Legal mobilization in the courts and in political discourse has emerged as an increasingly important strategy of social movements that complements other political approaches. This is true also for women’s movements in post-socialist countries, but most research on strategic litigation has focused so far on common law countries and on supranational litigation in Europe. Using the case of Poland as an example, this article asks why references to the law are so attractive in post-socialist contexts and what can be gained (...) by this with respect to actual rights, justice and social change. It focuses thereby on strategic litigation as the most sophisticated strategy that results from other sustained movement activities connected with the law. It draws on field research, interviews with activists and analyses of primary as well as secondary sources. The article explores the reasons for using the law as the ‘master frame’ by analysing the traditions of gender and law in state socialism and during democratic consolidation. Two examples of strategic litigation, the Tysiąc case for reproductive rights and the ‘Biedronka’ cases for employment rights, are analysed and situated in the context of other legal mobilization activities. These cases set the agenda for crucial social problems and resulted in binding decisions by the courts. A broad and predominantly supportive media discourse was conducive to cultivating public opinion. These analyses support the conclusion that legal mobilization tends to directly influence law and legal practices. It has a socializing effect on the population and their legal consciousness. In aiming at both state and society, these legal strategies of the women’s movement are a modest but crucial success for democratic consolidation. (shrink)

ZusammenfassungEthische Aspekte von Biobanken-basierter Forschung werden zunehmend kontrovers diskutiert. In diesem Artikel wird die Debatte um ethisch angemessene Formen der Einwilligung in Biobanken-basierte Forschung nachgezeichnet. Nach einer Einführung in etablierte Einwilligungsmodelle skizziert der Beitrag kurz die Entwicklung alternativer Ansätze und diskutiert die damit verbundenen ethischen und regulatorischen Herausforderungen. Dabei wird dargestellt, welche ethischen Prinzipien in diesen Diskussionen eine Rolle spielen. Der Beitrag schließt mit einem Ausblick für Deutschland.

In der Wissenschaftsgeschichte des 18. Jahrhunderts steht die deutsche Tradition sprachbasierter Erkenntnistheorie im Schatten der primär rationalistischen Strömungen. Der an Leibniz' Begriff der cognitio symbolica ebenso wie an den englischen Empirismus Bacons und Lockes anknüpfende Ansatz gerät dabei in den Hintergrund, obwohl diese Traditionslinie, die sowohl rationalistische als auch empiristische Elemente vereinbart, bis zum Ende des 18. Jahrhunderts fortbesteht. Dies hat weitreichende Konsequenzen sowohl für die Philosophie- und Literaturgeschichte als auch für die literaturwissenschaftliche Detailforschung, da weder Herders Erkenntnistheorie noch die (...) poetologischen Konzeptionen des 'Anti-Klassikers' Jean Paul und des Frühromantikers Novalis ohne Kenntnis der theoretischen Voraussetzungen erklärt werden können. Unter Auswertung empirisch belegbarer Quellen wie handschriftliche Nachlässe, Briefwechsel und Zitate wird die Entwicklung eines semiotischen Wissensbegriffs bis zu seinen Ursprüngen im 17. Jahrhundert zurückverfolgt und schrittweise nachvollzogen: Die theoretische Ausbildung erfolgt um 1760 durch den für die Wissenschaftsgeschichte des 18. Jahrhunderts höchst bedeutsamen Philosophen und Naturwissenschaftler Johann Heinrich Lambert (1728-1777). Eine systematische und historische Analyse der zentralen Schrift Herders "Eine Metakritik zur Kritik der reinen Vernunft" aus dem Jahr 1799 ergibt, daß Lamberts Ansatz in Herders Entwurf der Zeichenabhängigkeit allen menschlichen Denkens konsequent rezipiert wird. Schließlich müssen die poetologischen Konzeptionen Jean Pauls in der "Vorschule der Ästhetik" und in Novalis' "Theoretischem Werk" in die genannte Traditionslinie eingebunden werden. Infolgedessen sind besonders die Begriffe des Witzes und der Ironie Jean Pauls sowie der romantische Kritik-Begriff Novalis', der seine Enzyklopädistik stützt, wesentlich schärfer zu fassen als bisher. Was in Theorien an Auflösungsvermögen verkraftet werden kann und muß, findet in der Welt, die durch Theorie rekonstruiert werden soll, eine Parallele: Was der Mensch sei, ist nicht einmal menschen- und lebensweltlich eine klare Kante. In den Humankatastrophen der letzten hundert Jahre wird er zu einer verfeuerungsfähigen Biomasse. Man kann kaum den Eindruck gewinnen, daß sich daran etwas wirklich geändert hat. Es wird Tag für Tag hekatombenweise gestorben, gemordet, gefoltert. Der Mensch wird definiert als das Wesen, das man töten kann (...) durch Hunger, Krankheit, Folter, Mord und Krieg, namenlos, zahllos, heute hier, morgen dort. Man könnte sich denken, daß die Lehre vom Menschen, die Anthropologie, ihren Grund verliert und eigentlich zur Thanatologie konvertieren müßte. Und dank Gentechnologie erscheint am Horizont die Vision, der Mensch sei nicht mehr jemand, der nach dem Bilde eines Gottes geformt sei, sondern nunmehr jemand, der in den Stand versetzt wurde, sich ein machbares Bild von sich selber zu schaffen, die Exemplare der humanen Population so zu formatieren, daß sie dem alten Ideal der Kalokagathia entsprechen: tugendhaft, schön, alters- und behinderungslos, krankheits-, rausch- und drogenfrei, angemessenen Verstandes eine Idee der Devianzausmerzung, könnte man sagen, die Idee einer leid- und schicksalsfreien Ruhewelt, einer Re-Animation des Paradiesgedankens ohne Adam und ohne Eva. Bei Schiller bedeutet Spielen ein Handeln frei von Notwendigkeit und Pflicht und bedeutet dementsprechend das Genießen der Befreiung von der Notwendigkeit. Es ist diese Erfahrung der Freiheit, die das Spiel mit dem ästhetischen Phänomen der Schönheit verbindet und seinen großen erzieherischen Wert ausmacht. Die Eigenschaft, die wir als Schönheit bezeichnen, setzt dieselbe Leichtigkeit des Geistes voraus wie das Spiel. In einem schönen Kunstwerk herrscht weder die Form über den Stoff noch umgekehrt. Ein Kunstwerk ist ein freies Zusammenspiel von Form und (...) Inhalt, von Schönheit und Notwendigkeit, so dass es die höchste Erscheinungsform des Spiels darstellt. Spiele sind Stufen auf dem Weg zur Schönheit, weil sie die Spieler zum Genuss der freien Kreativität erziehen. Im Unterschied zu Schiller verwirft Montessori das Spiel als Erziehungsmittel. Sie behauptet, dass die Kinder arbeiten sollen, um sich ihren eigenen Weg durch die Schwierigkeiten der Realität zu bahnen. Allerdings lassen sich beim näheren Hinsehen in ihren Methoden viele Elemente der Freiheit erkennen, welche Schiller dem Spiel zuschreibt. Beispielsweise können sich die Kinder die Gegenstände aussuchen, mit denen sie „arbeiten” wollen. Sie brauchen sie auch nicht zwingend auf die Art einzusetzen, wie es ihnen die ErzieherInnen vormachen. Und vor allem genießen die Kinder ihre „Arbeit” voll und ganz. In der folgenden Abhandlung erläutert die Autorin zunächst Schillers Gedanken zur Erziehung durch Spiel, insbesondere im Hinblick auf das Phänomen der Phantasie. Im zweiten Teil setzt sich die Autorin mit der Frage auseinander, ob es richtig ist zu behaupten, dass Montessori die Phantasie als Erziehungsmittel ablehnt. (shrink)

Dans une belle śuvre d’art, la matičre n’est pas dominée par la forme ou vice-versa. Une śuvre d’art est un jeu libre (...) entre forme et substance, entre beauté et contrainte, et représente de ce fait le summum de l’activité ludique. Les jeux sont des pas sur la voie de la beauté, car ils éduquent ceux qui jouent au plaisir de la liberté de création. Contrairement ŕ la position de Schiller, Maria Montessori rejette le jeu comme moyen d’éducation. Elle pense que les enfants doivent travailler pour trouver leur voie ŕ travers les difficultés de la réalité. Or, l’analyse de ses méthodes révčle la présence de nombreux éléments de la liberté que Schiller attribue au jeu. Les enfants peuvent choisir les choses avec lesquelles ils « travaillent ». Ils ne sont pas obligés de les utiliser exactement de la maničre que l’éducateur leur montre. Et, ce qui est le plus important, les enfants prennent un grand plaisir ŕ exécuter leur « travail ». Dans cet article, l’auteur interprčte d’abord les réflexions de Schiller sur l’éducation ŕ travers le jeu, oů l’accent est mis sur l’imagination. In Schiller’s opinion, to play means to act free from the force of need as well as of duty and thus to enjoy liberation from necessity. It is this experience of freedom that links play with the aesthetical phenomenon of beauty and causes its high educational value. The quality that we call beauty represents the same lightness of spirit as the game does. In the beautiful work of art, the material is not dominated by the form or vice versa. The (...) work of art shows a free play between form and matter, between beauty and necessity, and thus represents the highest kind of play. Games are steps on the way to beauty, because they educate the player to enjoy the freedom of creativity. Contrary to Schiller’s position, Montessori refuses play as a means of education. She holds that children have to work in order to find their way in the difficulties of reality. But in studying her methods one realizes that there are many elements of that freedom which Schiller attributes to play. Children can chose the things with which they “work”. They are not forced to use them in exactly the same way that the nurse has shown them. And most important: the children enjoy their “work” thoroughly. In my paper I will first explain Schiller’s thoughts on education by play with special emphasis on the phenomenon of fantasy. In the second part of my paper I will discuss the question whether it is true to say that Montessori refuses fantasy as a means of education. (shrink)

In der vorliegenden grundlegenden Kritik zeigt die Autorin, dass diese These nicht haltbar ist. Anders als Habermas annimmt, findet kommunikatives Handeln keinen Eingang in die Prozeduralität der Politik. Das politische Handeln wird vielmehr durch systemische Vorgaben bestimmt. Diese ergeben sich im Wesentlichen aus der Prozeduralität des ökonomischen Systems sowie aus der über Macht bestimmten Prozeduralität des politischen Systems selbst.

D'où vient cette réalité historique particulière qu'est la morale protestante? C'est pour répondre à cette question que les deux premières parties de ce livre sont consacrées à une présentation des sources de l'éthique protestante, celles de la Réforme du 16e siècle (Luther et Calvin), et celles du puritanisme anglais. On découvrira à ce propos le lien étroit du protestantisme et de la modernité, pour le meilleur (démocratie) et pour le pire (utilistarisme). Dès lors, la question de l'avenir d'un tel lien (...) se pose et deux enjeux prioritaires sont ici mis en évidence : comment, dans une société sécularisée, faire valoir l'importance et la valeur d'une morale de conviction théologique? Gebsattel (1954), and Tellenbach (1980), temporality has been a main subject of phenomenological psychiatry. Drawing on philosophical concepts of Bergson, Husserl, and Heidegger, these authors have analyzed psychopathologic deviations of time experience, mainly from an individual point (...) of view, for example, as a slowing down or inhibition of lived time in depression or obsessive–compulsive disorder. Their analyses are still most valuable today, but may be carried further by introducing concepts such as embodied and intersubjective temporality into psychopathology. Martin Wyllie (2005), by opening up a wide scope of temporal phenomena and related concepts, makes a laudable effort to contribute to such a progress.In my commentary, I would like to propose a distinction that is suggested by much of Wyllie's analysis and may shed further light on psychopathology, namely between implicit and explicit temporality. If we look at a child while obliviously playing with his toys, lost to the world, we may assume that there is no sense of the time passing. Lived time runs with the movement of life, implicit in the child's experience of being engaged in his play and directed toward his goals. It "unfolds through the processes of bodily activity" (Wyllie 2005). Future and past do not stand out against the pure presence of "becoming." This implicit mode of temporality is retrieved every time that we are absorbed in what we are doing, and may even reach the climax of "flow experiences" (Csikszentmihalyi 1988) where the sense of time is lost in unimpeded, fluent performance.However, this changes when a gap arises between need and satisfaction, desire and fulfillment, or plan and execution. Now the future appears as a "not yet" or "yet to come," experienced as the temporality of awaiting, striving, or longing for. Time is felt as passing by and refusing the desired fulfillment; it becomes conscious or explicit. A similar gap arises between the present and something irretrievably lost, bringing the past to consciousness as a "no more." Again time is experienced explicitly, but now as moving on relentlessly and separating us from the lost object. The gap to the past may not be bridged any more: this is the temporality of missing or mourning. In both cases, explicit time arises as a negation of implicit or lived time (here my use of the term is a bit divergent from Wyllie's); it is experienced as a "not yet" or "no more," often with a component of displeasure or suffering (Fuchs 2001a, 2003)."Implicit" versus "explicit time" thus come near to another distinction well known in phenomenology, namely between the "lived" and [End Page 195] the "corporal body" (Leib versus Koerper). The first term refers to the body functioning in the tacit mode, as the medium of everyday performance. According to QBism, quantum states, unitary evolutions, and measurement operators are all understood as personal judgments of the agent using the formalism. Meanwhile, quantum measurement outcomes are understood as the personal experiences of the same agent. Wigner’s conundrum of the friend, in which two agents ostensibly have different accounts of whether or not there is a measurement outcome, thus poses no paradox for QBism. Indeed the resolution of Wigner’s original thought experiment was central to the development of QBist thinking. The (...) focus of this paper concerns two very instructive modifications to Wigner’s puzzle: One, a recent no-go theorem by Frauchiger and Renner, and the other a thought experiment by Baumann and Brukner. We show that the paradoxical features emphasized in these works disappear once both friend and Wigner are understood as agents on an equal footing with regard to their individual uses of quantum theory. Wigner’s action on his friend then becomes, from the friend’s perspective, an action the friend takes on Wigner. Our analysis rests on a kind of quantum Copernican principle: When two agents take actions on each other, each agent has a dual role as a physical system for the other agent. No user of quantum theory is more privileged than any other. In contrast to the sentiment of Wigner’s original paper, neither agent should be considered as in “suspended animation.” In this light, QBism brings an entirely new perspective to understanding Wigner’s friend thought experiments. Can events that take place after an individual’s death affect that person’s weIl-being? Aristotle apparently thought that they could, but Mark Overvold disagrees. Like other contemporary moral theorists, Overvold analyzes the notion of a person’s utility or welfare in terms of the fulfillment of the individual’s desires, but he adds the important qualification that the desites must be for states-of-affairs in which the agent is an essential constituent. The clear implication of such a view is that our welfare cannot be (...) affected by the post-mortem satisfaction of any of the interests which we had while alive.I shall defend Overvold against his critics who insist that at least some posthumous satisfactions can contribute to a person’s welfare. I shall also argue against Brad Hooker’s proposal that we revise Overvold’s theory in order to account for such cases. (shrink)

Through advances in production and treatment technologies, transparent glass has become an increasingly versatile material and a global hallmark of modern architecture. In the shape of invisible barriers, it defines spaces while simultaneously shaping their lighting, noise, and climate conditions. Despite these unique architectural qualities, little is known regarding the human experience with glass barriers. Is a material that has been described as being simultaneously there and not there from an architectural perspective, actually there and/or not there from perceptual, behavioral, (...) and social points of view? In this article, we review systematic observations and experimental studies that explore the impact of transparent barriers on human cognition and action. In doing so, the importance of empirical and multidisciplinary approaches to inform the use of glass in contemporary architecture is highlighted and key questions for future inquiry are identified. In European philosophies of history, the linear paradigm that has prevailed for centuries as a derivative of Christian salvation history (Heilsgeschichte), ultimately lost its monopoly with the arrival of the “post-age.” The result of this has been that ideas that have survived on the margins, even the cyclical interpretation of time attached to religious traditions, now seem capable of outliving the short-lived belief in continuous progress. According to the cyclical view of history, those who came last will leave first, with (...) those who came first leaving as the last adherents of the driving force of Western rationalization. Thus, within a century, beginning with World War 2, a major turning point has been crossed: Socialism was the first to disappear, and it looks like Secular Liberalism will be the next; then Protestantism, followed by Islam, and so forth. As seductive as these images may appear, they only mirror an auto-destructive thread at the very center of Europe’s troubled Geist. But can anything be done to save the most important European values, and specifically, the ethical drive to say “no” to power, which is perhaps the most important legacy of monotheism? Either as a self-limitation from within powerful institutions or as a mode of resistance on the margins of powerful developments—there is a strong adherence to the good (often named God) that helps people and communities survive their diasporic state. I will present this kernel of ethical monotheism by two relatively unknown twentieth-century examples of “diasporic knowledge”: Rebecca West’s Black Lamb and Grey Falcon (1941), in which she recorded her observations of the devastating effects of empires on Yugoslavia, and two poems by Rosario Castellanos, who decades before the debate on postcolonialism voiced the concerns of displaced indigenous cultures in her Mexican homeland. I suggest that, paradoxically, attention to diasporic voices is one way of realizing the spirit of European self-limitation that is so much needed today to prevent further damage to our societies and environment wrought by the excessive drive for progress fostered by an unethical monorationalism. In der Schweiz tragen Sterbehilfeorganisationen zu einer breiteren Akzeptanz bei. Wie aber ist die Suizidhilfe ethisch zu rechtfertigen? Und wie soll die emergente Praxis geregelt und gelebt werden? Die Beiträger*innen widmen sich diesen Fragen aus interdisziplinärer Perspektive. Sie beleuchten dabei vor allem das Problem der Freiverantwortlichkeit eines Suizidwunschs sowie (...) neu entstehende Vulnerabilitäten und analysieren so die soziokulturellen Herausforderungen für eine gute Versorgung am Lebensende. Over the past few years, even before the Brexit campaign and the outcome of the 2016 referendum in the United Kingdom, Europe has been haunted by the spectre of an impending split and disintegration of the Union. Self-appointed “kings” and “philosophers” of greater Europe seem to have been competing for the “unity award,” with more and more of them failing dramatically. One indicator of the public alarm at the prospect of the Union’s split is the exaggerated use of the word (...) “unity” and its cognates. But can the rhetoric of unity act as a cure for the disease? This essay suggests that, ironically, the constant use of organic metaphors and invocations of European unity seems to be paving the way for—rather than preventing—the rise of neo-authoritarian forces. In my commentary I will try to illustrate the fruitfulness of his approach by pointing to some connections with the phenomenology of the body as well as with recent memory and infant research.As Blankenburg himself indicates, the (...) notion of common sense developed by a shift of meaning from the classical sensus communis and thus has its original basis in the sensual-bodily experience. By the koinè aísthesis, Aristoteles meant a central sense organ integrating all single modalities of sensation (which he localized in the heart). In German physiology and psychiatry of the nineteenth century, the sensus communis was still translated as "Gemeingefühl" ("common feeling") or "cenesthesia" (Fuchs 1995). This term denoted the inner, proprioceptive bodily sensations, but also an original unity of the senses, which has been rediscovered by recent infant research as intermodal sensory perception. The affection of the body was thus regarded as the common basis of all sensation.Looking on this track for a bodily basis of the common sense, we find it in the habitual structure of the lived-body as analysed by Merleau-Ponty (1945). The body is the primary "matter-of-course," namely, the tacitly functioning medium of our everyday being-in-the-world prior to any subject-object split. The body schema, in Merleau-Ponty's view, is not only a system of familiar units of movement or "kinetic melodies," it also incorporates the surrounding things, tools, and spaces that are familiar to us and that we "inhabit." Thus, the musician "does not only manipulate the instrument like a separate object, but lives in it like a limb and inhabits the expressive musical space it opens" (Behnke 1997). But for Merleau-Ponty, the body schema is also the basis of "intercorporeity," i.e., a prepersonal sphere of reciprocal comportment and understanding prior to any explicit consensus and symbolic communication. In this sphere of elementary contact, the "atmospheric" senses play a major role: The sense of smell (as shown, e.g., by the expression "to scent treason" or in German, "jemand nicht riechen können" [not be able to "smell" or stand someone]) as well as the sense of taste whose ambiguous meaning, mentioned by Blankenburg, points to the bodily basis of the feeling for what is suitable, decent, or aesthetically pleasing. Even the designation of homo sapiens that we give to ourselves is derived from the latin sapere (to taste/to know), and thus shows that the knowledge characteristic for man is not an explicit one, but an intuitive, implicit knowing or "feel" for his surroundings, or as Kant says, an "aesthetic rather than intellectual judgment" (cited by Blankenburg).Polanyi (1967) has analysed this knowledge at the roots of common sense as "tacit knowledge." It is based on processes of Gestalt formation that enable us to grasp unified wholes through their constituting elements without still being aware of the latter. Thus, we understand the facial expression of others immediately but cannot tell from which details. Or we know how [End Page 323] to waltz without knowing the single movements or being able to explain it. Tacit knowledge implies all the taken-for-granted that we have forgotten once it has become our second nature and part of our bodily habits. It is mainly based on the neuronal coupling of single sensori-motor units by repeated perception or action. This unconscious knowing has only recently come to be explored by psychology under the heading of "implicit" or "procedural memory" (Schacter 1987, 1996). It contains familiar styles or "melodies" of moving, perceiving, and being-with-others in which our whole bodily and emotional experience is engaged.
