This article presents a structured and systematic approach for identifying and modelling compliance risks. The sophistication with which modern business is carried out and the unprecedented access to a global market means that businesses are exposed to increasing and diverse regulatory requirements in and across jurisdictions. Compliance with such requirements is practically challenging, partly due to the complexity of regulatory environments. One possibility in this regard is a risk-based approach to compliance, where resources are allocated to those compliance issues that (...) are most risky. Despite the need for risk-based compliance, few specific methods and techniques for identifying and modelling compliance risks have been developed. Due to the lack of methodological and tool support, compliance risk identification often involves unstructured brainstorming, with uncertain outcomes. The proposed approach consists of a five-step process for the structured identification and assessment of compliance risks. This process aims at facilitating the identification of compliance risks and their documentation in a consistent and reusable fashion. As part of the process, the article provides a systematic approach for a graphical modelling of compliance risks, which aims at facilitating communication among experts from different backgrounds. The creation of graphical models can be partly automated based on natural language patterns for regulatory requirements. Furthermore, the structuring of the compliance requirement in a template aims at simplifying the modelling of compliance risks and facilitating a potential future automated model. (shrink)

Opioid use disorder rarely presents as a unitary psychiatric condition, and the comorbid symptoms likely depend upon the diverse risk factors and mechanisms by which OUD can arise. These factors are heterogeneous and include genetic predisposition, exposure to prescription opioids, and environmental risks. Crucially, one key environmental risk factor for OUD is early life adversity. OUD and other substance use disorders are widely considered to derive in part from abnormal reward circuit function, which is likely also implicated in comorbid mental (...) illnesses such as depression, bipolar disorder, and schizophrenia. ELA may disrupt reward circuit development and function in a manner predisposing to these disorders. Here, we describe new findings addressing the effects of ELA on reward circuitry that lead to OUD and comorbid disorders, potentially via shared neural mechanisms. We discuss some of these OUD-related problems in both humans and animals. We also highlight the increasingly apparent, crucial contribution of biological sex in mediating the range of ELA-induced disruptions of reward circuitry which may confer risk for the development of OUD and comorbid neuropsychiatric disorders. The programme of bringing together Literary Studies and Intellectual History (›Geistesgeschichte‹) has its foundation in the notion of context. At first sight, literary text and historical context look as if they could be separated from each other with ease. However, each text carries with it contextual elements just as much as each context is always already imbued with textuality. What seems to be at stake is their relation. This is above all taken into account by functionalist approaches less interested in (...) the attribution of functions to seemingly pre-existent structures than seeing structure as following function. It clearly undermines the commonsensical assumption that structure precedes function – just as much as it destabilizes the hermeneutical relation between question and answer and the epistemological precedence of the real over the imaginary: obviously, the contextual ›seat in life‹ seems to have the same impact on text-making as textual meaning has in relation to its context; wherever the construction of a ›reality‹ looks like a plausible imaginary answer to the question of what the world is, imagination in literature and art seems to be the site of turning the answers back into questions. In the premodern period, seen as the epoch of a shift from a predominantly analogical world-view, characterized by a cosmological closure guaranteed by God, to the open concept of reality as the result of a temporal and causal, man/woman-made individual realization, this seems to be one of the decisive driving forces affecting the modification of the social imaginary, both in its framing and in its truth-finding methods, with regard to the process of ›epochal‹ change. Scientific exploration and thus our knowledge about the outside world is subject to the conditions of our experience.These conditions are condensed here into an interface model which,besides being physical,has an additional interface structure not reducible to physics. We suggest that this structure can dynamically be characterized by separate modes.Their selection and operation presupposes free will and a rudimentary concept of time and space. Based on some analogies with quantum networks it is argued that the 'observed' gets 'dressed'as a consequence of (...) the observing. One of the leading figures of Logical Positivism, Moritz Schlick, wrote a well-known article “On the Foundations of Knowledge”, edited in English by Sir Alfred Ayer in 1959, in which he proposes Konstantierungen, also known as affirmations or confirmations in English, to play the part of the much sought-after indubitable and incorrigible foundation of personal belief. In the present article I will oppose this view via the perspective of confirmations in their linguistic nature, a trait that renders Konstatierungen untenable both (...) as sentences in Language of Thought – where it is thought that is linguistic, and natural language is but a means for expressing it-, and as occurring in natural languages due to the obligatory phenomenon of grammatical evidentiality in many world languages. Given that the world as we perceive it appears to be predominantly classical, how can we stabilize quantum effects? Given the fundamental description of our world is quantum mechanical, how do classical phenomena emerge? Answers can be found from the analysis of the scaling properties of modular quantum systems with respect to a given level of description. It is argued that, depending on design, such partitioned quantum systems may support various functions. Despite their local appearance these functions are emergent properties (...) of the system as a whole. With respect to the separation of subject and object such functions of interest are control, simulation, and observation. They are interpreted in close analogy with more basic physical behavior. Organ procurement agencies claim that all major world religions approve of organ donation and do not address the ethical controversy about organ donation in the context of brain death that is readily available online. Eric T. Poehlman, Ph.D., was an internationally recognized, tenured professor at the University of Vermont (UVM) in Burlington when, in October 2000, a junior member of Poehlman’s laboratory became convinced that he had altered data from a study on aging volunteers from the Burlington area. This suspicion developed into one of the most significant cases of scientific misconduct in the history of the US Department of Health and Human Services’ (HHS) Office of Research Integrity (ORI), launching a US Department of (...) Justice (DOJ) civil and criminal fraud investigation and, eventually, to a much publicized guilty plea and felony conviction. In the end, Dr. Poehlman admitted to 54 findings of scientific misconduct made by the UVM and ORI, agreed to retract or correct ten of his publications and to exclude himself from federal procurement and nonprocurement transactions for life. The United States Government’s handling of this case was distinguished by a highly cooperative approach that integrated the resources of the US Attorney’s Office for the District of Vermont (USAO) and both ORI and the Office of the Inspector General (OIG) in HHS in the common goal of prosecuting research fraud. We consider work extraction from two finite reservoirs with constant heat capacity, when the thermodynamic coordinates of the process are not fully specified, i.e., are described by probabilities only. Incomplete information refers to both the specific value of the temperature as well as the label of the reservoir to which it is assigned. Based on the concept of inference, we characterize the reduced performance resulting from this lack of control. Indeed, the estimates for the average efficiency reveal that uncertainty regarding (...) the exact labels reduces the maximal expected efficiency below the Carnot value ), its minimum value reproducing the well known Curzon–Ahlborn value: \ . We also estimate the efficiency before the value of the temperature is revealed. It is found that if the labels are known with certainty, then in the near-equilibrium limit the efficiency scales as \ , while if there is maximal uncertainty in the labels, then the average estimate for efficiency drops to \ . We also suggest how the inferred properties of the incomplete model can be mapped onto a model with complete information but with an additional source of thermodynamic irreversibility. (shrink)

In this study Thomas Peattie offers a new account of Mahler's symphonies by considering the composer's reinvention of the genre in light of his career as a conductor and more broadly in terms of his sustained engagement with the musical, theatrical, and aesthetic traditions of the Austrian fin de siècle. Drawing on the ideas of landscape, mobility, and theatricality, Peattie creates a richly interdisciplinary framework that reveals the uniqueness of Mahler's symphonic idiom and its radical attitude toward the (...) presentation and ordering of musical events. The book goes on to identify a fundamental tension between the music's episodic nature and its often-noted narrative impulse and suggests that Mahler's symphonic dramaturgy can be understood as a form of abstract theatre. Abstract:In this paper we reconceptualize general music education as a "classical music education," departing from speculative reflection on the notion of conducting. We constitute this notion as an interpretative axis connecting, on the one hand, a different perspective on what classical music might mean in the context of general education, and, on the other hand, a more dynamic, techno-ecological concept of both music and education. This paper develops these connections by thinking along with a concrete specimen of classical music in (...) the strict sense, Mahler's First Symphony, in order to show exactly how thinking about such works may actually take on an aspect that is classical in a more properly general educational sense. Beyond a dichotomy between aesthetical and praxial appraisals of the classical musical work, with their exclusive emphases on intelligible form and socio-critical praxis respectively, our idea of classical music education implies a dynamic (re)conducting of the works. Through practices of (re)conducting, music education can treat works, not as static monuments of eternal beauty or instances of socio-historical criticality, but as catalysts of self-differentiating, transhuman musical experiences—of playing, listening, composing, and thinking—in which human, instrumental, and other techno-ecological agencies mutually transform each other. In this paper I explain Wittgenstein’s ambivalent remarks on the music of Gustav Mahler in their proper musico-philosophical context. I argue that these remarks are connected to Wittgenstein’s hybrid conception of musical decline and to his tripartite scheme of modern music. I also argue that Mahler’s conundrum was indicative of Wittgenstein’s grappling with his own predicament as a philosopher, and that this gives concrete sense to Wittgenstein’s admission that music was so important to him that without it he (...) was sure to be misunderstood. Summary The paper celebrates the person and work of Vittorio Benussi, a forgotten genius of psychology. In particular, it addresses the two most important scientific projects that Benussi developed during his time in Graz and Padua, respectively: the psychology of perception and the psychology of emotions and the unconscious. It highlights the originality and topicality of Benussi’s work and emphasizes its proximity to the latest trends in these research fields.

Irony, one of the most basic, pervasive, and variegated of rhetorical tropes, is as fundamental to musical thought as it is to poetry, prose, and spoken language.
