameworks that explore the ethical decision-making processes to which salespeople adhere when faced with ethical dilemmas. Past literature enriches our understanding; however, a critical review of the relevant literature suggests that an emotional route to salesperson ethical decision-making has yet to be explored. Given the fact that individuals’ emotional capacities play an important role in decision-making when faced with an ethical dilemma, there is a need for (...) empirical research in this area. We address this issue by outlining and testing an emotion-based model to study the ethical attitudes and behaviors of salespeople in a relational selling context. Building on the cognitive-affective model proposed by Gaudine and Thorne (J Bus Ethics 31:175–187, 2001 ), we outline a framework that incorporates higher order prosocial emotions: capacity for concern and capacity for guilt. We present evidence that preschool children oftentimes understand disjunctive sentences as if they were conjunctive. The result holds for matrix disjunctions as well as disjunctions embedded under every. At the same time, there is evidence in the literature that children understand or as inclusive disjunction in downward-entailing contexts. We propose to explain this seemingly conflicting pattern of results by assuming that the child knows the inclusive disjunction semantics of or, and that the conjunctive inference is a scalar implicature. We make (...) two assumptions about implicature computation in the child: that children access only a proper subset of the adult alternatives, and that children possess the adult capacity to strengthen sentences with implicatures. As a consequence, children are expected to sometimes not compute any implicatures at all, but in other cases they are expected to compute an implicature that is different from the adult implicature. We argue that the child’s conjunctive strengthening of disjunctive sentences realizes the latter possibility: the adult infers that the conjunction is false but the child infers that the conjunction is true. This behaviour is predicted when our assumptions about child development are coupled with the assumption that a covert exhaustive operator is responsible for strengthening in both the child and the adult. Specifically, children’s conjunctive strengthening is predicted to follow from the same mechanism used by adults to compute conjunctive free choice implicatures in response to disjunctive permission sentences. We furthermore argue that this parallel between the child and the adult extends to disambiguation preferences. In particular, we present evidence that children prefer to strengthen disjunctions to conjunctions, in matrix and embedded positions ; this result mirrors previous findings that adults prefer to compute free choice, at the root and under every. We propose a disambiguation strategy that explains the preference for conjunctive strengthening – by both the child and the adult – even though there is no general preference for exhaustification. Specifically, we propose that the preference for a conjunctive strengthening follows from a pragmatic preference for a complete answer to the Question Under Discussion. (shrink)

Nos propomos nesse artigo a contribuir à apreciação da assimilação de Schopenhauer da teoria das Ideias de Platão, por meio da comparação da interpretação schopenhaueriana dessa doutrina com sua exposição platônica. Para tanto, partiremos do roteiro de leitura da teoria das Ideias de Platão recomendado por Schopenhauer em suas preleções na Universidade de Berlim, e que destaca trechos de Filebo, A República e O Banquete. Após sua análise, defenderemos que Schopenhauer assume e ressignifica a distinção platônica entre o mundo como (...) protótipo e cópia, associando o primeiro às forças naturais fundamentais, e o segundo, aos fenômenos do princípio de razão suficiente. Mostraremos também que Schopenhauer espera “corrigir” [1] a “psicologia racional” de Platão, com o argumento de que “o conhecimento sem a intuição, que é intermediada pelo corpo, não possui estofo algum” [2], seguido da radicalização da teoria platônica de que o belo intuitivo facilita o conhecimento das Ideias. Public benefit corporations are National Health Service, that is, state, entities whose function to provide healthcare in discharge of public duties. If we regardvalue as the output of such organisations, it seems logical to connect the values of the organisation to thevalue produced by such organisations. But, on closer examination there are competing underlying logics in play: (1) those based on promoting organisational efficiency and efficacy; and (2) those based on the idea of building service provision around the clinician–patient relationship. (...) Underlying these logics are differing value sets. These clash. Because of the clashing of underlying moral frameworks the connection between values andvalue becomes hard, if not impossible. This paper argues that (1) the clash in these moral frameworks must be addressed by the organisation rather than between individuals or groups of individuals within the organisation; (2) alloying duties within hybrid professionals submerges but does not resolve these conflicts; (3) one approach could be to impose on the organisation itself an ethical imperative to promote, enhance and protect from deterioration the welfare of the patients; (4) a board ethics committee is a possible organisational structure that could transparently and fairly balance clashes within the competing moral frameworks in a way that could reconcile the competing logics and (5) if such conflicts can be better resolved at the organisational level what the organisation must do to achieve its objectives will become clearer because what needs to be valued would naturally emerge connecting values,value and what is valued. According to one view of linguistic information, a speaker can convey contextually new information in one of two ways: by asserting the content as new information; or by presupposing the content as given information which would then have to be accommodated. This distinction predicts that it is conversationally more appropriate to assert implausible information rather than presuppose it. A second view rejects the assumption that presuppositions are accommodated; instead, presuppositions are assimilated into asserted content and both are correspondingly open to (...) challenge. Under this view, we should not expect to find a difference in conversational appropriateness between asserting implausible information and presupposing it. To distinguish between these two views of linguistic information, we performed two self-paced reading experiments with an on-line stops-making-sense judgment. The results of the two experiments—using the presupposition triggers the and too—show that accommodation is inappropriate relative to non-presuppositional controls when the presupposed information is implausible but not when it is plausible. These results provide support for the first view of linguistic information: the contrast in implausible contexts can only be explained if there is a presupposition-assertion distinction and accommodation is a mechanism dedicated to reasoning about presuppositions. Este artigo mostra que não há uma tese de subdeterminação de teorias científicas pelos indícios observacionais, mas várias. Identificamos quatro, com significados, plausibilidades e implicações distintos. Mostra-se que as mais fortes não passam de conjeturas, e que as mais fracas são mais plausíveis, mas não possuem implicações filosóficas robustas – em particular, não implicam o antirrealismo científico –, embora forneçam indícios de alternativas teóricas sistematicamente ignoradas na ciência, bem como do emprego de critérios em parte valorativos de escolha de teorias.

Existing theoretical literature on justice, law, and community typically treats them as ideas studying them through an analytical and rational approach. In this article, I propose to investigate these concepts through aesthetic experience as an attempt to both sharpen our imagination of such concepts and demonstrate they are inseparable. I do this by painstakingly examining the movies Shoplifters by Kore-eda and The House That Jack Built by Von Trier. Rather than focusing on thematic analysis, I claim and show that film (...) form is crucial for aesthetic and affective experience. Furthermore, and against the conventional view, I argue that both movies articulate a spatialized vision of justice defined by its materiality. Together these aspects help us to keep (re)imagining law, justice, and community, and grasp better their worldmaking properties and powers. (shrink)

Este artigo apresenta a concepção de democracia adotada pela Teoria dos Sistemas Sociais na versão de Niklas Luhmann. Embora seja um tema pouco frequente na obra do sociólogo, ela foi exposta com clareza no artigo The Future of Democracy, publicado em 1990. Neste artigo, a concepção é apresentada como uma hipótese histórica que foi capaz de prever e explicar algumas características da democracia ocidental após a queda do bloco soviético. O artigo avança um desenvolvimento dessa concepção democrática para entender melhor (...) o ressurgimento dos movimentos políticos de extrema-direita na última década e, por outro lado, mostrar como tais movimentos são incompatíveis com o princípio democrático proposto pela teoria luhmanniana. Propomos comparar as respostas de Schopenhauer e Freud à questão do significado do prazer e desprazer, dadas por eles, respectivamente, em A ordem da salvação (W II) e Além do princípio do prazer. Ambos lhe respondem concordantemente, pois assinalam que a conduta humana ou os processos psíquicos se dilatam entre a busca do prazer e a fuga da dor (em Schopenhauer, a partir da afirmação da Vontade, e em Freud, conforme o princípio de prazer), e a busca da dor e (...) fuga do prazer (em Schopenhauer, no ascetismo ou graças ao “destino”, conduzido pela Vontade inconsciente, e em Freud, a partir da compulsão à repetição). Mesmo que na contradição schopenhaueriana se expresse mais uma polaridade entre o intelecto e a Vontade, e na freudiana, duas tendências subordinadas ao instinto de morte, defenderemos que ambos os autores estão mais afinados nesse tema do que no do dualismo entre Morte e Eros. Business leadership increasingly requires a master’s degree in business and graduate management admission test scores continue to be an important component of applications for admission to such programs. Given the ubiquitous use of GMAT scores as gatekeepers for business leadership, GMAT scores are likely to influence organizational ethical behavior through gender, cultural, and other biases in the GMAT. There is little prior literature in this area and we contribute by empirically documenting that GMAT scores are negatively related to the cultural (...) dimensions of masculinity and power distance and are positively related to math literacy, uncertainty avoidance, and individualism. We estimate that cultural factors may account for as much as an 80-point difference in cross-national mean GMAT scores which are also related negatively to local language literacy, national educational spending, wealth per capita, wealth inequality, and gender development. Most interestingly, we also find a significant negative association of GMAT scores with ethical orientation. These findings have important implications for business schools and corporate ethics and leadership. (shrink)

Este artigo visa a mostrar que é possível bloquear o regresso sem lançar mão de recursos argumentativos ad hoc. Algumas considerações sobre a forma lógica de frases relacionais contendo termos que se referem a propriedades e relações mostram como substituir a forma viciosa de regresso por uma menos problemática.

Este artigo aborda a mudança de paradigma para a noção de trabalho na sociedade impactada pela transformação digital. Reformulando o conceito de trabalho como transformação conservadora de energia, de acordo com a primeira lei da termodinâmica, para o entendimento do trabalho como redução da entropia, conforme a segunda lei, é possível compatibilizá-lo com os conceitos de informação e de comunicação. O artigo sugere que esta reformulação já estava implícita na teoria marxista e a diferencia do modelo ricardiano clássico. A transformação (...) digital é pensada como corte epistemológico no modo de produção, que traz consequências para o sistema funcional da economia. Neste, o modo dominante da economia capitalista (o capitalismo de plataforma) é confrontado com modos alternativos como o da Economia Solidária. O artigo examina se a transformação digital traz vantagens comparativas para a Economia Solidária e conclui positivamente neste sentido. (shrink)

This paper discusses Gilbert Ryle’s image of philosophy as cartography in an attempt to explore the idea of a cartography of the phenomenon, confronting it with the sense it takes in Edmund Husserl’s transcendental phenomenology. Ryle tries to grasp the particularity of philosophical tasks as being about specific sorts of problems, not about specific sorts of objects. What is required both of a cartographer and of a philosopher is, according to him, to look at familiar spaces in wholly unusual terms. (...) Husserlian phenomenology then, with its rediscovery of consciousness as an absolute, unbounded field, meets quite well this demand. The uncovered field of the phenomena is not a new region, opposing that of the objects as faced in the natural attitude. It is rather a completely different attitude, just as a map is not a share of the world, but a distinct orientation towards it. The phenomenon, therefore, would not be something that is there to be cartographed as much as a kind of cartography itself. A phenomenological cartography, however, is one that has its specific marks, different from those of the Rylean conception. (shrink)

This article argues that to disrupt legal education in a radical sense, students need to become acquainted with the art of worldmaking and the view that law is a “way of worldmaking”. First, I show that law is a cultural semiotic practice that requires decoding and, for that reason, demands a creative intervention by those that want to know, understand, and do things with law. Altogether this amounts to recognizing the different modes in which law creates, and is part of, (...) worlds. Second, I propose that due to different features of their aesthetic form, comics are a particularly effective medium to place students before the myriad ways in which law and lawyers make and reproduce worlds. Third, I illustrate the argument by exploring how the Saga comic series, through its formal multimodality and narrative and cultural complexity, can make good on that challenge. (shrink)

While the concepts of race and ethnicity have been abused historically, they are potentially invaluable in epidemiology and public health. Epidemiology relies upon variables that help differentiate populations by health status, thereby refining public health and health care policy, and offering insights for medical science. Race and ethnicity are powerful tools for doing this. The prerequisite for their responsible use is a society committed to reducing inequalities and inequities in health status. The problem of addiction to psychoactive substances, such as alcohol and other drugs, has been addressed in psychiatry traditionally from the perspective of a mechanistic-reductionist epistemological model, whose main focus in clinical care is to avoid or suppress the use of these substances, rather than understanding the meaning of a treatment and the meaning of the alterations of consciousness produced by these addictive substances. This paper attempts to contribute towards overcoming this epistemological perspective from the perspective of phenomenological psychopathology. In (...) the first part of the article, the main characteristics of phenomenology and its incorporation into the field of mental health will be presented. Then the issue of addiction will be analysed from two ways of understanding it: the mechanistic-reductionist model and the phenomenological dialectical model. Finally, the pragmatic consequences of the dialectical perspective of phenomenology, called Dialectical Phenomenology (DPh), which seeks to enrich the diagnostic process in the mental health clinic, allowing scientific diagnoses to approach the complexities of clinical reality, will be presented. We present its development in the philosopher’s capital work The World as Will and Representation and defend that it is present in a vital way in his three metaphysics, but is only made explicit in the last (of customs). Finally, we “dialogue” with the problematical issues that G. Simmel and C. Using a popular Sufi tale as a starting point, the author shows that in a postmodern age, wisdom can best be characterized as a willingness to see how parts and wholes relate to each other and how new meanings emerge from a dialogical interplay between the two. Wisdom can also be characterized by openness, by the ability to perceive connections among various viewpoints, and by a strong tolerance for ambiguity.

No De grammatico, Anselmo distingue e articula algumas noções linguísticas a fim de esclarecer uma suposta inconsistência na semântica dos termos denominativos. O presente estudo sustenta que a apelação é por ele concebida como uma noção básica a partir da qual a significação de um termo denominativo pode ser estabelecida. Essencialmente, Anselmo define a apelação em termos pragmático-referenciais e dela se vale para realizar três procedimentos consecutivos, cujo propósito é determinar a significação de um termo denominativo. De início, ele indica (...) o que o termo denominativo apela. Em seguida, ele explicita a significação da sentença que contém tal termo, substituindo-o por sua definição. Finalmente, ele identifica o que o termo abstrato dessa definição apela. Segundo Anselmo, dado que um termo denominativo significa per se o que na significação da sentença correspondente se predica do que ele apela e significa per aliud aquilo que ele apela, basta especificar ambas as apelações para, com base nelas, obter a significação de um termo denominativo. A tradução a seguir tem como pretensão demonstrar o modo como Gaston Berger (1896-1960) em seu texto Husserl et Hume, promove uma articulação entre a fenomenologia de Edmund Husserl e o empirismo de David Hume. No texto, o autor apresenta a maneira como a fenomenologia ao valorizar a experiência (tendo-a como imprescindível) se aproxima da filosofia de Hume, e ao tratá-la como insuficiente por si mesma, acaba por estabelecer uma estreita relação com o idealismo transcendental kantiano. O fato é que (...) por mais que Husserl acredite ter superado a imediaticidade dos fatos empíricos vindo a construir um novo sistema de idealismo transcendental, a sua fenomenologia jamais deixou de clara fazer referência a Hume. This paper aims to understand the kind of activities that industrial actors develop in order to protect their enterprises during industrial crisis conditions. A series of political unrest, insurgency, economic turmoil, deadly earthquakes, and economic embargo at the Indo- Nepal boarder escalated the industrial crisis in Nepal. The quest for sustainability of enterprises during the enduring nature of the crisis stimulated for a more detail conversation and survey. A perceptual survey of industrial actors accompanying conversation therein indicates that trade union (...) and association leaders develop positive attitude and advance specific activities for protecting their enterprises during industrial crisis conditions. The study finds that an empathic nature helps to develop a positive attitude among the industrial actors, which seems contributory for enterprises to survive during crisis conditions. The actors tend to positively perceive significance of specific activities under the conditions of difficulties and hardships and enhance immunity to the industrial crisis. This paper argues that the empathic nature of the industrial actors becomes more effective to safeguard the pluralistic interests of the stakeholders of the enterprise than the self- centric nature of the actors. The actors are not only engaged in safeguarding their claims on the industry but are also contributing—beyond their routine work—positively to strengthen the enterprise immunity during difficulties. This paper concludes with an insight of shifting managerial attention from the generic concepts like cost minimisation and product differentiation to the concepts of regularity in supply of goods and services in the business network by expanding the scope of industrial relations vertically and horizontally. The empathic nature of industrial actors enhances the effectiveness of the general system theory and social network theory by developing understanding of the role of industrial actors’ relations in sustaining and operationalizing a business network under organizational crisis conditions. Philosophy of science has undergone a naturalistic turn, moving away from traditional idealized concerns with the logical structure of scientific theories and toward focusing on real-world scientific practice, especially in domains such as modeling and experimentation. As part of this shift, recent work has explored how the project of philosophically understanding science as a natural phenomenon can be enriched by drawing from different fields and disciplines, including niche construction theory in evolutionary biology, on the one hand, and ecological and enactive (...) views in embodied cognitive science, on the other. But these insights have so far been explored in separation from each other, without clear indication of whether they can work together. Moreover, the focus on particular practices, however insightful, has tended to lack consideration of potential further implications for a naturalized understanding of science as a whole (i.e., above and beyond those particular practices). Motivated by these developments, here we sketch a broad-ranging view of science, scientific practice and scientific knowledge in terms of ecological-enactive co-construction. The view we propose situates science in the biological, evolutionary context of human embodied cognitive activity aimed at addressing the demands of life. This motivates reframing theory as practice, and reconceptualizing scientific knowledge in ecological terms, as relational and world-involving. Our view also brings to the forefront of attention the fundamental link between ideas about the nature of mind, of science and of nature itself, which we explore by outlining how our proposal differs from more conservative, and narrower, conceptions of “cognitive niche construction.”. Education has two distinct but interconnected layers. There is an outer layer concerned with knowledge transfer and skills and an inner layer concerned with the development of character and relationships with others, both individually and socially. This inner layer provides the individual with the capacity to influence and to change society. In that sense, such an inner layer is ‘political’. In this article we argue that the ‘political’ in education can take two distinct forms: either that of dialogue or of (...) defiance. We claim that the former is epitomised by the philosophy of Martin Buber and the latter by the philosophy of Frantz Fanon. Our analysis contrasting these two philosophies clarifies the implications for education, and thereby for the individual and for society. (shrink)

No Protágoras, de Platão, ao defender a sua concepção segundo a qual a virtude se ensina, o personagem que dá nome ao diálogo faz uma breve exposição do que seria a educação tradicional em seu tempo e atribui a ela, aos costumes e às leis o poder de promover nos cidadãos a conquista das virtudes cívicas fundamentais, ainda que destaque a necessidade do concurso da coerção. Uma comparação com a proposta de educação visando às mesmas virtudes na República mostrará uma (...) notável semelhança entre as duas concepções. Porém certas diferenças fundamentais também se fazem notar. O sofista do primeiro diálogo mencionado parece muito mais otimista do que o Sócrates do segundo quanto à possibilidade de promover a virtude. O que parece patente é que, segundo esse Sócrates, é necessária uma intervenção muito profunda na educação e nos costumes antes que se possa esperar que os homens adquiram e mantenham as virtudes cívicas fundamentais. Essa intervenção parece fundada num profundo conhecimento da alma humana e das forças em jogo nela. Race and ethnicity are closely related, contentious concepts that have been abused and misinterpreted through history, but have a vast potential for good, at least in the health sciences. This article is not intending to elaborate on the conceptual foundations of race and ethnicity; I have addressed that elsewhere and summarized my stance in the glossary reprinted below in the Appendix. The terminology used here follows the glossary. Assuming that the conceptual foundations of my stance are reasonable, the questions addressed (...) here focus on public health and its primary health science, epidemiology, in a European context. The questions are simple ones:1.In epidemiology and public health what are we trying to achieve when we use the concepts of race and ethnicity?2.What would we lose by rejecting these concepts?3.If we do not reject them, how do we put the concepts into operation to help achieve our goals?4.What practical actions can result from the application of these concepts in order to improve the health and well-being of populations? O presente artigo pretende explorar a máxima contida em Os irmãos Karamázov (se não há Deus, tudo é permitido?) à luz do pensamento de Immanuel Kant. Para tanto, se vale do pensamento de Dostoiévski apenas na medida em que ele serve como auxílio na apresentação da ideia de Deus e de sua relação com a posição do ateu. Tendo em vista a filosofia kantiana, buscamos não apenas a apresentação dessa ideia, mas também sua relação com o ato moral e com (...) a própria condição desse ato. Isso, portanto, resultará em Kant, uma resposta duplamente negativa à pergunta que reflete a posição ateísta de Ivan Karamazov. Pois Kant ao distinguir o ato moral por dever e conforme o dever, defende que recorrer a algo externo à razão (Deus) constituiria uma vontade meramente heterônoma. Portanto, o ato moral por excelência ocorre quando a ação é realizada de um modo unicamente guiado pela razão, com base num interesse puro, e isso conduz, por sua vez, à reprovação por parte de Kant da referida máxima presente na obra de Dostoiévski. In recent months, pharmaceutical manufacturers have brought legal challenges to a provision of the 2022 Inflation Reduction Act (IRA) empowering the federal government to negotiate the prices Medicare pays for certain prescription medications. One key argument made in these filings is that price negotiation is a “taking” of property and violates the Takings Clause of the US Constitution. Through original case law and health policy analysis, we show that government price negotiation and even price regulation of goods and services, including (...) patented goods, are constitutional under the Takings Clause. Finding that the IRA violates the Takings Clause would radically upend settled constitutional law and jeopardize the US’s most important state and federal health care programs. (shrink)

O presente artigo almeja demonstrar que em Einleitung in die Logik und Erkenntnistheorie, de 1906/07, por meio de uma crítica ao ceticismo, Husserl promove uma mudança que será significativa no desenvolvimento posterior de sua filosofia: a introdução da εποχή. Ao contrário do ceticismo grego, tal conceito em Husserl, ao suspender o juízo, busca um dado indubitável: o ego. Isso proporciona com que Husserl supere o ceticismo, tanto em sua face dogmática (negação de possibilidade de todo o conhecimento), quanto crítica (suspensão (...) do juízo perante o alcance do conhecimento). Com isso, pode-se perceber que ao retomar um conceito cético da filosofia antiga, e opor-se ao relativismo, Husserl inaugura o seu primeiro esboço de uma filosofia pura, que adiante será concretizada, em sua última fase, como idealismo fenomenológico-transcendental.
