"Public reason" is one of the central concepts in modern liberal political theory. As articulated by John Rawls, it presents a way to overcome the difficulties created by intractable differences among citizens' religious and moral beliefs by strictly confining the place of such convictions in the public sphere. Identifying this conception as a key point of conflict, this book presents a debate among contemporary natural law and liberal political theorists on the definition and validity of the idea of public reason. Its distinguished contributors examine the consequences of interpreting public reason more broadly as "right reason," according to natural law theory, versus understanding it in the narrower sense in which Rawls intended. The worldwide integration of capital markets continues to make progress and has resulted in both issuers and investors being active in various markets on both sides of the Atlantic. In times of financial crisis, this brings one question to the centre of attention which has not been discussed exhaustively before: in the situation of securities liability to investors in an international context, which is the applicable law to the liability claim? The harmonization of private international law rules in Europe gives (...) rise to new reflections on the problem of international issuer liability. In the United States, on the other hand, the Supreme Court has just ruled for the first time on matters relating to the international application of the US securities regulation, thereby overruling the settled case law of decades. This paper understands the role of issuer liability in a broader context as a ‘corporate governance’ device, and from this starting point, develops a new approach to the legal problem of cross-border securities liability. Nanomedicine is yielding new and improved treatments and diagnostics for a range of diseases and disorders. Nanomedicine applications incorporate materials and components with nanoscale dimensions where novel physiochemical properties emerge as a result of size-dependent phenomena and high surface-to-mass ratio. Nanotherapeutics and in vivo nanodiagnostics are a subset of nanomedicine products that enter the human body. These include drugs, biological products, implantable medical devices, and combination products that are designed to function in the body in ways unachievable at larger scales. (...) Nanotherapeutics andin vivonanodiagnostics incorporate materials that are engineered at the nanoscale to express novel properties that are medicinally useful. These nanomedicine applications can also contain nanomaterials that are biologically active, producing interactions that depend on biological triggers. Examples include nanoscale formulations of insoluble drugs to improve bioavailability and pharmacokinetics, drugs encapsulated in hollow nanoparticles with the ability to target and cross cellular and tissue membranes and to release their payload at a specific time or location, imaging agents that demonstrate novel optical properties to aid in locating micrometastases, and antimicrobial and drug-eluting components or coatings of implantable medical devices such as stents. Recently, individualized or personalized medicine (PM) has become a buzz word in the academic as well as public debate surrounding health care. However, PM lacks a clear definition and is open to interpretation. This conceptual vagueness complicates public discourse on chances, risks and limits of PM. Furthermore, stakeholders might use it to further their respective interests and preferences. For these reasons it is important to have a shared understanding of PM. Emergence of the novel pathogenic coronavirus SARS‐CoV‐2 and its rapid pandemic spread presents challenges that demand immediate attention. Here, we describe the development of a semi‐quantitative high‐content microscopy‐based assay for detection of three major classes (IgG, IgA, and IgM) of SARS‐CoV‐2 specific antibodies in human samples. The possibility to detect antibodies against the entire viral proteome together with a robust semi‐automated image analysis workflow resulted in specific, sensitive and unbiased assay that complements the portfolio of SARS‐CoV‐2 serological assays. Sensitive, specific (...) and quantitative serological assays are urgently needed for a better understanding of humoral immune response against the virus as a basis for developing public health strategies to control viral spread. The procedure described here has been used for clinical studies and provides a general framework for the application of quantitative high‐throughput microscopy to rapidly develop serological assays for emerging virus infections. Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

The living body appears like an endlessly renewable reservoir of authenticity, hope, and taboo. But, for the sake of conceptual clarity, we are often been told that the (mere) body should be distinguished from the flesh. That is, it’s undeniable that I have a body; that I notice yours; that we worry about their birth and death and upkeep. But the flesh is a more transcendentalized, loaded concept – not least given its frequently religious background (incarnation: the Word made Flesh). (...) It is the body ‘kicked upstairs’, ‘bumped up’ one ontological level. Flesh is like a mantra, an obsessive leitmotif. Is the difference just one of abstraction? Indeed, crucial to the narrative of phenomenology (most obviously in Merleau-Ponty but really, throughout, including in enactivism), to the story of ancestor worship and identity it tells itself and its acolytes around the campfire, is a basic distinction between the merely physical body and the flesh as something requiring ‘mineness’, namely, an understanding of it as uniquely ‘my own’, a feeling of ‘what it is like to be embodied’. This goes back to the Husserlian distinction between Körper, ‘body’ in the sense of one body among others in a vast mechanistic universe of bodies, and Leib, ‘flesh’ in the sense of a subjectivity which is the locus of experience. In this essay I reflect on this vision of the body’s authenticity and its costs, and contrast it with insights derived from Georges Canguilhem, whose critique of mechanism/mechanicism is not done in the name of a wholescale organicism and/or an unproblematized éloge of embodiment and privacy. In this Introduction we lay out the context of a ‘Continental philosophy of biology’ and suggest why Georges Canguilhem’s place in such a philosophy is important. There is not one single program for Continental philosophy of biology, but Canguilhem’s vision, which he referred to at one stage as ‘biological philosophy’, is a significant one, located in between the classic holism-reductionism tensions, significantly overlapping with philosophy of medicine, philosophy of technology and other themes moving away from the more common existential and (...) phenomenological motifs of post-war European thought. In recent years, many researchers engaged in diverse areas and approaches of “cultural-historical activity theory” (CHAT) realized an increasing international interest in Lev S. Vygotsky’s, A. N. Leont’ev’s, and A. Luria’s work and its continuations. Not so long ago, Yrjö Engeström noted that the activity approach was still “the best-held secret of academia” (p. 64) and highlighted the “impressive dimension of theorizing behind” it. Certainly, this remark reflects a time when CHAT was off the beaten tracks. But if this situation (...) begins to change today, in which direction will CHAT be heading? Will it continue to be one of those projects “unique for its practical, political, and civic engagement” committed “to ideals of social justice, equality, and social change” as it was in the beginning (Stetsenko & Arievitch, 2004, p. 58)? Although a positive future of CHAT seems to lie ahead, we consider in this article some of the problematics that may challenge all those who want to pass the “impressive dimensions of theorizing” from “insider” circles to a larger audience and from one generation to another as well as encourage newcomers to become part of this tradition through critical engagement in its theory and practice. A key to these engagements, we suggest, is not only the comprehensive empirical and philosophical basis, but also the role of dialectics as both topic and method. Therefore, the challenge for newcomers (as well as for “old-timers”) to take on the tradition of CHAT is not a small one indeed. We assume that a major reason for the increasing interest in CHAT lies in its potential to provide a non-reductionist approach to human development, which is due to its affinity to dialectics; however, the close interrelation to a tradition that reaches back to the theories of Georg W.F. Hegel and Karl Marx, among others, is not the easiest to master. In consideration of these difficulties, the purpose of this article is to investigate how contemporary approaches within CHAT can continue to provide a dialectical framework to preserve and renew the critical intention of this tradition, and how we run the risk of losing this sting. Thereby, we sensitize researchers to the problem of developing a cultural-historical approach within a historical situation that confronts us with new, unanswered questions. In this light, we also problematize the use of scientific language, for it may lead us to speak and argue un-dialectically when in fact we intend or ought to think dialectically. This article seeks to convey insights and arguments of how we can relate our theoretical approaches to a tradition of dialectical thinking and in what ways this is paramount for a critical engagement in theory and practice. In the first part, we therefore discuss not only some major theorems in Hegel’s and Marx’s work but also, and above all, Vygotsky’s way of developing the cultural-historical approach of psychology. Second, we argue that the contemporary, widely known version of CHAT, related to Yrjö Engeström’s theoretical and empirical work, neglects different aspects of dialectical thinking and consequently narrows its potential to a socio-critical approach to societal practice and human development. A crucial question of this scrutiny will be the notion of contradictions and how development is supposed to be achieved. In general, our intention is not only to clarify the role of dialectics as a method for activity theory but also to problematize the role of the subjects of research in CHAT and to confront ourselves with the problems of practicing and developing a critical science in face of a complex and challenging societal world. This edited volume presents papers on this alternative philosophy of biology that could be called “continental philosophy of biology,” and the variety of positions and solutions that it has spawned. In doing so, it contributes to debates in the history and philosophy of science and the history of philosophy of science, as well as to the craving for ‘history’ and/or ‘theory’ in the theoretical biological disciplines. In addition, however, it also provides inspiration for a broader image of philosophy of biology, (...) in which these traditional issues may have a place. The volume devotes specific attention to the work of Georges Canguilhem, which is central to this alternative tradition of “continental philosophy of biology”. This is the first collection on Georges Canguilhem and the Continental tradition in philosophy of biology. The category of ‘organism’ has an ambiguous status: is it scientific or is it philosophical? Or, if one looks at it from within the relatively recent field or sub-field of philosophy of biology, is it a central, or at least legitimate category therein, or should it be dispensed with? In any case, it has long served as a kind of scientific “bolstering” for a philosophical train of argument which seeks to refute the “mechanistic” or “reductionist” trend, which has been perceived (...) as dominant since the 17th century, whether in the case of Stahlian animism, Leibnizian monadology, the neo-vitalism of Hans Driesch, or, lastly, of the “phenomenology of organic life” in the 20th century, with authors such as Kurt Goldstein, Maurice Merleau-Ponty, and Georges Canguilhem. In this paper I try to reconstruct some of the main interpretive ‘stages’ or ‘layers’ of the concept of organism in order to critically evaluate it. How might ‘organism’ be a useful concept if one rules out the excesses of ‘organismic’ biology and metaphysics? Varieties of instrumentalism and what I call the ‘projective’ concept of organism are appealing, but perhaps ultimately unsatisfying. (shrink)

ABSTRACT: GEORGES CANGUILHEM’S BIOPHILOSOPHY The eminent French biologist and historian of biology, François Jacob, once notoriously declared «On n’interroge plus la vie dans les laboratoires»: laboratory research no longer inquires into the notion of “Life”. Certain influential French philosophers of science of the mid‐century such as Georges Canguilhem would disagree, or at least seek to resist some of Jacob’s diagnosis. Not by imposing a different kind of research program in laboratories, but by an unusual combination of historical and philosophical inquiry (...) into the foundations of the life sciences. Canguilhem speaks of «defending vitalist biology» and declares that Life cannot be grasped by logic. Is this history and philosophy of biology? Is it vitalism? It definitely is a different project from current philosophy of biology. One short‐lived term for it was “biophilosophy”. In this paper I explore the content of this term as it relates to the above questions. (shrink)

Debate over the relationship of law and bioethics is growing - what the relationship has been and what it should be in the future. While George Annas has praised law and rights-talk for creating modern bioethics, Carl Schneider has instead blamed law for hijacking bioethics and stunting moral reflection. Indeed, as modern bioethics approaches the 40-year mark, historians of bioethics are presenting divergent accounts. In one account, typified by Albert Jonsen, bioethics largely grew out of philosophy and theology, not (...) law. In another account, law has deeply shaped bioethics from the start, forging its central commitment to the rights of patients and research subjects and the fields imposition of broad fiduciary responsibilities on health care professionals and researchers.In addition to debating how to properly describe laws historical relationship to bioethics, commentators have argued over whether laws influence in bioethics is now good or bad. The eminent French biologist and historian of biology, François Jacob, once notoriously declared “On n’interroge plus la vie dans les laboratoires”: laboratory research no longer inquires into the notion of ‘Life’. Nowadays, as David Hull puts it, “both scientists and philosophers take ontological reduction for granted… Organisms are ‘nothing but’ atoms, and that is that.” In the mid-twentieth century, from the immediate post-war period to the late 1960s, French philosophers of science such as Georges Canguilhem, Raymond Ruyer and Gilbert Simondon (...) returned to Jacob’s statement with an odd kind of pathos: they were determined to reverse course. Not by imposing a different kind of research program in laboratories, but by an unusual combination of historical and philosophical inquiry into the foundations of the life sciences (particularly medicine, physiology and the cluster of activities that were termed ‘biology’ in the early 1800s). Even in as straightforwardly scholarly a work as La formation du concept de réflexe aux XVIIe et XVIIIe siècles (1955), Canguilhem speaks oddly of “defending vitalist biology,” and declares that Life cannot be grasped by logic (or at least, “la vie déconcerte la logique”). Was all this historical and philosophical work merely a reassertion of ‘mysterian’, magical vitalism? In order to answer this question we need to achieve some perspective on Canguilhem’s ‘vitalism’, notably with respect to its philosophical influences such as Kurt Goldstein. (shrink)

Well prior to the invention of the term ‘biology’ in the early 1800s by Lamarck and Treviranus (and lesser-known figures in the decades prior), and also prior to the appearance of terms such as ‘organism’ under the pen of Leibniz and Stahl in the early 1700s, the question of ‘Life’, that is, the status of living organisms within the broader physico-mechanical universe, agitated different corners of the European intellectual scene. From modern Epicureanism to medical Newtonianism, from Stahlian animism to the (...) discourse on the ‘animal economy’ in vitalist medicine, models of living being were constructed in opposition to ‘merely anatomical’, structural, mechanical models. It is therefore striking that the classic narratives of the Scientific Revolution conspicuously avoid any consideration of what status to grant living beings in a newly physicalized universe (I discuss this in Wolfe 2011, 2019 chapt. 1). Neither Harvey, nor Boyle, nor Locke (to name some likely candidates, the latter having studied with Willis and collaborated with Sydenham) ever ask what makes organisms unique, or conversely, what does not. In this chapter I seek to establish how something we might call ‘the knowledge of Life’, to use an expression of Georges Canguilhem’s, emerged as part of early modernity without being part of the mainstream history of life science. This leads to the question, can one can correlate early modern “knowledge of life” with the emergence of a science called ‘biology’? (see Zammito 2018, Wolfe 2019, Bognon-Küss and Wolfe eds. 2019). It was once fashionable to speak of, e.g. ‘precursors of Darwin’, and then Canguilhem and Foucault famously did away with the category of precursor. But how then do we account for the phase that precedes the constitution of a science? With the case of biology, how do we account for the increasing fascination with the ontology of Life during the decades prior to the ‘naming of biology’, as McLaughlin has called it, at the end of the eighteenth century? This increased focus on Life and the ontology of Life sits awkwardly, both with mainstream narratives of the Scientific Revolution and of the history of biology. In seeking to address this increased focus (in which vitalism plays a role but was by no means the only conceptual actor: Wolfe 2020), I critically examine Foucault’s notorious claim (Foucault 1966) that there was no such thing as ‘Life’ in the eighteenth century and thus no such thing as biology. One obvious difference, as P.-O. MéthotMéthot, Pierre-Olivier has shown, is Gayon’s appropriation of anglophone philosophy of biology; another is Canguilhem'sCanguilhem, (...) Georges way of presenting his work as restricted to contextualized, historicist claims while in fact it is shot through with strong normative (and at times metaphysical) claims on Life, normativity, and value. In this essay I reflect on how to conduct historical epistemologiesHistorical epistemology of the life sciences, focusing on two interrelated cases I have worked on in the past: vitalismVitalism (history of) and the constitution of biology. The species of vitalism discussed here, to immediately rule out two possible misconceptions, is neither the feverish cosa mentale found in ruminations on ‘biopolitics’ and fascism – where it alternates quickly between being a form of evil and a form of resistance, with hardly any textual or conceptual material to discuss – nor the opaque, and less-known form in which it exists in the worlds of ‘Theory’ in the humanities, perhaps closely related to the cognate, ‘materiality’. Rather, vitalism here is (...) a malleable construct, often with a poisonous reputation, hovering in the realms of the philosophy of biology, the history of medicine, and the scientific background of the Radical Enlightenment. This is a more vital vitalism, or at least a more ‘biologistic’, ‘embodied’, medicalized vitalism. I first distinguish between what I would call ‘substantival’ and ‘functional’ forms of vitalism, as applied to the eighteenth century. Substantival vitalism presupposes the existence of something like a vital force which either plays a causal role in the natural world as studied by scientific means, or remains a kind of hovering, extra-causal entity. Functional vitalism tends to operate ‘post facto’, from the existence of living bodies to the desire to find explanatory models that will do justice to their uniquely ‘vital’ properties in a way that fully mechanistic models cannot. I discuss some representative figures of the Montpellier school as being functional rather than substantival vitalists. A second point concerns the reprisal of vitalism in ‘late modernity’; from Hans Driesch to Georges Canguilhem. I suggest that in addition to the substantival and functional varieties, we then encounter a third, more existential form of vitalism, articulated by Canguilhem, in which vitalism is a kind of attitude towards Life. All of this, I hope, argues for a form of vitalism which is neither tedious scientism nor dangerous political rhetoric of health and sickness; instead, a vitalism with its own discreet charm. This article investigates the use of wolves to enchant the rationalization of Thompson Manitoba. The city attempted to refocus towards a more touristic economy based around the large wolf population in the surrounding regions. The paper also examines why this attempt at a tourist economy has not produced its intended results. I accomplish this by first discussing the McDonaldization and enchantment of the city. This discussion is framed through George Ritzer and Jeffery C. Alexander’s work. I then integrate Umwelt (...) analysis by focusing on Timo Maran’s Umwelt mapping to create a comparative approach in which wolf Umwelts within rationalized and enchanted settings can be compared to those in situ. I then make use of qualitative data analysis (QDA) to code a corpus of 50 articles from a local online newspaper that discuss the development of the tourism economy. Accordingly, I apply the theoretical perspectives mentioned to the QDA codes and themes. In the discussion section and conclusion of this paper, I note that wolf Umwelt was largely incompatible with the rationalizing system created within the city and that the use of wolves as enchantment relied on motifs of overly hyperreal intersubjectivity between humans and wolves. Consequently, collective representation regarding the tourist initiative was not constructed by this rationalization and enchantment. (shrink)

My strategy is to examine a recent trend in philosophical discussions of responsibility, a trend that tries, but I think ultimately fails, to give an acceptable analysis of the conditions of responsibility. It fails due to what at first appear to be deep and irresolvable metaphysical problems. It is here that I suggest that the condition of sanity comes to the rescue. What at first appears to be an impossible requirement for responsibility---the requirement that the responsible agent have created her- (...) or himself---turns out to be the vastly more mundane and non controversial requirement that the responsible agent must, in a fairly standard sense, be sane. "socialiste réel". Quelques années plus tôt Georges Canguilhem, résistant au scientisme triomphant, se proposait de continuer à penser la médecine comme un art qui devait s'adapter à chaque individu malade. Déplorant la disparition progressive de la clinique, il plaidait pour un dialogue continu entre le patient et le médecin Tandis que Sonia Combe s'appuie sur le discours de Christa Wolf pour appréhender l'expérience communiste à partir de l'étude de genre, revenant sur la double leçon de Christa Wolf et de Canguilhem, Antoine Spire se demande dans quelles conditions un retour de la médecine à la pratique clinique pourrait se faire et répondre à la demande des malades.
